BANK OF TANZANIAFINANCIAL SECTOR SUPPORT PROJECTCONSULTING SERVICESCREDIT NO. 4191-TAEXPRESSIONS OF INTERESTCONSULTANCY SERVICES FOR STUDY ON COURT CASES INVOLVING BANKS INTANZANIA1. This request for Expressions <strong>of</strong> Interest follows the General ProcurementNotice (GPN) <strong>of</strong> this <strong>project</strong> that appeared in UN Development Business(UNDB) issue number 692 <strong>of</strong> December 16, 2006.2. The Government <strong>of</strong> the United Republic <strong>of</strong> Tanzania has secured fundsfrom Development Partners towards the cost <strong>of</strong> the Financial SectorSupport Project (FSP). It is intended that part <strong>of</strong> the proceeds <strong>of</strong> the fundsbe applied to eligible payments under the contract for provision <strong>of</strong><strong>services</strong> for study on court cases involving <strong>bank</strong>s in Tanzania.3. The overall objective <strong>of</strong> the consultancy <strong>services</strong> needed is to assist theTanzania Bankers Association (TBA) in conducting a study on court casesinvolving <strong>bank</strong>s in Tanzania that will bring out empirical evidence <strong>support</strong>edby concrete data regarding the adverse effects <strong>of</strong> litigation and identify thecausal factors <strong>of</strong> excessive and time-consuming litigation involving <strong>bank</strong>s.Specifically the consultant will be expected to review and assess:a) the causes <strong>of</strong> delay in disposing <strong>of</strong> commercial cases;b) the adverse effects caused by unnecessary and/or excessively timeconsuminglitigation (<strong>support</strong>ed by factual data to the extentpractical); andc) possible legislative, regulatory or judicial reforms to limit and/orexpedite litigation and reduce costs.4. The Bank <strong>of</strong> Tanzania (the Client) now invites eligible consultants to expresstheir interest in providing the required <strong>services</strong>. Interested consultants mustprovide information indicating their pr<strong>of</strong>essional capability to undertakethe consultancy. Such information may include brochures, description <strong>of</strong>


similar assignments, experience in similar conditions, availability <strong>of</strong>appropriate skills among staff, etc.5. A short list <strong>of</strong> consultants will be prepared on the basis <strong>of</strong> Expressions <strong>of</strong>Interest submitted to Bank <strong>of</strong> Tanzania in writing. The selection <strong>of</strong> aconsultant will be in accordance with procedures set out by the WorldBank Guidelines; Selection and Employment <strong>of</strong> Consultants by World BankBorrowers, May 2004.6.
