3) check whether the prescribed inspecti<strong>on</strong>s c<strong>on</strong>firming the safety of <strong>products</strong> throughouttheir lifecycle have been per<strong>for</strong>med;4) instruct eliminati<strong>on</strong> of established n<strong>on</strong>-c<strong>on</strong><strong>for</strong>mity within a specified period;5) request that the <strong>products</strong> be marked with the prescribed c<strong>on</strong><strong>for</strong>mity markings, orremoval of markings that are not allowed;6) restrict or prohibit the making available of <strong>products</strong> <strong>on</strong> the market <strong>and</strong> implementadditi<strong>on</strong>al measures, in accordance with <str<strong>on</strong>g>law</str<strong>on</strong>g>, to ensure that the restricti<strong>on</strong> orprohibiti<strong>on</strong> is observed;7) instruct the withdrawal or recalling of <strong>products</strong> that are not in c<strong>on</strong><strong>for</strong>mity with theprescribed <strong>requirements</strong>;8) notify the competent ministry which has adopted the <strong>technical</strong> regulati<strong>on</strong> related to aparticular product <strong>for</strong> the purpose of undertaking the relevant measures;9) instruct destroying of n<strong>on</strong>-c<strong>on</strong><strong>for</strong>ming <strong>products</strong> if they present a serious risk to thesafety, life <strong>and</strong> health of humans, animals <strong>and</strong> plants, as well as the envir<strong>on</strong>mentprotecti<strong>on</strong>.When per<strong>for</strong>ming inspecti<strong>on</strong> supervisi<strong>on</strong>, the competent inspector shall be authorized to inspect thesupplier’s business premises <strong>and</strong> facilities.If the competent inspecti<strong>on</strong> authority does not have the necessary expert knowledge or equipment<strong>for</strong> per<strong>for</strong>ming c<strong>on</strong>trols or testing referred to in paragraph 2 of this Article, it may delegate c<strong>on</strong>trol<strong>and</strong> testing to the relevant c<strong>on</strong><strong>for</strong>mity <strong>assessment</strong> body.Costs of c<strong>on</strong>trol <strong>and</strong> testing of the c<strong>on</strong><strong>for</strong>mity of <strong>products</strong>, as well as other costs incurred in theprocedure of inspecti<strong>on</strong> supervisi<strong>on</strong>, shall be borne by the supplier if it is established that theproduct is not in c<strong>on</strong><strong>for</strong>mity with the prescribed <strong>requirements</strong>.An appeal against the decisi<strong>on</strong> by which the inspector instructed undertaking of measures referredto in paragraph 2 of this Article shall not stay the executi<strong>on</strong> of the decisi<strong>on</strong>.VIII. PENAL PROVISIONSArticle 35A legal pers<strong>on</strong> – c<strong>on</strong><strong>for</strong>mity <strong>assessment</strong> body shall be fined in the amount of RSD 100,000 to1,000,000 <strong>for</strong> misdemeanor if it:1) per<strong>for</strong>ms c<strong>on</strong><strong>for</strong>mity <strong>assessment</strong> <strong>and</strong>/or per<strong>for</strong>ms <strong>technical</strong> valuati<strong>on</strong> of <strong>products</strong>without the decisi<strong>on</strong> <strong>on</strong> appointment or authorizati<strong>on</strong> (Article 13 paragraph 1 <strong>and</strong>Article 18 paragraph 4);2) fails to notify the competent minister in accordance with the obligati<strong>on</strong>s referred to inArticle 15 of this Law;3) fails to act as instructed by the competent minister referred to in Article 16 paragraph 2of this Law.A resp<strong>on</strong>sible pers<strong>on</strong> within the legal pers<strong>on</strong> – c<strong>on</strong><strong>for</strong>mity <strong>assessment</strong> body shall also be fined inthe amount of RSD 20,000 to 50,000 <strong>for</strong> misdemeanor referred to in paragraph 1 of this Article.Article 36A legal pers<strong>on</strong> – supplier shall be fined in the amount of RSD 100,000 to 1,000,000 <strong>for</strong>misdemeanor if it:14
