YOUR CONTRACTYour contract is with Hurtigruten Ltd. on the basis ofthese conditions and the information contained inthe brochure, and shall be governed by English lawand the jurisdiction of the English Courts. You mayhowever choose the law and jurisdiction of Scotlandor Northern Ireland if you wish to do so. When youbook a holiday or sailing with us the contractbetween us will exist as soon as you or your travelagent asks us to confirm your booking. We thenbecome responsible to provide you with thearrangements you have booked and you becomeresponsible to pay for them, in each case subject tothese terms and conditions.When you make a booking you guarantee you havethe authority to accept and do accept on behalf ofyour party the terms of these booking conditionsand accept responsibility for making all payments tous for all members of the party. PAYMENTOnce you have asked us to confirm your bookingthe total price of the arrangements you havebooked is payable 30 days before your scheduleddeparture date. No second invoice will be sent.Any travel documents required will be issued 7 to 14days prior to departure.If you book less than 30 days before your scheduleddeparture date the full price is payable when youbook. Balance payment may be made by banktransfer or credit card.Credit Card ChargesNo charge will be made for deposits paid by Creditor Debit Card/Switch/Delta and no charge will bemade for balances paid by Debit Card/Switch/Delta.Your booking may be cancelled if you do not makepayment on time (we will not normally sendreminders) and cancellation charges as set out under“If You Cancel” (see below) will be payable by you.3. PRICESAll prices shown in this brochure are in Euro and areper person unless otherwise stated. The price ofyour arrangements was calculated using exchangerates quoted in the Financial Times Guide to WorldCurrencies on 4. September 2009, NorwegianKroner (NOK) 9.86320; €1.14440. We reserve theright to change any of the prices quoted in thisbrochure although there will be no change within 30days of your departure date. You will be advised ofthe current price of the holiday you wish to bookbefore your contract is confirmed. We reserve theright to increase or decrease prices in line with anychange in VAT, local and UK taxes, embarkation/disembarkation fees, fuel surcharges, exchangerates, security charges or any fees chargeable forthe services included in the cost of your holiday.Should it be necessary to make any surcharges wewill notify you of the relevant adjustments by issuinga new invoice. In any event we will absorb all suchincreases where they form less than 2% of the totalcost of your holiday (excluding any cancellationor amendment charges). Only amounts in excessof 2% will be invoiced to you, together with anadministration charge of €1.00 per person togetherwith an amount to cover agent’s commission.In the event that any surcharge means you payingin excess of 10% more on the original cost of yourholiday, you will be entitled to cancel your trip witha full refund of all monies paid (except amendmentfees). Should you wish to cancel under thesecircumstances you must exercise your right to do sowithin 14 days from the date of the invoice we sendyou showing the increase.Should the price of your holiday go down due tochanges above by more than 2% of your holidaycost then any refund due will be paid to you.Please note that travel arrangements are not alwayspurchased in local currency and some apparentchanges have no impact on the price of your traveldue to contractual or other protection in place.4. IF YOU CHANGE YOUR BOOKINGIf you wish to change your travel arrangements afterthey have been confirmed we will do our utmost tohelp but it may not always be possible. Any requestfor changes to be made must be in writing by theperson who made the booking or your travel agent.You will be asked to pay an administration charge of€50 per person and any further cost we incur inmaking this alteration. Costs may increase the closerto the departure date that changes are made.If you change the number of people in your party,the price of the arrangements will be recalculatedfor the new party size e.g. this may mean thataccommodation is under-occupied and each memberof the party may have to pay an increased price.Any increase in price caused by changes you haverequested is not a cancellation charge even thoughit may arise because a member of your party hascancelled. Any change by you to your confirmedarrangements after departure is in all cases subjectto availability and any relevant costs.5. IF YOU CANCEL - see you agent fordetailsYou, or any member of your party, may cancel yourtravel arrangements at any time. Written notificationfrom the person who made the booking or yourtravel agent must be received at our offices.We recommend ‘Recorded Delivery’. Cancellationtakes effect the day we receive your letter or email.Since we incur costs in relation to your arrangementsfrom the time we confirm your booking you will haveto pay the applicable cancellation charges as shownin the table below (which also applies if we cancelbecause you have failed to make payments on time- see “Payment” section) together with the cost ofany air fare for which we have had to pay at the timeof the booking and will be payable immediately oncancellation.6. IF WE CHANGE OR CANCEL YOUR BOOKINGWe reserve the right to change any of the details,and correct any errors in this brochure or invoices atany time. If changes are made before you havemade your booking we will advise you before weconfirm your arrangements. We reserve the rightin any circumstances to cancel your travelarrangements (for example if a minimum number ofparticipants for a particular travel arrangement is notreached, we may have to cancel it) and to changevessels and itineraries without liability for anysubsequent loss. Even after we have confirmed yourbooking we may have to make alterations but wewill not cancel your travel arrangements less than 8weeks before your departure except for reasons offorce majeure or failure by you to pay the finalbalance in full.Most alterations will be minor and while we will doour best to notify you or your travel agent of anychanges as soon as reasonably possible if there istime before your departure, we will have no otherliability to you.Occasionally we may have to make a significantchange to your confirmed arrangements.If we have to make a significant change we will notifyyou as soon as possible and you may either:(a) accept the change and the contract between uswill then be varied to incorporate the change; or(b) take alternative arrangements altogether (subjectto availability). If the alternative arrangementsselected are a lower price than those originallyconfirmed the difference will (if already paid) berefunded to you.(c) withdraw from the booking completely in whichcase we will as soon as possible, refund all moneypaid to us.Passengers must give notice of their decision assoon as reasonably possible and not later than 7days of being informed of the alteration.If you choose (a) or (b) above, you will receive ascompensation a credit towards the cost of yourarrangements, or any alternative selected. If youchoose (c) we will pay you compensation. In all caseswe will have no liability for any other or greatercompensation or for expenses or losses incurred.Compensation will not apply when we are forced tomake changes which cause you to withdraw orcancel your arrangements, by reason of unusual andunforeseeable circumstances beyond our controland which we could not have avoided by theexercise of all due care and our only liability will beto refund, as soon as possible, all money paid to usby you. We are unable to accept liability or paycompensation where the performance or promptperformance of our contractual obligation isprevented or affected by reason of circumstancesamounting to “force majeure” i.e. any event whichwe or the supplier(s) of the service(s) could not, evenwith due care foresee or avoid. Such events mayinclude, but are not limited to, war, threat of war orcivil commotions, riots, terrorist activity, industrialdispute, natural or nuclear disaster, adverse weather,fire, flood, drought, government action, portregulations and closures, technical transportationproblems, maintenance to vessels, scheduling oftransport and similar events outside our control.A ship delay does not constitute a change to holidayarrangements.7. OUR LIABILITY TO YOUWe accept liability for any damage caused to you orany person in your party by the failure to perform, orthe improper performance of, the contract madewhen your booking is confirmed (subject to anychanges subsequently agreed between us) unless:(a) the failures which occur in the performance of thecontract are attributable to you or some otherperson in your party;(b) such failures in performance are attributable to athird party unconnected with the provision of theservices contracted for and are unforeseeable andunavoidable or;(c) such failures are due to:(i) unusual or unforeseeable circumstances beyondour control, the consequences of which could nothave been avoided even if all due care had beenexercised; or(ii) an event which we, or the supplier of the servicescould not foresee or forestall even with all due care.Our liability, except in cases of death, injury orillness, shall be limited to the lesser of:i) the maximum of twice the cost of your travelarrangements.ii) the minimum amount payable in accordance withand/or in an identical manner to:(a) the contractual terms of the companies thatprovide the transportation and accommodation foryour travel arrangements, which are expresslyincorporated into the contract and also form theterms and conditions of separate contracts betweenyou and the carrier.(b) any relevant international conventions, includingthe Warsaw Convention 1929, whether as amendedby the Hague Protocol 1955 or the MontrealProtocol 1999, or otherwise, or the MontrealConvention 1999. Carriage of passengers and theirluggage by sea is governed by the AthensConvention 1974, and in respect of carriage by railby the Berne Convention and in respect of provisionof accommodation by the Paris Convention.Any action arising out of carriage by air or sea mustbe commenced within the two year time limitprescribed by the Warsaw and Montreal Conventionsor the Athens Convention as applicable. Legalproceedings for all claims for which time bars arenot stated in international conventions or are statedin the Norwegian Maritime Code must be madewithin one year from the date on whichdisembarkation did, or should have, taken place.The transport of passengers, baggage and vehiclesis subject to the provisions of the Act. no. 39 of 24June 1994 Norwegian Maritime Code, as amended,(“Norwegian Maritime Code”) and package toursare subject to the provisions of the Act no. 57 of 25August 1995 Relating to Package Tours (“ThePackage Tours Act”).We are to be regarded as having all benefit of anylimitation of compensation contained in these, orany other conventions, including claims for death,injury, delay to passengers and loss, damage anddelay to luggage. You may ask for copies of thetransport companies’ contractual terms or theinternational conventions from our offices at3, Shortlands, London, W6 8NE.Under EU law (Regulation 261/2004) you haverights in some circumstances to refunds and/orcompensation from your airline in cases of deniedboarding, cancellation or delay to flights, for whichyou must pursue the airline. Reimbursement in suchcases will not automatically entitle you to a refund ofany part of your holiday cost from us. Also, where adelay may result in entitlement to cancel a flight thisdoes not automatically entitle you to cancel orreceive a refund for any other arrangements, eventhough they may have been made in conjunctionwith your flight. If your airline does not complywith the Regulation you should complain to theAir Transport User’s Council on 020 7240 6061/www.auc.org.uk.8. INDEMNITYWhen you book arrangements with us you acceptresponsibility for the proper conduct of yourself andyour party. If your actions or omissions causedamage to any property in the provision of thecontracted arrangements, or cause delay ordiversion to any means of transportation, you agreeto fully indemnify us against any claim (includingprofessional fees and legal costs) made against usby or on behalf of the owner of such property orthe operator of other means of transportation.The Master of a ship has authority over the ship andpassengers at all times when they are boarding oron board. There will be no liability on our part, orthat of any supplier, for any refund, compensation,or costs thus incurred. Additionally, we will have theright to recover full costs resulting from the incidentfrom the passenger.At any port or place we may refuse to embark ormay disembark any passenger who, in the opinion ofthe ship’s authorized personnel, might be excludedfrom landing at further destinations by localauthorities or who may be suffering from anycontagious or infectious disease, or whose presencemay be detrimental to the wellbeing of passengersor crew. In cases of quarantine of the ship, orindividual passengers (passengers may be requiredto remain in their cabin or as instructed byauthorised personnel on board if they or any otheroccupant of the accommodation presents anysymptoms or may be considered to put otherpassengers at risk) we will not be liable for expensesthus caused and in such cases as above there will beno entitlement to any refund or compensation andwe will have no liability for costs incurred as a result.Each passenger warrants that they are fit to travel.Hurtigruten reserves the right to require anypassenger to produce evidence of the same andcannot accept liability for any situation arising out ofa failure to disclose any pre-existing condition ordisability. Passengers with physical or mentaldisabilities or other conditions which may requirespecial assistance, e.g. use of a wheelchair orscooter, or service animal, must advise us in writingbefore a booking is made. Passengers who usewheelchairs or who may require special assistancemust be accompanied by someone who is able toassist them on shore and at sea.Your specific passport and visa requirements andother immigration requirements are your responsibilityand you should confirm these with the relevantEmbassies and/or Consulates. We do not acceptresponsibility if you cannot travel because you havenot complied with the latest requirements. If youhave made independent travel arrangements youaccept responsibility for joining the ship in goodtime, regardless of any change to the sailing time ordate, or to the itinerary. We are not able to refundmonies paid to us, or any third party acting on ouror your behalf, or make compensation or otherpayments where, for whatever reason, you fail tojoin the ship. Passengers going ashore areresponsible for re-boarding the ship prior todeparture from port.9. COMPLAINT PROCEDUREIf you have a problem during your holidayconcerning any service we have confirmed you must,in compliance with EC legislation, inform the localsupplier, e.g. our local representative or agentimmediately to enable them to try to resolve thematter. You are also obliged to act in a way so as tominimise any loss. If the issue is not resolved locallyit is essential you notify our head office in writing,quoting the booking reference number, at theearliest opportunity and no later than 28 days afteryour return, to enable any complaint to beinvestigated.
