-1211-NEW RULE VII CONTINUATION OF APPROVED ACCOUNTING ANDREPORTING SYSTEM WHEN ACCOUNTING SYSTEM VENDOR'S LICENSELAPSES (1) In the event an accounting system vendor fails to renew its license, anoperator may continue to operate the approved accounting and reporting systempurchased from the vendor if the approved accounting and reporting system requiresno modification or support from a vendor to comply with [NEW RULE III].(2) In the event an accounting system vendor fails to renew its license andthe conditions for continuation cannot be met, operators using the system shall have120 days to convert to a new system.AUTH:IMP:23-5-621, MCA23-5-637, MCA4. The rules as proposed to be amended provide as follows, stricken matterinterlined, new matter underlined:23.16.<strong>10</strong>1 DEFINITIONS As used throughout this subchapter, the followingdefinitions apply:(1) "Accounting system vendor" means a person who sells or leases anaccounting system to a licensed gambling manufacturer, route operator, or gamblingoperator to be utilized as an approved automated accounting and reporting system,as provided in 23-5-637, MCA.(1) through (19) remain the same but are renumbered (2) through (20).AUTH:IMP:23-5-115, 23-5-621, MCA23-5-112, 23-5-118, 23-5-176, 23-5-629, 23-5-637, MCA23.16.<strong>10</strong>2 APPLICATION FOR GAMBLING LICENSE - LICENSE FEE(1) Every person working or acting as a card dealer, operator, route operator,card room contractor, manufacturer, distributor, manufacturer <strong>of</strong> electronic live bingoor keno equipment, sports tab game seller, accounting system vendor, ormanufacturer <strong>of</strong> illegal devices, as defined by Title 23, chapter 5, MCA, and by theserules, any nonpr<strong>of</strong>it organization, or any other person required by statute or rule tohold a license issued by the department, must possess a valid license issued by thedepartment. All licenses expire annually at midnight on June 30 unless otherwiseprovided for in these rules. Theinformation shall include, but not be limited to:(a) through (l)(vii) remain the same.(m) truth tables for all PALs used; and(n) an operators manual for each peripheral device utilized.; and(o) additional information to be provided for automated accounting andreporting systems:(i) electronic copy <strong>of</strong> an output data file produced by the system forcommunication to the department. File shall contain no less than one hundredrecords for each <strong>of</strong> the following classes:(A) video gambling machine startup;(B) video gambling machine electronic meter period;(C) video gambling machine event (if applicable);(D) video gambling machine before service (if applicable);(E) video gambling machine after service (if applicable); and(F) video gambling machine end.AUTH:IMP:23-5-115, 23-5-621, MCA23-5-607, 23-5-621, 23-5-631, 23-5-637, MCA23.16.1918 VIDEO GAMBLING MACHINES TESTING FEES (1) Eachperson submitting a video gambling machine, an automated accounting andreporting system, or a modification that changes the play or operation <strong>of</strong> a to anapproved video gambling machine or an automated accounting and reportingsystem for testing and department approval must:(a) be licensed as a manufacturer and/or accounting system vendor withinthe state <strong>of</strong> <strong>Montana</strong>;(b) at the time <strong>of</strong> submission deposit with the department a sum <strong>of</strong> money tocover the costs <strong>of</strong> the begin testing service. This sum is to be as follows:(i) video gambling machines, $3,000;(ii) automated accounting and reporting system, $2,000;(ii)(iii) modification to a an approved video gambling machine that alters theplay or operation <strong>of</strong> the machine and requires approval or automated accounting andreporting system, $300.(2) and (3) remain the same.AUTH:IMP:23-5-115, 23-5-621, MCA23-5-631, 23-5-637, MCA5. RATIONALE AND JUSTIFICATION New Rule I establishes a vendorlicense for persons who sell or lease approved automated accounting and reportingsystems. The need for the rule arises from the public policy statement in23-5-1<strong>10</strong>(1)(b), MCA, that directs the department to protect the gambling public fromunscrupulous vendors. The rule is required at this time because the department isdeveloping a new database and the time is approaching to test and license theaccounting systems that will be purchased by gambling operators as part <strong>of</strong> thesystem.
