On June 7, 2006, at <strong>10</strong>:30 a.m., a public hearing will be held in theDirector's Office (Fourth Floor) Conference Room <strong>of</strong> the Sam W. Mitchell Building, atHelena, <strong>Montana</strong>, to consider the amendment <strong>of</strong> the above-stated rules relating tomanufactured and mobile homes.Individuals planning to attend the hearing shall enter the building through theeast doors <strong>of</strong> the Sam W. Mitchell Building, 125 North Roberts, Helena, <strong>Montana</strong>.2. The Department <strong>of</strong> Revenue will make reasonable accommodations forpersons with disabilities who wish to participate in this public hearing or need analternative accessible format <strong>of</strong> this notice. The rules proposed to be amended provide as follows, stricken matterinterlined, new matter underlined:42.20.<strong>10</strong>6 DEFINITIONS The following definitions apply to this subchapter:(1) "Attached" as it applies to a manufactured or mobile home means beingbolted or cable anchored to the permanent foundation.(1) remains the same but is renumbered (2).(2)(3) "Comparable properties" means properties that have similar utility, use,function, and are <strong>of</strong> a similar type as the subject property. Comparable propertiesmust be influenced by the same set <strong>of</strong> economic trends, and physical, economic,governmental, and social factors as the subject property. Comparable propertiesmust have the potential <strong>of</strong> a similar use as the subject property. For any propertythat does not fit into this definition, the department will rely on the definition <strong>of</strong>comparable property contained in 15-1-<strong>10</strong>1, MCA.(a) Within the definition <strong>of</strong> comparable property in (1), the following types <strong>of</strong>property are considered comparable:(i) Ssingle-family residences with ancillary improvements are comparable toother single-family residences with ancillary improvements.;(ii) Mmulti-family residences are comparable to other multi-familyresidences.;(iii) Mmobile homes are comparable to other mobile homes.;<strong>10</strong>-5/18/06 MAR Notice No. 42-2-760
