<strong>Sam</strong> <strong>Higg<strong>in</strong>bottom</strong> <strong>Institute</strong> <strong>of</strong> <strong>Agriculture</strong>, Technology & Sciences(Formerly Allahabad Agricultural <strong>Institute</strong>)(Deemed-to-be-University)Leave Rules for Teach<strong>in</strong>g / Non-Teach<strong>in</strong>g Staff / employee <strong>of</strong> the University(Effective from July 2011)The leave rules as prescribed by SHIATS shall be applicable to all the staff members andemployees <strong>of</strong> SHIATS.(a)Right to Leave:Leave cannot be claimed as a matter <strong>of</strong> right and when the services <strong>of</strong> an <strong>in</strong>dividualare required by the University the demand for leave for any description may berefused or the staff/employee may be compulsorily recalled from leave by thesanction<strong>in</strong>g authority.(b)Earn<strong>in</strong>g <strong>of</strong> Leave:Leave shall be earned through period spent on duty.(c)Commencement and Term<strong>in</strong>ation <strong>of</strong> Leave:Leave ord<strong>in</strong>arily beg<strong>in</strong>s from the date on which leave as such is actually availed <strong>of</strong>,and ends on the day preced<strong>in</strong>g on which duty is resumed. If duties are rel<strong>in</strong>quishedor resumed <strong>in</strong> the afternoon the leave shall commence or end respectively on thefollow<strong>in</strong>g days. Weekends or other Gazette holidays <strong>of</strong> the University may beprefixed as well as suffixed to leave. Weekends or other Gazette holidays <strong>of</strong> theUniversity fall<strong>in</strong>g after the commencement <strong>of</strong> Leave shall be <strong>in</strong>clusive and becounted as Leave. Leave must be availed only after sanction except <strong>in</strong> case <strong>of</strong>emergencies. Staff and employees are required to <strong>in</strong>form Department Heads for theiroutstation movement and contact address dur<strong>in</strong>g leave periods and holidays.(d)On behalf <strong>of</strong> SHIATS, the power <strong>of</strong> grant<strong>in</strong>g the leave to the Directors/<strong>of</strong>ficers <strong>of</strong> theUniversity will rest with the Vice Chancellor. However the follow<strong>in</strong>g mechanism shallwork <strong>in</strong> sanction<strong>in</strong>g <strong>of</strong> the leave.Revised Leave Rule 19.4.2011 Page 1


i) Faculty Dean :They shall sanction Leave as allowed under these Rules to School Deans.ii)School Dean:They shall sanction the casual leave to all the staff <strong>in</strong>clud<strong>in</strong>g HoDs <strong>of</strong> thedepartment.They shall also sanction the earned leave up to 15 days to their staff <strong>in</strong>clud<strong>in</strong>gHoDs <strong>of</strong> the department.They will have limited power to sanction duty leave up to 15 days <strong>in</strong> anacademic year (not <strong>in</strong> one time).They shall also sanction compensatory leave.All leave application should preferably be routed through HoDs.iii) HoDs :Casual leave up to 3 days and Earned leave only up to 5 days can begranted by the HoDs for the staff / employees work<strong>in</strong>g under them.iv)Registrar and all Directors:Registrar will sanction the casual and earned leave to the support<strong>in</strong>g staff butthe casual leave more than 3 days to the <strong>of</strong>ficers work<strong>in</strong>g <strong>in</strong> Registrar <strong>of</strong>ficeshall be sanctioned by the Vice Chancellor. He can also sanction earnedleave to the <strong>of</strong>ficers <strong>of</strong> his department up to 15 days but <strong>in</strong> consultation withthe Vice Chancellor.Directors will sanction casual leave to the support<strong>in</strong>g <strong>of</strong>ficers / staff <strong>of</strong> theirDirectorate. Earned leave can be sanctioned by them up to 15 days.v) Vice Chancellor:Vice Chancellor can sanction all k<strong>in</strong>ds <strong>of</strong> leave to the <strong>of</strong>ficers and staff <strong>of</strong> theuniversity which is not covered above, however,Vice Chancellor will sanction earned leave beyond 15 days.Vice Chancellor will sanction medical leave, maternity leave, paternity leave,extraord<strong>in</strong>ary leave, special leave, study leave.Revised Leave Rule 19.4.2011 Page 2


Leave shall be <strong>of</strong> the follow<strong>in</strong>g categories: -1. Casual leave2. Earned leave3. Medical Leave4. Maternity leave5. Paternity leave6. Extraord<strong>in</strong>ary leave7. Duty leave8. Special leave9. Study leave10. Half-average pay leave11. Compensatory leave1. CASUAL LEAVE :Casual leave shall be on full pay for not more than 7 days <strong>in</strong> a month or 14 days <strong>in</strong> a(Academic) calendar year. It may be comb<strong>in</strong>ed with holidays. This leave cannot becarried over to the next (Academic) calendar year. The Maximum Casual Leaveavailed <strong>in</strong> cont<strong>in</strong>uation shall be 5 Days. CL, however, can neither be prefixedor suffixed with holidays. Gazette Holidays and weekends fall<strong>in</strong>g with<strong>in</strong> theperiod <strong>of</strong> Casual Leave shall not be counted as Leave provided the staffreports on duty on the first university work<strong>in</strong>g day ( explanation – 1) Sat & Sunbe<strong>in</strong>g weekend days the said period shall not be counted if the staff reports onduty on Monday.Staff members who are appo<strong>in</strong>ted on contract/adhoc basis shall be entitled only forcasual leave accord<strong>in</strong>g to the proportionate service. It will be one day for everymonth completed service and the maximum <strong>of</strong> two days casual leave can be availedat a time. They will not be entitled for any other leave except for the Universityholidays applicable as per university rules. However after complet<strong>in</strong>g two years <strong>of</strong>service without any break, such adhoc staff/employees shall be entitled for otherk<strong>in</strong>ds <strong>of</strong> leave like other regular appo<strong>in</strong>tees <strong>in</strong> their categories.Revised Leave Rule 19.4.2011 Page 3


2. EARNED LEAVE:(1) Staff <strong>of</strong> the University shall earn leave on full pay <strong>in</strong> respect <strong>of</strong> period spent on dutyand the earned leave admissible to such staff shall be one eleventh <strong>of</strong> the periodspent on duty, provided that when the total <strong>of</strong> his/her earned leave amounts to onehundred and eighty days he/she shall cease to earn such leave.• Earned Leave cannot be comb<strong>in</strong>ed with any other Leave.• Earned Leave beg<strong>in</strong>s on the day on which the staff rel<strong>in</strong>quishes his duties andends on the day preced<strong>in</strong>g the date on which he resumes them. All Sundays& University Holidays fall<strong>in</strong>g after the first day <strong>of</strong> commencement <strong>of</strong> Leave(but not immediately preced<strong>in</strong>g the date <strong>of</strong> jo<strong>in</strong><strong>in</strong>g) shall be counted as Leaveand be <strong>in</strong>clusive <strong>of</strong> the Leave period. In other words holidays fall<strong>in</strong>g <strong>in</strong>between shall be counted as EL.• Provided further that the maximum period <strong>of</strong> earned leave that may begranted at a time shall not be more than 120 days; if he/she has accumulated180 days <strong>of</strong> earned leave.• Earned Leave <strong>of</strong> 31 days can be availed <strong>in</strong> a calendar year. However, no staffcan avail more than 15 days Earned Leave at any given time unless thesame is sanctioned by the Vice Chancellor under special circumstances.Earned leave should preferably be taken dur<strong>in</strong>g semester / annual break onrecommendation <strong>of</strong> HoDs and Deans.• Only a maximum <strong>of</strong> 50% <strong>of</strong> Earned Leave can be accumulated <strong>in</strong> a year.3. MEDICAL LEAVELeave on a medical certificate for staff <strong>of</strong> the university may be granted notexceed<strong>in</strong>g 12 months <strong>in</strong> all dur<strong>in</strong>g his/her entire service. The leave on medicalcertificate together with earned leave, if any, shall not exceed eight months at a time.Medical leave shall be given on production <strong>of</strong> a certificate from such medicalauthority as the Vice Chancellor may, by general or special order, specify <strong>in</strong> thisbehalf and for a period not exceed<strong>in</strong>g that recommended by such medical authority.Medical leave exceed<strong>in</strong>g 30 days <strong>in</strong> anacademic year shall require approval <strong>of</strong> theExecutive Council. Leave on medical certificate will be admissible to a staff /employee subject to a condition that no leave may be granted under this provisionunless the authorities competent to sanction leave is satisfied that there is aRevised Leave Rule 19.4.2011 Page 4


easonable probability that the university staff will be fit to return to duty on the expiry<strong>of</strong> the leave applied for. In case <strong>of</strong> any doubt the Vice Chancellor may seek theop<strong>in</strong>ion <strong>of</strong> the Medical Board as approved by him before sanction<strong>in</strong>g the medicalleave exceed<strong>in</strong>g 10 days <strong>in</strong> case <strong>of</strong> staff / employee.4. MATERNITY LEAVE:The female staff shall be entitled to 135 days maternity leave at the time <strong>of</strong> delivery<strong>of</strong> child subject to changes made by University Executive Council. This will be <strong>in</strong>addition to all leave available.In case <strong>of</strong> miscarriage / abortion, the medical leave up to 4 weeks may be granted.5. PATERNITY LEAVE :A male staff / employee shall be granted paternity leave for a period <strong>of</strong> 15 dayswhich he can avail with<strong>in</strong>one month follow<strong>in</strong>g delivery. Such leave shall not bedebited aga<strong>in</strong>st the leave account.6. EXTRAORDINARY LEAVEExtraord<strong>in</strong>ary leave shall be without pay. It may be granted for such reasons as theexecutive council may deem fit. (for a period not exceed<strong>in</strong>g 3 years <strong>in</strong>itially but maybe extended for a period not exceed<strong>in</strong>g 2 years under special circumstances)• An employee cannot hold confirm posts at two places, i.e. if a teacher availsextraord<strong>in</strong>ary leave for jo<strong>in</strong><strong>in</strong>g a new job <strong>in</strong> any otherorganization/organization/Govt/university; then he/she may be allowed to availextraord<strong>in</strong>ary leave upto the time <strong>of</strong> his/her confirmation and then the leaveterm<strong>in</strong>ates.• An employee who holds a permanent post or who be<strong>in</strong>g permanent on alower post has been <strong>of</strong>ficiat<strong>in</strong>g on a higher post for more than 3 years, shallsubject to the concurrence <strong>of</strong> the State Government (if on Govt. payroll) , beentitled to count the period <strong>of</strong> extraord<strong>in</strong>ary leave sanctioned for undertak<strong>in</strong>ghigher scientific and technical studies towards his/her <strong>in</strong>crement <strong>in</strong> the timescale.• Staff/ Employee shall not be given <strong>in</strong>crement <strong>in</strong> his/ her pay scale for theperiod <strong>of</strong> extraord<strong>in</strong>ary leave when he /she jo<strong>in</strong> the University after the leave.Revised Leave Rule 19.4.2011 Page 5


• The period <strong>of</strong> extraord<strong>in</strong>ary leave shall be counted for the purpose <strong>of</strong> pensionand retirement benefits only.• The period <strong>of</strong> ord<strong>in</strong>ary leave may not be counted for the personal promotion,<strong>in</strong> case he or she has been work<strong>in</strong>g <strong>in</strong> the same or related fields.7. DUTY LEAVEDuty leave up to 15 days shall be on full pay for attend<strong>in</strong>g meet<strong>in</strong>gs <strong>of</strong> any <strong>of</strong> theuniversity bodies, sem<strong>in</strong>ars/conferences/selection committees for which a staff /employee may have been nom<strong>in</strong>ated.Duty leave will also <strong>in</strong>clude leave for conduct<strong>in</strong>g exam<strong>in</strong>ations <strong>of</strong> the university.Under Special circumstances, number <strong>of</strong> days may be <strong>in</strong>creased after obta<strong>in</strong><strong>in</strong>gapproval <strong>of</strong> the Vice Chancellor eg. Summer/w<strong>in</strong>ter schools.Duty Leave shall also be granted for perform<strong>in</strong>g any other duty <strong>of</strong> the University.However, staff / employee send by university authorities for perform<strong>in</strong>g special task(outstation) shall be considered on duty and not on duty leave.8. SPECIAL LEAVE / DEPUTATIONi) The Executive Council may, <strong>in</strong> special cases decide to send any <strong>of</strong> its academic stafffor special study <strong>of</strong> research abroad or to any place <strong>in</strong> India on such terms andconditions as it considers fit.ii) The Executive Council / Vice Chancellor may consider special leave <strong>of</strong> any nature onmerit for any staff.iii) Notwithstand<strong>in</strong>g anyth<strong>in</strong>g conta<strong>in</strong>ed <strong>in</strong> this rules --I An employee <strong>of</strong> the University who is elected, nom<strong>in</strong>ated to parliament or the statelegislature, shall not be required to resign or to take leave from the University for th<strong>edu</strong>ration <strong>of</strong> his/her membership or, except as provided by rules.I (A) for attend<strong>in</strong>g themeet<strong>in</strong>gs <strong>of</strong> any house or committee there<strong>of</strong>.I (A) The Executive Council shall fix a m<strong>in</strong>imum number <strong>of</strong> days dur<strong>in</strong>g which suchemployee shall be available <strong>in</strong> the University for his/her duties.Provided that where an employee <strong>of</strong> the Deemed University is not so availablebecause <strong>of</strong> the sessions <strong>of</strong> parliament or the state assembly/ legislative council,he/she shall be treated on duty.Revised Leave Rule 19.4.2011 Page 6


IIAn employee <strong>of</strong> the University who is a Member <strong>of</strong> Parliament or state assembly/legislative council may, throughout the term <strong>of</strong> his/her membership hold anyadm<strong>in</strong>istrative or remunerative <strong>of</strong>fice <strong>in</strong> the University Provided that such Employeeshall draw Honorarium/ Salary/Remuneration either from the University or from theParliament/ State Legislature. Further, such Employee shall be considered to be onduty whenever he/she has to attend sessions <strong>of</strong> parliament or the state assembly /legislative council or is on Deputation. For the purpose <strong>of</strong> allowances aris<strong>in</strong>g out <strong>of</strong>the travell<strong>in</strong>g <strong>of</strong> such employee, any such allowance shall not be admissible from theUniversity.Explanation–The membership <strong>of</strong> any authority or body <strong>of</strong> the Deemed University shall notbe deemed to be an adm<strong>in</strong>istrative or remunerative <strong>of</strong>fice for the purpose <strong>of</strong> these rules.9. STUDY LEAVE• The Study Leave shall be governed as per the provisions given <strong>in</strong> theRegulations for Pursu<strong>in</strong>g Higher Education <strong>of</strong> In-service Candidates <strong>of</strong>SHIATS.• The study leave may be granted upto 5 years at the discretion <strong>of</strong> the ViceChancellor /Executive Council. Further, extension <strong>of</strong> study leave/post-doctoralresearch leave may be granted under the provision <strong>of</strong> extraord<strong>in</strong>ary leave bythe Vice Chancellor /Executive Council.• Study leave can be allowed not more than once throughout the service periodunless otherwise allowed as special case by the Vice Chancellor /ExecutiveCouncil.10. HALF AVERAGE PAY LEAVE• Under extraord<strong>in</strong>ary circumstances the teacher/staff may avail leave on halfpay upto one day for every twenty two days <strong>of</strong> the period spent on duty.• Provided that such leave could be availed after he/she has completed at-least3 years <strong>of</strong> confirmed services exclud<strong>in</strong>g the period <strong>of</strong> probation.Revised Leave Rule 19.4.2011 Page 7


11. COMPENSATORY LEAVE• This leave is admissible to the support<strong>in</strong>g staffs who has worked dur<strong>in</strong>g theholidays.• Provided that at a time it should not be sanctioned for more than two days.• Provided that the employee avails this leave dur<strong>in</strong>g the month he/she wascalled on duty. Compensatory Leave cannot be accumulated.• However, no staff shall be granted Compensatory Leave <strong>in</strong> lieu <strong>of</strong> servicesrendered dur<strong>in</strong>g the period <strong>of</strong> Admission <strong>in</strong>clud<strong>in</strong>g preparation for theEntrance Exam<strong>in</strong>ation, declaration <strong>of</strong> results, Counsel<strong>in</strong>g, convocation andexam<strong>in</strong>ations etc.Note: 1) Format as enclosed is required to be added to the service book. EstablishmentOffice to take note.2) This Leave Rule once approve d by Hon’ble Vice Chancellor will supersede allprevious leave rules formed earlier or changed through special circulars byvarious authorities.
