DEER LAKES SCHOOL DISTRICTActions taken at <strong>the</strong> regular meeting – January 15, <strong>2007</strong>Purdons 53 P.S. 1432 (Post War Projects Act). This act providesthat a municipality, which includes school districts, has <strong>the</strong> authorityto create a Capital Reserve Fund <strong>from</strong>: (1) moneys transferredduring any fiscal year <strong>from</strong> Appropriations made for any particularpurpose which may not be needed and (2) surplus moneys in <strong>the</strong>General Fund <strong>of</strong> <strong>the</strong> treasury at <strong>the</strong> end <strong>of</strong> <strong>the</strong> fiscal year. Lowercourts have upheld a school district’s right under this provision toset up a Capital Reserve Fund <strong>from</strong> surplus funds.Each year <strong>the</strong> District will update its Capital Reserve Fundappropriation plan. The plan includes funds for capital needs aswell as special projects. Major capital equipment and specialproject allocations are determined by priority <strong>of</strong> need.It is intended that Capital Reserve Fund monies be expended withinfive years <strong>of</strong> transfer <strong>from</strong> General Fund.12. Authorized <strong>the</strong> <strong>Board</strong> Secretary to advertise <strong>the</strong> intent to adopt areferendum for a ballot question to increase an earned income tax toreduce property taxes, <strong>the</strong> required public hearing and any o<strong>the</strong>rnecessary advertisements pursuant to Act 1 concerning <strong>the</strong> May <strong>2007</strong>ballot question.13. Adopted <strong>the</strong> following resolution:• <strong>Deer</strong> <strong>Lakes</strong> School District is authorized to apply for funding in <strong>the</strong>amount <strong>of</strong> $149,150 <strong>from</strong> <strong>the</strong> Clean Buses for Kids School BusDiesel Retr<strong>of</strong>it Program. If selected for funding, <strong>the</strong> school districtis expecting to enter into a Funding Agreement with <strong>the</strong> ProgramAdministrator, ICF Incorporated, LLC. The Clean Buses for KidsSchool Bus Diesel Retr<strong>of</strong>it Program is undertaken in connectionwith <strong>the</strong> settlement <strong>of</strong> an enforcement action, United States vs.Toyota Motor Corporation, brought on behalf <strong>of</strong> <strong>the</strong> U.S.Environmental Protection Agency under <strong>the</strong> Clean Air Act. Ifselected for funding, <strong>the</strong> school district will implement a project toretr<strong>of</strong>it 21 school buses with diesel particulate filters.14. Approved <strong>the</strong> June 30, 2006 audit prepared by Hosack, Specht, Muetzel &Wood LLP.15. Approved a contract with GLA Water Consultants Inc. to flush and clean<strong>the</strong> chilled water system at <strong>the</strong> High School and fill <strong>the</strong> ro<strong>of</strong>-top units andpiping with glycol at a cost <strong>of</strong> $6,980.16. Approved a contract with Johnson Controls, Inc. to upgrade <strong>the</strong> existingJohnson Controls BAS in <strong>the</strong> East Union Intermediate Center to a NAEweb based controller at a cost <strong>of</strong> $8,966.00.

The current school district earnedincome tax rate is .5%.Explanation <strong>of</strong> Ballot QuestionUnder <strong>the</strong> Taxpayer Relief Act (also known as Special Session Act 1 <strong>of</strong>2006), each local school board—with voter approval—may impose a taxon earned income and net pr<strong>of</strong>its in order to pay for reductions in propertytaxes. In short, <strong>the</strong> funds generated by an additional income tax will beused to lower property taxes on approved homestead and farmsteadproperties starting with <strong>the</strong> <strong>2007</strong>-08 fiscal year.The Act provides that voters within each school district are to decidedirectly whe<strong>the</strong>r <strong>the</strong>ir school district will impose an additional income tax t<strong>of</strong>und property tax relief. This referendum question is being presented tovoters to allow <strong>the</strong>m to decide that question.If <strong>the</strong> majority <strong>of</strong> voters vote “yes” on this referendum question, residentsin <strong>the</strong> <strong>Deer</strong> <strong>Lakes</strong> School District will pay more in earned income taxes to<strong>the</strong> school district by 1 %. Residents who own and live in <strong>the</strong>ir homes(and who have applied and thus far have been approved to receive ahomestead or farmstead exclusion) will receive a reduction in <strong>the</strong>irproperty taxes by an estimated $ 257.00 for homesteads and $ 257.00 for

Inaddition, <strong>the</strong> proposed increase would generate an estimated $0.00 inrevenue—representing 0% <strong>of</strong> <strong>the</strong> estimated additional revenue generatedby <strong>the</strong> additional tax—which may be used for school district operations in<strong>2007</strong>-08 as permitted by <strong>the</strong> Taxpayer Relief Act.If <strong>the</strong> majority <strong>of</strong> voters vote “no” on this referendum question, no changeswould occur to <strong>the</strong> school district’s portion <strong>of</strong> <strong>the</strong> earned income tax rate.Therefore, no local revenue would be available for property tax relief.Voters’ decision on this referendum question will not affect <strong>the</strong> schooldistrict’s ability to receive state funds that will be used for property taxrelief.The current school district earned income tax rate is .5%. Installment payment dates. A taxpayer electing <strong>the</strong> installment payment optionmay pay <strong>the</strong> real estate tax in three (3) equal installment payments <strong>of</strong> one-third (1/3) <strong>of</strong><strong>the</strong> full tax amount. The installments are due on or before August 31, October 31, andDecember 15 <strong>of</strong> <strong>the</strong> year in which <strong>the</strong> tax is levied. Any installment not paid in full by<strong>the</strong>se dates is delinquent.2. Taxpayer election <strong>of</strong> installment payment option. Payment <strong>of</strong> <strong>the</strong> firstinstallment in full by August 31 will constitute taxpayer election to pay tax in installments.Installment payment is permitted only if <strong>the</strong> taxpayer elects by paying <strong>the</strong> first installmentpayment in full by August 31. If <strong>the</strong> taxpayer fails to meet this requirement, <strong>the</strong> fullamount <strong>of</strong> <strong>the</strong> real estate tax is due on or before October 31, and <strong>the</strong> real estate tax isdelinquent if not paid in full on or before October 31.3. No discount. No discount applies to installment payments.4. Penalty on delinquent installments. If a taxpayer makes <strong>the</strong> first installmentpayment by August 31 and fails to pay in full any subsequent installment by <strong>the</strong>installment due date, <strong>the</strong> installment not paid by <strong>the</strong> due date is delinquent, and apenalty will be added to <strong>the</strong> tax in <strong>the</strong> amount <strong>of</strong> ten percent (10%) <strong>of</strong> <strong>the</strong> amount <strong>of</strong> <strong>the</strong>installment not paid by <strong>the</strong> installment due date, without regard to any partial payment <strong>of</strong><strong>the</strong> installment.5. Ineligibility.
