c) The Bidder shall associate minimum one Subject Expert for each of thesubjects nominated by PES during every stage of development of theEducational Content till the final approval by the Technical Advisory Panel isobtained.d) The bidder shall use only licensed versions of the system/Application softwareand shall be held liable for any consequent action arising out ofpatent/intellectual property right violations and the PES shall not be responsiblefor any liabilities or damages arising thereof.e) The development work for the Multimedia Based Educational Content shouldbe undertaken in the premises of the successful Bidder. The developmentwork should ideally be carried out within Punjab but this is notmandatory. In case, the development and production of the EducationalContent is carried out from a place outside of the State of Punjab, theBidder will be required to establish a Project Coordination Unit atChandigarh vested with adequate decision-making authority w.r.t. day-todaycoordination with the Technical Advisory Panel of the PES. Anyadvice of the Technical Advisory Panel will have to be responded within aperiod of 3 (three) working days.f) The User's Rights of developed Multimedia Based Educational Content will vestwith the PES as far as their use within the State of Punjab is concerned.PROJECT DIRECTOR CUM DGSE, Punjab Edusat Society shall have all rightson Software, Source Code and related documentation for its unlimited,unrestricted use within the State of Punjab at unlimited number of locations,machines, computers, gadgets etc. in Govt. schools, Govt. aided schools andthrough Edusat programme. However, PROJECT DIRECTOR CUM DGSE,Punjab Edusat Society shall not allow its use to any other State Government forcommercial or non-commercial purposes.13
