4.18.3. The PROJECT DIRECTOR CUM DGSE, Punjab Edusat Society willreject a proposal for award if it determines that the Bidder recommended foraward has engaged in corrupt or fraudulent practices in competing for thecontract in question.4.18.4. The PROJECT DIRECTOR CUM DGSE, Punjab Edusat Society willdeclare a Bidder ineligible, either indefinitely or for a stated period of time, tobe awarded a contract if at any time it is determined that the Bidder hasengaged in corrupt and fraudulent practices in competing for or in executionof the contract.4.19. Performance security4.19.1. Within 7 (Seven) days of Notification of “Award of the Work” thecompany shall furnish Performance Security to PROJECT DIRECTOR CUMDGSE, Punjab Edusat Society @ 5% of the total accepted order value ofquoted bid by way of irrevocable and unconditional Bank Guarantee in favorof PROJECT DIRECTOR CUM DGSE, Punjab Edusat Society for a period tobe specified in the award of work.4.19.2. This Bank Guarantee should be of sufficient duration to cover the riskof PROJECT DIRECTOR CUM DGSE, Punjab Edusat Society. The proceedsof the Performance Security shall be payable to PROJECT DIRECTOR CUMDGSE, Punjab Edusat Society as compensation for any loss resulting fromthe Company’s failure to fulfill its obligations under the terms and conditionsof the Work Order.4.20. Fall Clause(i) The prices charged for the stores supplied under contract by the bidder shallin no way exceed the lowest price at which the bidder sells the Goods/ Services oroffer to sell Goods/ Services of identical description on similar terms and conditionsto any person/Organization including the purchaser or any department of the CentralGovt. or any Deptt. of the State Govt. or any statutory undertaking of the Central orState Govt. as the case may be during the period till performance of the supply orderplaced during the currency of the contract is completed.(ii) If at any time during the said period the bidder reduces the rate of sale price,sells or offers to sell such Goods/ Services to any person/Organization including thepurchaser or any Deptt. of Central Govt. or any Deptt. of State Govt. or any statutoryundertaking of the central or State Govt. as the case may be at price lower than theprice chargeable under the contract shall forthwith notify such reduction sale or offerto sell to the Society and the price payable under the contract for the Goods/Services supplied after the date of coming into force of such reduction or shall offerto sell shall stand correspondingly reduced.(iii) The bidder shall furnish the following certificate alongwith each bill or payment forsupplies made against the contract. The supplier has to certify that there has been noreduction in sale price of the Goods/ Services of description identical to the Goods/ Servicessupplied to the Govt. under the contract herein and such Goods/ Services have not beenoffered and sold by him on similar terms and conditions to any person/Organization22
