John’s Development RegulationsKennel OperationsAt the Regular Meeting <strong>of</strong> <strong>Council</strong> held on July 23, <strong>2012</strong>, <strong>Council</strong> agreed to accept the recommendationcoming out <strong>of</strong> the June 22, <strong>2012</strong> meeting <strong>of</strong> the Planning and Housing Committee that a text amendmentbe made to the <strong>St</strong>. John’s Development Regulations by adding a new section to the Regulations torequire that kennels must be in compliance with all applicable Municipal and Provincial legislation. Thisis in reference to the new Provincial Animal Health and Protection Act and accompanying regulations.<strong>Council</strong> further agreed that the text amendment be advertised for public review and comment and thatupon completion <strong>of</strong> this process, the amendment be referred to a future Regular Meeting <strong>of</strong> <strong>Council</strong> forconsideration <strong>of</strong> adoption.In accordance with the <strong>Council</strong> Directive <strong>of</strong> July 23, <strong>2012</strong>, the proposed text amendment has beenadvertised for public review and comment. The amendment has been advertised on two occasions in TheTelegram Newspaper and has been posted on the <strong>City</strong> website. Any written public submissions receivedby the <strong>City</strong> Clerk’s Department in response to the <strong>City</strong>’s advertising <strong>of</strong> the text amendment will bereferred to the agenda for the Regular Meeting <strong>of</strong> <strong>Council</strong> to be held on <strong>September</strong> <strong>10</strong>, <strong>2012</strong> at whichtime <strong>Council</strong> is scheduled to make a decision with respect to the proposed adoption <strong>of</strong> the textamendment.RecommendationIt is recommended that <strong>Council</strong> adopt the attached resolution for the <strong>St</strong>. John’s DevelopmentRegulations Amendment Number 543, <strong>2012</strong> which have the effect <strong>of</strong> adding a new section to Section 7<strong>of</strong> the Development Regulations to require that kennels operating in the city must be in accordance withall applicable Municipal and Provincial legislation.If the text amendment is adopted by <strong>Council</strong>, in accordance with the requirements <strong>of</strong> the Urban andRural Planning Act, the amendment will then be referred to the Department <strong>of</strong> Municipal Affairs withthe request for a Provincial registration <strong>of</strong> the amendment.Cliff Johnston, MCIPDirector <strong>of</strong> PlanningAttachment/sfG:\JOHNSTON\<strong>2012</strong>\Mayor - Text Amendment - Kennels - <strong>September</strong> 4, <strong>2012</strong>.doc
