28.5 Proposals by shareholders or holders of depositary receipts for shares shall be put on
the agenda only if they have been lodged in writing with the Board of Directors by
one or more shareholders or holders of depositary receipts for shares who alone or
deliver a written statement from the affiliated institution confirming that the number of
shares mentioned in the statement forms part of a collective depot and that the person
mentioned in the statement is a participant for the portion of the issued share capital
or the market value mentioned in the statement on the day on which proposals are
lodged in writing with the Board of Directors, or by other means to the satisfaction of
the Board of Directors. The provisions of the preceding sentence shall correspondingly
apply to depositary receipts for shares and to holders of depositary receipts for shares.
