ATTACHMENT IV (Continued)Proposed Text Amendments for Hedgesii.For every one (1) foot of height above the 10 feet, an additionaltwo (2) feet of setback is required when abutting the larger sidesetback, after determination of the (smaller) minimum five (5) footside setback has been made;iii. For every one (1) foot of height above the 10 feet, an additionaltwo (2) feet of setback is required when abutting the rear setback,except when abutting an accessory structure that is located aminimum of five (5) feet, the setback will be four (4) feet ofadditional setback for the hedge;iv. For hedges located on a corner lot, the corner side setback mayexceed the height 10 feet with a variance approval from the ZBA.However, the maximum hedge height of ten (10) feet shall remainwithin the required front setback of the same corner lot.(b.) Property owner agreements.i. The adjacent property owner(s) that share a common property linenearest to the hedge have agreed to the proposed increase in height;ii.The adjacent property owner(s) have provided verification ofownership in the adjacent property, have executed a notarizedletter agreeing to the proposed height variance and that the ownerof the hedge(s) shall maintain the hedge so that it does notoverhang onto the property of an adjoining property owner, andhave agreed that notice of the variance and maintenance can berecorded on their property with the Palm Beach County Clerk ofCourts;(c.) Lot size. The size of the lot and adjacent properties are conducive tothe height increase and will not detrimental to the public welfare.(2) Maximum height, exception. On corner lots and through lots adjacent to a collector orarterial right-of-way as designated by the city engineer, a fence or wall shall notexceed six feet in height and a hedge ten feet in height within the required frontsetback adjacent to the collector or arterial right-of-way. On residential lots directlyabutting commercial or industrial zoning districts, a fence or wall shall not exceedeight feet in height within the side or rear setback, outside of the front setback, wherethe property abuts the commercial or industrial zoning district. Fences, walls andhedges installed pursuant to this section shall be subject to the clear visionrequirements of subsection 33-112(e) 94-305(e) of this Code.CRC 11-06 - 13
