There were a couple of Planning workshops in April 19, 2011, and May 17, 2011. In theseworkshops, the Planning Board took into consideration various items regarding the hedge heightissue. The first point they considered was that hedges are currently allowed to be planted right atthe property line: the higher the hedge, the wider the branches and roots spread, which cannegatively affect an adjacent residential structure that meets the minimum five (5) foot setback.Second, a ten-foot or taller hedge can potentially cast a shadow for most of the day to the side ofan adjacent property to the east and the west. In some cases, the shadows that are cast by thesehigh hedges do not allow sod or other sun-light dependent landscaping to thrive. Third, anotherpotential issue that arises from the hedges being higher than ten (10) feet is the maintenanceissue it creates for the adjacent property owner. The residents that currently have these 15-foothigh or more hedges are creating undue hardship to their neighbors, not only are they infringingon their potential light, air and enjoyment that they would otherwise get, but also addingadditional hardship to maintain their side of the hedge. Fourth, the unintended consequence ofhaving a narrow lot next to two tall hedges is a tunnel effect by hindering the sun light and airflow from coming through to the smaller lot. It is apparent that the variation of lot sizes withinthe City does not provide for a one-size fits all solution. Last, staff does not believe the Cityshould convey neighborhood aesthetics where the only view from the rights-of-way is tallhedges. Tall hedges over 10 feet in height not only have the walling off effect, they also donothing to contribute to the welcoming neighborhood feel that makes the City proud. Theycontribute additional maintenance issues for the adjacent property owner and do not providemore privacy than what the current code provides (see pictures in ATTACHMENT III).As a result, at the May 17, 2011, Planning Board workshop, The Board recommended to keepthe existing hedge height status quo. The recommendation was presented at a June 6, 2011,Mayor/Commission work session and direction was given to Staff by the Mayor andCommissioners to leave the current regulations in place regarding the maximum hedge height of10 feet. But, had staff draft variance criteria and standards to amend the Zoning Code that willallow a property owner to apply for a variance from the maximum hedge height under certaincriteria provisions that are applicable only within the Residential Zoning Districts.3.
