Module Two: Being HeardScene 6: Truth and LiescharactersTylaOzLiamThe CoronerConstable WalcottThe Coroner sits facing the room. Immediately in front of her is the Coroner’s Officer. To her left isthe witness box and to her right the place for the press. The families and witnesses are gathered onthe benches. Sitting in distinct groups are Tyla and her parents, Jaz’s mum, Oz and his mum, Liam andhis parents. Liam is in a wheelchair but positioned so that this can’t be seen. Sound of quiet weeping.Coroner:Can I remind you this Inquest, adjourned for the funerals of the deceased, is nowreconvened. It is our primary aim to investigate the sequence of events that led to the road trafficcollision at the bend of Newton Road, known locally as ‘Bikers’ Dream’, resulting intwo fatalities.Since the victims, though in two separate cars, were part of the same incident, I amgoing to take the cases together. Members of the families, do you agree? The members of the families look at each other and nod.Coroner:Now, the purpose of this Inquest is not to apportion blame, but to establish who thevictims were and where, when and how they died.(Pause) So I’d like to call to the stand first please, the Collision Investigator.Constable Walcott is on the stand.Walcott:Coroner:Walcott:Coroner:Walcott:From my study of the markings on the road and the position of the two vehiclesinvolved, I draw the following conclusions. The two cars were travelling north on Newton Road, with Vehicle One on the insidelane, and Vehicle Two pursuing on the outside, right-hand lane. At the bend known asBikers’ Dream the front of Vehicle Two made contact with the rear of Vehicle One.Skid marks on the road indicate that the driver of Vehicle One lost control, came offthe carriageway and impacted with a tree. This vehicle subsequently caught fire.Vehicle Two then continued north on Newton Road, coming into contact with roadsidefurniture. This caused Vehicle Two to rotate and flip over several times, ejecting thefront seat passenger from the vehicle before coming to rest on the carriageway. Can you estimate the speed of the two vehicles?Yes, I calculate that both cars were travelling between 55 and 60 miles per hour. What is the speed limit on Newton road?40 miles per hour Ma’am.www.lscp.org.ukProvided by the London Safety Camera Partnership

Module Two: Being HeardCoroner:Thank you. Next I’d like to concentrate on Vehicle Two, so I’d like to call as my nextwitness Mr Oz Powell, who I understand was driving the vehicle at the time of the crash.Oz takes the stand and is sworn in.Oz:Coroner:Oz:Coroner:Oz:Tyla:Coroner:Oz:Tyla:Coroner:I swear to tell the truth, the whole truth and nothing but the truth, so help me God.Mr Powell, I am going to ask you to tell us exactly, in your own words, what happened thatnight. You do not have to say anything incriminating and you may wish to remain silent. No, I don’t mind telling. I’ve done nothin’ wrong, have I? Alright, we’d been to PassionsNightclub - Me, Tom and Ty. Tom drove us in his dad’s car, because he’d just passed hisdriving test. When we got to the nightclub, my girlfriend was in there and she was messing my headwith that idiot bloke, (indicates to Liam). So me and Tom decided to leave, but we hadto take Tyla with us ‘cause she was scared her Mum and Dad would find out she was in anightclub, like in case we left her. So all three of us left in the car.And who was driving at this point, Mr Powell?I was... but, I mean, I’ve done nothing wrong - nothing! You know, Tom’d had a drink andI was just lookin’ out for him… didn’t want him to lose his licence!(Unable to contain her rage) Liar!No interruptions please! There will be time to ask questions later.(To Oz) You may continue.Thank you. Well, as we were leaving the car park, that Liam - whatever his name is - hecame out as well, showing off, ‘cause he had my girlfriend in his car!He kept taunting me, you know, trying to race me… I was upset with him, but I didn’t wantto risk the safety of my passengers… so I just tried my best to ignore him… but he kepttrying to race me… and as we got up to Bikers’ Dream, that’s when he started to overtakeme - and he swerved right into me on the corner, you know. The car rolled over and over. There was nothing I could do, you know. And the next thing I remember is waking up inhospital, with my bandages on.(Shouting) Liar! You’re a liar! That’s not how it happened and you know it!May I remind you all that this is a legal hearing and all present are expected to conductthemselves properly.www.lscp.org.ukProvided by the London Safety Camera Partnership

Module Two: Being HeardScene 7: Instant RecallCharactersMr Anstey (Dad)TylaThe CoronerTyla is in the witness box.Tyla:Coroner:(Angrily) Oz is lying!Miss Anstey, I can understand that you are angry and upset. Now, please just tell mewhat happened.Tyla tries to compose herself. During her speech she sees flashbacks from the night of the crash andthe argument in the car park with Tom and Oz.Tyla:I couldn’t get my seatbelt fixed, so Tom came round to help me.Oz drove like a maniac. I was so scared. He caught up to the traffic lights, with Jaz. Hejust screamed insults at them, but they just ignored him.I think that made him even more angry ‘cause when the lights changed he roared up theroad, got in front of Liam and slowed right down so that Liam had no choice but to tryand pass him. But when he did, Oz put his foot down again.Tom and I were screaming at him to stop it, but he didn’t listen. I don’t think I’ll everforget the sound of the two cars hitting. Oz shunted Liam from behind, they lostcontrol and when our car rolled over, I thought we were all going to die!(Crying) It was poor Tom thrashing and crashing around the inside of the car becausethat maniac didn’t give him a chance to put his seatbelt on. That’s the last thingI remember - Tom lying dead on the road.(Indicates Oz) I hate him - I hate him! It’s all his fault!Tyla breaks down completely.Coroner:Dad:Coroner:Members of the families, do you have any questions you’d like to put to the witness? Not a question - a statement. I would like to say that our Tom was a wonderful soul.We are a close family and he was a good big brother to his sister. There’s just no wayhe would willingly have let Oz drive - not my car, with no insurance. He would want toprotect himself and his sister.Mr Anstey, I understand your feelings, and I am deeply sorry for your loss, but this isnot relevant to this inquisition. Nobody is on trial here.www.lscp.org.ukProvided by the London Safety Camera Partnership

Module Two: Being HeardScene 8: Fiery FinaléCharactersThe CoronerLiamMrs KaurDr Greener (Pathologist)Coroner:We heard earlier from the Pathologist, that the victim of the first car, Mr Tom Anstey, died from a fracture to the skull, and severe internal injuries to his organs, from violentcontact, first with the inside of the car and then the impact of being thrown out of thevehicle through the window, as the car rolled over and over. Now I would like to call Mr Liam Knowles to the stand, this time turning our attentionto Vehicle One involved in the crash, and the deceased Jasminder Kaur.Liam, in a wheelchair, wheels himself to the witness stand and recalls the night of the crash.Liam:Coroner:Liam:I thought she was dead… I never would have left her if I knew she was still alive.Mr Knowles I know this is difficult, but please tell the events of that night as youremember.Well, he was just mental, trying to force me to race… no matter what I did to try andget past him, he just kept at us. When he rammed my rear bumper, well I just lostcontrol of the car. The back was swinging from side to side and Jaz was screaming. Then we crashed into the tree.I looked at Jaz and she wasn’t moving. I thought she was dead… then I realised I couldsmell petrol and I knew I had to get out. Something was wrong with my legs. When I was out I looked back and I swear I saw Jaz’s fingers moving. I started to dragmyself back to the car, but as I got closer to it, it just… burst into flames. She didn’tstand a chance. That’s all I can remember.Shortly afterwards. Dr. Greener, the pathologist, is on the stand.Dr. Greener: Jasminder Kaur’s death was caused by her body sustaining severe burns from theresulting fire. It is quite possible that she would have suffocated due to the lack ofoxygen from the inferno.Coroner:Dr. Greener: Thank you.Coroner:I believe that death was not instantaneous. It’s my belief that she would have beenknocked unconscious by the initial impact with the tree and would have only justbeen regaining consciousness when the car caught fire.Thank you, Doctor Greener. As Coroner at this inquisition, I can draw conclusions, but cannot speculate. Havingheard all the evidence however, I am satisfied that on the balance of probability, there isa case to answer for causing death by dangerous driving. From the bench Mrs Kaur suddenly stands up and turns around to Oz.Mrs Kaur:Coroner:Mrs Kaur:(To Oz) It was you! You did this!Mrs Kaur...You killed them both!www.lscp.org.ukProvided by the London Safety Camera Partnership
