He was responsible for the design andimplementation of a business critical 15-000 user bespoke software application commercially commissionedby Cambridge University. As a result of this experience, <strong>Matthew</strong> brings to IT disputes an excellent and deepseated understanding of IT software, systems and development approaches, and first-hand appreciation ofthe realities of project definition and delivery. He is able to discuss details of a case with experts and clientsat the deepest technical level; he can “translate” technical concepts for the benefit of a legal team or anarbitral tribunal.<strong>Matthew</strong> acts and advises on a wide range of IT-related disputes. He is regularly instructed on behalf ofproviders and purchasers of IT systems and software across a variety of industry sectors. He has acted inrelation to disputes involving mainstream business systems (from stand-alone applications to large-scaleenterprise installations) and highly specialised applications such as broadcasting platforms,telecommunication networks, banking systems and safety critical software. Acting in a claim in excess of £100m involving rights to use of mast sites for 2G and 3G RadioAccess Networks. The dispute was primarily focussed on contractual matters and aspects oftelecommunications law, but also involved detailed technical factual and expert evidence in relationto the mechanisms involved in roaming and signal handover; Acting for a software development house in a claim against former employees for copyrightinfringement and breach of confidence arising out of alleged misappropriation of software sourcecode and misuse of commercial secrets by a competitor;Advising users and suppliers of software in relation to the scope and effect of end-user licenceagreements;Acting for a major vendor of network equipment in an arbitration concerning the sale and licenceback of intellectual property in software involving allegations of breach of contract and copyrightinfringement;Acting in an arbitration involving dispute as to intellectual property rights in UMTS access stratumtechnology;Acting for BSkyB in relation to its very substantial claim against EDS for deceit, negligence andbreach of contract relating to the procurement of a Customer Relationship Management System fornew state-of-the-art call-centres;Acting for a specialist software supplier in a multi-million pound dispute relating to project delay andallegations of defective design and implementation of safety critical software for the rail industry;Acting for a major telecoms provider in relation to a contractual dispute relating to theimplementation of an international high-speed data network;Advising a major insurer in relation to a dispute arising out of a long-term business outsourcingproject;Acting for an Internet trading company in relation to the abusive registration of domain names;Representing a software house in relation to a claim for alleged copyright infringement and breach oflicence terms arising out of the integration of a third-party function library;Advising a major telecoms provider in relation to the unlawful sale of “mod-chipped” decoder boxeson Internet auction sites;Acting for the purchaser of a bespoke stock control and invoicing system in a claim for damagesarising out of the supplier’s repudiatory breach of contract; Acting for a provider of aviation ground support services in relation to a contractual disputeconcerning the installation and supply of a global wide-area network;Acting for a systems integrator in relation to a dispute over a complex ERP/CRM implementation.In addition to his technology-focused work, <strong>Matthew</strong> has experience in aviation-related matters, in particularaircraft mortgages, engineers’ liens, disputes relating to aircraft maintenance and modifications andinsurance coverage disputes. <strong>Matthew</strong> has an excellent knowledge and understanding of aircraft operationand the practicalities of aviation infrastructure.
