REASONABLE NECESSITY STATEMENT: It is necessary to adoptRULES I through IX to protect active duty members of the Armed Forces fromdishonest and predatory insurance sales practices while located in this state and toauthorize the insurance commissioner to implement a system for the receipt anddissemination of reports from governmental agencies and insurers of disciplinaryaction taken by federal or state governmental entities or insurers against personsthat sell or solicit the sale of any life insurance product to active duty members of thearmed forces.5. Concerned persons may submit their data, views, or argumentsconcerning the proposed action either orally or in writing at the hearing. Writtendata, views, or arguments may also be submitted to Patrick M. Driscoll, StaffAttorney, State Auditor's Office, 840 Helena Ave., Helena, Montana 59601;telephone (406) 444-2040; fax (406) 444-3497; or e-mail padriscoll@mt.gov, andmust be received no later than 5:00 p.m., August 3, 2007.6. Patrick M. Driscoll, Staff Attorney of the State Auditor's Office andCommissioner of Insurance, has been designated to preside over and conduct thishearing.7. <strong>The</strong> department maintains a list of concerned persons who wish to receivenotices of rulemaking actions proposed by this agency. Persons who wish to havetheir name added to the list shall make a written request that includes the name andmailing address of the person to receive notices and specifies for which program theperson wishes to receive notices. Such written request may be mailed or deliveredto Darla Sautter, State Auditor's Office, 840 Helena Ave., Helena, Montana, 59601,or may be made by completing a request form at any rules hearing held by thedepartment.8. An electronic copy of this Proposal Notice is available through theSecretary of State’s web site at http://sos.mt.gov/ARM/Register. <strong>The</strong> Secretary ofState strives to make the electronic copy of the Notice conform to the official versionof the Notice, as printed in the Montana Administrative Register, but advises allconcerned persons that in the event of a discrepancy between the official printedtext of the Notice and the electronic version of the Notice, only the official printed textwill be considered.
