Although 75-10-405, MCA, provided rulemaking authority when this rulewas adopted, the statutes were later amended and the rulemaking authority for theunderground storage tank program is now provided in 75-11-505, MCA.17.56.304 REPAIRS (1) Owners and operators of UST systems must shallensure that repairs will prevent releases due to structural failure or corrosion for aslong as the UST system is used to store regulated substances. Owners andoperators must shall receive a permit from the department prior to making any repairof an UST system.(2) Tanks not meeting the design or construction standards of the applicablecode of practice adopted by reference in (4) may not be repaired and must be closedin accordance with ARM 17.56.702.(3) Repairs must meet the following requirements:(a) Repairs to UST systems must be conducted in accordance with allapplicable state, federal, and local laws and regulations and the applicable code ofpractice adopted by reference in (4).
