-906-(a) using DoD personnel, directly or indirectly, as a representative or agent inany official or business capacity with or without compensation with respect to thesolicitation or sale of life insurance to service members; or(b) using an insurance producer to participate in any United States ArmedForces sponsored education or orientation program.AUTH: 33-1-3<strong>13</strong>, 33-18-103, MCAIMP: 33-18-103, MCANEW RULE VII PRACTICES DECLARED FALSE, MISLEADING,DECEPTIVE, OR UNFAIR REGARDLESS OF LOCATION (1) <strong>The</strong> following acts orpractices by an insurer or insurance producer constitute corrupt practices, improperinfluences, or inducements and are declared to be false, misleading, deceptive, orunfair:(a) submitting, processing, or assisting in the submission or processing ofany allotment form or similar device used by the United States Armed Forces todirect a service member's pay to a third party for the purchase of life insurance. <strong>The</strong>foregoing includes, but is not limited to, using or assisting in using a servicemember's "MyPay" account or other similar internet or electronic medium for suchpurposes. This rule does not prohibit assisting a service member by providinginsurer or premium information necessary to complete any allotment form; or(b) knowingly receiving funds from a service member for the payment ofpremium from a depository institution with which the service member has no formalbanking relationship. For purposes of this rule, a formal banking relationship isestablished when the depository institution:(i) provides the service member a deposit agreement and periodicstatements and makes the disclosures required by the Truth in Savings Act, 12U.S.C. section 4301 et seq., and the regulations promulgated thereunder; and(ii) permits the service member to make deposits and withdrawals unrelatedto the payment or processing of insurance premiums.(c) employing any device or method or entering into any agreement wherebyfunds received from a service member by allotment for the payment of insurancepremiums are identified on the service member's Leave and Earnings Statement orequivalent or successor form as "savings" or "checking" and where the servicemember has no formal banking relationship as defined in (1)(b);(d) entering into any agreement with a depository institution for the purposeof receiving funds from a service member whereby the depository institution, with orwithout compensation, agrees to accept direct deposits from a service member withwhom it has no formal banking relationship;(e) using DoD personnel, directly or indirectly, as a representative or agent inany official or unofficial capacity with or without compensation with respect to thesolicitation or sale of life insurance to service members who are junior in rank orgrade, or to the family members of such personnel;(f) offering or giving anything of value, directly or indirectly, to DoD personnelto procure their assistance in encouraging, assisting, or facilitating the solicitation orsale of life insurance to another service member;MAR Notice No. 6-167 <strong>13</strong>-7/5/07
