PUBLIC MEETINGNOTICE OF MEETINGYou are invited to attend a Public Meeting to be held by the Development Services Committee <strong>of</strong>the <strong>Town</strong> <strong>of</strong> <strong>Markham</strong> to consider an application by <strong>Golden</strong>-<strong>Hauer</strong> <strong>Investments</strong> <strong>Ltd</strong>. to amendthe <strong>Town</strong>’s Zoning By-law 108-81, as amended.DATE: Monday, December 7th, 2009TIME:PLACE:7:00 pm.Council ChambersAnthony Roman Centre101 <strong>Town</strong> Centre Boulevard<strong>Markham</strong>, Ontario, L3R 9W3BACKGROUND319 Denison Street (the “subject property”) is located on the south side <strong>of</strong> Denison Street, east <strong>of</strong>Woodbine Avenue, and is owned by <strong>Golden</strong>-<strong>Hauer</strong> <strong>Investments</strong> <strong>Ltd</strong>. There is an existingindustrial/commercial building consisting <strong>of</strong> a property management <strong>of</strong>fice, a commercial paperdistribution company, a renovation and construction company and a restaurant. Industrial,commercial and restaurant uses surround the subject property. The subject property isdesignated “Industrial-Business Corridor Area” in the Official Plan which provides for accessoryand incidental retail uses associated with permitted light industrial uses. The subject property iszoned “Select Industrial and Limited Commercial [MC (40%)]” which prohibits any type <strong>of</strong>retail uses.PROPOSALXpedx, a commercial paper distribution (warehousing and wholesaling) company currentlyoperating on the subject property, <strong>of</strong>fers specialty paper, stationary and packaging products.Xpedx occuipes approximately 860 square metres (9, 250 square feet) within the existingbuilding. Xpedx is proposing that an associated retail use to the existing warehouse/wholesaleuse, be permitted throughout their entire operation. The proposed retail component wouldgenerate the need for 6 additional parking spaces.PURPOSE AND EFFECT OF THE PROPOSED AMENDMENTThe purpose and effect <strong>of</strong> the proposed amendment is to allow a retail use which would beaccessory to the primary industrial use.NOTE REGARDING ZONING BY-LAW AMENDMENTi)If a person or public body that files an appeal <strong>of</strong> a decision <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Markham</strong> in respect<strong>of</strong> the proposed Zoning By-law Amendment does not make oral submissions at a public meeting,or make written submissions to the <strong>Town</strong> <strong>of</strong> <strong>Markham</strong>, before the proposed zoning by-law ispassed, the person or public body is not entitled to appeal the decision <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Markham</strong>to the Ontario Municipal Board.ii)If a person or public body does not make oral submissions at a public meeting, or make writtensubmissions to the <strong>Town</strong> <strong>of</strong> <strong>Markham</strong>, before the proposed zoning by-law is passed, the personor public body may not be added as a party to the hearing <strong>of</strong> an appeal before the OntarioMunicipal Board unless, in the opinion <strong>of</strong> the Board, there are reasonable grounds to do so.ADDITIONAL INFORMATIONAdditional information is available from Stacia Muradali, Planner, ext. 2008 <strong>of</strong> the <strong>Town</strong>’sPlanning Department, tel.
