.7.16 <strong>Abuse</strong> which occurs within an instituti<strong>on</strong>al setting often includes more than <strong>on</strong>e formof harm as a result of rigid and insensitive routines, unskilled, intrusive or invasiveinterventi<strong>on</strong>s or an envir<strong>on</strong>ment which allows inadequate privacy or physical comfort. Thistype of abuse falls within the remit of regulators as well as purchasers of care. Legislati<strong>on</strong> isbeing introduced to widen the type of settings which are regulated. However, c<strong>on</strong>tractspecificati<strong>on</strong> m<strong>on</strong>itoring also has a role to play in protecting vulnerable adults. <str<strong>on</strong>g>In</str<strong>on</strong>g>stituti<strong>on</strong>alabuse is therefore not a separate category of abuse but a particular manifestati<strong>on</strong> of, andc<strong>on</strong>text for, it.7.17 Where a vulnerable adult appears to be able to make informed choices and is notbeing unduly intimidated the available opti<strong>on</strong>s should be explored with them and theirwishes respected, unless these c<strong>on</strong>flict with a statutory duty to intervene, or unless anotherpers<strong>on</strong>(s) is c<strong>on</strong>sidered to be at risk. <str<strong>on</strong>g>In</str<strong>on</strong>g> all circumstances they should be c<strong>on</strong>sulted andinvolved in decisi<strong>on</strong> making as far as possible. Service users have a right to make choicesand maintain their independence even when this involves a degree of risk. Where theindividual chooses to accept this risk, their wishes should be respected within their capacityto anticipate and understand the risk. Making sound professi<strong>on</strong>al judgements in thesesituati<strong>on</strong>s may require formal assessment of capacity in relati<strong>on</strong> to c<strong>on</strong>sent. Sexual acts orfinancial transacti<strong>on</strong>s are abusive in the absence of valid, informed c<strong>on</strong>sent, - lack ofunderstanding, misuse of authority, intimidati<strong>on</strong> or coerci<strong>on</strong> cut across aut<strong>on</strong>omous decisi<strong>on</strong>making <strong>on</strong> the part of vulnerable adults so that an initial refusal of help should not always betaken at face value.18
