PSO 8105 Page 1PSO 8105 – AGE RETIREMENTEXECUTIVE SUMMARYSTATEMENT OF PURPOSEThis PSO is issued to ensure compliance with Age Discrimination legislation and applicableregulations with regards to retirement age for all members of staff.This PSO explains the process of informing members of staff of the Service‟s intention to retirethem and the process by which a member of staff can request an extension beyond that date.This PSO does not affect the right of any current member of staff with rights to retire at60 (or 55 in the case of pre-fresh start officers).This PSO should be read in conjunction with NTS 43/2005, 29/2006, 37/2006.DESIRED OUTCOMETo ensure that all members of staff are properly informed of their retirement dates.To enable all members of staff to request to stay in service beyond the date that the Serviceintends to retire them and for that request to be properly considered.To ensure compliance with statutory regulations on Age.MANDATORY ACTIONSThe Service must:inform all members of staff of the intention to retire them at least 7 months (but no longerthan one year) before the Service intends to do so;give members of staff the opportunity to request to stay in service beyond the intendedretirement date;properly consider all such requests;give any member of staff whose request is unsuccessful the opportunity to exercise theirstatutory right to appeal;Staff must:give the Service notice of their intention to retirecomplete notification of their wish to work past their normal retirement ageRESOURCE IMPLICATIONSIt is not known how many staff will wish to exercise the right to work beyond the minimum age atwhich they may draw their pension, or how many are likely to request an extension beyondIssue no. 276 Issue date 28/06/07
PSO 8105 Page 2normal retirement age. This will depend on personal circumstances and numbers are likely tovary from year to year. The changes are not expected to have any significant impact onresources as staff will continue to draw salary at existing rates. The administration of retirementis expected to be absorbed by the SSC in due course.When a request to stay beyond normal retirement age is made (currently 65 for all grades as of 1October 2006), the responsible manager who actually takes the decision as to whether arequest is granted may have to attend a meeting required under the statutory regulations withthe member of staff.
