If the letter notifying the decision is sent on bahalf of the manager who hastaken the decision, it should make clear reference as to who took the decision.3.2.4 Statutory regulations do not require the decision maker or letter to set out the reasons forrefusing an extension past normal retirement age. The Service is entitled to refuse arequest to work past normal retirement age if the request for retirement has been properlyconsidered in accordance with the regulations. In such cases the reason for dismissal willalways be retirement.3.2.5 These procedures must be repeated each time an individual nears an extended point forretirement.Chapter 4: Appeals4.1 If a member of staff is not satisfied with the outcome of their request, they are entitled toappeal. They should do so in writing as soon as is reasonably practicable, setting out thegrounds of their appeal.Meetings4.2 The member of staff will be invited to a meeting to discuss the request. This will normally bewith the original manager‟s manager. This meeting will be in addition to any meetingpreviously held to hear representations for retention. It is required by statutory regulations.The member of staff has a right to be accompanied to the meeting by a work colleague orunion representative. This meeting is unnecessary if the request can be approved withoutthe meeting.Notifying the decision4.3 Following the appeal decision, the Service must provide the member of staff with a writtennotice of the decision as soon as is reasonably practicable. This letter must state details ofthe decision – i.e. accepted (if so, the date on which employment will end, or the fact thatemployment will continue indefinitely) or not accepted (if so, the date on which thedismissal is to take effect).4.4 As set out at 3.2.3, statutory regulations do not require the manger who hears the appeal,or letter notifying the outcome, to set out the reasons for refusing an extension past normalretirement age. The Service is entitled to refuse a request to work past normal retirementage if the request for retirement has been properly considered in accordance with theregulations.
