3. UNDERLYING PRINCIPLES / INFLUENCING FACTORS3.1 LegislationLocal authorities have no power to pass legislation to protect trees onprivate properties and therefore representation would have to be made tonational government to pass such legislation. Nevertheless, whenapplications for rezoning or subdivision are received, Council may, as acondition of approval, stipulate that a landscape plan (including treeplanting and care of existing trees) be included in any development plan.This will exclude properties for single residential use.The following legislation governs this <strong>Tree</strong> <strong>Management</strong> <strong>Policy</strong>:3.1.1 The Constitution of the Republic of South Africa, 1996, Chapter 2:Bill of RightsEveryone has the right:a. To an environment that is not harmful to their health or wellbeing;andb. To have the environment protected, for the benefit of present andfuture generations, through reasonable legislative and othermeasures that –i) prevent pollution and ecological degradation;ii) promote conservation; andiii) secure ecologically sustainable development and use ofnatural resources while promoting justifiable economic andsocial development.3.1.2 Water Services Act, 1997 (Act No 108 of 1997)One of the main objectives of this Act is the promotion of effectivewater resource management and conservation. It is thereforeimportant to promote the planning of indigenous and other droughttolerantplants to ensure the optimum use of our limited waterresources.3.1.3 Environmental Conservation Act, 1989 (Act No 73 of 1989)In Part V, Section 21 of this Act, provision is made whereby theminister may identify activities which may have a detrimental effecton the environment. <strong>Tree</strong> planting could be identified as such anactivity that may not be undertaken in a particular area.<strong>Drakenstein</strong> <strong>Municipality</strong> – <strong>Tree</strong> <strong>Management</strong> <strong>Policy</strong> Page 2
