We believe the success of both initiatives could be enhanced by the introduction of protection fromretaliatory <strong>eviction</strong>.The Renting Homes Bill represents a key opportunity to enshrine this protection in law. This would havea positive effect on compliance with standard contract obligations, both among landlords and tenants.Landlords would have greater incentive to meet their repairing obligations, while tenants would havegreater incentive to ensure they honour their obligations, in the knowledge that failure to do so mayexempt them from protection from retaliatory acts.We have concerns that the proposal to remove the ‘six-month moratorium’ may make households feelmore vulnerable to retaliatory <strong>eviction</strong> and therefore less likely to challenge their landlord on disrepair. Thismay be a particular problem for tenants on low incomes who are not in strong bargaining positions withlandlords.Introducing protection from retaliatory <strong>eviction</strong> would help tenants who are on periodic contracts to havemore confidence to raise issues with their landlord, whether on disrepair or failure to become registeredand accredited.30
