East African Community – <strong>Korwa</strong> G. <strong>Adar</strong>(EALA) representatives from Kenya and requested the EACJ (EAC Secretariat, EACJ,Ref. No. 1 of 2006):• To interpret and apply the treaty to the process of nominations and election ofKenya’s representatives to the EALA.• To declare that the rules of election applied by the Kenya National Assemblyconstitute a breach of Article 50 of the treaty.• To declare that the process of election, selection and/or nomination ofmembers to the EALA by Kenya is null and void.• To direct Kenya to repeat its nomination and election process in compliancewith Article 50 of the treaty.• To declare that Kenya’s Vice President and Leader of Government Businessand the Chairman of the National Rainbow Coalition (NARC) have no mandate todetermine persons to represent Kenya at the EALA, and• To restrain and prohibit the EAC Secretary General and the Clerk to the EALAfrom assembling, convening, recognizing, and administering oath of office orotherwise presiding over or participating in election of the Speaker or issuing anynotification in recognition of the EALA representatives from Kenya.The Attorney General of Kenya and the other respondents raised objections onkey legal questions in relation to the EAC treaty and the partner states. Theirsubmissions centred on the following:• That the EACJ lacks jurisdiction to determine the case and the jurisdictionvested in the Court in clause 27 (1) of the EAC treaty is restricted (EACSecretariat, EACJ Ref. No. 1 of 2006). Article 27 (1) of the treaty provides that“the Court shall initially have jurisdiction over the interpretation and application ofthis treaty” (EAC Secretariat 2002).• That Article 52 (1) of the treaty reserves the right of jurisdiction to determinesuch cases to the institution of the partner states. Article 52 (1) states, “anyquestion that may arise whether any person is an elected member of the Assemblyor whether any seat on the Assembly is vacant shall be determined by theinstitution of the partner state that determines questions of the election of33
