2 The rohe <strong>of</strong> Ngati Awa/Te Ati Awa ki Waikanae Iwi.Kukutauaki <strong>to</strong> Whareroa (seaward inland <strong>to</strong> Pukemore and Maunganuinorthward <strong>to</strong> Kapakapanui and Pukeatua <strong>to</strong> Ngawhakangutu the westward <strong>to</strong>Kukutauaki.MY SUBMISSION1 To the Board if you were <strong>to</strong> ask me who I represent, I would say Ngati Awa/TeAti Awa ki Waikanae Iwi cause that is who I am.2 The understanding why I say that there are two law in my world LORE andLAW.LORELAWMy tupuna lore is a complementary <strong>to</strong> the crown law and can bring a balancewhen the crown law is so restricted.It gives Ngati Awa/Te Ati Awa ki Waikanae Iwi the rights under wairuatanga,whakapapatanga,Kaitiakitanga, manaakitanga and right <strong>to</strong> TinoRangatiratanga over it future and rohe. Not <strong>to</strong> be restricted by crownrecognized bodies.This lore can overcome this situation when it looks like one group has themandate but in reality its Iwi have had their democratic rights anrangatiratanga strip from them.2002 Executive Te Runanga Ati Awa Ki Whakarongotai Inc withdraw theirsupport and the Environment Court rule that Takamore Trust was notrecognised as a mandate authority for whanau, hapu.Yet it was clear since 1995 <strong>to</strong> 2001 that Ngati Awa/Te Ati Awa Ki WaikanaeIwi had given Te Runanga o Ati Awa Ki Whakarongotai Inc the mandate forthem <strong>to</strong> support Takamore.Executive decision had more weight than the Iwi mandate. Ngati Awa/TeAti Awa Ki Waikanae Iwi are in the same situation now as we were then,same Executive.This law divide and rules.It is time that Ngati Awa/Te Ati Awa ki Waikanae Iwi where given a say <strong>of</strong> theirrohe .At a Ngati Awa/Te Awa Ki Waikanae Iwi public notifly meeting <strong>of</strong> the AGM <strong>of</strong> AtiAwa ki Whakarongotai Charitiable Trust at Whakarongotai Marae on the 28 July in4 | P age


collaboration with Mei Higgot notify the iwi <strong>of</strong> our intention <strong>to</strong> submit a submission inthis Board <strong>of</strong> Inquire this was not rejected by Iwi.I do not wish <strong>to</strong> cover the areas that Mei Higgot has cover in her submissionor Takamore Trustee. Our relationship with each other is open.Everyone changes in Local government and central government but we arethe same people and understand what consultation is require <strong>to</strong> be istransparent in our rohe, which up hold Manakitanga and Kaitiakitanga, <strong>to</strong> andgives Rangatiratanga NgatiAwa/Te ati Awa ki Waikanae Iwi.His<strong>to</strong>ry <strong>of</strong> Roading with the Rohe <strong>of</strong> Ngati Awa/Te Ati Awa Ki Waikanae.1875 – 1876About the time that the railway was being laid through this area <strong>of</strong> coast linedid Wi Parata Te Kakakura decide <strong>to</strong> move the village closer <strong>to</strong> it. This wasabout 1875-76 and it was about that time that a pakeha farmer, Morrison byname, petitioned Parliament for him <strong>to</strong> use private roads <strong>to</strong> obtain access <strong>to</strong>the railway station at Waikanae. Wi Parata explained it thus in the Land Courtsitting <strong>of</strong> Ngarara West in the 1980’s Mr Morrison had asked Parliament <strong>to</strong>intervene on his behalf for him <strong>to</strong> have access over private property from hisfarm on the south side <strong>of</strong> Waikanae river, he wanting <strong>to</strong> make use <strong>of</strong> the railhead in order <strong>to</strong> do so he had <strong>to</strong> use the only roads in existence at the timeand they belonged <strong>to</strong> Wi Parata Te Kakakura explained <strong>to</strong> the Judge thatthese roads were cut by his family so that he could drag his building fromTukurakau <strong>to</strong> be nearer the railway station.1952Designation <strong>of</strong> the Sandhills Mo<strong>to</strong>rway – this designation cut <strong>of</strong> the corner <strong>of</strong>Takamore with no regard for the urupa.1993KCDC started inquires <strong>to</strong> this designation1994KCDC started <strong>to</strong> investigate what was possible.Ngati Awi/Te Ati Awa ki Waikanae Iwi – hapu Otaraua - Takemore1995Takamore Trustees apply <strong>to</strong> the His<strong>to</strong>rical Trust with the support <strong>of</strong>Whakarongotai Marae committee, Ati Awa ki Whakarongotai Inc, <strong>to</strong>make the whole area around Takamore a wahi tapu.5 | P age

Western Link Road.Kapiti Coast District Council’s notice requirement for the “Proposaldesignation <strong>of</strong> the “Western Link Road”19 May 1998Report <strong>to</strong> Hearing Commissioners – page 71 – 11.4 Section 8 Treaty <strong>of</strong>Waitangi.The environmental group Te Runanga o Te Ati Awa Ki WhakarongotaiInc - Kapakapanui, do not believe that their concerns were accorded dueweight in the consultation and assessment process. They also considerthat their role as a partner has not been unders<strong>to</strong>od.15 – 16 – 17 June 1998 Hearing at Whakarongotai Marae – KapakapanuiEnvironment Group, Te Runanga o Ati Awa Ki Whakarongotai Inc, TakamoreTrustees.16 1999Takamore Trustees go <strong>to</strong> the Enviromental Court reject the theEnviromentCourt decision giving the green light <strong>to</strong> Western Link.17 2001 change <strong>of</strong> Executive <strong>of</strong> Ati Awa ki Whakarongotai Inc resulted inthe the Executive not Iwi, made a decision <strong>to</strong> with draw their support forTakamore Trustees. No Ngati Awa/Te Ati Awa Ki Waikanae Iwimandated.18 July 2002 Takamore and go the High Court seeking decision in their favour <strong>to</strong>protect a sacred site affected by the road.19 2004High CourtTakamore went back <strong>to</strong> the Enviroment Court <strong>to</strong> be over rule.Problem here was when Te Runanga o Ati Awa ki Whakarongotai Incwithdrew, it was said that the Environment court only recongised TeRunanga o Ati Awa ki Whakarongotai Inc as the mandated Iwi authority.6 | P age


Statement <strong>of</strong> evidence <strong>of</strong> Amos Kamo (Cultural/Heritage Effects) for theMZTA.CONSULTATION WITH TANGATA WHENUA.What has <strong>to</strong> take in<strong>to</strong> consideration when consulting with whenua and manawhenua with a his<strong>to</strong>ry Ngati Awa/Te Ati Awa ki Waikanae has <strong>to</strong> be base ontransparent, inclusive robust under tikanga under kaupapa tuku Iho. I believethis has not happen.Consultation process was handle with exclusion after 7 – 9 Oc<strong>to</strong>ber 2010 <strong>of</strong>Ngati Awa/Te Ati Awa Ki Waikanae Iwi.Annexure C: CONSULTATION SCHEDULES3 I was not the Chairperson <strong>of</strong> Marae I was the Secretary and made thatclear and had the support at that time <strong>of</strong> Chairperson <strong>to</strong> have thisconversation and committee.9 To my knowledge at no time has Bill Carter been the Chair o Ati Awa kiWhakarongotai Inc. He is the Chairperson <strong>of</strong> Asset Holding CompanyChairman under the Ati Awa ki Whakarongotai Charitable Trust.10 Ngati Awa/Te Ati Awa ki Waikanae Iwi had no input in<strong>to</strong> this decisionand where not informed.11 Kapiti Kaumatau Council Inc has its meeting on Whakarongotai Maraebut not <strong>to</strong> be taken that this allows Te Runanga o Ati Awa kiWhakarongotai Inc not <strong>to</strong> carry out its legal obligation <strong>to</strong> consult underthe rules <strong>of</strong> it constitution <strong>to</strong> meet with Ngati Awa/Te Ati Awa kiWaikanae Iwi who are (whanau, hapu and Iwi who whakapa <strong>to</strong> thoseances<strong>to</strong>rs who remain behind in Waikanae after 1848 and who identifywith the land in our rohe.16 Hui aa Iwi. This cannot taken <strong>to</strong> mean that Te Runanga o Ati Awa kiWhakarongotai Inc called this hui for Ngati Awa/Te Ati Awa Ki WaikanaeIwi. All those present where informed by Takamore Trustees andattended at the request <strong>of</strong> <strong>of</strong> Takamore hapu o Otaraua.153 Mrs Parata and Mrs Higgot.Have concerns about what is written here and wish <strong>to</strong> talk <strong>to</strong> this.157 Te Runanga o Ati Awa ki Whakarongotai Inc, the legal representive bodyfor Te Ati Awa ki Whakarongotai – who is this?.7 | P age


To say that Ngati Awa/Te Ati Awa ki Waikanae Iwi where a part <strong>of</strong> theconsultation is a understate, when?One has a very clear understanding that NZTA could be seen <strong>to</strong> be consultingwith the right people, and trusting that Te Runanga o Ati Awa kiWhakarongotai Inc where acting as responsible Officers, this was not thecase.Legal Identity has changed.TE RUNANGA O ATI AWA KI WHAKARONGOTAI INC – SUBMISSION ONMACKAYS TO PEKAPEKA EXPRESSWAY.2.3 Te Runanga o Ati Awa ki Whakarongotai Inc has obligated <strong>to</strong> hold a Huiaa Iwi every 6 weeks with Ngati Awa/Te Ati Awa ki Waikanae Iwi. KapitiKaumatau council Inc meet at Whakarongotai doesn’t have mandate <strong>to</strong>override legal obligation <strong>of</strong> the Runanga.2.5 The concern for this statement is that Te Runaga o Ati Awa KiWhakarongotai Inc has set up a new identity call Te Ati Awa kiWhakarongotai Expressway Committee.(without constitutional mandate)2.5 The Te Ati Awa ki Whakarongotai Expressway Expressway Committeehas been engaging constructively with NZTA and it consultants <strong>to</strong> dateand intent <strong>to</strong> maintain this relationship through<strong>to</strong>ut the life <strong>of</strong> the projectand beyond.The concerns about this statement is that on the 28 July 2010 at the AGM <strong>of</strong>legal identity <strong>of</strong> Ngati Awa/Te Ati Awa ki Waikanae Iwi. The Ati Awa KiWhakarongotai Charitable Trust it was table by and Executive <strong>of</strong> Te RunangaAti Awa Ki Whakarongotai Inc in the present <strong>of</strong> the submitter Daniel Mullen“that Te Runanga o Ati Awa ki Whakarongtai <strong>to</strong> be closed down” accepted.Daniel Mullen submission was send in on the 10 August 2012 sign as TeRunanga o Ati Awa ki Whakarongotai Ltd. Ngati Awa/Te Ati Awa ki WaikanaeIwi do not have such Ltd organisation <strong>to</strong> Ngati Awa/Te Ati ki Waikanae Iwiknowledge.At the monthly meeting <strong>of</strong> Whakarongotai Marae Committee and Trustees onthe 9 September 2012 Executive <strong>of</strong> Te Runanga o Ati Awa ki WhakarongotaiInc a notice <strong>of</strong> intent was given “that Te Runanga o Ati Ati Awa kiWhakarongotai <strong>to</strong> be closed down” the question ask was when <strong>to</strong>ld 4 weeks.My question is does Te Runanga O Ati Awa Ki Whakarongotai Inc submission haveany integrity in the Inquiry?Te Runanga o Ati Awa Ki Whakarongotai Inc set a MoU with NZTA my question is8 | P age

I am his his greatgreatgrand daughter. My Koro was his grandson.I married Te Pehi Parata the greatgrand son <strong>of</strong> Wi Parata who was the Rangitira forNgati Awa/Te Ati Awa ki Waikanae Iwi from 1977 – 1995 when he died.In the MLC minutes sittings in Otaki in the 1870s - 1880 there are reference whenland was been disputed that they support each other in the manner their upbringrequired them <strong>to</strong> do.Growning up and been married in<strong>to</strong> Parata whanau the last 50 years I have learnthis<strong>to</strong>ry, I have seen His<strong>to</strong>ry been made, an live in the present <strong>to</strong>, which gives oneknowledge in our rohe <strong>of</strong> Ngati Awa/Te Ati Awa ki Waikanae Iwi.Whakarongotai is not the Iwi it is the Marae. Whakarongotai is Ngati Awa/Te Ati Awamarae and was stipulated in the Court Order (dated 1948) a meeting place for NgatiAwa/Ngati Toa/Ngati Raukawa people.The then leading chief <strong>of</strong> the Parata whanau Tom Parata OBE being responsible forturning his whanau marae over <strong>to</strong> the people <strong>of</strong> the purposes as state above.Another unique happening at the time <strong>of</strong> the appointment <strong>of</strong> Trustees was the factthat all women were nominated as trustees under section 439 <strong>of</strong> the Maori AffairsAct 1953.I was a Trustee <strong>of</strong> Whakarongotai Marae from 1977 – 1998 and have just beennominated at the AGM <strong>of</strong> Trustees on 16 September 2012 <strong>to</strong> return as a Trustee.Whakarongotai Marae is the principle home <strong>of</strong> Ngati Awa/Te Ati Awa kiWaikanae.There are recording in the minutes since 1952 our Iwi involvement with Crownagencies, Local agencies.The foundation <strong>of</strong> all major decision for our Iwi the foundation <strong>of</strong> where many huibeen held <strong>to</strong> resolve issues <strong>of</strong> the day.Where identities representing Ngati Awa/Te Ati Awa where start from.9 | P age


Where Ngati Awa/Te Ati Awa ki Waikanae Iwi gather with community, other whanauoutside our Iwi <strong>to</strong> manaaki them on their issues <strong>to</strong> celebrate achievement,community hui for all our community in our rohe.So <strong>to</strong> acknowledge the true meaning <strong>of</strong> Manaakitanga under ‘ lore’ and thissubmission has been put <strong>to</strong> this Inquire <strong>to</strong> uphold for tangata whenua, manawhenua, our community asking for integrity and transparency , we may not all agree.When the process is done in a Tino Rangatiratanga way and we got the consultationright, and here is the evidence a community cannot be divide.In conclusion:With my whakapapa above and my knowledge <strong>of</strong> His<strong>to</strong>ry <strong>of</strong> Ngati Awa/Te Ati Awa kiWaikanae Iwi.
