ERMA NEW ZEALAND annual report <strong>on</strong> <strong>the</strong> <strong>aerial</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>SUMMARYThis is <strong>the</strong> first <str<strong>on</strong>g>Annual</str<strong>on</strong>g> <str<strong>on</strong>g>Report</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Aerial Use <strong>of</strong> <strong>1080</strong>, covering activities to 31 December, 2007. It reports <strong>on</strong><strong>the</strong> progress <strong>of</strong> <strong>the</strong> <strong>1080</strong> watch list, research developments and best practice guidance.The requirement for <strong>aerial</strong> <strong>1080</strong> operators to report <strong>on</strong> operati<strong>on</strong>s did not come into effect until 1 January 2008.This means <strong>the</strong>re were no reports received in <strong>the</strong> period <strong>of</strong> this annual report.However, post-operati<strong>on</strong>al reports are being progressively posted <strong>on</strong> <strong>the</strong> ERMA New Zealand website,www.ermanz.govt.nz/<strong>1080</strong>/, as <strong>the</strong>y come to hand.The implementati<strong>on</strong> <strong>of</strong> <strong>the</strong> watch list is well underway and ERMA New Zealand staff are collecting informati<strong>on</strong> <strong>on</strong><strong>1080</strong> operati<strong>on</strong>s – including complaints, incidents and o<strong>the</strong>r activities associated with <strong>the</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong> in NewZealand. This informati<strong>on</strong> is being combined with post-operati<strong>on</strong>al reports submitted by operators, and is also beingposted <strong>on</strong> <strong>the</strong> website.It is encouraging to note that several <strong>of</strong> <strong>the</strong> research recommendati<strong>on</strong>s from <strong>the</strong> Authority’s August 2007 Decisi<strong>on</strong><strong>on</strong> <strong>1080</strong> (see Box 1) are already being implemented. These include three completed projects looking at alternativesto <strong>1080</strong> and a fur<strong>the</strong>r six <strong>on</strong>going projects.There have also been more than 10 research projects examining ways <strong>of</strong> improving <strong>the</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>.ERMA New Zealand has also developed a Communicati<strong>on</strong>s Guideline for Aerial <strong>1080</strong> Operati<strong>on</strong>s, which is beingpublished and distributed at <strong>the</strong> same time as this report.BACKGROUNDThe Envir<strong>on</strong>mental Risk Management Authority completed a reassessment <strong>of</strong> <strong>1080</strong> for <strong>use</strong> in pest c<strong>on</strong>trol inAugust 2007. After careful c<strong>on</strong>siderati<strong>on</strong>, it c<strong>on</strong>cluded that <strong>the</strong> benefits <strong>of</strong> using <strong>1080</strong> outweighed <strong>the</strong> adverseeffects, and it released its decisi<strong>on</strong> to allow <strong>the</strong> c<strong>on</strong>tinued <strong>use</strong> <strong>of</strong> <strong>1080</strong>, with additi<strong>on</strong>al c<strong>on</strong>trols. It also maderecommendati<strong>on</strong>s for <strong>the</strong> development <strong>of</strong> “best practice” guidelines, and for fur<strong>the</strong>r research.In reaching its decisi<strong>on</strong>, <strong>the</strong> Authority was mindful that <strong>the</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong> was a polarising issue about whichmany New Zealanders had deeply felt c<strong>on</strong>cerns. It recognised <strong>the</strong> importance <strong>of</strong> engagement through bettercommunicati<strong>on</strong> and c<strong>on</strong>sultati<strong>on</strong> with <strong>the</strong> public, local communities, Māori and special interest groups; and madea commitment to a new management regime for <strong>1080</strong> operati<strong>on</strong>s to address an urgent need for fur<strong>the</strong>rimprovements in <strong>the</strong> way this vertebrate toxic agent is <strong>use</strong>d.Progress is detailed in this annual report.3


ERMA NEW ZEALAND annual report <strong>on</strong> <strong>the</strong> <strong>aerial</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>BOX 1: THE <strong>1080</strong> REASSESSMENT DECISIONIn February 2002, <strong>the</strong> Department <strong>of</strong> C<strong>on</strong>servati<strong>on</strong> (DoC) and <strong>the</strong> Animal Health Board (AHB) made anapplicati<strong>on</strong> to <strong>the</strong> Authority for a decisi<strong>on</strong> <strong>on</strong> whe<strong>the</strong>r <strong>the</strong>re were grounds for a reassessment <strong>of</strong> <strong>1080</strong> and <strong>the</strong>substances c<strong>on</strong>taining it. The Authority decided in March 2002 that <strong>the</strong>re were grounds for a reassessment,namely:• <strong>the</strong> large increase in <strong>the</strong> amount <strong>of</strong> <strong>1080</strong> being <strong>use</strong>d and planned for <strong>use</strong>;• new informati<strong>on</strong> relating to <strong>the</strong> effects <strong>of</strong> <strong>1080</strong> since it was first registered in 1964; and• c<strong>on</strong>siderable public c<strong>on</strong>cern about <strong>the</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>.In October 2006, DoC and <strong>the</strong> AHB submitted a joint applicati<strong>on</strong> for <strong>the</strong> reassessment <strong>of</strong> <strong>1080</strong>.The public was invited to make submissi<strong>on</strong>s <strong>on</strong> <strong>the</strong> applicati<strong>on</strong> and a number <strong>of</strong> public hearings were heldthroughout <strong>the</strong> country. An evaluati<strong>on</strong> <strong>of</strong> <strong>the</strong> submissi<strong>on</strong>s and <strong>the</strong> scientific evidence provided by bothapplicants and submitters was prepared by ERMA New Zealand staff. The Authority c<strong>on</strong>sidered <strong>the</strong> report and<strong>the</strong> evidence presented at <strong>the</strong> hearings and issued its decisi<strong>on</strong> <strong>on</strong> <strong>the</strong> reassessment (<strong>the</strong> <strong>1080</strong> Decisi<strong>on</strong>).The Authority decided to allow <strong>the</strong> c<strong>on</strong>tinued <strong>use</strong> <strong>of</strong> <strong>1080</strong> for ground and <strong>aerial</strong> operati<strong>on</strong>s. The c<strong>on</strong>trols thatpreviously existed were streng<strong>the</strong>ned and new c<strong>on</strong>trols <strong>on</strong> <strong>aerial</strong> applicati<strong>on</strong> were added beca<strong>use</strong> <strong>of</strong> <strong>the</strong> higherlevels <strong>of</strong> risk involved.The additi<strong>on</strong>al c<strong>on</strong>trols are part <strong>of</strong> a tighter management regime imposed by <strong>the</strong> Authority for <strong>aerial</strong> drops <strong>of</strong><strong>1080</strong>. However, informati<strong>on</strong> ga<strong>the</strong>red <strong>on</strong>operati<strong>on</strong>s will be shared with <strong>the</strong> public via <strong>the</strong> ERMA New Zealand <strong>1080</strong> webpage, www.ermanz.govt.nz/<strong>1080</strong>/and will be <strong>use</strong>d to inform any future reassessment <strong>of</strong> <strong>1080</strong> by <strong>the</strong> Authority.Informati<strong>on</strong> from post-operati<strong>on</strong>al reportsThe requirements for post-operati<strong>on</strong>al reporting are set out in <strong>the</strong> Decisi<strong>on</strong>. ERMA New Zealand has been workingwith industry <strong>on</strong> a standardised format for reporting to ensure that <strong>the</strong> informati<strong>on</strong> required is submitted.This requires <strong>1080</strong> operati<strong>on</strong>al managers to submit <strong>the</strong> following:• informati<strong>on</strong> about <strong>the</strong> management <strong>of</strong> <strong>the</strong> operati<strong>on</strong>, including why <strong>the</strong> operati<strong>on</strong> happened, who paid for <strong>the</strong>operati<strong>on</strong> and who carried out <strong>the</strong> operati<strong>on</strong>;• <strong>the</strong> locati<strong>on</strong> and size <strong>of</strong> <strong>the</strong> operati<strong>on</strong>;• informati<strong>on</strong> about statutory authorisati<strong>on</strong> <strong>of</strong> <strong>the</strong> operati<strong>on</strong>;• a timeline overview <strong>of</strong> who was c<strong>on</strong>sulted and how <strong>the</strong>y were c<strong>on</strong>sulted during <strong>the</strong> pre-operati<strong>on</strong>al c<strong>on</strong>sultati<strong>on</strong>,and <strong>the</strong> outcomes <strong>of</strong> that c<strong>on</strong>sultati<strong>on</strong>;• an overview <strong>of</strong> any incidents and complaints related to <strong>the</strong> operati<strong>on</strong> and <strong>the</strong> acti<strong>on</strong>s that resulted from thoseincidents and complaints;• informati<strong>on</strong> about how <strong>the</strong> areas were treated, when <strong>the</strong>y were treated and with what <strong>the</strong>y were treated;• an assessment <strong>of</strong> <strong>the</strong> outcomes <strong>of</strong> <strong>the</strong> operati<strong>on</strong>;• a map <strong>of</strong> <strong>the</strong> operati<strong>on</strong>al area;• copies <strong>of</strong> water sampling reports, if <strong>the</strong>se were required for <strong>the</strong> operati<strong>on</strong>; and• copies <strong>of</strong> any applicable species m<strong>on</strong>itoring report(s).Post-operati<strong>on</strong>al reports received after this reporting period will be posted <strong>on</strong> <strong>the</strong> ERMA New Zealand website,at www.ermanz.govt.nz/<strong>1080</strong>/ as <strong>the</strong>y come to hand.Complaints, incidents and o<strong>the</strong>r activitiesERMA New Zealand is advised <strong>of</strong> complaints, incidents and activities associated with <strong>1080</strong> <strong>use</strong> in three ways:• The public registering <strong>the</strong>ir c<strong>on</strong>cerns. A member <strong>of</strong> <strong>the</strong> public c<strong>on</strong>tacts ERMA New Zealand to express c<strong>on</strong>cernsabout particular <strong>1080</strong> operati<strong>on</strong>s or related practices.• Incident reporting. An operator or agency c<strong>on</strong>tacts ERMA New Zealand to express c<strong>on</strong>cerns about particular<strong>1080</strong> operati<strong>on</strong>s or related practices.• Media m<strong>on</strong>itoring. We learn through our media m<strong>on</strong>itoring service <strong>of</strong> incidents or c<strong>on</strong>cerns reported in <strong>the</strong> media.ERMA New Zealand assesses this informati<strong>on</strong> to determine <strong>the</strong> required resp<strong>on</strong>se. The matter may be passed <strong>on</strong> toan enforcement agency to be investigated. When a pers<strong>on</strong> asks for a complaint to be noted (ra<strong>the</strong>r than for acti<strong>on</strong>to be taken) this informati<strong>on</strong> is filed against <strong>the</strong> operati<strong>on</strong> in questi<strong>on</strong> for future reference.Incidents related to specific operati<strong>on</strong>s will be tracked and are expected to be reported in post-operati<strong>on</strong>al reports.A summary will be included in each year’s annual report, starting in 2010.5

ERMA NEW ZEALAND annual report <strong>on</strong> <strong>the</strong> <strong>aerial</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>BEST PRACTICE GUIDANCEIn its decisi<strong>on</strong> <strong>on</strong> <strong>1080</strong>, <strong>the</strong> Authority acknowledged a need for fur<strong>the</strong>r improvement in <strong>the</strong> way <strong>1080</strong> is <strong>use</strong>d, andrecommended that management practices around <strong>aerial</strong> drops <strong>of</strong> <strong>1080</strong> be standardised around best practice toensure c<strong>on</strong>sistency.Areas identified for <strong>the</strong> development <strong>of</strong> best practice guidance included:1. Communicati<strong>on</strong> and c<strong>on</strong>sultati<strong>on</strong>.2. Management <strong>of</strong> <strong>aerial</strong> <strong>1080</strong> operati<strong>on</strong>s.In 2008, ERMA New Zealand met with industry representatives to discuss <strong>the</strong> development and implementati<strong>on</strong><strong>of</strong> best practice guidelines. These guidelines will help operators to meet or exceed all mandatory c<strong>on</strong>trols. Theguidelines will also help communities and c<strong>on</strong>cerned parties identify whe<strong>the</strong>r an operator’s practices meet <strong>the</strong>expected standards.Communicati<strong>on</strong> and c<strong>on</strong>sultati<strong>on</strong>ERMA New Zealand has taken <strong>the</strong> lead in developing standards for communicati<strong>on</strong> using <strong>the</strong> Department <strong>of</strong>C<strong>on</strong>servati<strong>on</strong>’s (DoC) Standard Operating Procedures for C<strong>on</strong>sultati<strong>on</strong> and Notificati<strong>on</strong> as its guide.Modificati<strong>on</strong>s were made to reflect feedback from <strong>the</strong> c<strong>on</strong>sultati<strong>on</strong> process and <strong>the</strong> resulting guideline has beenpublished. http://ermanz.govt.nz/resources/publicati<strong>on</strong>s/<strong>1080</strong>/commsguideline.pdfManagement <strong>of</strong> <strong>aerial</strong> <strong>1080</strong> operati<strong>on</strong>sGuidance <strong>on</strong> <strong>the</strong> management <strong>of</strong> <strong>aerial</strong> <strong>1080</strong> operati<strong>on</strong>s will include informati<strong>on</strong> <strong>on</strong> signage, bait preparati<strong>on</strong> anddistributi<strong>on</strong>, as well as o<strong>the</strong>r parts <strong>of</strong> <strong>the</strong> life-cycle <strong>of</strong> an <strong>aerial</strong> <strong>1080</strong> operati<strong>on</strong>.Current guidance <strong>on</strong> <strong>the</strong> management <strong>of</strong> <strong>1080</strong> operati<strong>on</strong>s is found in a diverse range <strong>of</strong> documents (StandardOperating Procedures (SOPs), guides and codes), which vary in quality and relevance to current legislati<strong>on</strong> andpractices.The Nati<strong>on</strong>al Possum C<strong>on</strong>trol Agencies (NPCA) are leading a project where existing industry SOPs and guidelinesare being reviewed in order to develop industry-wide guidelines for <strong>the</strong> management <strong>of</strong> <strong>1080</strong> operati<strong>on</strong>s. Thisproject is in an early stage and should progress in 2009.7


ERMA NEW ZEALAND annual report <strong>on</strong> <strong>the</strong> <strong>aerial</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>RESEARCHDuring <strong>the</strong> reassessment, ERMA New Zealand identified several areas that would benefit from additi<strong>on</strong>al research. Itrecommended that <strong>the</strong> agencies involved in pest c<strong>on</strong>trol undertake fur<strong>the</strong>r research in <strong>the</strong> following areas:• alternatives to <strong>1080</strong> for pest c<strong>on</strong>trol;• improvements to <strong>the</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong>;• stability <strong>of</strong> <strong>1080</strong> in stored envir<strong>on</strong>mental samples;• OECD Test 309: Water Biodegradati<strong>on</strong>;• OECD Test 307: Aerobic and Anaerobic Transformati<strong>on</strong> in Soil; and• <strong>the</strong> effects <strong>of</strong> <strong>1080</strong> <strong>on</strong> R<strong>on</strong>goa Māori.In September 2007, <strong>the</strong> Authority wrote to <strong>the</strong> <strong>the</strong>n Acting Envir<strong>on</strong>ment Minister stressing <strong>the</strong> importance <strong>of</strong> morefocussed and better-funded research into <strong>the</strong> adverse effects and alternative methods <strong>of</strong> pest c<strong>on</strong>trol. It soughtGovernment support for <strong>the</strong> development <strong>of</strong> a research programme to ensure c<strong>on</strong>tinued public c<strong>on</strong>fidence in <strong>the</strong> <strong>use</strong><strong>of</strong> <strong>1080</strong>. This was met with a positive resp<strong>on</strong>se from <strong>the</strong> Government.The research summarised in this secti<strong>on</strong> occurred or c<strong>on</strong>cluded after <strong>the</strong> research provided in 2007 as part <strong>of</strong> <strong>the</strong><strong>1080</strong> reassessment and represents <strong>the</strong> latest informati<strong>on</strong> at <strong>the</strong> time <strong>of</strong> publicati<strong>on</strong>.Research into alternatives to <strong>1080</strong> is summarised in Table 2; into improvements to <strong>the</strong> <strong>use</strong> <strong>of</strong> <strong>1080</strong> in Table 3; and<strong>on</strong> <strong>the</strong> effects <strong>of</strong> <strong>1080</strong> <strong>on</strong> R<strong>on</strong>goa Māori in Table 4.Research into <strong>the</strong> stability <strong>of</strong> <strong>1080</strong> in stored envir<strong>on</strong>mental samples has been questi<strong>on</strong>ed by <strong>the</strong> Animal HealthBoard (AHB) and Department <strong>of</strong> C<strong>on</strong>servati<strong>on</strong> (DoC), as <strong>the</strong> results would not be easily applicable to o<strong>the</strong>r studieswhere stored samples are analysed for <strong>1080</strong>. Instead, Landcare Research has established quality assurancemeasures to reduce <strong>the</strong> risk <strong>of</strong> storage having an effect <strong>on</strong> samples.A research project <strong>on</strong> <strong>1080</strong> transformati<strong>on</strong> in soil (OECD Test 307) has been commissi<strong>on</strong>ed by <strong>the</strong> AHB and DoC.The AHB proposes to undertake modelling to determine <strong>the</strong> levels <strong>of</strong> <strong>1080</strong> that may get into drinking watersupplies from an <strong>aerial</strong> drop, and to determine if <strong>the</strong> Tolerable Daily Intake could be exceeded and (if so) for howl<strong>on</strong>g. A research proposal is currently being assessed for this project. The AHB c<strong>on</strong>siders that to assess risk,this research is more relevant than studies <strong>on</strong> water biodegradati<strong>on</strong>, as <strong>the</strong> effects <strong>of</strong> diluti<strong>on</strong> far outweigh anybiodegradati<strong>on</strong> effects.8
