Form S – Student PermissionPart A – Grant of licenceThe Student grants to ACARA a permanent, irrevocable, world-wide, non-exclusive, free, licence to use, modify,reproduce, communicate, perform, sub-licence and distribute the Work for any purpose that is not Commercial,on the following terms:1. The Student represents that the Work is entirely original work (except for any material which is owned bya third party (or third parties) and listed on the cover sheet accompanying each Work.2. Except to the extent specifically stated in Part B of this agreement (Consent to disclose Work), ACARAwill not identify the Student, their fellow students, teachers, or their school, and the Studentacknowledges and consents to the removal of such information from the Work before the Work isdistributed or communicated to any third party by ACARA.3. The Student consents to any of the following types of acts or omissions: (a) using, reproducing,communicating, adapting or exploiting all or any part of the Work, with or without attribution ofauthorship; (b) supplementing the Work with any other material; and (c) use of the Work in a differentcontext to that originally envisaged.4. ACARA will not falsely attribute authorship of the Work.5. ACARA will not return physical copies of the Work to the Student and does not guarantee that it will use,reproduce or communicate the Work.6. The Student consents to ACARA communicating, publishing, reproducing and sub-licensing the Workunder a range of different non-commercial licences, including a Creative Commons Attribution-Non-Commercial-ShareAlike 3.0 Australia licence.7. For the purposes of this licence:a. 'Commercial' means a purpose primarily intended for or directed towards commercial advantage orprivate monetary compensation;b. 'Student' means the student named on the front page of this agreement, or the parent or legalguardian on behalf of the Student where the Student is under 18 years of age; andc. ‘Work’ means any work created by the Student which is protected by the Copyright Act 1968(Commonwealth) and provided to ACARA, and includes:i. works which will be created by the Student in the future while attending his/her current school;andii. literary works (text), artistic works (photographs, drawings, logos, graphic design), musicalworks, sound recordings and cinematograph film works.Licence to use and consent to disclose – July 2012 – Form SPage 2 of 4
Form S – Student PermissionPart B – Consent to disclose Work and other Personal InformationThe Student consents to the School disclosing the Work and other Personal Information to ACARA or ACARA’srepresentatives in relevant schooling systems who then disclose this information to ACARA, on the followingterms:1. That the Work is only used for the Purpose (defined in clause 3).2. The Student has read the Privacy Statement below and agrees with its terms.3. In this consent and in the Privacy Statement below:a. Personal Information means, broadly, information that identifies the Student or could identify theStudent and has the same meaning as set out in the Privacy Act 1988 (Cth);b. ‘Purpose’ means to illustrate levels of achievement of relevant aspects of the Australian Curriculumachievement standards for each learning area and year. Works that are selected by ACARA will beuploaded onto the Australian Curriculum website, a public website. The Work will be annotated tohighlight evidence of student levels of achievement of different aspects of the achievement standards.Works that are selected by ACARA and uploaded to the Australian Curriculum website may also beused by other education bodies in a wide variety of non-commercial educational applications. State andTerritory Departments of Education and other education bodies, including the CommonwealthDepartment of Education, Employment and Workplace Relations, the Australian Institute for Teachingand School Leadership (AITSL), Education Services Australia, non-government school authorities andoverseas schools where the Australian curriculum is taught, may use the Works (or excerpts) in othersupport materials to assist teachers and students. These support materials may be made available indifferent forms, such as in hard copy, on disk, and as digital publications that can be downloaded fromthe intranet or web sites of education bodies, typically for classroom use or professional development.c. 'Student' means the student named on the front page of this agreement, or the parent or legal guardianon behalf of the Student where the Student is under 18 years of age; andd. ‘Work’ means any work created by the Student which is protected by the Copyright Act 1968(Commonwealth) and provided to ACARA, and includes:i. works which will be created by the Student in the future while attending his/her current school;andii.literary works (text), artistic works (photographs, drawings, logos, graphic design), musicalworks, sound recordings and cinematograph film works.Privacy StatementThis privacy statement applies to the Personal Information:contained in this form;contained in the Work; andcontained in the cover sheets attached to the Work.ACARA is subject to the Privacy Act 1988 (Cth) (Privacy Act). The Privacy Act sets out how AustralianGovernment agencies should collect, use, store and disclose Personal Information and how individuals canaccess records containing their Personal Information. ACARA is committed to protecting the privacy of thePersonal Information that it receives from the Student.What is Personal Information?Personal Information is, broadly, information that identifies the Student or could identify the Student. There aresome obvious examples of personal information, such as the Student’s name. Personal Information can alsoinclude photos, videos, and even information about what the Student likes - basically, any information where theStudent is reasonably identifiable.Information does not have to include your name to be Personal Information.
