<strong>Form</strong> S – <strong>Student</strong> <strong>Permission</strong>Part A – Grant of licenceThe <strong>Student</strong> grants to ACARA a permanent, irrevocable, world-wide, non-exclusive, free, licence to use, modify,reproduce, communicate, perform, sub-licence and distribute the Work for any purpose that is not Commercial,on the following terms:1. The <strong>Student</strong> represents that the Work is entirely original <strong>work</strong> (except for any material which is owned bya third party (or third parties) and listed on the cover sheet accompanying each Work.2. Except to the extent specifically stated in Part B of this agreement (Consent to disclose Work), ACARAwill not identify the <strong>Student</strong>, their fellow students, teachers, or their school, and the <strong>Student</strong>acknowledges and consents to the removal of such information from the Work before the Work isdistributed or communicated to any third party by ACARA.3. The <strong>Student</strong> consents to any of the following types of acts or omissions: (a) using, reproducing,communicating, adapting or exploiting all or any part of the Work, with or without attribution ofauthorship; (b) supplementing the Work with any other material; and (c) use of the Work in a differentcontext to that originally envisaged.4. ACARA will not falsely attribute authorship of the Work.5. ACARA will not return physical copies of the Work to the <strong>Student</strong> and does not guarantee that it will use,reproduce or communicate the Work.6. The <strong>Student</strong> consents to ACARA communicating, publishing, reproducing and sub-licensing the Workunder a range of different non-commercial licences, including a Creative Commons Attribution-Non-Commercial-ShareAlike 3.0 Australia licence.7. For the purposes of this licence:a. 'Commercial' means a purpose primarily intended for or directed towards commercial advantage orprivate monetary compensation;b. '<strong>Student</strong>' means the student named on the front page of this agreement, or the parent or legalguardian on behalf of the <strong>Student</strong> where the <strong>Student</strong> is under 18 years of age; andc. ‘Work’ means any <strong>work</strong> created by the <strong>Student</strong> which is protected by the Copyright Act 1968(Commonwealth) and provided to ACARA, and includes:i. <strong>work</strong>s which will be created by the <strong>Student</strong> in the future while attending his/her current school;andii. literary <strong>work</strong>s (text), artistic <strong>work</strong>s (photographs, drawings, logos, graphic design), musical<strong>work</strong>s, sound recordings and cinematograph film <strong>work</strong>s.Licence to use and consent to disclose – July 2012 – <strong>Form</strong> SPage 2 of 4
