JOURNEY CLAIMSSection 25(6)(a) and (b)Conditions of claimThe Act states that an injury is not compensable if it occurs when a worker is travellingin either direction between his/her place of residence and his/her place of employment,except when:• the journey is at the request or direction of their employer• the journey is work related, with the authority (express or implied) of the employer.An injury also is not compensable if it occurs when the worker is travelling between twojobs (<strong>for</strong> two different employers).Example:While on her way to work, Jennydeviates from her usual journey to collectsome computer disks <strong>for</strong> her employerand has a car crash resulting in a brokenleg.The worker must be travelling at therequest or direction of their employer, orthe journey must be work-related, <strong>for</strong> theinjury to be compensable.However, the medical practitioner shouldtreat the injury and make a professionaljudgment about whether it is consistentwith the stated cause.<strong>Reading</strong> <strong>Guide</strong> <strong>for</strong> <strong>Medical</strong> <strong>Practitioners</strong> Version: 2, June 2010Page 11 of 27
