Orient Flexi-Pax Tours, does not own,manage, control, promote, run or operate any transportationor recreational vehicle, motel, hotel, restaurant,or any supplier of services. All exchange orders, couponsand tickets are offered subject to the Terms & Conditionsunder which such services are offered or provided. OrientFlexi-Pax Tours and its representatives assume no liabilitywith respect to any negligence or malfeasances by thirdpartyservice providers, whether during the course of theprovision of transportation, hotel, and other accommodationservices, or otherwise, and are not responsible for anypersonal injury, illness, or property damage or any otherloss or expense whatsoever arising directly or indirectlyfrom the actions of third-party service providers or theirindividual agents in connection with a tour. Further, byparticipating in an Orient Flexi-Pax Tours tour, you arebound by our rules and you participate in the activities ofthe tour at your own risk. Orient Flexi-Pax Tours assumes noresponsibility at all and no liability at all for any death, injury,illness, quarantine, sickness, diseases, natural disaster,damage, loss, delay, accident, expense, defect or anyother abnormality which may result from your participationin any activity during the tour. The aforesaid Orient Flexi-PaxTours and/or their agents can accept no responsibility forlosses or accidental expenses due, as well, to delays orchanges in schedules or departures, hotel overbookings,defaults, sickness, weather, strikes, war, quarantines, riotsor insurrections or criminal acts committed by third parties,political disorders of any type, or other such similarcauses. All such losses or expenses will have to be borneby the passenger. Each exchange coupon, order andticket is to be regarded as one contracted on or in behalfof the particular company or person named in it. Thepassenger contract in use by the airline or steamshipcompany concerned, when issued, shall constitute the solecontract of air or steamship passage with the purchasesof these tours and/or the Passenger. The airline companiesconcerned are not to be held responsible for any act,omission or event during the time passengers are not onboard their planes or conveyances. The right is reservedto withdraw any tour announced in this Program and tomake such alterations to the itineraries as may be founddesirable for the proper carrying out of the tours. In theevent it becomes necessary or advisable in the Tour Operator’sdiscretion to alter the arrangements or itinerariesfor the passenger’s comfort or welfare for any reasonwhatsoever, such alterations may be made withoutpenalty to the Operator. Additional expenses, if any,shall be borne by the Passengers. The right is reservedto decline, to accept, or retain any person as a memberof any group at any time. This program is issued on thesole responsibility of the Tour Operator. It is not issuedon behalf of and does not commit any Airline whoseservices are used in the course of the tours. It is agreedby and between the passenger(s) and Orient Flexi-PaxTours that all disputes and matters whatever arisingunder, in connection with or incident to this agreementshall be litigated, if at all, in and before a court locatedin The City of New York, New York State, U.S.A., to theexclusion of the courts of any other city, state or country.The issuance and acceptance of tickets and/or otherdocuments in connection with a tour is considered acceptanceof the above terms.Special Notice: Delays, cancellations and overbookingmay occur on air flights, cruises, and land reservationsby the participating carriers and hotels. While OrientFlexi-Pax Tours will do everything possible to avoidthese inconveniences, it cannot and will not assumeresponsibility for the respective carriers and hotels.While every attempt is made to provide for accuracy inthe inclusions and pricing of the programs featured,Orient Flexi-Pax Tours reserves the right to correct anymisprints or price updates in its publications with writtennotice to the traveler. Any correction shall be made atleast 30 days prior to the day of departure.
