ASSEMBLY OF THE REPUBLICLAW NO. 40/2006 OF 25 AUGUST 2006LAW ON THE ORDER OF PRECEDENCE OF THE PROTOCOL OF THEPORTUGUESE STATEPursuant to Article 161 c) <strong>of</strong> <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>, <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic decrees <strong>the</strong>following:Secti<strong>on</strong> IGeneral PrinciplesArticle 1(Purpose)1 – This <str<strong>on</strong>g>Law</str<strong>on</strong>g> regulates <strong>the</strong> hierarchy and protocol for senior public dignitaries.2 – It also regulates <strong>the</strong> coordinati<strong>on</strong> with such a hierarchy <strong>of</strong> o<strong>the</strong>r dignitaries includedwithin <strong>the</strong> scheme <strong>of</strong> state relati<strong>on</strong>ships and, in additi<strong>on</strong>, <strong>the</strong> declarati<strong>on</strong> <strong>of</strong> nati<strong>on</strong>almourning.Article 2(Scope <strong>of</strong> applicati<strong>on</strong>)This <str<strong>on</strong>g>Law</str<strong>on</strong>g> applies in <strong>the</strong> whole <strong>of</strong> <strong>the</strong> nati<strong>on</strong>al territory and in <strong>Portuguese</strong> diplomatic andc<strong>on</strong>sular representati<strong>on</strong>s abroad.Article 3(Guarantee <strong>of</strong> pluralism)1 – At <strong>of</strong>ficial cerem<strong>on</strong>ies and <strong>on</strong> o<strong>the</strong>r occasi<strong>on</strong>s involving representati<strong>on</strong> <strong>of</strong> <strong>the</strong> state,<strong>the</strong> aut<strong>on</strong>omous regi<strong>on</strong>s and local government, <strong>of</strong>ficeholders from various bodies, <strong>of</strong> <strong>the</strong>scope corresp<strong>on</strong>ding to <strong>the</strong> organizing body and from <strong>the</strong> level immediately below,should be present.2 – The representati<strong>on</strong> <strong>of</strong> bodies made up <strong>of</strong> various parties should always includemembers <strong>of</strong> <strong>the</strong> majority and <strong>the</strong> oppositi<strong>on</strong>.Article 4(Representati<strong>on</strong>)For <strong>the</strong> purposes <strong>of</strong> this <str<strong>on</strong>g>Law</str<strong>on</strong>g>, a senior figure may solely be represented by ano<strong>the</strong>runder <strong>the</strong> terms <strong>of</strong> <strong>the</strong> specific legal provisi<strong>on</strong>s for such representati<strong>on</strong>.Article 5(Primacy)For senior public dignitaries, <strong>the</strong> order <strong>of</strong> precedence c<strong>on</strong>tained in this <str<strong>on</strong>g>Law</str<strong>on</strong>g> always hasprimacy, including at n<strong>on</strong>-<strong>of</strong>ficial cerem<strong>on</strong>ies.Article 6(Presiding authority at <strong>of</strong>ficial cerem<strong>on</strong>ies)1 – Official cerem<strong>on</strong>ies are presided over by <strong>the</strong> body that organizes <strong>the</strong>m.2 – This <str<strong>on</strong>g>Law</str<strong>on</strong>g> provides for <strong>the</strong> specific excepti<strong>on</strong>s in this respect.

Advisers and assistants to government membersArticle 8(Equivalence)1 – Senior public dignitaries not specifically menti<strong>on</strong>ed in <strong>the</strong> list c<strong>on</strong>tained in <strong>the</strong>preceding article shall be associated with <strong>the</strong> positi<strong>on</strong>s <strong>of</strong> those whose material andterritorial resp<strong>on</strong>sibilities are <strong>the</strong> closest.2 – The spouses <strong>of</strong> senior public dignitaries, or those who live with <strong>the</strong>m in a de factorelati<strong>on</strong>ship, provided <strong>the</strong>y are invited to <strong>the</strong> cerem<strong>on</strong>y, are accorded an equivalentplace to those pers<strong>on</strong>ages when <strong>the</strong>y are accompanying <strong>the</strong>m.Article 9(Electi<strong>on</strong> and seniority)1 – When dignitaries have identical positi<strong>on</strong>s, precedence is given to <strong>the</strong> <strong>on</strong>e whoseentitlement results from electi<strong>on</strong> by <strong>the</strong> people.2 – Am<strong>on</strong>g figures with equal entitlement, <strong>the</strong> l<strong>on</strong>gest in <strong>of</strong>fice has precedence, unlesssome o<strong>the</strong>r rule results from <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> present <str<strong>on</strong>g>Law</str<strong>on</strong>g>.Secti<strong>on</strong> IIIBodies that exercise sovereign powerArticle 10(President <strong>of</strong> <strong>the</strong> Republic)1 – The President <strong>of</strong> <strong>the</strong> Republic has absolute precedence and presides at any <strong>of</strong>ficialcerem<strong>on</strong>y that he or she pers<strong>on</strong>ally attends, with <strong>the</strong> excepti<strong>on</strong> <strong>of</strong> acts carried out in <strong>the</strong>Assembly <strong>of</strong> <strong>the</strong> Republic.2 – In accordance with <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>, <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic is substituted by<strong>the</strong> President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic, who, in such cases, as Interim President<strong>of</strong> <strong>the</strong> Republic, has <strong>the</strong> status <strong>of</strong> President <strong>of</strong> <strong>the</strong> Republic for protocol purposes.3 – For <strong>the</strong> purposes <strong>of</strong> this <str<strong>on</strong>g>Law</str<strong>on</strong>g>, no <strong>on</strong>e may represent <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic;accordingly, no pers<strong>on</strong>al delegate <strong>of</strong> his or hers has precedence over pers<strong>on</strong>ages in ahigher category.Article 11(President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic)1 – In <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic, <strong>the</strong> president in <strong>of</strong>fice always presides, even if <strong>the</strong>President <strong>of</strong> <strong>the</strong> Republic is present.2 – The President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic presides at any <strong>of</strong>ficial cerem<strong>on</strong>y,provided that <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic is not attending in pers<strong>on</strong>, except in <strong>the</strong> case<strong>of</strong> acts carried out in <strong>the</strong> Supreme Court <strong>of</strong> Justice or <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>al Court.3 – The President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic is substituted and may namesome<strong>on</strong>e to represent him or her, in accordance with <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong> and <strong>the</strong> Rules <strong>of</strong>Procedure, by <strong>on</strong>e <strong>of</strong> <strong>the</strong> Vice-presidents <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic, who, in suchcases, has <strong>the</strong> same status as <strong>the</strong> president for protocol purposes.Article 12(Prime Minister)4


ASSEMBLY OF THE REPUBLIC1 – The Prime Minister presides at <strong>of</strong>ficial cerem<strong>on</strong>ies which nei<strong>the</strong>r <strong>the</strong> President <strong>of</strong><strong>the</strong> Republic nor <strong>the</strong> President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic is attending.2 – The Prime Minister may be represented, in cases <strong>of</strong> absence or inability to attend, bya minister <strong>of</strong> his or her choice, who, in such cases, has <strong>the</strong> respective status for protocolpurposes.Article 13(Presidents <strong>of</strong> <strong>the</strong> Supreme Court <strong>of</strong> Justice and <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>al Court)The Presidents <strong>of</strong> <strong>the</strong> Supreme Court <strong>of</strong> Justice and <strong>the</strong> C<strong>on</strong>stituti<strong>on</strong>al Court alwayspreside in <strong>the</strong>ir respective courts, except when <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic is present.Article 14(Ministers)1 – Ministers are ranked according to <strong>the</strong> organizati<strong>on</strong>al legislati<strong>on</strong> applying to <strong>the</strong>government.2 – In diplomatic cerem<strong>on</strong>ies, <strong>the</strong> Minister <strong>of</strong> Foreign Affairs has precedence over allo<strong>the</strong>rs.3 – In military cerem<strong>on</strong>ies, <strong>the</strong> Minister <strong>of</strong> Defence has precedence over all o<strong>the</strong>rs,except for those c<strong>on</strong>nected with <strong>the</strong> Nati<strong>on</strong>al Republican Guard, in which it falls to <strong>the</strong>Minister <strong>of</strong> Home Affairs.4 – In cerem<strong>on</strong>ies related to individual ministries, <strong>the</strong> respective minister hasprecedence.Article 15(Vice-presidents <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic)1 – The precedence accorded to <strong>the</strong> Vice-presidents <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic,am<strong>on</strong>g <strong>the</strong>mselves, corresp<strong>on</strong>ds to <strong>the</strong> representativity <strong>of</strong> <strong>the</strong>ir Parliamentary Group.2 – The Vice-president substituting or representing <strong>the</strong> President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong>Republic <strong>on</strong> account <strong>of</strong> <strong>the</strong> latter’s absence, inability to attend or decisi<strong>on</strong> to delegate isentitled to <strong>the</strong> respective status for protocol purposes.Article 16(Senior Party and Parliamentary Leaders)Presidents or secretaries-general <strong>of</strong> political parties represented in <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong>Republic and <strong>the</strong> Presidents <strong>of</strong> <strong>the</strong> Parliamentary Groups are ranked according to <strong>the</strong>irelectoral representativity.Article 17(Senior Dignitaries from <strong>the</strong> Aut<strong>on</strong>omous Regi<strong>on</strong>s)1 – Throughout <strong>the</strong> nati<strong>on</strong>al territory and in <strong>Portuguese</strong> diplomatic and c<strong>on</strong>sularrepresentati<strong>on</strong>s abroad, protocol accords ministerial status to Representatives <strong>of</strong> <strong>the</strong>Republic and Presidents <strong>of</strong> Legislative Assemblies and Regi<strong>on</strong>al Governments.2 – The provisi<strong>on</strong>s <strong>of</strong> <strong>the</strong> point above apply without prejudice to <strong>the</strong> order <strong>of</strong> precedenceestablished in <strong>the</strong> present <str<strong>on</strong>g>Law</str<strong>on</strong>g>.3 – The h<strong>on</strong>ours established in <strong>the</strong> legislati<strong>on</strong> <strong>of</strong> each Aut<strong>on</strong>omous Regi<strong>on</strong> for <strong>the</strong>presidents <strong>of</strong> <strong>the</strong> respective bodies <strong>of</strong> <strong>the</strong>ir own governments are protected.Article 185

ASSEMBLY OF THE REPUBLICArticle 34(Senior Foreign and Internati<strong>on</strong>al Dignitaries)The same protocol applies to dignitaries from foreign states and internati<strong>on</strong>alorganizati<strong>on</strong>s as applies to <strong>the</strong>ir counterparts in Portugal.Article 35(Senior Dignitaries from <strong>the</strong> European Uni<strong>on</strong>)1 – When in Portugal, <strong>the</strong> President <strong>of</strong> <strong>the</strong> European Parliament immediately succeeds<strong>the</strong> President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic and, likewise, dignitaries from <strong>the</strong>European Parliament <strong>the</strong>ir <strong>Portuguese</strong> counterparts.2 – The President <strong>of</strong> <strong>the</strong> European Council comes immediately after <strong>the</strong> Prime Minister,except if he or she is <strong>the</strong> head <strong>of</strong> state, in which case <strong>the</strong> positi<strong>on</strong> is immediately after<strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic.3 – The President <strong>of</strong> <strong>the</strong> European Commissi<strong>on</strong> immediately follows <strong>the</strong> Prime Ministerand, likewise, European Commissi<strong>on</strong>ers <strong>the</strong>ir <strong>Portuguese</strong> ministerial counterparts.4 – European Uni<strong>on</strong> judicial and administrative dignitaries should receive similartreatment to that provided for in <strong>the</strong> numbers above.Article 36(Senior Diplomatic Dignitaries)1 – Foreign ambassadors accredited in Lisb<strong>on</strong>, when a separate place cannot be reservedfor <strong>the</strong>m, immediately follow <strong>the</strong> Secretary-General <strong>of</strong> <strong>the</strong> Ministry <strong>of</strong> Foreign Affairs;<strong>the</strong>y are ranked am<strong>on</strong>g <strong>the</strong>mselves according to seniority in <strong>the</strong> presentati<strong>on</strong> <strong>of</strong>credentials, with <strong>the</strong> traditi<strong>on</strong>al precedence <strong>of</strong> <strong>the</strong> Apostolic Nuncio as Dean <strong>of</strong> <strong>the</strong>Diplomatic Corps being observed.2 – When <strong>on</strong> a duly announced <strong>of</strong>ficial visit to <strong>the</strong> Aut<strong>on</strong>omous Regi<strong>on</strong>s or to districtsor municipalities <strong>on</strong> <strong>the</strong> mainland <strong>of</strong> <strong>the</strong> Republic, foreign ambassadors accredited inLisb<strong>on</strong> have <strong>the</strong> right to <strong>the</strong> same treatment as ministers.3 – On <strong>the</strong> occasi<strong>on</strong> <strong>of</strong> <strong>of</strong>ficial visits by high-level foreign delegati<strong>on</strong>s, <strong>the</strong> ambassador<strong>of</strong> <strong>the</strong> country in questi<strong>on</strong> forms part <strong>of</strong> <strong>the</strong> company <strong>of</strong> <strong>the</strong> dignitary that presides overit, occupying, with identical h<strong>on</strong>ours, <strong>the</strong> positi<strong>on</strong> immediately after those treated in itas ministers.4 – When in Portugal, <strong>Portuguese</strong> ambassadors accredited in foreign countries aretreated in <strong>the</strong> same way, for protocol purposes, as foreign ambassadors.5 – Diplomatic representatives <strong>of</strong> a lower rank than ambassador are c<strong>on</strong>sidered equal to<strong>Portuguese</strong> diplomats <strong>of</strong> <strong>the</strong> same category and <strong>the</strong> latter, in turn, to o<strong>the</strong>r state servants<strong>of</strong> an identical level.6 – C<strong>on</strong>suls general, c<strong>on</strong>suls and vice-c<strong>on</strong>suls in <strong>the</strong> career service precede h<strong>on</strong>oraryc<strong>on</strong>suls and vice-c<strong>on</strong>suls; <strong>the</strong>y are all ranked, in each category, by seniority based <strong>on</strong> <strong>the</strong>date <strong>of</strong> <strong>the</strong>ir letters patent.7 – In diplomatic representati<strong>on</strong>s abroad, <strong>the</strong> appropriate <strong>of</strong>ficeholder always presides,except when <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic, <strong>the</strong> President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong>Republic, <strong>the</strong> Prime Minister or <strong>the</strong> Minister <strong>of</strong> Foreign Affairs is present.8 – In visits by <strong>Portuguese</strong> delegati<strong>on</strong>s headed by dignitaries with <strong>the</strong> status <strong>of</strong> ministersfor protocol purposes, <strong>the</strong> latter have precedence in all external acts <strong>of</strong> <strong>the</strong> respectiveprogramme.9


ASSEMBLY OF THE REPUBLICArticle 37(Relatives <strong>of</strong> Foreign Heads <strong>of</strong> State)The relatives <strong>of</strong> foreign heads <strong>of</strong> state should be treated as special guests <strong>of</strong> <strong>the</strong>President <strong>of</strong> <strong>the</strong> Republic and placed close to him or, in his absence, to <strong>the</strong> pers<strong>on</strong> who,by virtue <strong>of</strong> his or her highest rank for protocol purposes, is presiding.Article 38(Religious Authorities)When invited to <strong>of</strong>ficial cerem<strong>on</strong>ies, religious authorities are accorded <strong>the</strong> treatmentappropriate to <strong>the</strong> dignity and representativity <strong>of</strong> <strong>the</strong> duties that <strong>the</strong>y carry out; <strong>the</strong>y areranked according to <strong>the</strong>ir respective representati<strong>on</strong> in <strong>Portuguese</strong> society.Article 39(University Authorities)1 – University vice-rectors and presidents <strong>of</strong> polytechnic institutes preside at <strong>the</strong> actscarried out in <strong>the</strong>ir instituti<strong>on</strong>s, except when <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic or <strong>the</strong>President <strong>of</strong> <strong>the</strong> Assembly <strong>of</strong> <strong>the</strong> Republic attends.2 – Deputati<strong>on</strong>s <strong>of</strong> academic c<strong>on</strong>gregati<strong>on</strong>s who take part in <strong>of</strong>ficial cerem<strong>on</strong>ies comedirectly after <strong>the</strong>ir vice-chancellors or presidents.Article 40(Civil Society Dignitaries)When invited to <strong>of</strong>ficial cerem<strong>on</strong>ies, <strong>the</strong> leaders <strong>of</strong> employers’ and trade uni<strong>on</strong>c<strong>on</strong>federati<strong>on</strong>s and any o<strong>the</strong>r civil society bodies occupy places appropriate to <strong>the</strong>irimportance and representativity.Article 41(Civil Governors)1 – In <strong>the</strong>ir districts, civil governors directly follow <strong>the</strong> president <strong>of</strong> <strong>the</strong> municipalassembly for <strong>the</strong> municipality where <strong>the</strong> cerem<strong>on</strong>y is taking place, except when <strong>the</strong>y areexpressly representing a member <strong>of</strong> <strong>the</strong> government invited to preside, in which case<strong>the</strong>y shall assume <strong>the</strong> duty to preside.2 – In <strong>of</strong>ficial cerem<strong>on</strong>ies c<strong>on</strong>nected with safety, protecti<strong>on</strong> and relief, if no members <strong>of</strong><strong>the</strong> government are present, <strong>the</strong> civil governors in <strong>the</strong> respective districts assume <strong>the</strong>positi<strong>on</strong> <strong>of</strong> ministers for protocol purposes, thus preceding <strong>the</strong> mayor <strong>of</strong> <strong>the</strong>municipality where such cerem<strong>on</strong>ies take place.Secti<strong>on</strong> VIINati<strong>on</strong>al MourningArticle 42(Announcement)1 – The government announces a period <strong>of</strong> nati<strong>on</strong>al mourning, its length and its scope,in <strong>the</strong> form <strong>of</strong> a decree.10
