Gypsum Gas Wars: Conoco vs. The Kum N Go
Publisher’s Report
I don’t get to the Town
of Gypsum as much as I like,
except to relax on the lawn
at an occasional Gypsum
Daze concert, or to attend an
occasional town council
meeting at one of the bestrun
governments around.
But, I was passing
through town last week and
noticed a gas sign on the
Conoco station that read
$2.45 per gallon. Usually, I
make it a habit, when in the
west end of the county, to
get my fill-ups at Corky’s
gas station in West Eagle.
Corky’s is historically not
only the cheapest gas station
in the county, but also provides
Remi or Mike to, get
this, actually fill your tank
for you (shades of the
1960s).
I always like to ask the
boys, “Can ya get any service
in this joint?”
“No,” Mike always
answers.
“Fill it with the cheap
stuff,” I reply, and then he
proceeds to fill the tank with
unleaded gas.
But, I digress.
El Centenario-Edwards
Nobody beats our
prices - nobody! You
can call, text & surf
the web unlimited,
for only $40.00 a
month. Wireless
internet modems
also available.
Unlimited Internet -
$40.00. 926-8603.
$2.45 a gallon in
Gypsum, I wondered?
That is lower than
Kansas City and Denver
prices. I looked down at the
gas gauge in my car and it
read “empty,” so I pulled in
and filled up, feeling very
good about only paying
$2.45 per gallon.
And, then I noticed it. A
new Kum N Go gas station
magically appeared across
the street in that forever
vacant lot in front of the
Columbine Market.
Now, I understood.
Competition has arrived in
Gypsum!
The next day, I had to be
back in Gypsum again and
noticed that $2.45 per gallon
was gone, and was replaced
by $2.58 per gallon. Geez,
that didn’t last long. I didn’t
really need gas, but I decided
to buy some at the new
Kum N Go, just to check out
the inside of the store, which
looked pretty nice.
Unfortunately, it took
forever to get the credit card
to work in the new pumps,
because the store was in the
process of lowering the
price by a penny, so it
could be a cent lower
than the Conoco across
the street.
While waiting for
the computers to come
back up, I decided to
shoot some pictures
and talk to people at
both gas stations.
Clearly, I was in
the middle of a goodole-fashioned
gas war.
I liked that, having
grown immune to paying
some of the highest
gas prices in the country
in Vail for the last
35 years.
This was an event
of epic proportion. A
real gas war in Eagle
County. I have never
seen that before.
So, when the Kum N Go
dropped it’s price to $2.57
right in front of me, I felt
badly because I had just
paid $2.58. Then, I drove
across the street and took
pictures of a girl at the
Conoco, dropping her station’s
price to $2.56 minutes
later.
Na - na na, na - na - na!
G y p s u m g a s s t a t i o n s
b a t t l e f o r c u s t o m e r s !
Just like two little kids
trying to best each other. It
felt “really good” taking
advantage of this.
But, I’ll still buy from
Corky’s in Eagle. They have
consistently had the lowest
prices in the county for
years. Besides, I wouldn’t be
happy if I couldn’t ask,
“Can ya get any service in
this joint?”
Vail Council wants to add debt, without voter approval
Publisher’s Opinion
If you ran a business in
Eagle County, would you
borrow $12 million in this
economic climate, and pay
it back, along with $7 million
more in interest? This
publisher wouldn’t, and
neither would Vail
Councilman Kevin Foley.
Should government do
it without voter approval,
as required by the state constitution’s
Taxpayer Bill of
Rights (TABOR), which
was initiated by voters
state-wide and passed in
1992?
It appears that most of
the rest of the Vail Council
thinks so, as no one else
objected to that idea at a
1pm meeting of the council
on Tuesday, August 17th.
This Vail meeting was
held 30 minutes prior to
Council’s usually wellnoticed
work session, while
acting as another legal entity
known as the Vail Re-
Investment Authority, with
only three-to-four days
notice of the meeting, and
conveniently minutes
before the Channel 5 Public
Access camera would
arrive to shoot the regular
work session meeting, to
prevent voters from being
informed.
Vail’s experienced bond
counsel, Dee Wisor, cited a
2001 Colorado Appellate
Court decision, offering his
opinion that their decision
eliminates the need for
voter approval for borrowing
money in this instance,
thereby overturning
TABOR.. This case was
never brought before the
Colorado Supreme Court,
but most Colorado courts
have been known for overturning
voters’ rights.
And, the courts wonder
why the “Clear the Bench”
campaign wants more
judges removed for usurping
voters’ rights in the
November election!
If the loan idea passes at
the Tuesday, September
21st meeting of the
Authority, it would indebt
Vail taxpayers for the next
20 years.
The Authority doesn’t
even know what it wants to
Gary says,
“Boyz Toyz & Sonz
now rents ATVs!”
spend the money on.
Did I mention that Vail
has approximately $50 million
in reserves that it could
use instead of borrowing
money? Did I mention that
Vail will have $3 million
more in cash available at
the end of the year that it
could apply to this, plus it
could tap $10 million from
the voter-approved tax for
a never-to-be-built conference
center, that voters
could simply approve for
this new purpose, thereby
saving the need to borrow
$12 million?
But, to do that, the
council would have to ask
for voter approval. They
obviously don’t trust voters
to do that?
The fact is, the Vail
Town Council doesn’t trust
the voters to approve
indebting themselves for 20
years, in what could be a
loan up to $26 million, plus
$14 million or more in
interest!
They are right. The voters
are smart enough not to
approve that when Vail has
the cash to do it and the
”I will take you to a fun place to ride!”
Publisher’s Opinion
In 2003 and 2004, the
publisher was privileged to
have spent two to three
afternoons a week having
“cocktails with the boys” at
the Edwards Brewery.
The boys usually consisted
of my friends, Gerald
Gallegos, Richard DeClark,
Mike Walters, myself, and
others who periodically
dropped by.
The publisher has
known Gerald since 1975,
when Gerald was a bouncer
at Vail’s number one bar, the
Nu Gnu. Gerald was built
like the stones he carried
back in those days. He was
one tough dude, not someone
you wanted to mess
with, if you know what I
mean, and I think you do.
Travel
Section
But, he had a soft side to
him. You didn’t have to be
afraid of Gerald. That soft
side stayed with him
throughout his life.
As friend Richard
DeClark said about Gerald’s
passing, “He wrote the book
on how to give back,” referring
to how Gerald had
helped build a stone business
into a mega corporation
and then gave back to
the community.
“Nobody has done
more than that guy!”
DeClark continued. “He
gave back more than he
took!”
Mike Walters told the
publisher the day after
Gallegos passed, “It’s not as
much fun today as it was
before Gerald died.”
After Gerald died, an
acquaintance said to me that
Gerald wasn’t as perfect as
some thought.
I responded that of all
the wealthy people I’ve
known, Gerald gave more
back than anyone, period,
bar none! It wasn’t even
E. C. Attorney responds to illegals using false Soc Sec #s
Dear Editor,
I wanted to touch base
with you and let you know
where we are at in your
request for more details on
the county’s notification
policies when we deny
services. As we discussed,
the county does verify the
legal eligibility of all those
applying for assistance.
Those that are not eligible
are denied.
We do not, however,
notify law enforcement of
such denials.
I have done some brief
research and have found
that our practices seem to
be consistent with other
Letters
to the
Editor
counties in the state. The
reason for this is that county
health and human service
departments act as an
arm of the state in providing
these assistance programs.
C.R.S. §26-1-114
states that it is the state
department of human services
who will establish rules
and safeguards restricting
the use or disclosure of
information concerning
applicants.
I have reviewed some
of the rules and regulations
from the state on the confidentiality
of applicants and
am attaching those. We are
required to verify alien registration
numbers of recipients
and if the State
Department tells us that the
name and number do not
correspond, we are directed
to terminate assistance. We
are not authorized by the
state to take any additional
action.
There are several
statutes that I located dealing
with confidentiality of
dependency and neglect
cases (19-1-301 et al), child
support enforcement cases
(26-13-102.7), and the above
health and human services
cases (26-1-114). The general
theme indicates limited
disclosure and only when
specifically authorized by
the state. For instance, the
directive from the state in
reporting illegal aliens as it
applies to food stamp
authorizes counties to
make such notification to
law enforcement, but only
when we are aware of firm
evidence (known to have a
final order of deportation
outstanding) and not on
mere suspicion.
Our concern is that our
employees could face
penalties, and we could
face a loss of subsidies for
failing to follow state directives
in this regard.
Kathy Lyons is out this
week at training, but I will
ask that she verify my
information is correct with
the state when she gets
back. If so, it appears the
issue is at a state level, as
we cannot do more absent
different direction from
them.
As always, call or stop
by with any questions.
Business Briefs - Vail, Colorado - www.BusinessBriefs.net - Aug 26 thru Sept 29, 2010 - Page 7
Minturn town attorney won’t read removal petition
From Page 1
she was displeased with
Christensen.
Christensen serves
two roles with the small
town, serving a majority of
votes on the council as the
council’s attorney, and also
serving as the Town’s prosecutor.
Other towns are different
This situation where
the town attorney serves
dual roles in Minturn, is different
from some other
towns in Eagle County, that
opt to have a separate prosecutor
and a separate adviser
to their council.
Christensen, the
town’s attorney since 1984,
was not available to respond
to a last-minute telephone
call from Business Briefs on
deadline day before the July
29th issue, but later told
Business Briefs that, “I
haven’t read the petition
because it could unnecessarily
bias me against citizens
that signed it.”
By not reading the
petition, Christensen will
less likely know which citizens
want him gone, should
he have to prosecute any
later in the Minturn
Municipal Court.
Christensen showed
Business Briefs a sealed
envelope that he stated was
a copy of the petition.
“As a prosecutor, I
have to be neutral,” he stated.
“We’re all human.”
Naturally, any citizen
who is prosecuted by
the town attorney, could
also possibly hold a bias
against him, as well.
Refuses to fight Freedom
of Information requests
Christensen also
told Business Briefs that he
had advised the town not to
fight Freedom of
Information requests.
In fact, the town
printed agendas with total
transparency under state
statute, which read “to discuss
personnel matters concerning
the Town Attorney.”
According to the
Town’s website, “the town
attorney is appointed by the
Minturn Town Council and
provides legal advice and
Allen Christensen
File Photo
counsel to the Town Council
and town officials in matters
relating to their official
duties. The town attorney is
also the legal representative
of the Town in county, state
and federal court and
directs outside counsel who
represent the Town in that
capacity. The town attorney
attends all council meetings
and drafts ordinances and
resolutions for council
approval. The town attorney
reviews and consults on
contracts regarding town
services and provides legal
opinions and staff consultation
on such issues as land
use and development, property
acquisition, personnel,
finance, liquor licensing and
such other matters as the
town council or town manager
may direct. The town
attorney prosecutes violations
of the municipal code
before the Town of Minturn
Municipal Court.”
According to the
agenda of the August 4, 2010
meeting of council, an
Executive Session was
called to disuss Christensen,
and again at the August 18,
2010 meeting, as well.
Council will address it at
September 1st meeting
At the August 18th
meeting, Mayor Gordon
“Hawkeye” Flaherty indicated
that the subject of the
status of the Town Attorney
would be discussed in the
open portion of the
Wednesday, September 1st
meeting of council and that
the council would “take
action regarding the petition.”
The Mayor also said
that the council was “taking
it (the petition) very seriously,”
and that the “public can
speak” at the meeting.
This differs from
Town Administrator Jim
White’s previous statement
to Business Briefs, when he
indicated that because it
was a personnel issue, it
would not be discussed
before the public.
Clearly, a public
hearing would be far more
transparent, but not necessarily
legally required.
If your looking for perfect
people, the only people
I can think of is you, the
reader, and myself; and I’m
not so sure about you. I’m
even beginning to wonder
about me!
Gerald was known to
hand out $100.00 bills to the
working class of Eagle
County - regularly. That was
in addition to him writing
large checks to local charities,
over and over and over
again!
One waitress, who was
happily married, said to me,
“I count on Gerald to help
me feed my family. There is
no one like Gerald!”
Whenever we’d have
cocktails, Gerald always
wanted to pick up the tab.
The publisher likes free
drinks, just like everyone
else. But, after a couple of
times of this, I told Gerald
that I can afford to buy my
own drinks, and that occasionally
he needed to let me
pick up the tab and “get
over it!”
Occasionally, I’d have to
threaten to take him outside
Gerald Gallegos
(Courtesy-Gallegos Corp)
and hurt him if he didn’t
cooperate. I did threaten
him, but if you don’t know
me, then you don’t know
that I couldn’t begin to hurt
Gerald in a fair fight.
I know the waiters and
waitresses would cringe if
they thought old cheapface
here was going to pick up
the tab, instead of Gerald,
because they know I’m only
good for a 15-20% tip.
But, I am certain that
Gerald always slipped them
a hundred on top of my tip.
I saw Gerald a few
weeks ago at the Dance Gala
benefit. I spoke with him for
about five minutes and then
returned to my table. I said
to a friend, “I don’t think
Gerald has much longer to
be with us.”
Rest in peace, Gerald.
You deserve it, friend!
