former defense attorney<br />

who was recently elected<br />

to be the Fifth Judicial<br />

District Attorney, won<br />

<strong>his</strong> <strong>first</strong> <strong>jury</strong> <strong>trial</strong> last<br />

week in Eagle.<br />

<strong>Brown</strong> turned in a<br />

solid performance convicting<br />

<strong>Eric</strong> Paul <strong>Moser</strong><br />

on two charges.<br />

<strong>Moser</strong> was suspected<br />

of burglarizing the home<br />

of Merv and Lanie<br />

Lapin, who live in Vail.<br />

Another solid performance<br />

was turned in<br />

by a young, former Vail<br />

patrolman, Ryan Larsen,<br />

who was the only officer<br />

who answered the call<br />

around midnight last<br />

year. Without the help of<br />

Vail police detectives,<br />

Larsen tracked the<br />

movements of the suspect<br />

to a Rifle, Colorado<br />

Radio Shack store via<br />

the use of Lainie Lapin’s<br />

missing credit card, and<br />

the use of <strong>his</strong> own credit<br />

card six minutes later.<br />

It is unclear why Vail<br />

police detectives waited<br />

B r u c e B r o w n<br />

almost nine months later<br />

to perform finger printing<br />

at the Lapin home,<br />

instead of the day after<br />

the burglarly.<br />

The young patrolman,<br />

who is not a<br />

trained police detective,<br />

failed to perform the finger<br />

printing the night of<br />

the burglarly, but <strong>his</strong><br />

actions to track the<br />

movement of the suspect<br />

to Rifle turned out<br />

to be more important to<br />

the timeline of <strong>his</strong> capture.<br />

Prosecutor <strong>Brown</strong><br />

inherited the case from<br />

<strong>his</strong> predecessor, Mark<br />

Hurlbert, and made the<br />

most of what evidence<br />

was available to get the<br />

two convictions, mostly<br />

on circumstantial evidence.<br />

<strong>Moser</strong> never took the<br />

stand in <strong>his</strong> defense, but<br />

fortunately for him had<br />

a strong defense provided<br />

by Sommer Spector<br />

of the Public Defender’s<br />

office. Spector skillfully<br />

fought to get five not<br />

guilty findings on five of<br />

the seven charges. Her<br />

closing argument was<br />

outstanding.<br />

Patrolman Larsen is<br />

now working as a<br />

Washington state city<br />

patrolman, but came<br />

back to Eagle County to<br />

testify at the <strong>trial</strong>.<br />

<strong>Moser</strong> was supposedly<br />

homeless for a time<br />

and was working in Vail,<br />

prior to the burglary.<br />

Sentencing is set for<br />

next month, and <strong>Moser</strong><br />

is elegible for up to 18<br />

months on one charge,<br />

and up to 6 years on<br />

another charge.<br />

Letters - Alpine Arms owner sues <strong>over</strong> gun restrictions!<br />

radical policies<br />

of expanded Brady registration<br />

checks and the<br />

magazine ban have gone<br />

into effect.<br />

In addition to RMGO’s<br />

plans to fight for repeal of<br />

these anti-gun laws in the<br />

Colorado Legislature, we<br />

are announcing our plans<br />

to take both of these draconian<br />

laws to court.<br />

RMGO, working with<br />

John Sternberg, a Pueblo<br />

resident, and Matt<br />

Solomon of Alpine Arms in<br />

Eagle, Colorado, is filing a<br />

lawsuit to challenge the<br />

constitutionality of both<br />

HB 13-1229 (Expanded<br />

Brady Registration Checks)<br />

and HB 13-1224 (The<br />

Magazine Ban).<br />

The gun-grabbers may<br />

claim that they are expanding<br />

background checks<br />

under the guise of “public<br />

safety,” but you and I both<br />

know better - they want to<br />

track and register every<br />

single one of your firearms<br />

and ban private sales altogether.<br />

The simple truth is, if<br />

the anti-gunners can’t get<br />

an outright ban on all<br />

firearms, they’ll dismantle<br />

your Second Amendment<br />

rights piece by piece - and<br />

that’s exactly what’s happening<br />

here.<br />

T<strong>his</strong> measure goes so<br />

far as to limit your ability<br />

to loan, sell, or even gift<br />

your firearm to those closest<br />

to you. It doesn’t matter<br />

if it’s for hunting, shooting<br />

at the range, or even loaning<br />

a firearm to a friend<br />

you may feel is in danger.<br />

These laws <strong>over</strong>reach<br />

so many constitutional barriers<br />

it’s not even funny.<br />

In addition to challenging<br />

expanded Brady registration<br />

checks, RMGO’s<br />

lawsuit also attacks the<br />

constitutionality of the draconian<br />

magazine ban.<br />

HB 13-1224 doesn’t just<br />

ban all magazines <strong>over</strong> 15<br />

rounds, it also bans all<br />

magazines with a removable<br />

floor plate (nearly<br />

every magazine) that can<br />

To make matters worse,<br />

many firearms with fixed<br />

tube or box magazines can<br />

also be readily converted<br />

to hold more rounds than<br />

the 15-round limit, essentially<br />

banning the firearm<br />

itself.<br />

HB 13-1224 also<br />

requires that any gun<br />

owner with “grandfathered”<br />

magazines (those<br />

purchased before July 1st,<br />

2013) maintain “continuous<br />

possession” of that<br />

magazine.<br />

T<strong>his</strong> provision means<br />

the grandfathered owner<br />

of the magazine is strictly<br />

prohibited from ever<br />

allowing anyone to hold or<br />

use the firearm if the<br />

firearm is in a functional<br />

state - making it impossible<br />

for firearms to be used and<br />

shared in ordinary and<br />

innocent ways.<br />

As law-abiding gun<br />

owners, you and I both<br />

intuitively know that the<br />

ban on all magazines <strong>over</strong><br />

15 rounds directly and<br />

gravely harms our ability<br />

to use firearms for lawful<br />

purposes, especially selfdefense.<br />

Getting the radical antigun<br />

agenda repealed or<br />

<strong>over</strong>turned is not going to<br />

happen <strong>over</strong>night, and it<br />

certainly won’t be easy.<br />

that the Eagle County<br />

Airport needs more revenue.<br />

I clearly understand<br />

that less flights means less<br />

revenue. But, please DO<br />

NOT charge for parking.<br />

Please, LISTEN to the people!<br />

Now, it appears that<br />

the Eagle County Airport<br />

has come up with a better<br />

idea. Let’s just raise the<br />

revenue from the transportation<br />

booths inside the<br />

terminal.<br />

Since the current transportation<br />

booths have not<br />

been rebid for nine years,<br />

maybe a new Request for<br />

Proposals (RFPs) sounds<br />

like a good idea.<br />

How much more revenue<br />

should we try to<br />

raise? How about 20-30%<br />

or maybe 50%? It has been<br />

NINE YEARS!<br />

The old RFPs were<br />

based on a monthly minimum<br />

for the busy five<br />

months (December<br />

through April), and/or<br />

whatever was greater,<br />

if a business is<br />

ordered not to sell alcohol,<br />

the local g<strong>over</strong>nments<br />

can lose sales tax<br />

revenue on the sale of<br />

drinks.<br />

Customers won’t necessarily<br />

know that they<br />

cannot order liquor with<br />

their meal until after they<br />

have arrived at a restaurant<br />

that is under an order<br />

not to sell alcohol.<br />

The state rarely busts<br />

establishments for<br />

serving other minors,<br />

except minors who work<br />

for the state!<br />

There never seems to<br />

be a bust for the sale of<br />

alcohol to minors for anyone<br />

but the state’s setup<br />

person. That is, the state<br />

never seems to catch anyone<br />

who doesn’t work for<br />

the state. T<strong>his</strong> indicates<br />

that the system is working<br />

fairly well, if the state<br />

is unable to find minors<br />

purchasing alcohol,<br />

except those that work for<br />

the state.<br />

Is the state violating<br />

Sign posted in bars and<br />

restaurants! Is the state in<br />

violation by buying?<br />

How can the state<br />

itself not be guilty of aiding<br />

and abetting the sale<br />

of alcohol to a minor<br />

when they encourage a<br />

minor to use sneaky tactics<br />

to encourage the sale<br />

of alcoholic beverages to<br />

that minor?<br />

There are 58 pages of<br />

liquor laws. The publisher<br />

did a cursory<br />

review, but could not<br />

find where it is legal for<br />

enforcement agents to<br />

violate the very law that<br />

bars and restaurants<br />

have to follow.<br />

That doesn’t mean<br />

that law doesn’t exist. It<br />

only means the publisher<br />

couldn’t find it.<br />

Bartenders have been<br />

charged for pouring a<br />

drink and then asking<br />

for ID prior to serving!<br />

“How fair is that?”<br />

asked one bartender who<br />

was told they were in<br />

violation of liquor law,<br />

even though they had not<br />

yet given the drink to the<br />

state’s entrapment person.<br />

How do other countries<br />

enforce liquor laws?<br />

The publisher was<br />

advised that in one country,<br />

they simply throw the<br />

underage person out of<br />

the bar and send them on<br />

their way.<br />

Is it time to<br />

change our liquor laws?<br />

Enriching the state by<br />

using sneaky tactics to<br />

entrap unsuspecting<br />

owners and employees<br />

seems to violate the “I’m<br />

from the g<strong>over</strong>nment and<br />

I am here to help” edict.<br />

Is it time for the legislature<br />

to review archaic<br />

laws, or to at least require<br />

the enforcement agencies<br />

inside the Airport. In fact,<br />

before inside an airport.<br />

For example, when I<br />

travel to Boston, DC, LA,<br />

Florida or Las Vegas, I<br />

always just walk outside to<br />

a taxi queue.<br />

fees that these two companies<br />

be asked to pay per<br />

year.<br />

T<strong>his</strong> represents a possible<br />

increase of $250K<br />

per year to the Eagle<br />

County Airport.<br />

These increases are<br />

outrageous!<br />

In the past, HMT paid<br />

$6 per trip, now assuming<br />

an average trip ticket of<br />

$130. T<strong>his</strong> would be $13, or<br />

an increase of $7 per trip,<br />

or an increase from 4.6% to<br />

10% per trip.<br />

In the past, CME paid<br />

$10 per trip, now assuming<br />

an average trip ticket of<br />

$300, t<strong>his</strong> would be $30, or<br />

an increase of $20 per trip,<br />

or an increase from 3.3% to<br />

10% per trip.<br />

Sounds great, right?<br />

Well, what if CME<br />

decides that a minimum<br />

additional $150K per year,<br />

or $350-$400K per year, is<br />

JUST TOO MUCH, and<br />

they don’t bid at all?<br />

Instead, they choose to<br />

have 5 to 10 GREETERS<br />

with clipboards, and call<br />

the Eagle County Airport’s<br />

bluff?<br />

Can the Eagle County<br />

Airport afford to LOSE<br />

$180-$190K in revenue, on<br />

a gamble to make $150K<br />

more?<br />

What I want to know is<br />

why the Eagle County<br />

Airport wants to take t<strong>his</strong><br />

gamble, and why they<br />

want to risk alienating<br />

CME?<br />

I suggest the airport<br />

look at other potential<br />

sources of revenue like:<br />

1. Offering the third<br />

booth that has been<br />

vacant?<br />

2. Fixing the current<br />

Automatic Vehicle<br />

Identification System<br />

(AVI), a read system that I<br />

believe is missing at least<br />

25% to 75% of VALID<br />

READS.<br />

We believe these two<br />

sources could easily generate<br />

an additional $100K<br />

plus per year, and still<br />

allow a vendor like CME,<br />

the ability to provide outstanding<br />

customer service<br />

to our valued guests at the<br />

Eagle County Airport.<br />
