New DA, Bruce Brown, wins his
first jury trial, over Eric Moser!
Publisher’s Opinion
Eagle - Bruce Brown, a
former defense attorney
who was recently elected
to be the Fifth Judicial
District Attorney, won
his first jury trial last
week in Eagle.
Brown turned in a
solid performance convicting
Eric Paul Moser
on two charges.
Moser was suspected
of burglarizing the home
of Merv and Lanie
Lapin, who live in Vail.
Another solid performance
was turned in
by a young, former Vail
patrolman, Ryan Larsen,
who was the only officer
who answered the call
around midnight last
year. Without the help of
Vail police detectives,
Larsen tracked the
movements of the suspect
to a Rifle, Colorado
Radio Shack store via
the use of Lainie Lapin’s
missing credit card, and
the use of his own credit
card six minutes later.
It is unclear why Vail
police detectives waited
B r u c e B r o w n
almost nine months later
to perform finger printing
at the Lapin home,
instead of the day after
the burglarly.
The young patrolman,
who is not a
trained police detective,
failed to perform the finger
printing the night of
the burglarly, but his
actions to track the
movement of the suspect
to Rifle turned out
to be more important to
the timeline of his capture.
Prosecutor Brown
inherited the case from
his predecessor, Mark
Hurlbert, and made the
most of what evidence
was available to get the
two convictions, mostly
on circumstantial evidence.
Moser never took the
stand in his defense, but
fortunately for him had
a strong defense provided
by Sommer Spector
of the Public Defender’s
office. Spector skillfully
fought to get five not
guilty findings on five of
the seven charges. Her
closing argument was
outstanding.
Patrolman Larsen is
now working as a
Washington state city
patrolman, but came
back to Eagle County to
testify at the trial.
Moser was supposedly
homeless for a time
and was working in Vail,
prior to the burglary.
Sentencing is set for
next month, and Moser
is elegible for up to 18
months on one charge,
and up to 6 years on
another charge.
New condos starting at $59,000.00 in Playa del Carmen!
Now a section designated for Canadians & Americans
Own a new own condo in Playa del Carmen - near new shopping center! P a r t y w i t h n e w f r i e n d s b y t h e p o o l !
Advertorial
Playa del Carmen,
Mexico - F i n a l l y ,
affordable, titled Real
Estate in Playa del
Carmen, Mexico.
Playa has long been
known as the playground
of the rich.For
the first time, Playa has
a project that more buyers
can afford.
Playa is well known
in chic circles, welcoming
the most cosmopolitan
people from North
and South America,
Europe, and most
recently, Asia, to its
crystal clear waters and
powder white sand
beaches.
But until recently,
the price of the Real
Estate has kept the
dream of living there
out of the reach of those
who are not millionaires.
This new project features
2-bedroom condos
starting at $59,000 USD,
and 2-bedroom townhomes
starting at
$99,000 USD, in a
secure, gated community.
This is a chance to
allow a buyer who is
not wealthy realize their
dream of having a place
in one of the most exclusive
zip codes in this
hemisphere.
For the last several
years, when someone
only had $100,000.00 to
spend, they usually
ended up in Tulum or
Merida, because prices
were usually lower
there.
And, this project features
high quality
building practices,
aimed at the American
and Canadian Market.
Playa del
Carmen has long been
associated with environmentally
friendliness,
and this project
plays into that theme
perfectly.
Letters - Alpine Arms owner sues over gun restrictions!
From Page 1
beat them in court.
As of July 1st, the gungrabbers’
radical policies
of expanded Brady registration
checks and the
magazine ban have gone
into effect.
In addition to RMGO’s
plans to fight for repeal of
these anti-gun laws in the
Colorado Legislature, we
are announcing our plans
to take both of these draconian
laws to court.
RMGO, working with
John Sternberg, a Pueblo
resident, and Matt
Solomon of Alpine Arms in
Eagle, Colorado, is filing a
lawsuit to challenge the
constitutionality of both
HB 13-1229 (Expanded
Brady Registration Checks)
and HB 13-1224 (The
Magazine Ban).
The gun-grabbers may
claim that they are expanding
background checks
under the guise of “public
safety,” but you and I both
know better - they want to
track and register every
single one of your firearms
and ban private sales altogether.
The simple truth is, if
the anti-gunners can’t get
an outright ban on all
firearms, they’ll dismantle
your Second Amendment
rights piece by piece - and
that’s exactly what’s happening
here.
This measure goes so
far as to limit your ability
to loan, sell, or even gift
your firearm to those closest
to you. It doesn’t matter
if it’s for hunting, shooting
at the range, or even loaning
a firearm to a friend
you may feel is in danger.
These laws overreach
so many constitutional barriers
it’s not even funny.
In addition to challenging
expanded Brady registration
checks, RMGO’s
lawsuit also attacks the
constitutionality of the draconian
magazine ban.
HB 13-1224 doesn’t just
ban all magazines over 15
rounds, it also bans all
magazines with a removable
floor plate (nearly
every magazine) that can
Letters Policy
be readily converted to
hold more rounds - something
even the bill’s chief
sponsor, gun-grabbing
Rep. Rhonda Fields, has
publicly confirmed.
To make matters worse,
many firearms with fixed
tube or box magazines can
also be readily converted
to hold more rounds than
the 15-round limit, essentially
banning the firearm
itself.
HB 13-1224 also
requires that any gun
owner with “grandfathered”
magazines (those
purchased before July 1st,
2013) maintain “continuous
possession” of that
magazine.
This provision means
the grandfathered owner
of the magazine is strictly
prohibited from ever
allowing anyone to hold or
use the firearm if the
firearm is in a functional
state - making it impossible
for firearms to be used and
shared in ordinary and
innocent ways.
As law-abiding gun
owners, you and I both
intuitively know that the
ban on all magazines over
15 rounds directly and
gravely harms our ability
to use firearms for lawful
purposes, especially selfdefense.
Getting the radical antigun
agenda repealed or
overturned is not going to
happen overnight, and it
certainly won’t be easy.
Dudley Brown, Rocky
Mountain Gun Owners,
Executive Director
Greedy and maybe
ill-advised Eagle Airport?
Dear Publisher,
OK, I understand that
that the Eagle County
Airport needs more revenue.
I clearly understand
that less flights means less
revenue. But, please DO
NOT charge for parking.
Please, LISTEN to the people!
Now, it appears that
the Eagle County Airport
has come up with a better
idea. Let’s just raise the
revenue from the transportation
booths inside the
terminal.
Since the current transportation
booths have not
been rebid for nine years,
maybe a new Request for
Proposals (RFPs) sounds
like a good idea.
How much more revenue
should we try to
raise? How about 20-30%
or maybe 50%? It has been
NINE YEARS!
The old RFPs were
based on a monthly minimum
for the busy five
months (December
through April), and/or
whatever was greater,
Is State Liquor Authority violating Colorado Liquor Law?
From Page 3
The busts often can
have negative affects on
the towns in Eagle
County and the county
government. For example,
if a business is
ordered not to sell alcohol,
the local governments
can lose sales tax
revenue on the sale of
drinks.
Customers won’t necessarily
know that they
cannot order liquor with
their meal until after they
have arrived at a restaurant
that is under an order
not to sell alcohol.
The state rarely busts
establishments for
serving other minors,
except minors who work
for the state!
There never seems to
be a bust for the sale of
alcohol to minors for anyone
but the state’s setup
person. That is, the state
never seems to catch anyone
who doesn’t work for
the state. This indicates
that the system is working
fairly well, if the state
is unable to find minors
purchasing alcohol,
except those that work for
the state.
Is the state violating
Colorado liquor laws?
Sign posted in bars and
restaurants! Is the state in
violation by buying?
How can the state
itself not be guilty of aiding
and abetting the sale
of alcohol to a minor
when they encourage a
minor to use sneaky tactics
to encourage the sale
of alcoholic beverages to
that minor?
There are 58 pages of
liquor laws. The publisher
did a cursory
review, but could not
find where it is legal for
enforcement agents to
violate the very law that
bars and restaurants
have to follow.
That doesn’t mean
that law doesn’t exist. It
only means the publisher
couldn’t find it.
Bartenders have been
charged for pouring a
drink and then asking
for ID prior to serving!
“How fair is that?”
asked one bartender who
was told they were in
violation of liquor law,
even though they had not
yet given the drink to the
state’s entrapment person.
How do other countries
enforce liquor laws?
The publisher was
advised that in one country,
they simply throw the
underage person out of
the bar and send them on
their way.
Is it time to
change our liquor laws?
Enriching the state by
using sneaky tactics to
entrap unsuspecting
owners and employees
seems to violate the “I’m
from the government and
I am here to help” edict.
Is it time for the legislature
to review archaic
laws, or to at least require
the enforcement agencies
to stop entrapment?
Letters - Greedy and maybe ill-advised EC Airport?
From Page 9
against a per-trip charge of
$4 for a sedan, $6 for an
SUV, or $10-14 for a van.
Currently, and for the
past nine years, these
inside transportation
booths were run by
Colorado Mountain
Express (CME) and High
Mountain Taxi (HMT).
Please note that I
understand having a booth
for CME, since they are
both a shuttle and a limo
service, but I have never
understood a taxi booth
inside the Airport. In fact,
I have never seen one
before inside an airport.
For example, when I
travel to Boston, DC, LA,
Florida or Las Vegas, I
always just walk outside to
a taxi queue.
The blue box shows
Year CME HMT
2010 $180,173.95 $47,747.74
2011 $186,908.46 $51,200.20
2012 $192,451.50 $52,632.68
2013
thru
Aug $166,549.09 $43,697.57
2014
only $350-$400K? $125-$150K?
the revenue numbers just
released by the Eagle
County Air Terminal
Corporation (ECAT) for
the past three years for
these two companies,
under the current RFP.
The 2014-only numbers,
under our analysis,
in the bottom of the blue
box shows, under the
NEW 10% Revenue
Proposed RFP by the
ECAT, vastly increased
fees that these two companies
be asked to pay per
year.
This represents a possible
increase of $250K
per year to the Eagle
County Airport.
These increases are
outrageous!
In the past, HMT paid
$6 per trip, now assuming
an average trip ticket of
$130. This would be $13, or
an increase of $7 per trip,
or an increase from 4.6% to
10% per trip.
In the past, CME paid
$10 per trip, now assuming
an average trip ticket of
$300, this would be $30, or
an increase of $20 per trip,
or an increase from 3.3% to
10% per trip.
Sounds great, right?
Well, what if CME
decides that a minimum
additional $150K per year,
or $350-$400K per year, is
JUST TOO MUCH, and
they don’t bid at all?
Instead, they choose to
have 5 to 10 GREETERS
with clipboards, and call
the Eagle County Airport’s
bluff?
Can the Eagle County
Airport afford to LOSE
$180-$190K in revenue, on
a gamble to make $150K
more?
What I want to know is
why the Eagle County
Airport wants to take this
gamble, and why they
want to risk alienating
CME?
I suggest the airport
look at other potential
sources of revenue like:
1. Offering the third
booth that has been
vacant?
2. Fixing the current
Automatic Vehicle
Identification System
(AVI), a read system that I
believe is missing at least
25% to 75% of VALID
READS.
We believe these two
sources could easily generate
an additional $100K
plus per year, and still
allow a vendor like CME,
the ability to provide outstanding
customer service
to our valued guests at the
Eagle County Airport.
Advertorial for
Attorney Erik Johnson
The effects of the recent
economic downturn are continuing
to devastate individuals
and families. Many people
are suffering from job
losses, business failures or
unplanned medical costs.
Hardworking and honest
citizens are unable to find a
bank willing to lend money
or modify a loan.
Mounting financial pressure
causes extreme anxiety
and ruins relationships.
Money problems often
lead to divorce.
Get a fresh start
Filing for bankruptcy can
be life-changing. It is an
opportunity to “hit the reset
button” and rebuild your
credit anew.
Once a bankruptcy is
filed, all collection efforts
by creditors stop.
All eligible debts are forgiven.
You have a chance to
breathe and regroup.
Should you
consider filing?
Many people facing
tough financial times are
unsure about whether they
should file bankruptcy.
A few reasons to consider
filing for a “Chapter 7”
bankruptcy include:
• emotional freedom from
the stress of trying to make
ends meet
• regaining the ability to
focus on earning a living,
free of harassment by creditors
• a chance to learn how to
correctly manage money so
mistakes aren’t repeated
• an opportunity to clean up
one’s credit report and
rebuild a reputation with
lenders.
Bankruptcy Myths vs. Facts
Many myths prevent
people from filing for bankruptcy
and making a sensible
financial decision. Some of
the common ones are:
Myth: Filing bankruptcy
reflects personal failure
Fact: Most people who file
didn’t do anything risky or
reckless that led to their
financial crisis. People file
because life has dealt them a
Attorney Erik Johnson
blow - like divorce, a job loss,
identity theft or a serious illness
which wreaked havoc
on their finances. Most people
file after months or years
of struggling to pay their
bills and falling further
behind.
Myth: I will lose my home or
car.
Fact: In most cases you will
not lose your home or car.
Exemptions in the law are
available that allow you to
keep certain assets after
bankruptcy.
Myth: I will lose my retirement
savings.
Fact: Retirement funds in
pension plans and IRAs are
protected. You are unlikely to
lose your retirement savings.
Myth: I will never be able to
rebuild my credit.
Fact: You can rebuild your
credit after filing for bankruptcy.
As long as your bills
are paid on time, your credit
score will rise, and you will
consequently be able to qualify
and obtain new credit.
Gradually, your credit will be
re-established.
Myth: Creditors can still
harass and sue me if I file for
bankruptcy.
Fact: Creditors are prohibited
from collection activities
such as filing lawsuits, making
phone calls, or sending
letters, if you file for bankruptcy.
Myth: Bankruptcy is wrong.
Fact: Bankruptcy laws reflect
the well-established principle
that society is better off if
individuals have the opportunity
to obtain relief from
their debts and start again.
Filing for bankruptcy is
purely a business decision
and not a moral one. It is
often the only recourse for an
individual who is a victim of
predatory lending, demeaning
collection practices, or
unanticipated illness or
injury.
How can I help?
Most of the people I see
are good, honest folks who
have come upon hard times
and have no other options.
They have exhausted
their alternatives.
For individuals awash in
overwhelming debt with little
or no prospect of paying it
back, filing for bankruptcy
can offer a fresh start and a
new chapter.
Bankruptcy is not always
the answer, but for some it
may be the only answer.
If you think bankruptcy
may be an appropriate next
step for you, I can help you
decide. My role is to guide
you through the legal
process in an efficient, ethical
and cost-effective manner.
