March 7th issue, Business
Briefs wrote, “The publisher
thought that 7 executive
committee members would
be elected by the heads of the
Precinct Committee. Wrong!”
What should have been
written is “The publisher
thought that 7 executive
committee positions would
be elected by the executive
committee, not the Precinct
chairmen.”
The correction doesn’t
affect the gist of the story
which is that the 4 moderates
on the local executive committee
stupidly expelled 3
precinct committee people,
instead of just censuring

Eagle County - In the last issue of
Business Briefs, dated March 7th, we
took on the leaders of the local
Republican Party.
In this issue, we
take on the leaders of
the local Democrat
Party.
And, boy do they
deserve it.
In a March 22nd
story in an obscure
online only website,
former Vail Trail editor
David O.
Williams suckered in
and wrote a story
about something he
knew nothing about - a
town hall meeting between Eagle
County’s new Democrat State
Representative Diane Mitsch Bush
from Steamboat, and a variety of
Eagle County residents at the Avon
Town Library.
Mitsch Bush, a nice woman and
supposedly a former Constitutional
Professor at Colorado State
University, allowed a decent discussion
on a variety of issues, including
the latest ridiculous gun control bills
that she helped introduce at the state
legislature.
Matt Solomon, a paramedic, a
deputy coroner and the owner of the
Alpine Arms gun shop in Eagle, confronted
Busch tactfully, trying to
explain why Busch was so wrong to
support such draconian measures,
which unquestionably infringed on

and treasonous!
But, she did it
anyway!
our Second Amendment rights.
After the meeting, Solomon put
out a newsletter identifying why
Bush was wrong, and shortly thereafter,

Democratic Party put
out there newsletter
which was factually
inaccurate.
Williams, who was
one of the last managing
editors of the
Trail amidst it’s
demise, was always
well-known for rarely
attending meetings
that he occasionally
wrote about.
Ye Olde Business
Briefs publisher
remembers telling him,
“Of course you wouldn’t know
about that, David, because you
rarely attend meetings!”
But, even after an email warning
by Solomon advising Williams to
not write an incorrect story, Williams
did so anyway. Business Briefs is
shocked!
So, what did the local
Democrat newsletter get wrong?
“Although the discussion at the
Town Hall was polite and respectful,
one participant followed the meeting
by printing untrue statements
attributed to Representative Mitsch
Bush in the newsletter Alpine Arms

Diana Donovan
Recently, former Vail
councilwoman Diana
Donovan wrote an opinion
piece for the Vail Daily titled
“Too much planned for Ford
Park.”
I don’t recall Donovan,
who is well-known for trying
to block most of the improvements
to the old buildings in
Vail, ever complaining about
the construction of the
Donovan Park Pavilion on
the open space known as
Donovan Park.
It seems very hypocritical
to complain about improving
Ford Park for the people who
actually use it, yet allow for
an improvement at Donovan
Park with her name on the
building.
Rewriting
Vail history!
“To the victors go the
spoils,” as the saying goes.
We got a kick out of a comment
by former Vail Mayor
Dick Cleveland, who stated
that Ye Olde Publisher was “a
thorn in each of our sides,”
referring to a panel of four
former Mayors of Vail and
current Mayor Andy Daly.
The publisher responded,
“That’s the nicest thing
you’ve ever said about me,
Dick!”
Actually, Ye Old
Publisher is not aware of
being a thorn to current
Mayor Daly yet, but who
knows, there is still time.
We do take issue with
Mayor Daly’s projection into
Vail’s future, calling a possible
tunnel over Interstate 70
from East Vail to West Vail
“The Jim Lamont Memorial
Tunnel.”
Why should Jim Lamont
get the credit, we ask?
Ye Olde Publisher
brought up the subject in
1988, and was laughed at,
before Lamont ever did, suggesting
that a huge greenbelt
be laid above the highway,
with the exorbitant cost of the
tunnel to be born by two new
resort hotels, one in East Vail
and one in West Vail.
Why not call it the “Ye
Olde Publisher” tunnel?
Actually, to get the facts
correct, some college kid in
Boulder actually launched
the idea before Ye Olde
Publisher did. But, he left out
the financing portion (leave it
to the conservative publisher
to find a way to build it without
the sucker taxpayers getting
hung with it)!
More Rewriting
Vail history!
The Vail Mayor’s panel
incorrectly credited former
Mayor Peggy Osterfoss with
preventing traffic lights from
being built at the entrance of
Vail.
Actually, some credit
goes to former
Councilwoman Donovan,
who fought the lights for several
months.
However, the former
council held a secret meeting
on a snowy Saturday morning
at the old Kiandra Lodge
(now the Sonnenalp) with no
one from the public attending
(as they desired) to slam the
traffic light decision through,
trying to run government in a
vacuum as they were often
accused of.
The council was going to
pass the light issue 7-0, when
Charlie Wick, the former
Assistant Town Manager, told
the council that Donovan had
called and asked if was worth
her time to come over to convince
the council not to pass
the stoplights.
Council was polled and
told Wick to tell Donovan to
“stay home!”
Donovan did stay home
and gave up.
But, Ye Olde Publisher
did not give up. First, former
Councilwoman Gail Wahrlich
Lowenthal changed her
mind, saying she doesn’t
often agree with (then Ye
Young non-publisher), then
she helped change the next
councilman’s mind, until
finally they had enough votes
to STOP THE STOPLIGHTS!
Ye Olde Publisher took
some credit for stopping this
but Donovan got angry about
it. Oh well!
Sheriff Joe Hoy versus
Vail Police Chief
Dwight Henninger
The publisher recently
told Sheriff Hoy that his position
on defending the 2nd
Amendment was deeply
appreciated. Of course, as
expected, Chief Henninger
helped trash it and violated
his oath of office. Pathetic!

In the March 27th Vail
Daily, Henry Bornstein
“cried me a river” by whining
about how his supposed
awful critics supposedly can’t
take him on directly.
Bornstein seems to
believe, in our opinion, that
we shouldn’t have armed
guards defend our teachers
and children in the schools.
Then, he “Booringly”
tells us he was an A student,
or words to that effect, and a
great lawyer in his day.
Amazingly, a few paragraphs
later, after alleging
that his critics can’t take him
on directly, he does the very
thing he complained about by
claiming that Karl Lundgren,
Dick Gustafson and Ye Olde
Publisher know nothing
about the U. S. Constitution,
without citing any specificity.
Of course, OLD HENRY
fails to back that up “directly,”
making Henry a hypocrite!
His “legal brief” diatribes
are laughable.
Keep writing, Henry.

kitchen, storage and bathrooms,

stage for dances and concerts.

floor has plenty of room

EC School District
wins Shack lawsuit!
Staff Report
Eagle - Mary Shack’s passionate
attempt to get the
Eagle County School District
to pay for outside services for
her child ended in failure
March 26th, when
Administrative Law Judge
Laura Broniak ruled that
Shack’s child had received a
Free Appropriate Public
Education (FAPE) and that
the school district and
Mountain Board of
Cooperative Educational
Services (BOCES) had not
violated it’s Child Find obligations.
BOCES is the
Administrative Unit that the
district works with to provide
services such as speech
and language therapy for
children.
Ms. Shack believed that
the district’s form for
requesting an evaluation of
her child should have started
the clock ticking o a 60 day
requirement to provide specific
services to her child, but
this form allegedly titled
“Evaluation” wasn’t the correct
form she supposedly
needed to apply with, rather,
it was just a screening form,

request for services, but
board President Jeanne
McQueeney admitted to the
Business Briefs publisher
that they did not respond to
Ms. Shack because they were
only copied in the emails,
and that by policy, only she
could respond on their
behalf, and she chose not to.
Superintendent Sandra
Smyser also chose not to
respond to Ms. Shack.
Judge Broniak ruled that
neither BOCES nor the school
district “committed any violation”
whether “procedural
or substantive” that “denied
a Free Appropriate Public
Education, and that Ms.
Shack had failed to meet her
burden of proof.
Ms. Shack may appeal
the decision, but didn’t return
calls to Business Briefs.

Don’t let this happen to 1200 Deer and Elk
on the Scudder/Webster Ranch near Lake Creek!
This super-imposed picture of elk crossing

on open-space land purchased with
your tax dollars! Don’t let this happen!
The Open Space Advisory Committee (OSAC) is trying to buy the 740 acre
Scudder/Webster property near Homestead in Edwards, with your tax dollars. This
property has access off of Lake Creek Road.
According to Toby Sprunk, the Director of OSAC for Eagle County, his expectation
is to bring in “tens of thousands” of visitors to Eagle County. This may be
acceptable in some areas, but not in the Homestead and Lake Creek neighborhoods.
How many of those “tens of thousands” do you
want cruising around on ATVs and snowmobiles?
If you are told that the 740 acres will not be motorized, BE SUSPICIOUS!
A representative of the Eagle Valley Land Trust (EVLT) told representatives of
Homestead and other Homestead property owners that if Homestead did not put a
portion of their common area open space in an undevelopable conservation easement
(with ZERO COMPENSATION for doing so), then Eagle County could allow
up to 160 more homes to be developed in the middle of Homestead on the “L” property
that Eagle County bought with “general funds,” instead of “open space funds.”
In my opinion, this threat of over-development, in the middle of Homestead,
constituted EXTORTION against the homeowners of Homestead, who were forced
to give away VALUABLE common area property rights for ZERO DOLLARS!
This threat, in my opinion, is why I call the Eagle Valley Land Trust -
“Eagle Valley Land THEFT!”
