Staff Report Eagle - Mary Shack’s passionate attempt to get the Eagle County School District to pay for outside services for her child ended in failure March 26th, when Administrative Law Judge Laura Broniak ruled that Shack’s child had received a Free Appropriate Public Education (FAPE) and that the school district and Mountain Board of Cooperative Educational Services (BOCES) had not violated it’s Child Find obligations. BOCES is the Administrative Unit that the district works with to provide services such as speech and language therapy for children. Ms. Shack believed that the district’s form for requesting an evaluation of her child should have started the clock ticking o a 60 day requirement to provide specific services to her child, but this form allegedly titled “Evaluation” wasn’t the correct form she supposedly needed to apply with, rather, it was just a screening form, Playa Palms Beach Hotel Downtown Playa del Carmen, Mexico Rooms as low as $105.00 per night! “It’s convenient, picturesque & right on the beach!” Simone Fodde even though it allegedly said “Evaluation.” Ms. Shack had based her complaint on 60 days from signing that form, not a different form that her husband, Patrick Shack, later signed that was also allegedly called an “Evaluation” form. Ms. Shack had copied certain members of the school board about her request for services, but board President Jeanne McQueeney admitted to the Business Briefs publisher that they did not respond to Ms. Shack because they were only copied in the emails, and that by policy, only she could respond on their behalf, and she chose not to. Superintendent Sandra Smyser also chose not to respond to Ms. Shack. Judge Broniak ruled that neither BOCES nor the school district “committed any violation” whether “procedural or substantive” that “denied a Free Appropriate Public Education, and that Ms. Shack had failed to meet her burden of proof. Ms. Shack may appeal the decision, but didn’t return calls to Business Briefs. “Hearing the ocean at night is the best!
