1. INTRODUCTION<br />

The <strong>Guidelines</strong> are intended for shipowners/oper<strong>at</strong>ors, Masters, Company<br />

<strong>Security</strong> Officers, Ship <strong>Security</strong> Officers, Recognized <strong>Security</strong> Organiz<strong>at</strong>ions,<br />

General Safety Inspectors, the staff <strong>at</strong> <strong>IMMARBE</strong> including its Design<strong>at</strong>ed Offices<br />

and other interested parties. These <strong>Guidelines</strong> are also to be found on<br />

<strong>IMMARBE</strong>’s website www.immarbe.com.<br />

1.1 Background<br />

In response to the terrorist <strong>at</strong>tacks of 11 th September 2001 and the perceived<br />

risks to ships and the danger of ships being used for terrorist purposes, the<br />

Intern<strong>at</strong>ional <strong>Maritime</strong> Organiz<strong>at</strong>ion (IMO) began extensive work towards<br />

modifying the Convention for the Safety of Life <strong>at</strong> Sea (SOLAS) 1974 (as<br />

amended) and cre<strong>at</strong>ing the new Intern<strong>at</strong>ional Ship and Port Facility <strong>Security</strong><br />

(ISPS) Code.<br />

An IMO diplom<strong>at</strong>ic conference convened in December 2002 adopted a<br />

series of amendments to SOLAS which include a new Chapter XI-2 solely<br />

addressing ship security. A two part Intern<strong>at</strong>ional Ship and Port Facility<br />

<strong>Security</strong> (ISPS) Code was also adopted, Part A of which is mand<strong>at</strong>ory and<br />

Part B of which provides guidelines regarding the provisions of Chapter XI-<br />

2 of SOLAS 1974, as amended, and Part A of the Code. The Code will come<br />

into force on 1 st July 2004.<br />

1.2 Registr<strong>at</strong>ion of Merchant <strong>Ships</strong> (Ship <strong>Security</strong>) Regul<strong>at</strong>ions 2004, S.I. No.<br />

90 of 2004<br />

On 30 th April 2004, the Minister responsible for the Intern<strong>at</strong>ional Merchant<br />

Marine Registry of Belize (<strong>IMMARBE</strong>) passed the above mentioned<br />

Regul<strong>at</strong>ions giving legal effect in Belize to the ISPS Code insofar as these<br />

rel<strong>at</strong>e to ship security. This St<strong>at</strong>utory Instrument (S.I.) has identified<br />

<strong>IMMARBE</strong> as the Administr<strong>at</strong>ion and outlines the l<strong>at</strong>ter’s responsibilities in<br />

rel<strong>at</strong>ion to ship security measures for all Belize registered vessels to which the<br />

ISPS Code applies. <strong>IMMARBE</strong> has issued the <strong>Maritime</strong> <strong>Security</strong> <strong>Guidelines</strong><br />

contained herein in order to assist all concerned in the better understanding<br />

of the way in which the security measures are being administered and<br />

enforced in Belize. These <strong>Guidelines</strong> are by no means comprehensive and<br />

should be read in conjunction with SOLAS Chapter XI-2, the ISPS Code as<br />

well as the Registr<strong>at</strong>ion of Merchant <strong>Ships</strong> (Ship <strong>Security</strong>) Regul<strong>at</strong>ions 2004.<br />

1.3 Applic<strong>at</strong>ion<br />

1.3.1 The ISPS Code and Regul<strong>at</strong>ions apply to the following types of ships<br />

engaged on intern<strong>at</strong>ional voyages:<br />

passenger ships including high-speed passenger craft, cargo ships,<br />

including high speed craft, of 500 GT or more, and to mobile offshore<br />

drilling units. They do not apply to warships, naval auxiliaries or<br />

other ships owned or oper<strong>at</strong>ed by a Contracting Government and used<br />

only on non-commercial Government service.<br />

1.3.2 All ships referred to in 1.3.1 above will be required by 1 st July 2004 (or<br />

other d<strong>at</strong>es as mentioned in the individual provisions) to conform to<br />

the ISPS Code and Regul<strong>at</strong>ions in SOLAS Chapter XI-2 which require<br />

ship modific<strong>at</strong>ions, establish additional equipment, documentary,<br />

inform<strong>at</strong>ion and oper<strong>at</strong>ional requirements. Owners/oper<strong>at</strong>ors are<br />

requested to ensure th<strong>at</strong> their vessels have onboard copies of Chapter<br />

XI-2 of SOLAS, the ISPS Code as well the <strong>Guidelines</strong> contained herein.<br />

1.3.3 SOLAS Chapter XI-2 Regul<strong>at</strong>ion 11 – Altern<strong>at</strong>ive security agreements<br />

– allows Contracting Governments to enter into bil<strong>at</strong>eral or<br />

multil<strong>at</strong>eral agreements with other Contracting Governments on<br />

altern<strong>at</strong>ive security arrangements covering short intern<strong>at</strong>ional voyages<br />

on fixed routes between port facilities loc<strong>at</strong>ed within their territories.<br />

Such agreements must be reviewed periodically and must not<br />

compromise the level of security of other ships or port facilities not<br />

covered by the agreement. No ship covered by such an agreement<br />

can conduct any ship-to-ship activities with a ship not covered by<br />

the agreement.<br />

Owners of Belize registered vessels engaged on regular, short<br />

intern<strong>at</strong>ional voyages e.g. ferry oper<strong>at</strong>ors, who seek to introduce<br />

altern<strong>at</strong>ive security measures should apply to <strong>IMMARBE</strong> as well as<br />

to the governments of the ports which they serve.<br />

1.3.4 SOLAS Chapter XI-2 Regul<strong>at</strong>ion 12 – Equivalent security<br />

arrangements - permits a flag st<strong>at</strong>e to allow a particular ship or group<br />

of ships flying its flag to implement other security measures equivalent<br />

to those required by the SOLAS Chapter XI-2 Regul<strong>at</strong>ions and the ISPS<br />

Code, provided th<strong>at</strong> such measures are <strong>at</strong> least as effective as those<br />

prescribed. In the event th<strong>at</strong> <strong>IMMARBE</strong> allows such security<br />

measures, it is obliged to inform the IMO.<br />

Shipping companies who wish to take advantage of this provision<br />

should consult <strong>IMMARBE</strong> regarding such equivalent security<br />

arrangements.<br />

1.3.5 It should be noted th<strong>at</strong>, although SOLAS 1974 (as amended), the ISPS<br />

Code and Regul<strong>at</strong>ions issued thereunder apply to the ships referred to<br />

in Section 1.3.1 above, the U.S.A.’s <strong>Maritime</strong> Transport<strong>at</strong>ion <strong>Security</strong><br />

Act 2003 (MTSA) additionally requires th<strong>at</strong>:<br />

• for the purposes of establishing the applicability of the ISPS Code,<br />

the ITC and not the Interim Scheme shall be taken into<br />

consider<strong>at</strong>ion<br />

• vessels gre<strong>at</strong>er than 100 GT but less than 500 GT should comply<br />

with the MTSA requirements failing which they will be denied<br />

entry into U.S. w<strong>at</strong>ers after 1 st July 2004.<br />

Owners/oper<strong>at</strong>ors of vessels gre<strong>at</strong>er than 100 GT but less than 500 GT<br />

(ITC) trading with the United St<strong>at</strong>es (USA) are required to submit their<br />

Ship <strong>Security</strong> Plans to the U.S. Coast Guard for approval. <strong>Security</strong><br />

Plans are to be mailed to:<br />

Due to the large number of Ship <strong>Security</strong> Plans under review by the<br />

U.S. Coast Guard, Owners/oper<strong>at</strong>ors should submit their plans<br />

immedi<strong>at</strong>ely so as to allow adequ<strong>at</strong>e time for review and approval<br />

prior to 1 st July 2004. As we have already notified all parties<br />

concerned, Owners/oper<strong>at</strong>ors of such ships are required to inform<br />

our Administr<strong>at</strong>ion whether or not they will be calling <strong>at</strong> U.S. ports<br />

and to confirm th<strong>at</strong> they have submitted and received approval of<br />

their <strong>Security</strong> Plans from the U.S. Coast Guard.<br />

2. DEFINITIONS<br />

2.1 Administr<strong>at</strong>ion: The Intern<strong>at</strong>ional Merchant Marine Registry of Belize –<br />

<strong>IMMARBE</strong><br />

2.2 Company: The owner of the ship, or the organiz<strong>at</strong>ion or person such as the<br />

Manager or the Barebo<strong>at</strong> Charterer, assuming the responsibility for oper<strong>at</strong>ion<br />

of the ship from the ship owner, and when assuming such responsibility has<br />

agreed in writing in accordance with ISM Declar<strong>at</strong>ions with the<br />

Administr<strong>at</strong>ion to take over all the duties and responsibilities imposed by the<br />

ISM Code.<br />

2.3 Recognized <strong>Security</strong> Organiz<strong>at</strong>ion (RSO): A <strong>Security</strong> Organiz<strong>at</strong>ion with<br />

appropri<strong>at</strong>e expertise in security m<strong>at</strong>ters and with appropri<strong>at</strong>e knowledge of<br />

ship and port oper<strong>at</strong>ions authorized by the Administr<strong>at</strong>ion in rel<strong>at</strong>ion to ISPS<br />

Certific<strong>at</strong>ion as shown in Section 5 below.<br />

2.4 Port Facility <strong>Security</strong> Officer (PFSO): The person design<strong>at</strong>ed as<br />

responsible for the development, implement<strong>at</strong>ion, revision and maintenance<br />

of the port facility security plan and for liaison with the Ship <strong>Security</strong> Officer<br />

and the Company <strong>Security</strong> Officer.<br />

2.5 Company <strong>Security</strong> Officer (CSO): The person design<strong>at</strong>ed by the<br />

Company for ensuring th<strong>at</strong> a Ship <strong>Security</strong> Assessment is carried out; th<strong>at</strong> the<br />

ship security plan is developed, submitted for approval and thereafter<br />

implemented and maintained and for liaison with the port facility security<br />

officer, ship security officer and the Administr<strong>at</strong>ion.<br />

2.6 Ship <strong>Security</strong> Officer (SSO): A senior officer on board the ship, who if<br />

not the Master, is accountable to the Master and design<strong>at</strong>ed by the Company<br />

as responsible for the security of the ship, including implement<strong>at</strong>ion and<br />

maintenance of the ship security plan and for liaison with the Company<br />

<strong>Security</strong> Officer, Port Facility <strong>Security</strong> Officer and the Administr<strong>at</strong>ion.<br />

3. LINKAGES FOR MARITIME SECURITY IN BELIZE<br />

These are to be found in Attachment 1 which shows all Linkages for <strong>Maritime</strong><br />

<strong>Security</strong> in Belize. Briefly:<br />

3.1 The N<strong>at</strong>ional <strong>Security</strong> Council (NSC) is the council which focuses on issues<br />

with wide implic<strong>at</strong>ions affecting the n<strong>at</strong>ional security and economic wellbeing<br />

of Belize.<br />

The Director-General of <strong>IMMARBE</strong> – the Administr<strong>at</strong>ion (ships) – as well as<br />

the Ports Commissioner of the Belize Port Authority (BPA) – Design<strong>at</strong>ed<br />

Authority (port facilities) will <strong>at</strong>tend meetings of this body whenever a topic<br />

involving <strong>Maritime</strong> <strong>Security</strong> will be addressed. The NSC’s Coordin<strong>at</strong>or is<br />

the single n<strong>at</strong>ional contact point to interface with the IMO for maritime<br />

security m<strong>at</strong>ters.<br />

3.2 The N<strong>at</strong>ional Emergency Management Office (NEMO) deals with n<strong>at</strong>ional<br />

emergencies, n<strong>at</strong>ural disaster management e.g. in rel<strong>at</strong>ion to hurricanes etc.<br />

within Belize. They will be kept informed by the NSC and the BPA of any<br />

maritime security incidents which may necessit<strong>at</strong>e their involvement.<br />

3.3 The Ministry of Finance and Home Affairs<br />

The Minister responsible for <strong>IMMARBE</strong> (the Administr<strong>at</strong>ion) is also the<br />

Minister of Finance and Home Affairs. The Registrar of Merchant <strong>Ships</strong> is<br />

also the Legal Counsel for the Ministry of Finance and Home Affairs and the<br />

Director-General of the Intern<strong>at</strong>ional Financial Services Commission. Both<br />

the aforementioned will be kept informed by the NSC’s Coordin<strong>at</strong>or and the<br />

Director-General of <strong>IMMARBE</strong> of any m<strong>at</strong>ters affecting maritime security in<br />

rel<strong>at</strong>ion to ships registered in Belize.<br />

3.4 The Intern<strong>at</strong>ional Merchant Marine Registry of Belize (<strong>IMMARBE</strong>)<br />

This is the Administr<strong>at</strong>ion responsible for all ships registered in Belize. As<br />

can be seen from Attachment 1, it has direct links to the Ministry of Finance<br />

and Home Affairs, the Registrar of Merchant <strong>Ships</strong>, the NSC, NEMO, the<br />

Recognized <strong>Security</strong> Organiz<strong>at</strong>ions (RSOs), Company <strong>Security</strong> Officers<br />

(CSOs), Ship <strong>Security</strong> Officers (SSOs) as well as the Interpol office in<br />

Belmopan (the capital of Belize). Both <strong>IMMARBE</strong> and the Belize Port<br />

Authority (BPA) liaise with each other on all m<strong>at</strong>ters rel<strong>at</strong>ing to maritime<br />

security which may affect the other.<br />

<strong>IMMARBE</strong> has its own <strong>Security</strong> Committee which consists of the following<br />

members: The Director-General, the Head of the Technical Department, the<br />

<strong>Security</strong> Co-ordin<strong>at</strong>or. Others may be co-opted to this Committee as deemed<br />

necessary. This Committee deals with all m<strong>at</strong>ters rel<strong>at</strong>ing to maritime<br />

security for ships registered in Belize. It is convened by the Director-General.<br />

3.5 The Belize Port Authority (BPA)<br />

The BPA is the Design<strong>at</strong>ed Authority in Belize for port facilities in Belize. It<br />

comes under the responsibility of the Ministry of Health and<br />

Communic<strong>at</strong>ions, its Minister and its CEO. It has its own Port <strong>Security</strong><br />

Regul<strong>at</strong>ions as well as its own <strong>Guidelines</strong>.<br />

4. THE ADMINISTRATION – <strong>IMMARBE</strong><br />

Chapter XI-2 of SOLAS and the ISPS Code place various responsibilities on the<br />

Administr<strong>at</strong>ion which, amongst others include:<br />

4.1 Approving the Ship <strong>Security</strong> Plan (SSP) and relevant amendments to a<br />

previously approved Plan.<br />

4.2 Verifying the compliance of ships with the provisions of Chapter XI-2 and the<br />

ISPS Code.<br />

4.3 Issuing the Intern<strong>at</strong>ional Ship <strong>Security</strong> Certific<strong>at</strong>e (ISSC) to ships under the<br />

Belize flag.<br />

4.4 Exercising control and compliance measures.<br />

4.5 The Setting of <strong>Security</strong> Levels for ships under the Belize flag.<br />

4.6 Communic<strong>at</strong>ion of the inform<strong>at</strong>ion required by Regul<strong>at</strong>ion 13 of Chapter XI-2<br />

of SOLAS, not l<strong>at</strong>er than 1 st July 2004, to the IMO and to the shipping and<br />

port industries as any changes thereto.<br />

4.7 Testing of Ship <strong>Security</strong> Plans.<br />

4.8 Declar<strong>at</strong>ion of <strong>Security</strong>.<br />

4.9 Contact Points within the Administr<strong>at</strong>ion to whom a Ship <strong>Security</strong> Officer, a<br />

Company <strong>Security</strong> Officer or a Port Facility <strong>Security</strong> Officer can report<br />

security concerns affecting a Belize registered vessel.<br />

4.10 Thre<strong>at</strong>s to ships and Other Incidents <strong>at</strong> Sea.<br />

4.11 Manning levels, taking into account any additional workload resulting from<br />

the implement<strong>at</strong>ion of the Ship <strong>Security</strong> Plan.<br />

4.12 Issuance of Continuous Synopsis Records.<br />

5. ISPS CERTIFICATION<br />

<strong>IMMARBE</strong> has deleg<strong>at</strong>ed its responsibilities in rel<strong>at</strong>ion to the approval of Ship<br />

<strong>Security</strong> Plans, verific<strong>at</strong>ion of the compliance of ships with the provisions of<br />

Chapter XI-2 and the ISPS Code as well as the issuance of ISSCs and Interim<br />

ISSCs to the Recognized <strong>Security</strong> Organiz<strong>at</strong>ions listed in Attachment 2 Page 5 for<br />

Ship <strong>Security</strong> under paragraph 2. This list may be amended from time to time.<br />

<strong>IMMARBE</strong> will receive from the RSOs copies of Verific<strong>at</strong>ion Reports and all<br />

ISSCs immedi<strong>at</strong>ely upon issuance of same.<br />

6. CONTROL AND COMPLIANCE MEASURES<br />

When a Contracting Government imposes control measures on a Belize registered<br />

vessel, whether in a port or intending to enter a port, it should contact <strong>IMMARBE</strong><br />

without delay in order to enable <strong>IMMARBE</strong> to fully liaise with them.<br />

7. SECURITY LEVELS<br />

7.1 <strong>Security</strong> Levels<br />

Part A of the ISPS Code defines three <strong>Security</strong> Levels for intern<strong>at</strong>ional use.<br />

These are:<br />

<strong>Security</strong> Level 1 -<br />

<strong>Security</strong> Level 2 -<br />

<strong>Security</strong> Level 3 -<br />

normal, the level <strong>at</strong> which ships and port facilities<br />

normally oper<strong>at</strong>e.<br />

heightened, the level applying for as long as there<br />

is a heightened risk of a security incident.<br />

exceptional, the level applying for the period of<br />

time when there is the probable or imminent risk<br />

of a security incident.<br />

7.2 Setting of <strong>Security</strong> Levels<br />

A ship is required to act upon the security levels set by Contracting<br />

Governments. <strong>IMMARBE</strong> will set security levels and provide security level<br />

inform<strong>at</strong>ion and any changes thereto to ships flying the Belize flag. Masters<br />

of all ships are required to acknowledge receipt of <strong>IMMARBE</strong>’s<br />

instructions to change to <strong>Security</strong> Level 2 or 3. If such instructions are<br />

issued whilst a ship is in port or intends to enter a port of a Contracting<br />

Government, the ship must advise, without delay, the relevant Contracting<br />

Government and the Port Facility <strong>Security</strong> Officer of the situ<strong>at</strong>ion.<br />

However, prior to entering a port or whilst in a port within the territory of a<br />

Contracting Government, a Belize registered ship may be required by the<br />

Contracting Government to set a higher security level than th<strong>at</strong> set by<br />

<strong>IMMARBE</strong>. If a ship is <strong>at</strong> a security level which is different to th<strong>at</strong> of the<br />

Port or Coastal St<strong>at</strong>e’s w<strong>at</strong>ers in which it sails, then the ship will set the<br />

higher security level when so advised.<br />

<strong>IMMARBE</strong> will consider the following when setting the appropri<strong>at</strong>e security<br />

level:<br />

• the degree th<strong>at</strong> the thre<strong>at</strong> inform<strong>at</strong>ion is credible<br />

• the degree th<strong>at</strong> the thre<strong>at</strong> inform<strong>at</strong>ion is corrobor<strong>at</strong>ed<br />

• the degree th<strong>at</strong> the thre<strong>at</strong> inform<strong>at</strong>ion is specific or imminent<br />

• the potential consequences of such a security incident<br />

• the relevance of the inform<strong>at</strong>ion to the ship’s oper<strong>at</strong>ing area<br />

7.3 Communic<strong>at</strong>ion of <strong>Security</strong> Levels<br />

<strong>IMMARBE</strong> will maintain an up-to-d<strong>at</strong>e d<strong>at</strong>abase with all the current contact<br />

details for Companies and ships. Any changes thereto must be notified to<br />

<strong>IMMARBE</strong> immedi<strong>at</strong>ely by the Owner/oper<strong>at</strong>or. Normally, the setting of<br />

security levels will be communic<strong>at</strong>ed by <strong>IMMARBE</strong> by email to the Company<br />

<strong>Security</strong> Officer(s) (CSO) and to the Ship <strong>Security</strong> Officer (s) (SSO) unless<br />

<strong>IMMARBE</strong> is notified otherwise in advance.<br />

7.4 <strong>Guidelines</strong> rel<strong>at</strong>ing to each <strong>Security</strong> Level<br />

The measures which might be taken <strong>at</strong> each of the <strong>Security</strong> Levels outlined by<br />

the ISPS Code are contained in Attachment 3. These guidelines are the same<br />

as those issued by the Intern<strong>at</strong>ional Chamber of Shipping.<br />

8. SHIP SECURITY ALERT SYSTEM (SSAS)<br />

Those ships which are required to be fitted with a ship security alert system on 1 st<br />

July 2004 or not l<strong>at</strong>er than the first survey of the radio install<strong>at</strong>ion thereafter and<br />

those not l<strong>at</strong>er than by the first survey of the radio install<strong>at</strong>ion after 1 st July 2006 in<br />

compliance with SOLAS Chapter XI-2 Regul<strong>at</strong>ion 6 are required to ensure th<strong>at</strong> it<br />

transmits the alert to the Company. Upon receipt of an alert, the Company<br />

through the Company <strong>Security</strong> Officer (CSO) must notify <strong>IMMARBE</strong>. Such<br />

notific<strong>at</strong>ion will include the name and the loc<strong>at</strong>ion of the ship whose SSAS has been<br />

activ<strong>at</strong>ed in order to enable <strong>IMMARBE</strong> to immedi<strong>at</strong>ely notify the St<strong>at</strong>e(s) in the<br />

vicinity of which the ship is presently oper<strong>at</strong>ing. The communic<strong>at</strong>ion between the<br />

Company and <strong>IMMARBE</strong> will be maintained until it is verified th<strong>at</strong> the situ<strong>at</strong>ion has<br />

returned to normal.<br />

The Company must notify <strong>IMMARBE</strong> of the type of security alert system th<strong>at</strong> will be<br />

used on a ship in order to comply with Regul<strong>at</strong>ion 6.<br />

9. THE COMMUNICATION OF THE INFORMATION FOR MARITIME<br />

SECURITY RELATING TO THE ADMINISTRATION FOR BELIZE<br />

REGISTERED VESSELS<br />

9.1 The communic<strong>at</strong>ion of the inform<strong>at</strong>ion rel<strong>at</strong>ing to the Administr<strong>at</strong>ion<br />

required by SOLAS Chapter XI-2 Regul<strong>at</strong>ion 13 which has been<br />

communic<strong>at</strong>ed to the IMO and is posted on <strong>IMMARBE</strong>’s website is contained<br />

in Attachment 2.<br />

9.2 The Contact Points within <strong>IMMARBE</strong> to whom a Ship <strong>Security</strong> Officer (SSO),<br />

or a Company <strong>Security</strong> Officer (CSO), or a Port Facility <strong>Security</strong> Officer<br />

(PFSO) can report security concerns affecting a Belize registered vessel are<br />

contained in Attachment 2 Pages 3 & 4 under paragraphs 1.4 and 1.5.<br />

10. TESTING OF SECURITY PLANS<br />

<strong>IMMARBE</strong> may, to the extent considered appropri<strong>at</strong>e, test the effectiveness of the<br />

Ship <strong>Security</strong> Plans, or of amendments to such Plans, which have been approved by<br />

RSOs on their behalf. In such an event, <strong>IMMARBE</strong> will inform the CSO of the<br />

selected ship of their intention in order to co-ordin<strong>at</strong>e the testing.<br />

11. DECLARATION OF SECURITY (DoS)<br />

11.1 The main purpose of a Declar<strong>at</strong>ion of <strong>Security</strong> (DoS) is to ensure th<strong>at</strong><br />

agreement is reached between the ship and the port facility (or between<br />

ships) as to the respective security measures each will undertake in<br />

accordance with the provisions of their respective approved <strong>Security</strong> Plans.<br />

11.2 The DoS can be completed when the Master or SSO deem it necessary or<br />

when the Contracting Government of the port facility require same.<br />

<strong>IMMARBE</strong> may also request the completion of a DoS in which case the SSO<br />

or PFSO should acknowledge receipt of the request and discuss appropri<strong>at</strong>e<br />

security measures.<br />

11.3 It is likely th<strong>at</strong> a DoS will be requested in any of the following circumstances:<br />

• <strong>at</strong> higher security levels<br />

• when a ship has a higher security level than a port facility, or another<br />

ship which it interfaces<br />

• for ship/port interface or ship-to-ship activities th<strong>at</strong> pose a higher risk<br />

to persons, property or the environment for reasons specific to th<strong>at</strong><br />

ship, including its cargo or passengers or circumstances of the port<br />

facility.<br />

12. THREATS TO SHIPS AND OTHER INCIDENTS AT SEA<br />

Our <strong>Guidelines</strong> as to the consider<strong>at</strong>ions and measures which might be taken in<br />

rel<strong>at</strong>ion to the abovementioned topic are contained in Attachment 4.<br />

13. MASTER’S RESPONSIBILITY<br />

It should be borne in mind <strong>at</strong> all times th<strong>at</strong> the Master of a ship has the ultim<strong>at</strong>e<br />

responsibility for the safety and security of the ship. Nothing in these <strong>Guidelines</strong> or<br />

the SSP is intended to constrain the Master to take or execute any decision which, in<br />

his professional judgement is necessary to maintain the safety and security of the<br />

ship. Therefore, if in the professional judgement of the Master, a conflict between<br />

any safety and security requirements applicable to the ship arises, the Master should<br />

give precedence to measures intended to maintain the safety of the ship and take<br />

such temporary security measures as he deems best after consider<strong>at</strong>ion of all the<br />

relevant circumstances.<br />

14. MANNING LEVELS<br />

The Company should take into consider<strong>at</strong>ion any additional workload which may<br />

result from the implement<strong>at</strong>ion of the Ship <strong>Security</strong> Plan (SSP) in order to ensure<br />

th<strong>at</strong> the ship is sufficiently and effectively manned and th<strong>at</strong> the additional workload<br />

gener<strong>at</strong>ed by compliance with the Code is comp<strong>at</strong>ible with the intern<strong>at</strong>ional work<br />

hour regul<strong>at</strong>ions. The Company should consider the use of suitable contracted<br />

personnel for short periods of time to supplement the ship’s security force in order<br />

to provide adequ<strong>at</strong>e protection in certain circumstances.<br />

15. ISSUANCE OF CONTINUOUS SYNOPSIS RECORDS (CSRs)<br />

15.1 <strong>IMMARBE</strong> will issue CSRs upon applic<strong>at</strong>ion by the owner/oper<strong>at</strong>or. These<br />

will be couriered directly to the l<strong>at</strong>ter who shall be responsible for<br />

reimbursement of the courier charges to <strong>IMMARBE</strong> by paying these to the<br />

relevant Deputy Registrar/Agent of the ship for onward transmission to<br />

<strong>IMMARBE</strong>.<br />

15.2 The CSR will be issued in the English language and must be available for<br />

inspection onboard <strong>at</strong> all times.<br />

15.3 In the event of any changes, the Company or the Master of the ship is<br />

authorized to amend the CSR on the form provided to reflect the changes.<br />

However, <strong>IMMARBE</strong> must be informed of such changes immedi<strong>at</strong>ely.<br />

15.4 Upon receipt of notific<strong>at</strong>ion of any changes, <strong>IMMARBE</strong> will issue a revised,<br />

upd<strong>at</strong>ed CSR within three months.<br />

15.5 If a ship is transferred to another flag, the Company is required to notify<br />

<strong>IMMARBE</strong> immedi<strong>at</strong>ely so as to enable <strong>IMMARBE</strong> to forward a copy of the<br />

CSR to the new flag St<strong>at</strong>e covering the period during which the ship was<br />

under the Belize flag.<br />

16. SECURITY RECORDS<br />

With regard to the guidance required to be given by the Administr<strong>at</strong>ion in<br />

accordance with Part A Section 10 of the ISPS Code, <strong>IMMARBE</strong> has decided th<strong>at</strong><br />

<strong>Security</strong> Records should be kept for a minimum period of 5 years.<br />

17. ENFORCEMENT<br />

17.1 In accordance with the provisions of the Registr<strong>at</strong>ion of Merchant <strong>Ships</strong> (Ship<br />

<strong>Security</strong>) Regul<strong>at</strong>ions, 2004:<br />

• Both the Company and the Master will be guilty of an offence if a ship<br />

which is required to comply with the Regul<strong>at</strong>ion of SOLAS Chapter XI-<br />

2 and the ISPS Code proceeds or <strong>at</strong>tempts to proceed to sea on or after<br />

1 st July 2004 unless there is in force a valid ISSC or Interim ISSC.<br />

• Any contravention or breach of these Regul<strong>at</strong>ions will be subject to the<br />

provisions of the Registr<strong>at</strong>ion of Merchant <strong>Ships</strong> (Disciplinary)<br />

Regul<strong>at</strong>ions, 1999 S.I. 56/99. These provide, amongst other m<strong>at</strong>ters,<br />

for the imposition of written warnings, penalties, fines, cancell<strong>at</strong>ion of<br />

registr<strong>at</strong>ion documents and suspension or revoc<strong>at</strong>ion of authority.<br />

17.2 In our Circular Warning on ISPS Code Compliance d<strong>at</strong>ed 5 th April 2004 as<br />

well as in earlier circulars issued in 2003, we drew <strong>at</strong>tention to the serious<br />

consequences of non-compliance with the ISPS Code by 1 st July 2004:<br />

• Vessels will be detained by Port St<strong>at</strong>e Control authorities and may be<br />

denied entrance to/departure from ports and subjected to in-depth<br />

inspections, quite apart from the disciplinary actions against vessels<br />

and companies which <strong>IMMARBE</strong> will be forced to take in such cases.<br />

• By way of reinforcement, our Administr<strong>at</strong>ion will issue Prohibition<br />

from Sailing Notices to all vessels which have not complied as <strong>at</strong> 1 st<br />

July 2004 and will publish such inform<strong>at</strong>ion to the Port St<strong>at</strong>e Control<br />

Authorities.<br />

GUIDELINES REGARDING THREATS TO SHIPS<br />

AND OTHER INCIDENTS AT SEA<br />

Our <strong>Guidelines</strong> as to the consider<strong>at</strong>ions and measures which might be taken in<br />

rel<strong>at</strong>ion to thre<strong>at</strong>s to ships and other incidents <strong>at</strong> sea are as follows:<br />

1. Our advice concerning actions which might be taken <strong>at</strong> each of the<br />

security levels 1 to 3 are contained in Section 7of the <strong>Guidelines</strong> and<br />

Attachment 3 thereof.<br />

2. General<br />

At sea, ships are most vulnerable to <strong>at</strong>tack while sailing near land and<br />

passing through narrow channels where maneuverability is limited.<br />

Pir<strong>at</strong>es might steal any valuable item on a ship or even the ship itself.<br />

Carrying large sums of money on board should be avoided if possible. If<br />

pir<strong>at</strong>es learn about such funds, it may invite an <strong>at</strong>tack.<br />

Pir<strong>at</strong>es have been known to monitor communic<strong>at</strong>ions. Therefore,<br />

discussions regarding inform<strong>at</strong>ion about a ship’s cargo or valuables<br />

should be avoided. Crewmembers going shore should also be advised not<br />

to discuss details about a Ship’s cargo or itinerary.<br />

Smaller ships and ships with fewer crewmembers are more vulnerable to<br />

<strong>at</strong>tack. To compens<strong>at</strong>e, owners/oper<strong>at</strong>ors may wish to consider<br />

implementing additional security measures and/or installing appropri<strong>at</strong>e<br />

surveillance and detection equipment, such as closed circuit surveillance<br />

systems, which may be monitored from a central loc<strong>at</strong>ion.<br />

Early detection provides an opportunity to sound alarms, implement<br />

security procedures, contact authorities for assistance, illumin<strong>at</strong>e a suspect<br />

craft, and take evasive maneuvers. Maintaining vigilance and enhancing<br />

security measures and procedures are the best deterrents to avoid an<br />

<strong>at</strong>tack. In case of an imminent <strong>at</strong>tack, the Master/SSO should contact<br />

the CSO and he in turn must notify our Administr<strong>at</strong>ion immedi<strong>at</strong>ely.<br />

Pir<strong>at</strong>es may feign distress as a trick to get close to a ship. As a<br />

consequence, any ship – including junks, fishing bo<strong>at</strong>s, pleasure bo<strong>at</strong>s,<br />

and dhows – should be considered as a potential thre<strong>at</strong>.<br />

If a Master determines it is necessary to invite people onboard, only one<br />

person should be transferred <strong>at</strong> a time. The individual should be carefully<br />

searched. <strong>Security</strong> should be <strong>at</strong> a high level of alert with lookouts<br />

maintained on all sides of the ship.<br />

The following are additional security guidelines for consider<strong>at</strong>ion:<br />

• Brief crewmembers on the risks of being <strong>at</strong>tacked by pir<strong>at</strong>es or<br />

armed bandits.<br />

• Secure the bridge, engine room, steering gear compartments,<br />

officers’ cabins, and crew accommod<strong>at</strong>ions.<br />

• Carefully plan any response to an apparent <strong>at</strong>tack and ensure the<br />

crew is appropri<strong>at</strong>ely trained.<br />

• If possible, avoid high-risk areas and bottlenecks.<br />

• Consider delaying the ship’s arrival if there is a high thre<strong>at</strong> from<br />

piracy <strong>at</strong> a port and if a berth is not immedi<strong>at</strong>ely available so as to<br />

minimize the ship’s vulnerability whilst awaiting its turn to berth.<br />

3. <strong>Security</strong> Measures <strong>at</strong> Sea<br />

When approaching or sailing through high-risk areas:<br />

• Augment bridge w<strong>at</strong>ches and lookouts.<br />

• Establish additional w<strong>at</strong>ches on the stern and where there are<br />

visual and radar “blind spots”.<br />

• Equip w<strong>at</strong>ches with low-light binoculars and/or night-vision<br />

goggles.<br />

• When monitoring nearby ships, give additional <strong>at</strong>tention to small<br />

craft m<strong>at</strong>ching the speed of the ship or traveling parallel to the ship.<br />

• Ensure someone responsible for communic<strong>at</strong>ions remains on duty.<br />

• Maintain radio communic<strong>at</strong>ions with appropri<strong>at</strong>e shore and naval<br />

authorities.<br />

If a suspicious ship <strong>at</strong> sea approaches in a thre<strong>at</strong>ening manner:<br />

• Increase speed and alter course if safe to do so.<br />

• Not to allow the ship to come alongside; do not respond to<br />

messages by radio, light, or hailing.<br />

• Note details of the thre<strong>at</strong>ening ship and video or photograph the<br />

ship if possible.<br />

• At night, switch off the we<strong>at</strong>her deck lighting; direct searchlights <strong>at</strong><br />

the approaching ship.<br />

• Keep personnel clear of the we<strong>at</strong>her deck.<br />

4. In the event the ship is seized by pir<strong>at</strong>es etc.<br />

• Remain calm and direct others to do the same; do not resist armed<br />

pir<strong>at</strong>es unless there is a clear life-thre<strong>at</strong>ening situ<strong>at</strong>ion.<br />

• Ensure the safety of the ship and personnel according to maritime<br />

practice.<br />

• Initi<strong>at</strong>e <strong>Security</strong> Alarm, if possible.<br />

• Broadcast a distress message, if possible.<br />

• Offer reasonable cooper<strong>at</strong>ion; try to establish a reasonable rapport.<br />

• Try to identify the number of <strong>at</strong>tackers.<br />

• Attempt to increase the number of egress points.<br />

• Attempt to determine the demands of the hijackers, as well as<br />

potential deadlines.<br />

• Use secure communic<strong>at</strong>ions if available for negoti<strong>at</strong>ors to talk with<br />

the hijackers.<br />

• The Master and crew should not <strong>at</strong>tempt to negoti<strong>at</strong>e with the<br />

hijackers unless directed by authorities.<br />

Following an <strong>at</strong>tack, you shall submit immedi<strong>at</strong>ely to the CSO and to<br />

<strong>IMMARBE</strong> a report which shall include inform<strong>at</strong>ion on the identity and<br />

loc<strong>at</strong>ion of the ship, any injuries or damage, a description of the <strong>at</strong>tackers<br />

and other m<strong>at</strong>erial inform<strong>at</strong>ion.<br />

5. Terrorism<br />

You should be aware th<strong>at</strong>:<br />

• <strong>Maritime</strong> Authorities are concerned th<strong>at</strong> a ship might be turned<br />

into a weapon not unlike the jetliners th<strong>at</strong> were crashed into the<br />

World Trade Centre in New York. A ship could also be used to<br />

smuggle a weapon of mass destruction to a port, which is then<br />

deton<strong>at</strong>ed.<br />

• A suspected member of the Al Quaeda terrorism network<br />

<strong>at</strong>tempted to enter Canada illegally using a container which had<br />

been modified with a bed, b<strong>at</strong>tery-powered he<strong>at</strong>er, toilet, and<br />

enough w<strong>at</strong>er for the three week voyage to Toronto.<br />

• Terrorists may <strong>at</strong>tempt to gain access to a ship by infiltr<strong>at</strong>ion or<br />

assault. In prepar<strong>at</strong>ion for an <strong>at</strong>tack involving the maritime<br />

industry, terrorists are likely to conduct surveillance of potential<br />

targets.<br />

Vigilance and adherence to the Ship <strong>Security</strong> Plan are of vital importance.<br />

6. If your ship is oper<strong>at</strong>ing in the territorial sea or has communic<strong>at</strong>ed an<br />

intention to enter the territorial sea of a Contracting Government where a<br />

thre<strong>at</strong> exists, you should receive advice from the relevant maritime<br />

authorities concerning special security measures.<br />

YOU ARE REMINDED THAT THE ABOVE ARE ONLY GUIDELINES AND<br />

ARE SUPPLEMENTAL TO THE REGULATIONS IN SOLAS CHAPTER XI-2,<br />

THE ISPS CODE, THE REGISTRATION OF MERCHANT SHIPS (SHIP<br />

SECURITY) REGULATIONS 2004 AS WELL AS TO THE PROVISIONS OF<br />

SECTION 13 OF THE GUIDELINES “MASTER’S RESPONSIBILITY.”<br />
