3. Emergency release of information pursuant to this authority does not constitute the<br />

declassification of the information released.<br />

4. Under these conditions, the disclosing official shall:<br />

Limit the amount of classified information disclosed; the information should be<br />

provided only to the individuals necessary to achieve the intended purpose<br />

Transmit the classified information via approved Federal Government channels<br />

by the most secure and expeditious method possible, or by other means deemed<br />

necessary when time is of the essence<br />

Provide instructions about what specific information is classified, the level of<br />

classification, and how it should be safeguarded<br />

­ Safeguarding measures should include a discussion on the appropriate<br />

methods, and the location of materials designated, for packing and wrapping<br />

classified information as noted in Chapter 6, Section 6-300<br />

Ensure physical custody of classified information remains with an authorized<br />

Federal Government representative in all but the most extraordinary and unique<br />

circumstances<br />

­ If a custodial change occurs, each change of custody shall be documented and<br />

receipted by utilizing a EPA Form 1550-5, Classified <strong>Information</strong> Chain of<br />

Custody Record a sample is provided in Appendix M<br />

Provide appropriate briefings to the recipients on their responsibilities not to<br />

disclose the information, and obtain a signed SF 312, Classified <strong>Information</strong><br />

Nondisclosure Agreement<br />

­ In emergency situations requiring immediate verbal release of information, the<br />

signed SF 312 documenting the briefing may be received after the emergency<br />

abates<br />

Notify the Director, SMD, and the originating agency (at the earliest opportunity<br />

permitting, but not more than seven days after the release) of the emergency<br />

release of classified information. This notification will include:<br />

­ A description of the disclosed classified information<br />

­ Name(s) and contact information of the individuals to which the information<br />

was disclosed<br />

­ How the information was disclosed<br />

­ Justification for the emergency release<br />

­ Location of the information and how the information is being safeguarded<br />

­ A description of the de-briefings provided to uncleared individuals<br />

­ A copy of the signed SF 312s<br />
