Republic of South Sudan
Early this year, RCN Justice & Démocratie (RCN J&D)
re-opened its programme in the Republic of South Sudan.
This enabled RCN J&D to continue developing the
operational and human resource capacity of the Ministry
of Justice. The project entitled ‘Support to the Southern
Sudanese Legal System by Enhancing the Capacity and
Skills of the Ministry of Justice’ is financed by the Belgium
Ministry of Foreign Affairs. The initial duration of
the project was of 10 months but it has recently been
extended by an additional 4 months, until the 31 st of
March 2012. The trainings are given in English (the official
language of Southern Sudan) to prosecutors and
legal administrative support staff.
About 35 prosecutors from 10 states will receive elementary
legal training in common law principles, Southern
Sudanese criminal law and procedure, civil law, evidence
and professional ethics. Furthermore, 25 support
staff members are presently receiving training in comprehensive
administrative, basic finance and office management.
The course is accompanied by training manuals,
handouts and English language dictionaries. The
trainings consist in lectures, personal study assignments,
group work, presentations, short essays, debates and
question and answer sessions. Trainees are especially
encouraged to use English to communicate their ideas
verbally and in writing.
A graduation ceremony for the 1 st batch of prosecutors
who participated in the training was held recently together
with the Ministry. Hosted by RCN J&D, the
graduation ceremony was attended by the Deputy Minister,
the Under-Secretary and the Director of Trainings
along with the rule of law actors present in South Sudan.
RCN J&D has selected potential trainers from the pool
of trainees to help establish in-house training capacity in
the Ministry in order to ensure that the Ministry can
plan, organise, manage and implement its own courses
using its own trainers.
Key legislation will be printed to provide copies for
each trainee, including (1) The Interpretation of Laws Act
2006 (2) The Penal Code Act 2008 (3) The Evidence Act
2006 (4) The Criminal Procedure Act 2008 (5) The Transitional
Constitution of the Republic of South Sudan, 2011.
RCN J&D aims to further support the Ministry of Justice
on a day-to-day basis by making basic operating equipment
available in order to strengthen the operational
capacity of their offices. RCN J&D is therefore presently
in discussion with the Ministry to identify and prioritise
their logistical needs.
The South Sudan project is financed by the Belgian Federal
public service for foreign affairs, foreign trade and
development cooperation.

Après avoir conduit des projets pendant une dizaine
d’années, le programme Belgique, après une interruption
de quelques mois, a repris le 1 er juillet 2011. Les activités
précédentes du Projet Nord sont toutes nées du
souhait d’inviter le public belge à construire une mémoire
des crises et des crimes de droit international par
le récit de personnes qui les ont vécues, les interrogent
et les bousculent. Un nouveau projet de sensibilisation
démarre, en poursuivant des activités similaires aux projets
précédents (diffusion de la première série radiophonique
notamment, sur les ondes et dans des lieux d’éducation
au développement) et en produisant une seconde
série radiophonique.
La nouvelle série radio cherche désormais à interroger
les actes criminels de génocide, crimes contre l’humanité
et de guerre à travers les portraits de leurs auteurs. Parallèlement,
RCN Justice & Démocratie continue à développer
son volet éducatif et préventif sur ces sujets par
des animations participatives dans les écoles du secondaire,
les diasporas, les groupes de recherche, les associations
et les universités (grâce aux outils pédagogiques
construits autour de la première série radio). Par
ailleurs, suite aux succès des traductions de la première
série en anglais, en kinyarwanda et en kirundi, nous mettons
désormais en œuvre sa traduction en néerlandais.
En tant que centre labellisé relatif à la transmission de
la mémoire, RCN J&D a vocation d’informer et de créer
des espaces de débats autour de notre responsabilité
individuelle et collective face à des situations de crise. Le
programme Belgique est fondé sur la conviction que la
justice est un art de la parole et que cet art s’enrichit
d’autres modes de représentation qui tous, interrogent
le mystère de l’humanité et les fondements du langage.
En Belgique, les projets de RCN J&D sont soutenus par la
Direction générale du développement belge (DGD) et
la Cellule démocratie ou barbarie de la Communauté
française.
