25. Gwnaethom ofyn i'r Gweinidog pam roedd y <strong>Bil</strong> yn cynnwys cynifer<br />

o bwerau i lunio is-ddeddfwriaeth. Dywedodd wrthym:<br />

“I believe that this <strong>Bil</strong>l puts a great deal more onto the f<strong>ac</strong>e of<br />

the legislation than the legislation that it updates and<br />

substitutes for. The C<strong>ar</strong>e Stand<strong>ar</strong>ds Act 2000 is the Act that,<br />

prim<strong>ar</strong>ily, we’ve relied on in these fields up until now … we<br />

have sought to put a great deal more, p<strong>ar</strong>ticul<strong>ar</strong>ly in relation to<br />

workforce regulation, on the f<strong>ac</strong>e of the <strong>Bil</strong>l than has been the<br />

case in statute up until now.” 14<br />

26. Nes ymlaen pan oedd yn ateb cwestiynau ynglŷn â <strong>Gofal</strong><br />

<strong>Cymdeithasol</strong> <strong>Cymru</strong> yn creu rheolau, meddai:<br />

“This is prim<strong>ar</strong>ily the p<strong>ar</strong>t of the <strong>Bil</strong>l where we have pl<strong>ac</strong>ed a<br />

great deal more on the f<strong>ac</strong>e of the <strong>Bil</strong>l than is in the Act of<br />

P<strong>ar</strong>liament that it supersedes. We have elevated into prim<strong>ar</strong>y<br />

legislation the fundamental principles and processes of<br />

workforce regulation.” 15<br />

27. Yn ogystal, dywedodd wrthym:<br />

“There <strong>ar</strong>e <strong>ar</strong>eas where we know the <strong>Bil</strong>l will need updating over<br />

time, where leaving those powers to regulations and so on,<br />

rather than having to return to the Assembly every time we<br />

have to do something of that order, is necess<strong>ar</strong>y. We think that<br />

the <strong>Bil</strong>l sets out a cle<strong>ar</strong> direction of travel, proper p<strong>ar</strong>ameters<br />

for the use of subordinate legislation … we think we’ve got the<br />

balance broadly right.” 16<br />

28. Gwnaethom hefyd ofyn pam nad oedd dyletswydd i ymgynghori<br />

yn ymddangos yn rheolaidd <strong>ar</strong> wyneb y <strong>Bil</strong>, yn enwedig pan oedd y<br />
