129. Mae Erthygl 6 o'r Confensiwn Ewropeaidd <strong>ar</strong> Hawliau Dynol yn<br />

nodi bod gan unigolyn yr hawl i dreial teg, er mwyn cynnal ei hawliau<br />

sifil.<br />

130. Gwnaethom drafod y pwynt hwn yng nghyd-destun y cwestiwn a<br />

ddylid defnyddio'r weithdrefn gad<strong>ar</strong>nhaol wrth lunio rheoliadau o dan<br />

adran 124(5), gan fod yr adran hon yn ymwneud â'r hawl i dreial teg<br />

dan y Confensiwn Ewropeaidd <strong>ar</strong> Hawliau Dynol, a chan y gallai gael ei<br />

glastwreiddio gan gyfansoddiad panel addasrwydd i ym<strong>ar</strong>fer.<br />

131. Dywedodd y Gweinidog:<br />

“the <strong>Bil</strong>l is c<strong>ar</strong>efully constructed to make sure that all necess<strong>ar</strong>y<br />

investigations and checks and balances <strong>ar</strong>e in pl<strong>ac</strong>e prior to any<br />

decision to go to a fitness-to-pr<strong>ac</strong>tise panel, and then the <strong>Bil</strong>l is<br />

cle<strong>ar</strong> that the composition of such a panel cannot draw on<br />

anyone who has been involved in the consideration of whether<br />

or not to bring such a panel together.” 65<br />

132. Ychwanegodd wedyn:<br />

Ein b<strong>ar</strong>n ni<br />

“the fitness-to-pr<strong>ac</strong>tise panel must be lay led, so its<br />

membership will be drawn from people outside the<br />

professional ambit itself. We think that those powers <strong>ar</strong>e more<br />

than sufficient to make sure that the human rights convention<br />

and the rights to a fair trial, and so on, <strong>ar</strong>e very, very properly<br />

protected. I don’t myself come to the conclusion that there is a<br />

need for the affirmative procedure to be applied to those,<br />

because I think those rights <strong>ar</strong>e very adequately protected in<br />

the way the legislation is drafted.” 66<br />

133. Rydym yn nodi sylwadau'r Gweinidog, ond credwn y byddai'r<br />

weithdrefn gad<strong>ar</strong>nhaol yn briodol.<br />

Argymhelliad 12: rydym yn <strong>ar</strong>gymell y dylai'r Gweinidog gyflwyno<br />

diwygiad i'r <strong>Bil</strong> er mwyn defnyddio gweithdrefn gad<strong>ar</strong>nhaol wrth<br />

lunio rheoliadau sy'n cael eu llunio o dan adran 124(5).<br />
