Arguments in favor of zero rating<br />

Some key assumptions in the arguments against zero rating are worth examining. At its<br />

heart, net neutrality implies a pure, ideal way in which a user connects, navigates and<br />

learns on the Internet, free from influence and intermediaries. However this notion of a<br />

neutral experience conflicts with the established theories of the sociology of knowledge 8<br />

which posit that knowledge is mediated by social constructs. Neutrality is impossible<br />

because the Internet, like any medium, is by definition mediated or conveyed by<br />

intermediaries. 9 Calling a longing for a “paradise lost” 10 of a golden age of Internet<br />

neutrality that never was, net neutrality advocate Alejandro Pisanty critiques the<br />

excessive idealism of the net neutrality movement in favor of practical measures. In any<br />

case, one shortcoming of net neutrality is that it overwhelming focuses on internet<br />

service providers (ISPs) but fails to recognize the influence and non-neutral practices of<br />

global platforms, which have significant market power, users bases in the hundreds of<br />

millions (if not billions), and far high profitability and market shares than ISPs.<br />

One proof point against neutrality is the popularity of walled gardens. Apple’s hardware<br />

and software designs are part of a tightly-controlled, vertically integrated, closed product<br />

ecosystem. Apple would not exist if there was the equivalent of network neutrality for<br />

computer hardware and software. Similarly “curated” Internet experiences are<br />

demanded by users, including The J Net for conservative Jews which blocks offending<br />

content; Islamic Mobile 11 which offers zero rated mobile access to the Koran and other<br />

religious content for Muslims; broadband packages bundled with software and support<br />

tailored for the elderly in Denmark; 12 zero rated mobile plans for the World Cup, 13 and<br />

mobile plans designed for grandmothers to message with the grandchildren via<br />

WhatsApp. 14<br />

The assertion that all plans must be “affordable full access” assumes that users value all<br />

data equally. But many would gladly substitute “low cost limited access” without feeling<br />

any twinge of discrimination; rather they feel it is their right. Consumers increasingly<br />

demand the ability to pick and choose among the cable channels and eschew paying for<br />

the full packages; they see no difference with internet access.<br />

For many users, selecting a provider purely on speed and price is not only difficult, it’s<br />

boring. It is preferable for some users to select a plan based upon brand identity, 15<br />

cross-marketing, cross-selling, a particular phone, features, benefits, or functionality<br />

they value. In this way, users are looking for operators who best cater to their needs, not<br />

necessarily the provider that provides the most data at the lowest price.<br />
