Several people suggested that they would like to have a time for seniors to get<br />
together in the clubhouse. We have cards and other games that we will set out<br />
if anyone is interested in getting a game going or you are welcome to bring your<br />
favorite. Those who have attended seem to enjoy just getting to know each other. If<br />
the group stays consistent, we have lots of ideas such as potluck luncheons.<br />

PLAYGROUPS<br />
<strong>Memorial</strong> <strong>Parkway</strong> moms have recently started a playgroup. Our<br />
goal is for our children to build friendships, for each other and to build<br />
friendships and build our sense of community in <strong>Memorial</strong> <strong>Parkway</strong>.<br />

PARKING VIOLATIONS AND STATE LAWS:<br />
DID YOU KNOW?<br />
IT IS A PARKING VIOLATION TO...<br />
BLOCKING SIDEWALKS:<br />
If a vehicle is parked blocking a sidewalk, it becomes very difficult<br />
for pedestrians, bicycles, children, strollers and wheelchairs to pass<br />
safely. Blocking the sidewalk can result in forcing these people to<br />
enter into the street causing unsafe conditions.<br />
BLOCKING DRIVEWAYS:<br />
When a vehicle is parked blocking a driveway, it creates an<br />
inconvenience for the homeowners attempting to leave or enter his/<br />
her driveway.<br />
48 HOUR PARKING:<br />
No vehicle can be parked on any residential street for more than 48<br />
consecutive hours.<br />
PARKING TOO CLOSE TO AN INTERSECTION OR CROSSWALK:<br />
Vehicles may not be parked within 30 feet of a stop sign or within 20<br />
feet of a crosswalk.<br />
BLOCKING A FIRE HYDRANT:<br />
This is one of the most common violations is when a vehicle is<br />
parked blocking a fire hydrant or fire lane. This can create problems<br />
for emergency vehicles and hinders their ability to do their job<br />
effectively. No vehicles may be parked within 15 feet of a fire hydrant.<br />
This information was provided by the Harris County Sheriff’s Office<br />
in order to familiarize you with a few common laws, which we should<br />
keep in mind when operating a motor vehicle. Your safety and the<br />
safety of others is very important to us. Remember to always buckle<br />
up.<br />
2016 MAINTENANCE FEES<br />
Statements for the 2016 maintenance fees were mailed to all<br />
homeowners during the first week of October 2015. If you do not<br />
receive this statement, please contact the office with your current<br />
mailing address. This fee was due on January 1, 2016.<br />
The Board of Directors is allowing 3 ways to pay your fees:<br />
1. Mail check or money order for the total amount due to the address<br />
shown on the statement. Make sure your payee address is correct.<br />
2. Pay online via credit card at mphoa.org and click on the pay online<br />
tab. Credit card payments may also be made in the office. There is<br />
a $10 convenience charge for all assessments paid via credit card.<br />
Payment plans are no longer offered. You may make payments, but<br />
all late fees and interest will be added to your account until there is a<br />
zero balance. If your account is not paid in full by April 1, 2016, we<br />
will either file a lawsuit against you in Small Claims Court or turn your<br />

account over to our attorney for legal pursuit in which all costs are<br />
the responsibility of the delinquent owner. In some cases, it may be<br />
necessary to take both actions. Any account not paid before January<br />
31, 2016, will incur a late fee of $25. Accounts not paid before<br />
February 29, 2016, will incur an additional late fee of $25. Accounts<br />
not paid before March 31, 2016, will incur an additional late fee of<br />
$50. All unpaid fees after January 31, 2016, carry a finance charge<br />
of 10% per annum. Accounts not paid by March 31, 2016, may be<br />
turned over for legal pursuit in which all costs are the responsibility<br />
of the delinquent owner. Legal fees can range from $150 to over<br />
$2,000.<br />

If you have a neighbor with a terrible backyard such as garbage<br />
dumping, unsanitary conditions, unsecured private swimming pools,<br />
etc., you can go to Harris County Public Health and Environmental<br />
Services’ Website to file a complaint, www.hcphes.org/eph/<br />
complaints.<br />
NEED CURB REPAIR??<br />
Do you have a broken curb in front of your home... Did you know that<br />
Harris County Precinct 3 will come and fix it? It is as easy as going<br />
to their website and filling out the service request form. They will<br />
come and fix it for free (well, that is your tax dollars at work)! They<br />
will not fix the curved part that attaches to your driveway, that is the<br />
homeowner’s responsibility. You can go to www.harriscountytx.gov/<br />
servicerequestform/default.aspx?pct3 and fill out the service request<br />
form if you have a broken curb that needs repaired.<br />

SIDEWALKS<br />
All sidewalks, within Common Areas, shall be maintained by the<br />
Association. All other sidewalks shall be maintained by the owner<br />
of the lot on which the sidewalk is situated. If any section of your<br />
sidewalk is uneven, which may cause someone to trip and hurt<br />
themselves, you are responsible for repairing or replacing that<br />
section of the sidewalk and liable for any injuries incurred. In some<br />
cases, a sunken section of a sidewalk may be caused by a water or<br />
sewer line leak. If you’re in doubt, you can call Precinct 3 at 281-463-<br />
6300 and request that someone come to your home and check it out.<br />
MPCA ID INFORMATION<br />
Every resident must have a MPCA I.D. CARD to use the pools,<br />
clubhouse and tennis courts. If you’re a new resident or have never<br />
had a card, complete the I.D. Registration form which can be found<br />
at mphoa.org under forms and documents and turn it into the office<br />
and wait at least 3 days before coming to get your picture taken for<br />
the ID card. We will begin taking pictures in April. If you already have<br />
a card and the information is current, all you have to do is turn the<br />
card in to the office for a 2016 sticker.<br />
The Cimarron Pool will be open weekends in May. The schedule will<br />
be posted at a later date on our webpage.<br />
VEHICLE PARKING ON THE STREET<br />
It is not a violation of our deed restrictions to park a vehicle on the<br />
street as long as it is not being stored, is fully operational and has<br />
current tags.<br />
However, the Transportation Code of Texas, Title 6, Chapter 545,<br />
Section 302, states that<br />
.a vehicle cannot park closer than 15 feet to a fire hydrant.<br />
.a vehicle cannot park closer than 20 feet to an intersection.<br />
.a vehicle cannot park closer than 30 feet to a stop sign.<br />
The Board has asked our Constables to take the appropriate action<br />
whenever there is a violation of the Transportation Code.<br />
The parking of vehicles on the street has become a big problem<br />
in our neighborhood. School buses can’t pull close to the curb to<br />
pick up and let off students. In some cases, emergency vehicles<br />
may not be able to reach their destination if traffic flow is inhibited,<br />
especially when two cars are parked directly across from each other.<br />
Plus, vehicles parked on the street are those that are vandalized the<br />
most.<br />
Some of the worst areas are the cul-de-sacs where it’s hard enough<br />
to back out of a driveway or navigate the circle even when there<br />
aren’t any vehicles parked on the street.<br />
Be considerate of your neighbors and don’t park your vehicle in<br />
front of their house or block their mailbox. Also, think of the neighbor<br />
across the street and park so that you’re not making it difficult for<br />
them to back out of their own driveway.<br />
All of our homes have at least a two or three-car garage and room for<br />
several cars in the driveway. We respectfully request that you refrain<br />
from parking on the street.<br />
STREET GUTTERS AND DRAINS<br />
We ask that you keep the street area in front of your home clean, so<br />
that leaves, pine needles, grass clippings and dirt won’t accumulate<br />
in the gutters next to the curb and end up being washed into the<br />
drains causing them to back up and flood the streets. If you see<br />
someone putting grass clippings, oil or other debris down the drains,<br />

please contact the MUD District and the County at 281-463-6300.<br />
This includes lawn contractors that are blowing the leaves into the<br />
street instead of bagging them.<br />
Some of our residents feel that this was a waste of our time and are<br />
upset that we had written to them stating that they were getting this<br />
waste from a neighbor up the street. On the other hand, most of our<br />
residents understood that backed-up drains would cause flooding<br />
on some of our streets and cleaned up their yards and streets<br />
regardless of where the debris came from. We ask that you do the<br />
same. THANK YOU!<br />
LAWN MAINTENANCE<br />
Many of you have received letters regarding the need to re-sod the<br />
bare spots in your yard. We suggest that you take care of this matter<br />
in the next month or two. If there are trees in the yard that may be<br />
preventing the lawn from getting ample sunlight, you may have to get<br />
them trimmed. You may also have to lay new dirt so that the seeds<br />
can take hold.<br />

We also encourage you to keep your lawn mown and edged one<br />
a weekly basis, if necessary to maintain a neat appearance at all<br />
times. Remember to remove the weeds growing between the seams<br />
of the concrete on the sidewalk and driveway.<br />
GARAGE SALES<br />
MPCA would like to suggest that garage sales be conducted the first<br />
Friday and Saturday of each month. This will eliminate the many<br />
signs that are out each week and also makes for a stronger turn<br />
out. Most area communities only allow sales twice a year. <strong>Memorial</strong><br />
<strong>Parkway</strong> could be known for its “Once a Month” garage sales. Do<br />
not attach your garage sale signs to the STOP signs, as it is against<br />
the law and the County can issue citations for this. If a sign is on a<br />
public right of way, like the esplanades), they may be subject to fines<br />
of $500-$1,000 per occurrence per day. We also ask that you do not<br />
post your signs on the property of another resident. When your sale<br />
is over, please go back and pick up all of your signs.<br />
MEMORIAL PARKWAY COMMUNITY<br />
ASSOCIATION RULES FOR USE -<br />
CIMARRON PARKWAY CLUBHOUSE<br />
1. General Information<br />
a. The clubhouse is a smoke free area, SMOKING IS PROHIBITED.<br />
b. The clubhouse is approximately, 34’X37’ or 1,258 square feet<br />
and accommodates a maximum of 50 people per Harris County Fire<br />
Code.<br />
c. Approximately 50 chairs, 8 (6’x3’) tables, 2 (8’x3’) tables and 6 (5’)<br />
round tables are available for use.<br />
d. There is a roll down projector screen and a mounted television<br />
for use.<br />
e. There is an attached kitchen with a sink, refrigerator, 2 ovens,<br />
microwave and dishwasher.<br />
f. There is a large ice machine available for ice during parties.<br />
g. The clubhouse facilities and parking lot are monitored by video<br />
surveillance.<br />
2. Homeowner Reservation<br />
a. Clubhouse rental is subject to availability on a first come/first<br />
serve basis.<br />
b. The clubhouse is only rented to <strong>Memorial</strong> <strong>Parkway</strong> adult residents<br />
(owner or renter) in good standing (maintenance fee current and not<br />
in violation of deed restrictions). Resident must show valid ID when<br />
renting facility and must be present during the entire time of rental.<br />
c. A rental fee of $50 is required at the time the reservation is made.<br />
Payments can only be accepted by check or money order, no cash.<br />
d. Rental of the Clubhouse requires refundable deposit of $275. The<br />
deposit must be a check issued from the personal account of the<br />
resident signing the agreement and accepting responsibility for the<br />
use of the facility. This amount will be refunded barring any damage<br />

to the facility caused by user and/or guest; as long as the facility is<br />
left in a clean and orderly condition; and the rental rules and/or rental<br />
agreement are not broken.<br />
e. Any rule broken will cause forfeiture of the entire deposit.<br />
f. Date and hours of reservation include set-up and cleanup. Resident<br />
may not enter before or stay beyond the reserved time. Entering<br />
before or staying after reserved time will result in an additional $100<br />
Use Fee charge to the homeowner.<br />
g. A ratio of two (2) members 21 years of age or older per fifteen (15)<br />
minors is required.<br />
h. MPCA reserves the right to cancel any scheduled rental should<br />
the need arise. At least a 24-hour notice will be given if at all possible.<br />
i. The Use Fee and Deposit will be returned if cancellation is made<br />
10 days prior to reservation date. The Use Fee will be forfeited if<br />
cancellation notice is less than 10 days in advance of reservation<br />
date.<br />
j. There will be $25 “returned check fee” on any check returned to<br />
MPCA for insufficient funds.<br />
k. The clubhouse is available to non-profit groups for meetings<br />
during the week (Monday - Thursday). A representative and renter<br />
for the group must be a resident of <strong>Memorial</strong> <strong>Parkway</strong>.<br />
l. Slumber parties may stay (with arrangements made through<br />
MPCA office) until 8:00 am the following morning.<br />
3. Hours of Rentals & Fee Rates<br />
a. Monday - Saturday - 8 am-4 pm….. $50<br />
b. Monday - Saturday - 5 pm-1 am….. $50<br />
c. Sunday - 8 am-1 pm….. $50<br />
d. Sunday - 1:30 pm-1 am….. $50<br />
e. All Day Rentals from 8 am-1 am….. $100<br />
4. Hours of Rentals & Fee Rates for Non Profit Group Meetings<br />
a. Monday - Thursdays for not more than 6 hours per month on a<br />
first come first serve basis.<br />
5. Keys<br />
a. The date and time to pick up the key from the office is noted on<br />
the Agreement Form. It is typically the day before the event or on<br />
Friday prior to the Saturday, Sunday Rentals. It is the responsibility<br />
of the renter to get the key as indicated. If other arrangements have<br />
to be made, the resident is responsible for using the facility will be<br />
charged a $25 cash fee upon delivery of keys. (NO EXCEPTIONS)<br />
b. After you are done with the facility you are to drop the keys in the<br />
drop slot of the MPCA Office door prior to leaving the complex.<br />
6. Behavior of Residents/Guest<br />
a. The Renter agrees that he or she will be present on the premises<br />
during the entire time of the rental.<br />
b. The Renter of the clubhouse assumes total responsibility for the<br />
safety and actions of their guests on all MPCA grounds and property<br />
during the time they are in use of the facility. Anyone who fails to abide<br />
by facility rules may be asked to leave the facility by the appropriate<br />
MPCA representative or authorized person. MPCA reserves the right<br />
to terminate any user’s occupancy at any time.<br />
c. The Renter accepts the clubhouse in its current condition unless<br />
otherwise expressly provided for in the Agreement.<br />
d. No merchandise is to be offered for sale on MPCA property.<br />
e. In the event that alcohol is consumed, the user agrees to indemnify<br />
and hold harmless MPCA in the event that damage or injury results<br />
from the consumption of alcohol by the use or users guests. No<br />
alcohol may be consumed by minors on MPCA grounds.<br />
f. Music or activities must not disturb other users or residents in the<br />
vicinity of the facilities.<br />
g. Fireworks are not allowed at any MPCA facility.<br />
h. No pool use allowed while renting/using the Clubhouse. No one is<br />
allowed in the Clubhouse in a wet bathing suit.<br />
i. No equipment or furnishings belonging to MPCA may be removed<br />
from the facilities.<br />
j. No one is to move the couches, console, plants, rugs, end tables,<br />

coffee tables, blinds and curtains. The only items that are allowed to<br />
be moved are stacking chairs and folding tables.<br />
k. The movable tables and chairs must be put into their original<br />
positions before leaving the premises. Extra chairs and tables<br />
stored in the storage room must also be put away before leaving the<br />
premises. Do not remove dollies.<br />
l. All bicycles, skateboards, motorcycles, rollerblades etc. are not<br />

items must be parked in the designated parking lot areas.<br />
m. No decorations (glitter, sequins, streamers and confetti) of any<br />
kind can be attached to the ceiling or walls, etc. Birdseed can be<br />
thrown outside. All excess must be swept away from all the walkways<br />
and parking lot. Peeled wall paint or wallpaper from tape used to<br />
hang decorations will be considered damaged.<br />

7. Cleaning of the Facilities<br />
a. A representative of MPCA will inspect the facility with you when<br />
you pick up the keys. It is the responsibility of the Renter of the<br />
clubhouse to inspect the facility per the check-list, both before and<br />
after use.<br />
b. If the facility is damaged, left in an unsecured condition, or not<br />
clean after use, the deposit will be forfeited or held to cover the cost<br />
necessary to repair or clean the facility back to its original condition.<br />
A minimum of $100 will be charged to the Renter/Homeowner to<br />
cover normal cleanup of the facility if not left clean. An additional<br />
charge of 15% of the total cost of cleaning or repairs will be assessed<br />
to cover the expenses of handling the damages.<br />
c. The Renter must clean entirely all the surfaces in the facility<br />
including the kitchen, the tables, chairs, etc. Sweep and mop the<br />
floors. Clean the bathrooms and flush the toilets. You are provided<br />
trashcans liners to replace the 4 trashcans when you leave. If you<br />
think you should need additional liners, bring some from home.<br />
d. All trash must be bagged and placed in dumpster located at the<br />
rear of the parking lot.<br />
e. Cleaning supplies are located in the kitchen sink cabinet. Mops<br />
and brooms are located in the outside hall on the other side of the ice<br />
machine. A vacuum cleaner is located in the storeroom.<br />
f. The clubhouse and the premises must be returned in the condition<br />
in which it received. You are responsible for checking the facility prior<br />
to usage to insure everything is in working order.<br />
g. The thermostat must be returned to 78 in the cooling season or<br />
65 in the heating season. You must turn off all appliances and lights<br />
before you leave the premises.<br />
h. Before you leave the MPCA Property, put keys and check-out<br />
sheet through the mail slot in the office door.<br />
i. MPCA is not responsible for items left by the clubhouse users or<br />
parties that they may have rented party supplies from.<br />
8. Security and Safety Measurers:<br />
a. MPCA reserves the right to require a security guard be present.<br />
When this is required, the user must present a paid receipt from the<br />
security company in no less than five (5) working days prior to the<br />
event.<br />
b. Office parking spaces are not to be used at any time by Renter<br />
or guest. MPCA reserves the right to tow away any vehicle in any of<br />
these spaces.<br />
c. Renter shall comply with all Municipal, County, State, Federal and<br />
Association ordinances, statues, laws rules and regulations.<br />
d. In consideration for the right to use the clubhouse the renter and<br />
his or her guest, hereby release and agree to indemnify, defend and<br />
hold harmless, <strong>Memorial</strong> <strong>Parkway</strong> Community Association and their<br />
respective affiliates, agents, directors, employees (collectively the<br />
“released parties”) from and against any and all claims, liabilities,<br />
demands, losses, injuries and damages arising out of incidental to<br />
or in any way resulting from the use of the clubhouse and whether or<br />
not caused by the negligence of the released parties. This agreement<br />
shall be governed and construed under the laws of the State of Texas.<br />

DEED RESTRICTIONS<br />
If you receive a courtesy notice from us regarding a violation of a<br />
deed restriction, contact the office within 10 days to let us know<br />
your intentions for resolving the matter, as we understand that some<br />
violations will require more than 10 days to get bids, find contractors<br />
and make financial arrangements. Please don’t wait until you get<br />
a second letter or a third letter, which incurs a $50 fine. We will be<br />
happy to give you ample time to cure the violation.<br />
<strong>Memorial</strong> <strong>Parkway</strong> Community Association has inspectors that<br />
drive through the neighborhood checking for violations of our deed<br />
restrictions. They are not permitted to get out of their cars and/or<br />
trespass on your property. They only take pictures of violations that<br />
can be seen from the street.<br />
If you see one of our inspectors stopped in front of your<br />
home, please do not approach their vehicle to confront them.<br />
Their vehicles are identified with a MPCA sign on the car door that<br />
says deed restriction inspector. Some of our inspectors have been<br />
threatened, verbally abused and some have been followed. If they<br />
see you approach their vehicle, they have every right to drive off<br />
without talking to you.<br />

If you get a notice of violation and you feel it was sent to you in<br />
error, please call the office. Our staff will look at the picture taken<br />
of the violation and confirm whether the address is correct or not.<br />
Our inspectors make every effort to make sure they’ve got the right<br />
violation logged to the right address with the right picture to go along<br />
with it. But with 2,219 homes to inspect and over 25 miles of streets,<br />
they sometimes get it wrong. If that’s the case, we apologize for the<br />
mistake and will remove the violation from your record.<br />

Control Committee Guidelines.” The inspectors, MPCA Board and<br />
office staff are not in the business of harassing our residents, but are<br />
only trying to enforce the documents that all homeowners agreed to<br />
abide by when they purchased property in <strong>Memorial</strong> <strong>Parkway</strong>.<br />
This past February, we had 2 independent contractors inspect every<br />
home in our neighbor to see if there were any violations of our deed<br />

restrictions that still need to be resolved. They took over 800 pictures<br />
of alleged violations. It took the office staff two weeks to get all of<br />
the letters sent to the homeowner and/or resident living in the home.<br />
Many of the violations were in regard to peeling paint, faded paint,<br />
dirt on the siding, mold/mildew on siding, trim and gutters, plus mold/<br />
mildew on the bricks. They observed fences that were falling down or<br />
missing boards. Another widespread violation in our neighborhood is<br />
the storage of miscellaneous items in public view, either on the porch,<br />
on the driveway, in the yard, next to the garage, etc. Of course, these<br />
are only a few of the violations that still need to be corrected.<br />
We are trying to keep our subdivision as attractive as possible and<br />
certainly do not intend to make any of our residents feel like they are<br />
being singled out.<br />

REMINDER FOR DOG WALKERS<br />
Be a responsible / considerate pet owner by picking up your dog’s<br />
waste from your neighbor’s yard when you’re out for a walk. There’s<br />
nothing more frustrating than stepping in fecal matter in your own<br />
yard when you don’t even have a pet.<br />
LEASH LAW<br />
Animals that are not properly restrained pose a threat to all our<br />
residents. While you may know your pet is friendly, an animal running<br />
at someone who is walking by is very scary for that person. Many<br />
children are afraid of animals and become frightened, which could<br />
result in the child getting hurt trying to avoid the animal.<br />
Harris County Animal Control advises, “All dogs and cats must be<br />
kept under restraint while in the unincorporated areas of Harris<br />
County, Texas. The custodian of a dog or cat is not authorized<br />
to have, harbor or keep any unlicensed dog or cat nor to allow<br />
any dog or cat to become a stray.”<br />
Restraint is defined as “the control of a dog or cat under the<br />
following circumstances:<br />
1. When it is controlled by a line or leash not more than six (6) feet in<br />
length, if the line or leash is held by a human being who is capable of<br />
controlling or governing the dog or cat in question.<br />
2. When it is within a fully enclosed vehicle.<br />
3. When it is on the premise of the custodian and the animal does not<br />
have access to sidewalk or street.<br />
While it may be nice to have your animal out in the yard while you<br />
work or play, it is against the law, unless the animal is properly<br />
restrained.<br />
Let’s all help keep our community a safe and comfortable place for<br />
all our residents by being responsible pet owners. This will not only<br />
protect anyone who may be walking or bicycling in the area, but also<br />
the pet owner who could be held legally responsible or possibly sued<br />
for failing to properly restrain their pet.<br />
Please remember that cats fall under the same laws as dogs and<br />
must be licensed and kept restrained when not on the premises of<br />
the owner. We’ve been told that spreading moth balls in flower beds<br />
might keep cats away.<br />

The ACC is receiving record numbers of requests to make<br />
improvements or changes to the exterior of homes. We thank you for<br />
your cooperation in filling out the forms before starting any work. If<br />
you are planning to do any repairs, re-roofing, re-painting, additions,<br />
pools, storage sheds, fencing or patio covers please turn in a request<br />
form for approval. Forms can be found in the newsletter or online at<br />
our website WWW.MPHOA.ORG. You may also pick up a form from<br />
the office during office hours.<br />
RESIDENT COMMENT FORM<br />
If you have noticed a problem in the subdivision you think needs<br />
taking care of, please complete the resident comment form and turn<br />
it in to the office. The subdivision gets a drive through inspection<br />
twice a month. Some problems may not be noticed at that time. It is<br />
helpful if residents can inform the office in writing of such problems.<br />
Having complaints in writing is helpful, if the association has to take<br />
legal steps in enforcing deed restriction violations. Our subdivision<br />
was formed 35 years ago and we need to take steps to keep it<br />
looking nice so the value of homes will continue to increase.<br />

The <strong>Memorial</strong> <strong>Parkway</strong> Clubhouse located at 21600 Cimarron is<br />
available to non-profit adult and youth groups for meetings. The<br />
meeting times and days for adult and youth groups are from:<br />

Color for a Cause is a fun 5k color run event hosted by James E.<br />
Taylor High School National Honor Society and Future Business<br />
Leaders of America benefiting The Arc of Katy, a local non-profit<br />
organization that works to create opportunities for individuals with<br />
intellectual and developmental disabilities. The run is open to<br />
participants of all ages, will not be timed; it’s all for fun. In addition to<br />

The Noyes Fine Arts Foundation (NFAF) is premiering the first annual<br />
Puttin’ On The Ritz Gala - a black tie spectacular event for Katy. The<br />
Noyes Fine Arts Foundation plans to build the first state-of-the-art,<br />
community oriented performance center in Katy, Texas, an initiative<br />
named The Katy Grand Theatre Project. The Katy Grand Theatre<br />
