It is of concern to me (whilst acknowledging the competing demands on the police at that<br />

time) that within months of the commencement of the murder investigation resources were<br />

scaled down due to other investigative commitments.<br />

Whilst it is important to note that the investigation, over time, took several courses, some<br />

with more substantive results than others, the conclusion is inevitable that failings,<br />

particularly in the critical early stages of the investigation, significantly undermined<br />

attempts to bring those responsible for the attack to justice.<br />

Throughout my investigation I have identified evidence of the destruction of important<br />

police documents such as records relating to the arms importation in late 1987/early 1988<br />

and case-specific material such as forensic exhibits seized as part of the pre-cursor<br />

incidents and the Loughinisland murders. In addition, an important evidential opportunity<br />

was lost by the handling of the car used in the killings.<br />

In 2011 my predecessor recommended that the PSNI undertake a review of the murder<br />

investigation. Police concluded this review in 2012 making numerous recommendations for<br />

further investigative steps, which have since been undertaken by a PSNI Major<br />

Investigation Team. Whilst I am satisfied that no enquiries, which might be regarded as<br />

being of a critical nature, remain outstanding, not all investigative actions arising from the<br />

review have been finalised. I understand that the PSNI now intend to re-allocate<br />

investigation of the Loughinisland murders to their Legacy Investigations Branch, thereby<br />

introducing uncertainty as to the timescales and manner in which the inquiry will be<br />

progressed. Such is the position of these and numerous other unresolved murders, which<br />

occurred during the ‘Troubles’, arising from the absence of an effective mechanism for<br />

dealing with the ‘Past’.<br />

Collusion<br />

The failures to bring the killers to justice cannot be explained solely by a failure or<br />

otherwise of investigative actions. It was a central complaint of the families that there was<br />

‘collusion’ between elements within the police and loyalist paramilitaries. It is clear that<br />

discussion around the issue of collusion in Northern Ireland is extremely controversial and<br />

politically sensitive.<br />
