missi<strong>on</strong> <strong>to</strong> <strong>Brazil</strong> from 7 <strong>to</strong> 17 March 2016. The main objective <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> visit was <strong>to</strong> identify<br />

and assess <str<strong>on</strong>g>the</str<strong>on</strong>g> main issues currently facing <strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> country and <strong>to</strong> follow<br />

up <strong>on</strong> key recommendati<strong>on</strong>s made in 2009 by <str<strong>on</strong>g>the</str<strong>on</strong>g> previous mandate holder.<br />

<strong>Brazil</strong> has a number <str<strong>on</strong>g>of</str<strong>on</strong>g> exemplary c<strong>on</strong>stituti<strong>on</strong>al provisi<strong>on</strong>s pertaining <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and was, in <str<strong>on</strong>g>the</str<strong>on</strong>g> past, a leader in <str<strong>on</strong>g>the</str<strong>on</strong>g> area <str<strong>on</strong>g>of</str<strong>on</strong>g> demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong>’ terri<strong>to</strong>ries. However, in <str<strong>on</strong>g>the</str<strong>on</strong>g> eight years since <str<strong>on</strong>g>the</str<strong>on</strong>g> visit <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> previous<br />

mandate holder, <str<strong>on</strong>g>the</str<strong>on</strong>g>re has been a disturbing absence <str<strong>on</strong>g>of</str<strong>on</strong>g> progress in <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

his recommendati<strong>on</strong>s and <str<strong>on</strong>g>the</str<strong>on</strong>g> resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>on</strong>g-standing issues <str<strong>on</strong>g>of</str<strong>on</strong>g> key c<strong>on</strong>cern <strong>to</strong><br />

<strong>indigenous</strong> <strong>peoples</strong>. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> noted a worrying regressi<strong>on</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>. In <str<strong>on</strong>g>the</str<strong>on</strong>g> current political c<strong>on</strong>text, <str<strong>on</strong>g>the</str<strong>on</strong>g> threats facing <strong>indigenous</strong><br />

<strong>peoples</strong> may be exacerbated and <str<strong>on</strong>g>the</str<strong>on</strong>g> l<strong>on</strong>g-standing protecti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir human <strong>rights</strong> may be<br />

The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>, Vic<strong>to</strong>ria Tauli-Corpuz,<br />

visited <strong>Brazil</strong> from 7 <strong>to</strong> 17 March 2016, at <str<strong>on</strong>g>the</str<strong>on</strong>g> invitati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government. The purpose <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> visit was <strong>to</strong> identify and assess <str<strong>on</strong>g>the</str<strong>on</strong>g> main issues currently facing <strong>indigenous</strong> <strong>peoples</strong> in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> country and <strong>to</strong> follow up <strong>on</strong> key recommendati<strong>on</strong>s made in 2009 by <str<strong>on</strong>g>the</str<strong>on</strong>g> previous<br />

mandate holder, following his visit <strong>to</strong> <strong>Brazil</strong>.<br />

2. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>’s visit was prompted by requests <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

<strong>peoples</strong> in <strong>Brazil</strong> and communicati<strong>on</strong>s sent by <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government<br />

between 2010 and 2015 regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> communities in Ma<strong>to</strong> Grosso do Sul and<br />

Raposa-Serra do Sol, <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te and <str<strong>on</strong>g>the</str<strong>on</strong>g> São Luiz do Tapajós hydroelectric projects,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ lands and attacks against and killings <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

pers<strong>on</strong>s defending <str<strong>on</strong>g>the</str<strong>on</strong>g>ir human <strong>rights</strong>.<br />

3. The visit coincided with <str<strong>on</strong>g>the</str<strong>on</strong>g> heightening <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> political crisis in <strong>Brazil</strong> that led <strong>to</strong><br />

c<strong>on</strong>siderable political upheaval, including <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>going process <strong>to</strong> impeach <str<strong>on</strong>g>the</str<strong>on</strong>g> President and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> formati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> an interim Government. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is closely m<strong>on</strong>i<strong>to</strong>ring <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

situati<strong>on</strong> and is in communicati<strong>on</strong> with <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong> about <strong>her</strong> c<strong>on</strong>cerns<br />

regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> implicati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se political developments and associated instituti<strong>on</strong>al,<br />

legislative or policy changes for <str<strong>on</strong>g>the</str<strong>on</strong>g> well-being and survival <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

enjoyment <str<strong>on</strong>g>of</str<strong>on</strong>g> land and cultural <strong>rights</strong>.<br />

In <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> evolving political situati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> report also includes observati<strong>on</strong>s<br />

<strong>on</strong> informati<strong>on</strong> received by <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> following <strong>her</strong> visit, which has direct<br />

bearing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> issues examined during <str<strong>on</strong>g>the</str<strong>on</strong>g> visit. The objective <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> report is <strong>to</strong> encourage<br />

an open and c<strong>on</strong>structive dialogue with <str<strong>on</strong>g>the</str<strong>on</strong>g> Government in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> realizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

II. Overview <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> missi<strong>on</strong><br />

During <strong>her</strong> visit <strong>to</strong> <strong>Brazil</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> travelled <strong>to</strong> Brasilia and <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

states <str<strong>on</strong>g>of</str<strong>on</strong>g> Ma<strong>to</strong> Grosso do Sul, Bahia and Pará. She met with representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> three<br />

branches <str<strong>on</strong>g>of</str<strong>on</strong>g> Government in Brasilia, including <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Indian Foundati<strong>on</strong> (FUNAI),<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Prosecu<strong>to</strong>r General, <str<strong>on</strong>g>of</str<strong>on</strong>g>fices <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r at <str<strong>on</strong>g>the</str<strong>on</strong>g> federal and state levels, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Peoples (CIMI) and <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Anthropological Associati<strong>on</strong> (ABA).<br />

7. The Specil <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> visited <str<strong>on</strong>g>the</str<strong>on</strong>g> Guarani-Kaiowá people in Kurussu Ambá,<br />

Guayviry and Taquara <strong>indigenous</strong> lands as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> Dourados reserve. She met with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Terena Council in Ma<strong>to</strong> Grosso do Sul; <str<strong>on</strong>g>the</str<strong>on</strong>g> Tupinambá in Serra do Padeiro and Atikum<br />

villages in Tupinambá de Olivença <strong>indigenous</strong> land. She also spoke <strong>to</strong> representatives <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Pataxó in Comexatiba <strong>indigenous</strong> land in Bahia. In Pará, she visited Juruna <strong>indigenous</strong><br />

land, a Muratu village, Volta Grande and met with representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Parakanã in<br />

Apyterewa <strong>indigenous</strong> land and <str<strong>on</strong>g>the</str<strong>on</strong>g> recently c<strong>on</strong>tacted Arara people in Cachoeira Seca<br />

<strong>indigenous</strong> land. She also met with representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Curuaia and Xipaya in Altamira.<br />

The situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós River basin was explained <strong>to</strong> <strong>her</strong> by<br />

members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Munduruku, Arara Vermelha, Apiaká, Arapiun, Borari and Tapuia <str<strong>on</strong>g>of</str<strong>on</strong>g> Pará.<br />

She met representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> more than 50 <strong>indigenous</strong> <strong>peoples</strong> from at least 13 states,<br />

including <str<strong>on</strong>g>the</str<strong>on</strong>g> Yanomami, Maxakali, Manoki, Kaingang and Ka’apor and <str<strong>on</strong>g>the</str<strong>on</strong>g> Amaz<strong>on</strong><br />

Cooperati<strong>on</strong> Network. She also met <strong>indigenous</strong> students at <str<strong>on</strong>g>the</str<strong>on</strong>g> University <str<strong>on</strong>g>of</str<strong>on</strong>g> Brasilia and a<br />

wide range <str<strong>on</strong>g>of</str<strong>on</strong>g> civil society and human <strong>rights</strong> organizati<strong>on</strong>s working in <str<strong>on</strong>g>the</str<strong>on</strong>g> area <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>.<br />

8. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> expresses <strong>her</strong> gratitude <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Federal Government <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong><br />

for its full cooperati<strong>on</strong>, which enabled <strong>her</strong> <strong>to</strong> carry out <strong>her</strong> visit freely and independently.<br />

She also expresses <strong>her</strong> deep gratitude <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> representatives who invited<br />

organizing parts <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>her</strong> agenda, as well as <strong>indigenous</strong> pers<strong>on</strong>s who travelled from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

communities <strong>to</strong> meet with <strong>her</strong>. She thanks <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s country team and <str<strong>on</strong>g>the</str<strong>on</strong>g> Office<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s High Commissi<strong>on</strong>er for Human Rights for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir support in ensuring<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> success <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>her</strong> visit.<br />

III. Demographic, legal and policy c<strong>on</strong>text<br />

9. T<strong>her</strong>e are approximately 305 groups in <strong>Brazil</strong> who self-identify as <strong>indigenous</strong><br />

<strong>peoples</strong>, speaking over 274 different languages. Despite <str<strong>on</strong>g>the</str<strong>on</strong>g> fact that <str<strong>on</strong>g>the</str<strong>on</strong>g>y represent <strong>on</strong>ly<br />

0.43 per cent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> populati<strong>on</strong>, <strong>indigenous</strong> <strong>peoples</strong> are present in 80 per cent <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong>ian<br />

municipalities. Genocidal col<strong>on</strong>ial processes resulted in <str<strong>on</strong>g>the</str<strong>on</strong>g> decline <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> native populati<strong>on</strong><br />

from an estimated five milli<strong>on</strong> people, prior <strong>to</strong> European arrival, <strong>to</strong> less than <strong>on</strong>e milli<strong>on</strong>,<br />

<strong>to</strong>day. However, according <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> 2010 nati<strong>on</strong>al census by <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Institute <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Geography and Statistics, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> populati<strong>on</strong> is growing.<br />

10. The nine states comprising <str<strong>on</strong>g>the</str<strong>on</strong>g> Amaz<strong>on</strong> regi<strong>on</strong> have <str<strong>on</strong>g>the</str<strong>on</strong>g> highest c<strong>on</strong>centrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong> in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> diversity and populati<strong>on</strong>. The states <str<strong>on</strong>g>of</str<strong>on</strong>g> Amaz<strong>on</strong>as and Ma<strong>to</strong><br />

Grosso do Sul are home <strong>to</strong> 20 per cent and 9 per cent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> country’s <strong>indigenous</strong><br />

populati<strong>on</strong>, respectively, with <str<strong>on</strong>g>the</str<strong>on</strong>g> Guarani-Kaiowá comprising 3 percent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> populati<strong>on</strong><br />

in Ma<strong>to</strong> Grosso do Sul. By 2015, <str<strong>on</strong>g>the</str<strong>on</strong>g> presence <str<strong>on</strong>g>of</str<strong>on</strong>g> 26 isolated <strong>indigenous</strong> <strong>peoples</strong> was<br />

c<strong>on</strong>firmed through surveys and field activities c<strong>on</strong>ducted by FUNAI. Surveys are ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r in<br />

process or pending in relati<strong>on</strong> <strong>to</strong> over 50 o<str<strong>on</strong>g>the</str<strong>on</strong>g>r isolated groups.<br />

11. The progressive 1988 C<strong>on</strong>stituti<strong>on</strong> c<strong>on</strong>tains some exemplary provisi<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

protecti<strong>on</strong> and promoti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>. Recogniti<strong>on</strong> is afforded <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

country’s cultural diversity and two articles in <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong> address <strong>indigenous</strong> <strong>peoples</strong>’<br />

<strong>rights</strong>. Article 231 provides that Indians shall have “<str<strong>on</strong>g>the</str<strong>on</strong>g>ir social organizati<strong>on</strong>, cus<strong>to</strong>ms,<br />

languages, creeds and traditi<strong>on</strong>s recognized, as well as <str<strong>on</strong>g>the</str<strong>on</strong>g>ir original <strong>rights</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> lands <str<strong>on</strong>g>the</str<strong>on</strong>g>y<br />

traditi<strong>on</strong>ally occupy”. It provides protecti<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g>se <strong>rights</strong>, especially in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

exploitati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> natural resources <strong>on</strong> <strong>indigenous</strong> lands; protects <strong>indigenous</strong> <strong>peoples</strong> against<br />

dispossessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> or forced removal from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands; and places a duty up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Uni<strong>on</strong> <strong>to</strong><br />

demarcate <str<strong>on</strong>g>the</str<strong>on</strong>g> lands traditi<strong>on</strong>ally occupied by <strong>indigenous</strong> <strong>peoples</strong> and “<strong>to</strong> protect and<br />

ensure respect for all <str<strong>on</strong>g>the</str<strong>on</strong>g>ir property”. Article 232 provides <strong>indigenous</strong> <strong>peoples</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

organizati<strong>on</strong>s with standing <strong>to</strong> sue <strong>to</strong> defend <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> and authorizes <str<strong>on</strong>g>the</str<strong>on</strong>g> Public<br />

Prosecu<strong>to</strong>r <strong>to</strong> intervene <strong>on</strong> behalf <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in all pertinent cases. 1 In 2002,<br />

<strong>Brazil</strong> ratified Internati<strong>on</strong>al Labour Organizati<strong>on</strong> (ILO) Indigenous and Tribal Peoples<br />

C<strong>on</strong>venti<strong>on</strong>, 1989 (No. 169), which is c<strong>on</strong>sidered <strong>to</strong> be ranked above domestic laws. 2<br />

12. Following c<strong>on</strong>sultati<strong>on</strong>s with <strong>indigenous</strong> <strong>peoples</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Envir<strong>on</strong>ment established <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Policy <strong>on</strong> Land and Envir<strong>on</strong>ment<br />

Management in 2012 <strong>to</strong> address <str<strong>on</strong>g>the</str<strong>on</strong>g> realizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> following land<br />

demarcati<strong>on</strong>. The policy aims <strong>to</strong> ensure practical steps <strong>to</strong> guarantee <strong>indigenous</strong> <strong>peoples</strong> full<br />

possessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands and recogniti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir traditi<strong>on</strong>al knowledge and governing<br />

capacity over <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>ries and natural resources.<br />

IV. Informati<strong>on</strong> presented <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g><br />

13. During <strong>her</strong> visit, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> received extensive informati<strong>on</strong> from<br />

<strong>indigenous</strong> <strong>peoples</strong>, civil society and representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government. The present report<br />

c<strong>on</strong>tains a brief overview <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> main <str<strong>on</strong>g>the</str<strong>on</strong>g>mes that were brought <strong>to</strong> <strong>her</strong> attenti<strong>on</strong>. These<br />

include <str<strong>on</strong>g>the</str<strong>on</strong>g> positive measures and initiatives taken by <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <strong>to</strong> implement<br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> and measures taken by <strong>indigenous</strong> <strong>peoples</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves <strong>to</strong> this<br />

end; issues pertaining <strong>to</strong> reprisals, threats and killings <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>; <str<strong>on</strong>g>the</str<strong>on</strong>g> impact <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

large-scale development projects in or near <strong>indigenous</strong> <strong>peoples</strong>’ lands and associated<br />

c<strong>on</strong>sultati<strong>on</strong> processes; c<strong>on</strong>cerns raised in relati<strong>on</strong> <strong>to</strong> land demarcati<strong>on</strong> processes; <str<strong>on</strong>g>the</str<strong>on</strong>g> role<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI; and issues pertaining <strong>to</strong> access <strong>to</strong> justice.<br />

A. Positive measures and initiatives<br />

14. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> commends <str<strong>on</strong>g>the</str<strong>on</strong>g> Government for <str<strong>on</strong>g>the</str<strong>on</strong>g> measures and initiatives<br />

taken <strong>to</strong> realize <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>. During <strong>her</strong> visit, she was informed <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

following:<br />

(a) The c<strong>on</strong>structive and proactive role <str<strong>on</strong>g>of</str<strong>on</strong>g> specialized agencies, such as FUNAI<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r’s Office, aimed at protecting <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, despite<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> difficult circumstances in which <str<strong>on</strong>g>the</str<strong>on</strong>g>y operate, in particular staff working in local<br />

FUNAI <str<strong>on</strong>g>of</str<strong>on</strong>g>fices or in remote areas;<br />

(b) The establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> an internati<strong>on</strong>ally recognized legal and administrative<br />

framework for <str<strong>on</strong>g>the</str<strong>on</strong>g> demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> lands and <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> land <strong>rights</strong>,<br />

including in cases involving isolated <strong>indigenous</strong> <strong>peoples</strong>;<br />

(c) The Government’s oppositi<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> proposed c<strong>on</strong>stituti<strong>on</strong>al amendment,<br />

PEC 215, which would undermine <str<strong>on</strong>g>the</str<strong>on</strong>g> land demarcati<strong>on</strong> and <strong>rights</strong> protecti<strong>on</strong> framework;<br />

(d) Decisi<strong>on</strong>s by <str<strong>on</strong>g>the</str<strong>on</strong>g> Federal Supreme Court <strong>to</strong> prevent evicti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

<strong>peoples</strong>, in particular in Ma<strong>to</strong> Grosso do Sul, São Paulo, Bahia, Rio Grande do Sul and<br />

Paraná;<br />

including acknowledgment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> need <strong>to</strong> improve <str<strong>on</strong>g>the</str<strong>on</strong>g> family allowance and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r social<br />

programmes <strong>to</strong> avoid negative impacts <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>’ ways <str<strong>on</strong>g>of</str<strong>on</strong>g> life and aut<strong>on</strong>omy<br />

and <strong>to</strong> make such services more sensitive and resp<strong>on</strong>sive <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> specific situati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong>.<br />

15. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> also noted <str<strong>on</strong>g>the</str<strong>on</strong>g> good practices and proactive approaches <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> <strong>to</strong> pursue <str<strong>on</strong>g>the</str<strong>on</strong>g> realizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>. These include <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

development <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sultati<strong>on</strong> pro<strong>to</strong>cols incorporating <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>sultati<strong>on</strong> and free, prior and<br />

informed c<strong>on</strong>sent procedures developed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Wajãpi in Amapá and <str<strong>on</strong>g>the</str<strong>on</strong>g> Munduruku in<br />

Pará; self-demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> lands; 4 <str<strong>on</strong>g>the</str<strong>on</strong>g> formati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> alliances with <str<strong>on</strong>g>the</str<strong>on</strong>g> Quilombola and<br />

Ribeirinho communities <strong>to</strong> streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n land and self-governance <strong>rights</strong> such as in Oriximiná<br />

in Pará; self-protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> terri<strong>to</strong>ries, for example, through <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> forest<br />

guards set up by <str<strong>on</strong>g>the</str<strong>on</strong>g> Ka’apor in Maranhão; and partnerships with judicial bodies <strong>to</strong><br />

streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n <strong>indigenous</strong> c<strong>on</strong>flict-resoluti<strong>on</strong> systems, such as that between <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong><br />

<strong>peoples</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Roraima and <str<strong>on</strong>g>the</str<strong>on</strong>g> Federal Supreme Court, and <strong>to</strong> defend <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>, such as that<br />

between <str<strong>on</strong>g>the</str<strong>on</strong>g> Yanomami and <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r’s Office for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir right <strong>to</strong> health.<br />

16. These c<strong>on</strong>stitute steps by <strong>indigenous</strong> <strong>peoples</strong> <strong>to</strong>wards self-management and selfregulati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>ries and self-determinati<strong>on</strong> and aut<strong>on</strong>omy, as envisaged in ILO<br />

C<strong>on</strong>venti<strong>on</strong> No. 169, <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous Peoples<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> Organizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> American States draft American Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Indigenous Peoples. They should be fully supported by <str<strong>on</strong>g>the</str<strong>on</strong>g> Government. The <str<strong>on</strong>g>Special</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> also commends <str<strong>on</strong>g>the</str<strong>on</strong>g> active network <str<strong>on</strong>g>of</str<strong>on</strong>g> civil society organizati<strong>on</strong>s assisting<br />

<strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> asserti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al<br />

<str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> <strong>on</strong> Human Rights and Indigenous Peoples.<br />

B. Violence, threats and killings<br />

17. A matter <str<strong>on</strong>g>of</str<strong>on</strong>g> pressing c<strong>on</strong>cern is <str<strong>on</strong>g>the</str<strong>on</strong>g> number <str<strong>on</strong>g>of</str<strong>on</strong>g> documented and reported attacks <strong>on</strong><br />

<strong>indigenous</strong> <strong>peoples</strong>. According <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Missi<strong>on</strong>ary Council for Indigenous Peoples,<br />

92 <strong>indigenous</strong> pers<strong>on</strong>s were murdered in 2007; by 2014, that number had increased <strong>to</strong> 138,<br />

with Ma<strong>to</strong> Grosso do Sul having <str<strong>on</strong>g>the</str<strong>on</strong>g> highest number <str<strong>on</strong>g>of</str<strong>on</strong>g> deaths. 5 Attacks and killings are<br />

frequently reprisals after <strong>indigenous</strong> <strong>peoples</strong> reoccupy ancestral lands following l<strong>on</strong>g delays<br />

in demarcati<strong>on</strong> processes.<br />

18. Community members in Ma<strong>to</strong> Grosso do Sul showed <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> bullet<br />

wounds <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir bodies and <strong>to</strong>ok <strong>her</strong> <strong>to</strong> places w<strong>her</strong>e family members had been killed. They<br />

also recounted incidents <str<strong>on</strong>g>of</str<strong>on</strong>g> arbitrary arrests and criminalizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir leaders. Fears were<br />

expressed that <str<strong>on</strong>g>the</str<strong>on</strong>g> anti-terrorism law, which has been criticized by a number <str<strong>on</strong>g>of</str<strong>on</strong>g> United<br />

Nati<strong>on</strong>s <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>s, could be inappropriately applied <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong> and<br />

increase <str<strong>on</strong>g>the</str<strong>on</strong>g> risk <str<strong>on</strong>g>of</str<strong>on</strong>g> such criminalizati<strong>on</strong>. Likewise in Bahia, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g><br />

received detailed accounts <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>to</strong>rture and arbitrary arrests. Staff and members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Government and civil society organizati<strong>on</strong>s working with <strong>indigenous</strong> <strong>peoples</strong> also provided<br />

<strong>her</strong> with disturbing accounts <str<strong>on</strong>g>of</str<strong>on</strong>g> a regular pattern <str<strong>on</strong>g>of</str<strong>on</strong>g> threats and intimidati<strong>on</strong> by State and<br />

private ac<strong>to</strong>rs.<br />

19. Numerous cases <str<strong>on</strong>g>of</str<strong>on</strong>g> violence against <strong>indigenous</strong> <strong>peoples</strong> in urban settings were<br />

reported, with an emblematic and particularly disturbing case being <str<strong>on</strong>g>the</str<strong>on</strong>g> beheading <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

Kaingang baby in Santa Catarina <strong>on</strong> 31 December 2015. The failure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> mainstream<br />

media <strong>to</strong> report this case was regarded by many people as symp<strong>to</strong>matic <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> general<br />

public’s growing prejudice against, and hatred <strong>to</strong>wards, <strong>indigenous</strong> <strong>peoples</strong>.<br />

20. The recogniti<strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> need <strong>to</strong> protect human <strong>rights</strong> defenders,<br />

including <strong>indigenous</strong> leaders, and <str<strong>on</strong>g>the</str<strong>on</strong>g> important role that <str<strong>on</strong>g>the</str<strong>on</strong>g> former Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Women,<br />

Racial Equality, Youth and Human Rights played in this regard is noteworthy. However,<br />

informati<strong>on</strong> provided by communities throughout <str<strong>on</strong>g>the</str<strong>on</strong>g> country indicates that <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

programmes remain inadequate for <strong>indigenous</strong> <strong>peoples</strong>, partially due <strong>to</strong> lack <str<strong>on</strong>g>of</str<strong>on</strong>g> engagement<br />

<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> state governments. T<strong>her</strong>e is also a lack <str<strong>on</strong>g>of</str<strong>on</strong>g> trust in state and border police and,<br />

in some cases, even in <str<strong>on</strong>g>the</str<strong>on</strong>g> federal police, arising from <str<strong>on</strong>g>the</str<strong>on</strong>g> involvement <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers in<br />

incidents <str<strong>on</strong>g>of</str<strong>on</strong>g> violence against <strong>indigenous</strong> <strong>peoples</strong>. In most cases, impunity allows violent<br />

practices by private security forces, armed mercenaries and State forces <strong>to</strong> c<strong>on</strong>tinue<br />

unabated.<br />

C. Land demarcati<strong>on</strong><br />

21. A c<strong>on</strong>stant refrain from <strong>indigenous</strong> <strong>peoples</strong> throughout <str<strong>on</strong>g>the</str<strong>on</strong>g> country was <str<strong>on</strong>g>the</str<strong>on</strong>g> urgent<br />

need <strong>to</strong> complete <str<strong>on</strong>g>the</str<strong>on</strong>g> land demarcati<strong>on</strong> processes, as this is fundamental <strong>to</strong> all <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>.<br />

They repeatedly stressed that <str<strong>on</strong>g>the</str<strong>on</strong>g> State’s prol<strong>on</strong>ged lack <str<strong>on</strong>g>of</str<strong>on</strong>g> effective acti<strong>on</strong> and protecti<strong>on</strong> is<br />

forcing <str<strong>on</strong>g>the</str<strong>on</strong>g>m <strong>to</strong> reclaim <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands in order <strong>to</strong> guarantee <str<strong>on</strong>g>the</str<strong>on</strong>g>ir survival. Many even stated<br />

that if faced with evicti<strong>on</strong>s <str<strong>on</strong>g>the</str<strong>on</strong>g>y would not leave <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands and would be prepared <strong>to</strong> die <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>m, if necessary.<br />

22. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> heard that efforts <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> <strong>to</strong> reclaim <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

lands, resist evicti<strong>on</strong>s and protect <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>ries from illegal activities frequently placed<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>m in c<strong>on</strong>flict situati<strong>on</strong>s, as was <str<strong>on</strong>g>the</str<strong>on</strong>g> case <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Guarani-Kaiowá and Terena in Ma<strong>to</strong><br />

Grosso do Sul, <str<strong>on</strong>g>the</str<strong>on</strong>g> Pataxó and Tupinambá in Bahia, <str<strong>on</strong>g>the</str<strong>on</strong>g> Arara and Parakanã in Pará, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Ka’apor in Maranhão and <str<strong>on</strong>g>the</str<strong>on</strong>g> Guarani Mbya and Kaingang in <str<strong>on</strong>g>the</str<strong>on</strong>g> sou<str<strong>on</strong>g>the</str<strong>on</strong>g>rn states <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong>.<br />

23. The current stagnati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> land demarcati<strong>on</strong> processes was attributed <strong>to</strong> a<br />

combinati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> fac<strong>to</strong>rs, including:<br />

(a)<br />

The debilitati<strong>on</strong> and understaffing <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI;<br />

(b) The lack <str<strong>on</strong>g>of</str<strong>on</strong>g> political will <strong>to</strong> c<strong>on</strong>clude demarcati<strong>on</strong> procedures at <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

ministerial and Presidential level;<br />

(c) A poor understanding <str<strong>on</strong>g>of</str<strong>on</strong>g> and appreciati<strong>on</strong> for <strong>indigenous</strong> <strong>peoples</strong>’ distinct<br />

ways <str<strong>on</strong>g>of</str<strong>on</strong>g> life and <str<strong>on</strong>g>the</str<strong>on</strong>g> absence <str<strong>on</strong>g>of</str<strong>on</strong>g> human <strong>rights</strong> training for senior members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> executive;<br />

(d) A c<strong>on</strong>stant cycle <str<strong>on</strong>g>of</str<strong>on</strong>g> administrative delays and <str<strong>on</strong>g>the</str<strong>on</strong>g> judicializati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> almost all<br />

demarcati<strong>on</strong> processes by vested interests, coupled with Supreme Court delays in granting<br />

final decisi<strong>on</strong>s <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> cases;<br />

(e) The possibility <str<strong>on</strong>g>of</str<strong>on</strong>g> political gain by certain ac<strong>to</strong>rs through misrepresentati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> implicati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> land demarcati<strong>on</strong> for small farmers and municipalities,<br />

leading <strong>to</strong> discriminati<strong>on</strong> against and c<strong>on</strong>flict with <strong>indigenous</strong> <strong>peoples</strong>;<br />

(f) L<strong>on</strong>g-standing efforts by <str<strong>on</strong>g>the</str<strong>on</strong>g> legislature <strong>to</strong> reform demarcati<strong>on</strong> processes and<br />

modify envir<strong>on</strong>mental legislati<strong>on</strong> so as <strong>to</strong> facilitate resource exploitati<strong>on</strong> in <strong>indigenous</strong><br />

lands;<br />

(g) Failure <strong>to</strong> recognize <str<strong>on</strong>g>the</str<strong>on</strong>g> compatibility <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> lands and c<strong>on</strong>servati<strong>on</strong><br />

units and <str<strong>on</strong>g>the</str<strong>on</strong>g> role that respect for <strong>indigenous</strong> <strong>peoples</strong>’ land <strong>rights</strong> can play in envir<strong>on</strong>mental<br />

c<strong>on</strong>servati<strong>on</strong> and sustainable development.<br />

24. The urgency for land demarcati<strong>on</strong> is exacerbated by deforestati<strong>on</strong>, destructi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

rivers and depleti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> soil quality due <strong>to</strong> intensive m<strong>on</strong>ocropping and mining activities, all<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> which render land and water inadequate for sustaining <strong>indigenous</strong> <strong>peoples</strong>’ lives. The<br />

inadequacy <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State’s resp<strong>on</strong>se <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>se threats has prompted <strong>indigenous</strong> <strong>peoples</strong> <strong>to</strong><br />

protect <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>ries and natural resources <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves. At times, this puts <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lives at<br />

risk, as in <str<strong>on</strong>g>the</str<strong>on</strong>g> case <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ka’apor <strong>indigenous</strong> land in Maranhão and <str<strong>on</strong>g>the</str<strong>on</strong>g> Manoki <strong>indigenous</strong><br />

land in Ma<strong>to</strong> Grosso do Sul.<br />

25. Many <strong>indigenous</strong> <strong>peoples</strong> and civil society organizati<strong>on</strong>s expressed c<strong>on</strong>cern about<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> isolated <strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> states <str<strong>on</strong>g>of</str<strong>on</strong>g> Pará, Ma<strong>to</strong> Grosso, Maranhão,<br />

R<strong>on</strong>d<strong>on</strong>ia and Amaz<strong>on</strong>as. They highlighted <str<strong>on</strong>g>the</str<strong>on</strong>g> need <strong>to</strong> streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n and enhance <str<strong>on</strong>g>the</str<strong>on</strong>g> efforts<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI <strong>to</strong> ensure respect for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> and protect <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>ries, including through<br />

dialogue and cooperati<strong>on</strong> with bordering countries.<br />

D. Role <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Indian Foundati<strong>on</strong><br />

26. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> received informati<strong>on</strong> from <strong>indigenous</strong> <strong>peoples</strong> throughout<br />

<strong>Brazil</strong> in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> important role that FUNAI and <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r’s Office play<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>. Governmental agencies and ministries also referred <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

reliance <strong>on</strong> FUNAI <strong>to</strong> realize <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own acti<strong>on</strong>s and programmes for <strong>indigenous</strong> <strong>peoples</strong>.<br />

However, it was also stressed that <str<strong>on</strong>g>the</str<strong>on</strong>g> capacity and local presence <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI were being<br />

debilitated <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> point w<strong>her</strong>e <str<strong>on</strong>g>the</str<strong>on</strong>g> Foundati<strong>on</strong> may so<strong>on</strong> no l<strong>on</strong>ger be able <strong>to</strong> fulfil its<br />

mandate. C<strong>on</strong>cerns were raised regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> political, ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than technical basis <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

nominati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> President <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI and <str<strong>on</strong>g>the</str<strong>on</strong>g> implicati<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g> aut<strong>on</strong>omy and ability <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Foundati<strong>on</strong> <strong>to</strong> fulfil its mandate.<br />

27. Indigenous <strong>peoples</strong>, civil society and independent experts also expressed fear for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

survival <str<strong>on</strong>g>of</str<strong>on</strong>g> many <strong>indigenous</strong> <strong>peoples</strong> in isolati<strong>on</strong> and initial c<strong>on</strong>tact, in <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> new and<br />

complex threats, including cross-border threats, infrastructure development, agribusiness<br />

expansi<strong>on</strong>, Christian missi<strong>on</strong>aries and reduced State protecti<strong>on</strong>.<br />

E. Access <strong>to</strong> justice<br />

28. The growing use by <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> “security suspensi<strong>on</strong>” (suspensão de<br />

segurança) mechanism — which allows for certain <strong>rights</strong> <strong>to</strong> be suspended in favour <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r interests — was raised by <strong>indigenous</strong> <strong>peoples</strong> as a major c<strong>on</strong>cern in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

development projects. This mechanism allows projects <strong>to</strong> proceed even if <str<strong>on</strong>g>the</str<strong>on</strong>g>y may result in<br />

serious violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> State has not complied with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

duty <strong>to</strong> c<strong>on</strong>sult in order <strong>to</strong> obtain <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior and informed c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> stakeholders.<br />

29. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> was informed that some judicial decisi<strong>on</strong>s c<strong>on</strong>tinue <strong>to</strong> refer<br />

<strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong> in a pejorative and discrimina<strong>to</strong>ry manner. She was also <strong>to</strong>ld that<br />

some judges and public defenders seem unable <strong>to</strong> relate <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> reality <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>,<br />

which places an extra burden <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong> when <str<strong>on</strong>g>the</str<strong>on</strong>g>y attempt <strong>to</strong> assert <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

<strong>rights</strong>.<br />

30. Indigenous leaders also expressed fear that justice would be denied if <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> <strong>to</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands that have not yet been demarcated were <strong>to</strong> be extinguished without <str<strong>on</strong>g>the</str<strong>on</strong>g>ir c<strong>on</strong>sent<br />

in negotiati<strong>on</strong>s between <str<strong>on</strong>g>the</str<strong>on</strong>g> Government and third parties.<br />

31. Informati<strong>on</strong> received by <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> indicate that impunity is pervasive<br />

in relati<strong>on</strong> <strong>to</strong> serious violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, including killings <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

leaders. Such intimidati<strong>on</strong>, attacks and killings frequently arise in c<strong>on</strong>texts w<strong>her</strong>e<br />

<strong>indigenous</strong> <strong>peoples</strong> attempt <strong>to</strong> assert <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> over <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands and go hand in hand with<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> criminalizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> leaders.<br />

32. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> was seriously c<strong>on</strong>cerned about reports <str<strong>on</strong>g>of</str<strong>on</strong>g> adopti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> children authorized by judges without due respect for <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> children<br />

as set out in <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Child, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir extended families,<br />

who, in <strong>indigenous</strong> cultures, traditi<strong>on</strong>ally play an important role in such c<strong>on</strong>texts, and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir communities.<br />

F. Development projects and <str<strong>on</strong>g>the</str<strong>on</strong>g> duty <strong>to</strong> c<strong>on</strong>sult<br />

33. Indigenous <strong>peoples</strong> reported dire threats <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> and existence in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> large-scale or high-impact development projects, including megaprojects such as <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> hydroelectric dams and infrastructure, mining and <str<strong>on</strong>g>the</str<strong>on</strong>g> laying <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

transmissi<strong>on</strong> lines, that are launched without meaningful c<strong>on</strong>sultati<strong>on</strong> <strong>to</strong> seek <str<strong>on</strong>g>the</str<strong>on</strong>g>ir free,<br />

prior and informed c<strong>on</strong>sent in accordance with ILO C<strong>on</strong>venti<strong>on</strong> No. 169 and <str<strong>on</strong>g>the</str<strong>on</strong>g> United<br />

Nati<strong>on</strong>s Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous Peoples. 6 C<strong>on</strong>cerns were also raised in<br />

relati<strong>on</strong> <strong>to</strong> attempts <strong>to</strong> change or enact nati<strong>on</strong>al legislati<strong>on</strong> that directly impact <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>,<br />

such as <str<strong>on</strong>g>the</str<strong>on</strong>g> Mining Code, without meaningful prior c<strong>on</strong>sultati<strong>on</strong> with c<strong>on</strong>cerned <strong>indigenous</strong><br />

<strong>peoples</strong>.<br />

34. A number <str<strong>on</strong>g>of</str<strong>on</strong>g> megaprojects that have serious implicati<strong>on</strong>s for <strong>indigenous</strong> <strong>peoples</strong>’<br />

<strong>rights</strong> were brought <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> attenti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>. These include projects for<br />

which no prior c<strong>on</strong>sultati<strong>on</strong> <strong>to</strong>ok place with <strong>indigenous</strong> <strong>peoples</strong> or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r minority groups,<br />

such as <str<strong>on</strong>g>the</str<strong>on</strong>g> Quilombola in Oriximiná in Pará, including bauxite mining and associated<br />

hydroelectric power plants, which <strong>to</strong>ge<str<strong>on</strong>g>the</str<strong>on</strong>g>r c<strong>on</strong>stitute a major industrial complex; <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

polluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rio Doce by <str<strong>on</strong>g>the</str<strong>on</strong>g> collapse <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Minas Gerais dam and its impact <strong>on</strong><br />

<strong>indigenous</strong> <strong>peoples</strong>, such as <str<strong>on</strong>g>the</str<strong>on</strong>g> Krenak, who are dependent <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> river for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

livelihoods and subsistence; and <str<strong>on</strong>g>the</str<strong>on</strong>g> major transmissi<strong>on</strong> line projects inside c<strong>on</strong>stituti<strong>on</strong>ally<br />

protected and demarcated lands, such as <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> lands <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Waimiri-Atroari in<br />

Roraima.<br />

35. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> received extensive informati<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> and<br />

operati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te and <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós River basin dams, which raised issues<br />

comm<strong>on</strong> <strong>to</strong> many megaprojects in <strong>Brazil</strong>.<br />

V. Emblematic cases<br />

A. Belo M<strong>on</strong>te<br />

36. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> visited <str<strong>on</strong>g>the</str<strong>on</strong>g> Juruna people <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Xingu River who are<br />

affected by <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te dam. Since its outset almost 30 years ago, <str<strong>on</strong>g>the</str<strong>on</strong>g> project has been<br />

shrouded in c<strong>on</strong>troversy and resisted by <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> whose lives it impacts. In<br />

2009, <str<strong>on</strong>g>the</str<strong>on</strong>g> previous mandate holder noted that <strong>indigenous</strong> groups and n<strong>on</strong>-governmental<br />

organizati<strong>on</strong>s had complained that <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te project was being carried out without<br />

adequate mitigati<strong>on</strong> measures and c<strong>on</strong>sultati<strong>on</strong>s with <str<strong>on</strong>g>the</str<strong>on</strong>g> affected <strong>indigenous</strong> communities. 7<br />

In his observati<strong>on</strong>s <strong>on</strong> this case, he highlighted <str<strong>on</strong>g>the</str<strong>on</strong>g> need for c<strong>on</strong>certed efforts <strong>to</strong> carry out<br />

adequate c<strong>on</strong>sultati<strong>on</strong>s with <strong>indigenous</strong> <strong>peoples</strong> and <strong>to</strong> endeavour <strong>to</strong> reach c<strong>on</strong>sensus with<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>m <strong>on</strong> all aspects <str<strong>on</strong>g>of</str<strong>on</strong>g> projects affecting <str<strong>on</strong>g>the</str<strong>on</strong>g>m. He also stressed that <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum steps <strong>to</strong><br />

be taken should include <str<strong>on</strong>g>the</str<strong>on</strong>g> mitigati<strong>on</strong> and land demarcati<strong>on</strong> measures proposed by<br />

FUNAI. 8<br />

37. A series <str<strong>on</strong>g>of</str<strong>on</strong>g> prominent nati<strong>on</strong>al court cases were filed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r’s<br />

Office. However, <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary’s invocati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> security suspensi<strong>on</strong> mechanism<br />

prevented legal challenges by <strong>indigenous</strong> <strong>peoples</strong> and allowed <str<strong>on</strong>g>the</str<strong>on</strong>g> projects <strong>to</strong> proceed<br />

without compliance with <str<strong>on</strong>g>the</str<strong>on</strong>g> State duty <strong>to</strong> c<strong>on</strong>sult <strong>to</strong> seek <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior and informed<br />

c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> affected <strong>peoples</strong>. The Inter-American Commissi<strong>on</strong> <strong>on</strong> Human Rights issued<br />

precauti<strong>on</strong>ary measures in 2011, 9 in which it addressed <str<strong>on</strong>g>the</str<strong>on</strong>g> lack <str<strong>on</strong>g>of</str<strong>on</strong>g> adequate prior<br />

c<strong>on</strong>sultati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> inaccessibility <str<strong>on</strong>g>of</str<strong>on</strong>g> impact assessments and <str<strong>on</strong>g>the</str<strong>on</strong>g> urgent need <strong>to</strong> protect<br />

<strong>indigenous</strong> <strong>peoples</strong>’ life and physical integrity. Despite this, governmental authorizati<strong>on</strong>s<br />

were issued for <str<strong>on</strong>g>the</str<strong>on</strong>g> project <strong>to</strong> proceed.<br />

38. Notably, in November 2015, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Institute <str<strong>on</strong>g>of</str<strong>on</strong>g> Envir<strong>on</strong>ment and Renewable<br />

Natural Resources (IBAMA) granted Norte Energia S.A. an operating licence,<br />

notwithstanding documented reports by FUNAI <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-compliance with <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s<br />

stipulated in <str<strong>on</strong>g>the</str<strong>on</strong>g> 2010 request. 10 Similar advice from <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r’s Office not <strong>to</strong><br />

approve <str<strong>on</strong>g>the</str<strong>on</strong>g> project until <str<strong>on</strong>g>the</str<strong>on</strong>g> necessary mitigati<strong>on</strong> measures were in place was ignored.<br />

39. At <str<strong>on</strong>g>the</str<strong>on</strong>g> time <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>’s visit in March 2016, c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> dam<br />

had been completed and <str<strong>on</strong>g>the</str<strong>on</strong>g> reservoirs were being filled. As foreseen by <str<strong>on</strong>g>the</str<strong>on</strong>g> affected<br />

<strong>indigenous</strong> <strong>peoples</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> dam has resulted in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir loss <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>trol over <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands, rivers and<br />

resources. Although <str<strong>on</strong>g>the</str<strong>on</strong>g> dam itself is not located within demarcated <strong>indigenous</strong> lands, it<br />

directly affects <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> surrounding 11 <strong>indigenous</strong> lands.<br />

40. During <strong>her</strong> visit <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> area, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> was informed <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> lack <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

meaningful and culturally appropriate informati<strong>on</strong> and c<strong>on</strong>sultati<strong>on</strong>s and <str<strong>on</strong>g>the</str<strong>on</strong>g> successful<br />

attempts <strong>to</strong> divide <str<strong>on</strong>g>the</str<strong>on</strong>g> communities. Community members and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir representatives rejected<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> noti<strong>on</strong> that <str<strong>on</strong>g>the</str<strong>on</strong>g> Government or Norte Energia had adequately c<strong>on</strong>sulted <str<strong>on</strong>g>the</str<strong>on</strong>g>m or<br />

informed <str<strong>on</strong>g>the</str<strong>on</strong>g>m <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> potential impacts during any <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> phases <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> project. They said<br />

that public hearings <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> project were grossly inadequate compared with <str<strong>on</strong>g>the</str<strong>on</strong>g> standard <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

c<strong>on</strong>sultati<strong>on</strong> provided for in ILO C<strong>on</strong>venti<strong>on</strong> No. 169 and <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s Declarati<strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir free, prior and informed c<strong>on</strong>sent and no opportunities had been provided for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

participati<strong>on</strong> in decisi<strong>on</strong>-making. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> was also informed that adequate<br />

impact assessments had not been c<strong>on</strong>ducted or shared.<br />

41. The communities described how <str<strong>on</strong>g>the</str<strong>on</strong>g>ir traditi<strong>on</strong>al livelihoods based <strong>on</strong> fishing and<br />

hunting were no l<strong>on</strong>ger possible as river currents had been radically changed, <str<strong>on</strong>g>the</str<strong>on</strong>g> water had<br />

turned turbid and fish s<strong>to</strong>cks had decreased. They explained that mosqui<strong>to</strong>-transmitted<br />

illnesses had increased, extensive areas had been deforested, islands had been submerged<br />

and <strong>peoples</strong> had been displaced. Inadequate and inappropriate housing has been provided<br />

for those displaced by <str<strong>on</strong>g>the</str<strong>on</strong>g> dam, sometimes <strong>to</strong> places which lacked access <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Xingu<br />

River.<br />

42. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> was particularly alarmed <strong>to</strong> learn that mitigati<strong>on</strong> measures<br />

and enabling c<strong>on</strong>diti<strong>on</strong>s identified as necessary for <str<strong>on</strong>g>the</str<strong>on</strong>g> project <strong>to</strong> proceed had not been<br />

implemented, which compounded <str<strong>on</strong>g>the</str<strong>on</strong>g> serious impacts <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>’ lives and<br />

<strong>rights</strong>. The demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Cachoeira Seca <strong>indigenous</strong> lands 11 as well as regularizati<strong>on</strong> and<br />

full protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Apyterewa and Paquiçamba <strong>indigenous</strong> lands had not proceeded in<br />

accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> agreed time frames. Adequate compensati<strong>on</strong> had not been provided for<br />

loss <str<strong>on</strong>g>of</str<strong>on</strong>g> livelihoods, nor had participa<strong>to</strong>ry m<strong>on</strong>i<strong>to</strong>ring units <strong>to</strong> protect <strong>indigenous</strong> lands been<br />

established and <str<strong>on</strong>g>the</str<strong>on</strong>g> local FUNAI has been weakened ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than streng<str<strong>on</strong>g>the</str<strong>on</strong>g>ned.<br />

43. Meanwhile, <str<strong>on</strong>g>the</str<strong>on</strong>g> measures taken had compounded <str<strong>on</strong>g>the</str<strong>on</strong>g> harm — including <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

distributi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> processed foods <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> communities, allegedly <strong>to</strong> quell oppositi<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

project —, with <str<strong>on</strong>g>the</str<strong>on</strong>g> effect <str<strong>on</strong>g>of</str<strong>on</strong>g> accelerating <str<strong>on</strong>g>the</str<strong>on</strong>g> loss <str<strong>on</strong>g>of</str<strong>on</strong>g> traditi<strong>on</strong>al livelihoods. Communities<br />

complained that <str<strong>on</strong>g>the</str<strong>on</strong>g>y lacked drinking water and health services and had become dependent<br />

<strong>on</strong> markets in faraway Altamira <strong>to</strong> sell what produce <str<strong>on</strong>g>the</str<strong>on</strong>g>y can <strong>to</strong> purchase food.<br />

44. Communities residing al<strong>on</strong>g <str<strong>on</strong>g>the</str<strong>on</strong>g> river face unannounced release <str<strong>on</strong>g>of</str<strong>on</strong>g> water or declines<br />

in water levels, resulting in stagnant pools <str<strong>on</strong>g>of</str<strong>on</strong>g> water near <str<strong>on</strong>g>the</str<strong>on</strong>g>ir homes which attract hordes <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

disease-bearing mosqui<strong>to</strong>s. These pools were visible in <str<strong>on</strong>g>the</str<strong>on</strong>g> community that <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> visited. Members <str<strong>on</strong>g>of</str<strong>on</strong>g> that same community explained that, in January 2016,<br />

Norte Energia had opened <str<strong>on</strong>g>the</str<strong>on</strong>g> floodgates with no advance warning, causing <str<strong>on</strong>g>the</str<strong>on</strong>g> river level<br />

<strong>to</strong> rise by seven metres in <strong>on</strong>e hour and washing away <str<strong>on</strong>g>the</str<strong>on</strong>g>ir boats, which had yet <strong>to</strong> be<br />

replaced at <str<strong>on</strong>g>the</str<strong>on</strong>g> time <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>’s visit.<br />

45. On 7 December 2015, a case was filed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r’s <str<strong>on</strong>g>of</str<strong>on</strong>g>fice in Altamira<br />

against <str<strong>on</strong>g>the</str<strong>on</strong>g> Government and Norte Energia, alleging ethnocide as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> impacts <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> project — a reflecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> gravity <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> such megaprojects and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

inadequacy <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> associated mitigating measures. Ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r case was opened by <str<strong>on</strong>g>the</str<strong>on</strong>g> Inter-<br />

American Commissi<strong>on</strong> <strong>on</strong> Human Rights against <strong>Brazil</strong> <strong>on</strong> 21 December 2015, illustrating<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> serious <strong>on</strong>going c<strong>on</strong>cern about <str<strong>on</strong>g>the</str<strong>on</strong>g> well-being <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> affected <strong>indigenous</strong> <strong>peoples</strong> at <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

nati<strong>on</strong>al, regi<strong>on</strong>al and internati<strong>on</strong>al levels.<br />

46. A licence was issued by <str<strong>on</strong>g>the</str<strong>on</strong>g> government <str<strong>on</strong>g>of</str<strong>on</strong>g> Pará for <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo Sun gold mining<br />

project, which is in close proximity <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te dam and which directly affects <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Juruna community. This proceeded in <str<strong>on</strong>g>the</str<strong>on</strong>g> absence <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sultati<strong>on</strong>s <strong>to</strong> obtain <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior<br />

and informed c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> c<strong>on</strong>cerned and without <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> an<br />

urgently needed cumulative assessment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> envir<strong>on</strong>mental, social and human <strong>rights</strong><br />

impacts. The potential impacts are <str<strong>on</strong>g>the</str<strong>on</strong>g>refore a matter <str<strong>on</strong>g>of</str<strong>on</strong>g> very serious c<strong>on</strong>cern.<br />

B. Tapajós dam complex and São Luiz do Tapajos dam<br />

47. According <strong>to</strong> informati<strong>on</strong> provided <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>, <str<strong>on</strong>g>the</str<strong>on</strong>g>re are<br />

10 <strong>indigenous</strong> <strong>peoples</strong> in 118 villages in <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós River basin, an area extraordinarily<br />

rich in animal and plant biodiversity. The Munduruku, who number around 13,000 people,<br />

is <str<strong>on</strong>g>the</str<strong>on</strong>g> largest group, and <str<strong>on</strong>g>the</str<strong>on</strong>g> presence <str<strong>on</strong>g>of</str<strong>on</strong>g> isolated <strong>peoples</strong> has also been documented in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Tapajós regi<strong>on</strong>.<br />

48. Munduruku representatives with whom <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> met described <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

sacredness <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> river, forests and resources. They explained that <str<strong>on</strong>g>the</str<strong>on</strong>g>y were now living<br />

under a c<strong>on</strong>stant threat as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós project, but emphasized <str<strong>on</strong>g>the</str<strong>on</strong>g>ir unity in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

struggle <strong>to</strong> protect <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>ry and prevent its destructi<strong>on</strong>. In order <strong>to</strong> facilitate<br />

meaningful c<strong>on</strong>sultati<strong>on</strong>s, <str<strong>on</strong>g>the</str<strong>on</strong>g>y developed a c<strong>on</strong>sultati<strong>on</strong> pro<strong>to</strong>col which <str<strong>on</strong>g>the</str<strong>on</strong>g>y presented <strong>to</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Government in January 2015; <str<strong>on</strong>g>the</str<strong>on</strong>g>y have not yet received any resp<strong>on</strong>se. Instead <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

culturally appropriate prior c<strong>on</strong>sultati<strong>on</strong>s, individual households had allegedly been<br />

approached by a c<strong>on</strong>sulting firm employed by Grupo de Estudo Tapajós and <str<strong>on</strong>g>of</str<strong>on</strong>g>fered<br />

compensati<strong>on</strong> <strong>to</strong> aband<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir oppositi<strong>on</strong> and debilitate <strong>indigenous</strong> collective decisi<strong>on</strong>making<br />

in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> project. As in o<str<strong>on</strong>g>the</str<strong>on</strong>g>r projects, so-called public hearings were being<br />

c<strong>on</strong>flated with <str<strong>on</strong>g>the</str<strong>on</strong>g> State duty <strong>to</strong> c<strong>on</strong>sult <strong>indigenous</strong> <strong>peoples</strong>. In additi<strong>on</strong>, c<strong>on</strong>cerns had been<br />

expressed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> security forces <strong>to</strong> intimidate <str<strong>on</strong>g>the</str<strong>on</strong>g> Munduruku and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r <strong>indigenous</strong><br />

<strong>peoples</strong> opposed <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> project.<br />

49. Extensive documentati<strong>on</strong> was provided <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> alleging violati<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós dam complex. In additi<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

absence <str<strong>on</strong>g>of</str<strong>on</strong>g> good faith c<strong>on</strong>sultati<strong>on</strong>s <strong>to</strong> obtain <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior and informed c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

affected <strong>peoples</strong> were <str<strong>on</strong>g>the</str<strong>on</strong>g> failure <strong>to</strong> demarcate <strong>indigenous</strong> lands affected by <str<strong>on</strong>g>the</str<strong>on</strong>g> project and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> inadequate envir<strong>on</strong>mental and social impact assessments after political<br />

decisi<strong>on</strong>s regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> dams had been taken. These assessments are reported <strong>to</strong> have<br />

grossly underestimated <str<strong>on</strong>g>the</str<strong>on</strong>g> impacts <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> risks associated<br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> dams and ignored <str<strong>on</strong>g>the</str<strong>on</strong>g> unique relati<strong>on</strong>ship that <strong>indigenous</strong> <strong>peoples</strong> have with <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

terri<strong>to</strong>ries, up<strong>on</strong> which <str<strong>on</strong>g>the</str<strong>on</strong>g>ir cultural and physical survival depends.<br />

50. T<strong>her</strong>e also appears <strong>to</strong> be a lack <str<strong>on</strong>g>of</str<strong>on</strong>g> a cumulative impact analysis <str<strong>on</strong>g>of</str<strong>on</strong>g> dam cascades at<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> river basin level and <str<strong>on</strong>g>the</str<strong>on</strong>g> associated impacts <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>’ livelihoods. The<br />

necessary mitigati<strong>on</strong> and compensati<strong>on</strong> measures have reportedly not been adequately<br />

costed, rendering <str<strong>on</strong>g>the</str<strong>on</strong>g> ec<strong>on</strong>omic viability studies unreliable and posing fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r threats <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

well-being <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>.<br />

51. The Tapajós complex facilitates a number <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r activities that impact directly <strong>on</strong><br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, including illegal mining (garimpo) and logging activities and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> roads and ports. Logging c<strong>on</strong>cessi<strong>on</strong>s in <str<strong>on</strong>g>the</str<strong>on</strong>g> Itaituba II nati<strong>on</strong>al forest,<br />

which overlaps <str<strong>on</strong>g>the</str<strong>on</strong>g> Sawré Muybu <strong>indigenous</strong> land, and <str<strong>on</strong>g>the</str<strong>on</strong>g> Crepori nati<strong>on</strong>al forest, which<br />

impacts Munduruku lands, were issued by <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Envir<strong>on</strong>ment without prior<br />

c<strong>on</strong>sultati<strong>on</strong>. The Public Prosecu<strong>to</strong>r has opened legal cases regarding <str<strong>on</strong>g>the</str<strong>on</strong>g>se c<strong>on</strong>cessi<strong>on</strong>s and<br />

obtained favourable preliminary decisi<strong>on</strong>s, but a significant risk <str<strong>on</strong>g>of</str<strong>on</strong>g> fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r logging remains.<br />

52. As was <str<strong>on</strong>g>the</str<strong>on</strong>g> case in <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te project, cases filed by <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r<br />

addressing human right violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós complex have been subject <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> security<br />

suspensi<strong>on</strong> mechanism, thus rendering ineffective ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r judicial decisi<strong>on</strong> affirming that<br />

c<strong>on</strong>sultati<strong>on</strong> with <strong>indigenous</strong> <strong>peoples</strong> had <strong>to</strong> take place prior <strong>to</strong> granting an operating<br />

licence for <str<strong>on</strong>g>the</str<strong>on</strong>g> dam.<br />

53. Following <str<strong>on</strong>g>the</str<strong>on</strong>g> visit by <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>, in April 2016, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>n Government<br />

<strong>to</strong>ok a number <str<strong>on</strong>g>of</str<strong>on</strong>g> steps <strong>to</strong> protect <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Munduruku. This included initiating <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Sawré Muybu terri<strong>to</strong>ry and suspending <str<strong>on</strong>g>the</str<strong>on</strong>g> licensing procedure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

VI. General observati<strong>on</strong>s<br />

54. The challenges facing many <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong>’s <strong>indigenous</strong> <strong>peoples</strong> are enormous. The<br />

origins <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se challenges range from his<strong>to</strong>rically based and deeply entrenched<br />

discriminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a structural nature, manifested in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>temporary neglect and denial <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, <strong>to</strong> more recent developments associated with changes in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

political landscape.<br />

55. Serious challenges <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> arise in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> increasing<br />

discriminati<strong>on</strong>, as manifested in dem<strong>on</strong>strati<strong>on</strong>s against <strong>indigenous</strong> <strong>peoples</strong>; stalled<br />

demarcati<strong>on</strong> processes, including approximately 20 land demarcati<strong>on</strong>s pending Presidential<br />

ratificati<strong>on</strong> and ministerial declarati<strong>on</strong>; <strong>on</strong>going evicti<strong>on</strong>s and c<strong>on</strong>stant threats <str<strong>on</strong>g>of</str<strong>on</strong>g> fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

evicti<strong>on</strong>s; pr<str<strong>on</strong>g>of</str<strong>on</strong>g>ound and ever-increasing impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> megaprojects located in or near<br />

<strong>indigenous</strong> <strong>peoples</strong>’ terri<strong>to</strong>ries and implemented without meaningful prior c<strong>on</strong>sultati<strong>on</strong>s <strong>to</strong><br />

obtain <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior and informed c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> affected <strong>peoples</strong>; violence, racism,<br />

killings, threats and intimidati<strong>on</strong> perpetrated with impunity against <strong>indigenous</strong> <strong>peoples</strong> and<br />

those who work with <str<strong>on</strong>g>the</str<strong>on</strong>g>m; inadequate protecti<strong>on</strong> for <strong>indigenous</strong> communities and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

leaders and increasingly frequent criminal allegati<strong>on</strong>s against <str<strong>on</strong>g>the</str<strong>on</strong>g>m.<br />

56. As a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se challenges, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> believes that, <strong>to</strong>day,<br />

<strong>indigenous</strong> <strong>peoples</strong> face more pr<str<strong>on</strong>g>of</str<strong>on</strong>g>ound risks than at any time since <str<strong>on</strong>g>the</str<strong>on</strong>g> adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

C<strong>on</strong>stituti<strong>on</strong> in 1988. Some <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>her</strong> c<strong>on</strong>cerns and observati<strong>on</strong>s are highlighted below.<br />

A. Structural issues<br />

57. The c<strong>on</strong>centrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> ec<strong>on</strong>omic and political power in <str<strong>on</strong>g>the</str<strong>on</strong>g> hands <str<strong>on</strong>g>of</str<strong>on</strong>g> a small segment<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong>ian society has his<strong>to</strong>rically c<strong>on</strong>tributed <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> exploitati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> lands and resource<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>, without c<strong>on</strong>siderati<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> or well-being.<br />

58. During <strong>her</strong> visit, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> repeatedly heard reports that individual,<br />

political and ec<strong>on</strong>omic gain has c<strong>on</strong>tributed <strong>to</strong> instituti<strong>on</strong>al racism, violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

<strong>peoples</strong>’ <strong>rights</strong> and c<strong>on</strong>flicts, including in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> decisi<strong>on</strong>s pertaining <strong>to</strong><br />

megaprojects and exploitati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> natural resources in <strong>indigenous</strong> lands.<br />

59. The observati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> previous mandate holder that “<strong>indigenous</strong> <strong>peoples</strong> as a whole<br />

are disadvantaged ec<strong>on</strong>omically and in terms <str<strong>on</strong>g>of</str<strong>on</strong>g> access <strong>to</strong> political power in relati<strong>on</strong> <strong>to</strong> most<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> rest <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong>ian society” 12 would, unfortunately, appear <strong>to</strong> be even more pertinent<br />

<strong>to</strong>day, with indicati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> deep-seated structural discriminati<strong>on</strong> <strong>to</strong>wards <strong>indigenous</strong> <strong>peoples</strong><br />

being <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> increase and instituti<strong>on</strong>al changes serving <strong>to</strong> fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r disempower <str<strong>on</strong>g>the</str<strong>on</strong>g>m.<br />

B. Violence and discriminati<strong>on</strong> against <strong>indigenous</strong> <strong>peoples</strong><br />

60. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is particularly c<strong>on</strong>cerned at <str<strong>on</strong>g>the</str<strong>on</strong>g> level <str<strong>on</strong>g>of</str<strong>on</strong>g> racially based<br />

violence against <strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> states <str<strong>on</strong>g>of</str<strong>on</strong>g> Ma<strong>to</strong> Grosso do Sul, Pará, Bahia,<br />

Maranhão, Rio Grande do Sul, Santa Catarina and Paraná. Tackling and eliminating racism,<br />

discriminati<strong>on</strong> and violence against <strong>indigenous</strong> <strong>peoples</strong> and ensuring protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> lives<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> leaders and community members is an issue that requires immediate and<br />

c<strong>on</strong>certed acti<strong>on</strong>. She is extremely c<strong>on</strong>cerned that states, such as Pará, with an alarmingly<br />

high rate <str<strong>on</strong>g>of</str<strong>on</strong>g> murders <str<strong>on</strong>g>of</str<strong>on</strong>g> human <strong>rights</strong> and envir<strong>on</strong>mental defenders, including <strong>indigenous</strong><br />

<strong>peoples</strong>, have no policy for <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> human <strong>rights</strong> defenders and no functi<strong>on</strong>ing<br />

partnership with <str<strong>on</strong>g>the</str<strong>on</strong>g> federal programme.<br />

61. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> Raporteur was extremely alarmed that a series <str<strong>on</strong>g>of</str<strong>on</strong>g> armed attacks, leading<br />

<strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> injury <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> communities <str<strong>on</strong>g>of</str<strong>on</strong>g> Kurussu Amba, Dourados and<br />

Taquara in Ma<strong>to</strong> Grosso do Sul, were carried out immediately followed <strong>her</strong> visit <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>se<br />

areas. Equally alarming is <str<strong>on</strong>g>the</str<strong>on</strong>g> fact that, some days after <str<strong>on</strong>g>the</str<strong>on</strong>g>se incidents <strong>to</strong>ok place,<br />

<strong>indigenous</strong> <strong>peoples</strong> reported that no State authority had visited <str<strong>on</strong>g>the</str<strong>on</strong>g> areas.<br />

62. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> decries <str<strong>on</strong>g>the</str<strong>on</strong>g>se attacks and calls <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <strong>to</strong> put an<br />

end <strong>to</strong> such human <strong>rights</strong> violati<strong>on</strong>s, <strong>to</strong> investigate <str<strong>on</strong>g>the</str<strong>on</strong>g>m and <strong>to</strong> bring <str<strong>on</strong>g>the</str<strong>on</strong>g>ir intellectual<br />

authors and perpetra<strong>to</strong>rs <strong>to</strong> justice. She commends <str<strong>on</strong>g>the</str<strong>on</strong>g> Prosecu<strong>to</strong>r General and <str<strong>on</strong>g>the</str<strong>on</strong>g> Public<br />

Prosecu<strong>to</strong>r for carrying out <str<strong>on</strong>g>the</str<strong>on</strong>g> investigati<strong>on</strong> in<strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> violent attacks <str<strong>on</strong>g>of</str<strong>on</strong>g> 14 June 2016 in<br />

Ma<strong>to</strong> Grosso do Sul and for denouncing 12 people involved in using militias against<br />

<strong>indigenous</strong> <strong>peoples</strong>. She urges <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary <strong>to</strong> promptly c<strong>on</strong>clude <str<strong>on</strong>g>the</str<strong>on</strong>g> process and hold<br />

those resp<strong>on</strong>sible <strong>to</strong> account.<br />

C. Megaprojects, legislative and administrative measures and <str<strong>on</strong>g>the</str<strong>on</strong>g> duty<br />

<strong>to</strong> c<strong>on</strong>sult<br />

63. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is c<strong>on</strong>cerned that prior c<strong>on</strong>sultati<strong>on</strong>s were not carried out<br />

with affected <strong>indigenous</strong> <strong>peoples</strong> in relati<strong>on</strong> <strong>to</strong> megaprojects such as <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo Sun gold<br />

mine in Pará and <str<strong>on</strong>g>the</str<strong>on</strong>g> Manaus-Boa Vista transmissi<strong>on</strong> line in Roraima. She is also c<strong>on</strong>cerned<br />

that, in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te and São Luiz do Tapajós dams, mere public hearings<br />

were deemed <strong>to</strong> fulfil <str<strong>on</strong>g>the</str<strong>on</strong>g> obligati<strong>on</strong> <strong>to</strong> c<strong>on</strong>sult. In general, <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no adequate mechanism<br />

for c<strong>on</strong>sultati<strong>on</strong> with <strong>indigenous</strong> <strong>peoples</strong> in relati<strong>on</strong> <strong>to</strong> major development projects.<br />

64. In additi<strong>on</strong>, no c<strong>on</strong>sultati<strong>on</strong> procedure has been established in relati<strong>on</strong> <strong>to</strong> policies or<br />

legislative and administrative measures that directly impact <strong>indigenous</strong> <strong>peoples</strong>. This lack<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sultati<strong>on</strong> is highly problematic, given <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tinued attempts in <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al<br />

C<strong>on</strong>gress, w<strong>her</strong>e <strong>indigenous</strong> <strong>peoples</strong> have little <strong>to</strong> no representati<strong>on</strong>, <strong>to</strong> weaken <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

c<strong>on</strong>stituti<strong>on</strong>al and legislative protecti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>. These include proposals for<br />

c<strong>on</strong>stituti<strong>on</strong>al amendment PEC 215, which would transform land <strong>rights</strong> recogniti<strong>on</strong> from a<br />

technical <strong>to</strong> a political process and legislati<strong>on</strong>, such as <str<strong>on</strong>g>the</str<strong>on</strong>g> new Mining Code, and changes<br />

<strong>to</strong> licensing procedures for megaprojects, which undermine <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> <strong>to</strong><br />

lands, terri<strong>to</strong>ries and resources and do not include adequate safeguards.<br />

65. These acti<strong>on</strong>s c<strong>on</strong>stitute a failure <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <strong>to</strong> implement good<br />

faith c<strong>on</strong>sultati<strong>on</strong>s with <strong>indigenous</strong> <strong>peoples</strong> in order <strong>to</strong> obtain <str<strong>on</strong>g>the</str<strong>on</strong>g>ir free, prior and informed<br />

c<strong>on</strong>sent. Such c<strong>on</strong>sultati<strong>on</strong>s are necessary <strong>to</strong> protect <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> in<br />

accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> State duty set out in <str<strong>on</strong>g>the</str<strong>on</strong>g> domestic legal framework, ILO C<strong>on</strong>venti<strong>on</strong><br />

No. 169, <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous Peoples and<br />

internati<strong>on</strong>al and regi<strong>on</strong>al human <strong>rights</strong> treaties and jurisprudence.<br />

66. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is c<strong>on</strong>cerned that <str<strong>on</strong>g>the</str<strong>on</strong>g> State’s interpretati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> when its duty<br />

<strong>to</strong> c<strong>on</strong>sult corresp<strong>on</strong>ds <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> requirement <strong>to</strong> obtain <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior and informed c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong> is not c<strong>on</strong>sistent with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s and purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> legal<br />

instruments that protect <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, including <str<strong>on</strong>g>the</str<strong>on</strong>g>ir right <strong>to</strong> selfdeterminati<strong>on</strong><br />

by which <str<strong>on</strong>g>the</str<strong>on</strong>g>y determine <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own social, cultural and ec<strong>on</strong>omic<br />

development and maintain and develop <str<strong>on</strong>g>the</str<strong>on</strong>g>ir aut<strong>on</strong>omous ways <str<strong>on</strong>g>of</str<strong>on</strong>g> life, and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir right <strong>to</strong><br />

cultural and physical survival as <strong>peoples</strong>. 13<br />

67. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is particularly c<strong>on</strong>cerned about <str<strong>on</strong>g>the</str<strong>on</strong>g> potential impact <strong>on</strong><br />

<strong>indigenous</strong> <strong>peoples</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós dam complex. Impacts similar <strong>to</strong> those in <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo<br />

M<strong>on</strong>te project appear inevitable unless <str<strong>on</strong>g>the</str<strong>on</strong>g>re is full compliance with human <strong>rights</strong> standards<br />

from <str<strong>on</strong>g>the</str<strong>on</strong>g> planning stages through <strong>to</strong> project design and operati<strong>on</strong>.<br />

68. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> welcomes <str<strong>on</strong>g>the</str<strong>on</strong>g> Government’s recogniti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> impacts <strong>on</strong><br />

Sawré Muybu <strong>indigenous</strong> lands caused by <str<strong>on</strong>g>the</str<strong>on</strong>g> São Luiz do Tapajós dam and <str<strong>on</strong>g>the</str<strong>on</strong>g> suspensi<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> licensing process by <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Institute <str<strong>on</strong>g>of</str<strong>on</strong>g> Envir<strong>on</strong>ment and Renewable Natural<br />

Resources in <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> project’s incompatibility with <strong>indigenous</strong> <strong>peoples</strong>’<br />

c<strong>on</strong>stituti<strong>on</strong>ally recognized <strong>rights</strong>. She is, however, c<strong>on</strong>cerned by reports that <str<strong>on</strong>g>the</str<strong>on</strong>g> land<br />

demarcati<strong>on</strong> process may face political obstacles owing <strong>to</strong> its implicati<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g> licensing<br />

processes. Completi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> land demarcati<strong>on</strong> process is essential for <str<strong>on</strong>g>the</str<strong>on</strong>g> Munduruku and<br />

would serve as a first significant step <strong>to</strong> guaranteeing <str<strong>on</strong>g>the</str<strong>on</strong>g>ir human <strong>rights</strong> and those <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

affected <strong>peoples</strong>.<br />

D. Land demarcati<strong>on</strong><br />

69. A comm<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>me in discussi<strong>on</strong>s with members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> executive was <str<strong>on</strong>g>the</str<strong>on</strong>g> percepti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> being hamstrung by <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary and <str<strong>on</strong>g>the</str<strong>on</strong>g> legislature when attempting <strong>to</strong> protect<br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> and demarcate <strong>indigenous</strong> lands. Although impediments<br />

undoubtedly exist, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> does not believes that <str<strong>on</strong>g>the</str<strong>on</strong>g>y c<strong>on</strong>stitute an<br />

acceptable excuse for such lengthy delays in <str<strong>on</strong>g>the</str<strong>on</strong>g> land demarcati<strong>on</strong> processes and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

associated violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>rights</strong> leading <strong>to</strong> violence against <strong>indigenous</strong> communities. A<br />

serious c<strong>on</strong>cern is <str<strong>on</strong>g>the</str<strong>on</strong>g> frequent issuance <str<strong>on</strong>g>of</str<strong>on</strong>g> evicti<strong>on</strong> orders when <strong>indigenous</strong> <strong>peoples</strong> reclaim<br />

and occupy lands that <str<strong>on</strong>g>the</str<strong>on</strong>g>y are entitled <strong>to</strong> under <str<strong>on</strong>g>the</str<strong>on</strong>g> 1988 C<strong>on</strong>stituti<strong>on</strong>, but which <str<strong>on</strong>g>the</str<strong>on</strong>g> State<br />

has failed <strong>to</strong> demarcate in <str<strong>on</strong>g>the</str<strong>on</strong>g> last 28 years. While not necessarily binding in o<str<strong>on</strong>g>the</str<strong>on</strong>g>r cases, 14<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> highly c<strong>on</strong>troversial and str<strong>on</strong>gly c<strong>on</strong>tested Supreme Court interpretati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> 1988<br />

C<strong>on</strong>stituti<strong>on</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> Raposa-Serra do Sol ruling — which introduced <str<strong>on</strong>g>the</str<strong>on</strong>g> temporal<br />

framework requiring <strong>indigenous</strong> <strong>peoples</strong> <strong>to</strong> have been in possessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands or <strong>to</strong><br />

have had claims in process when <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong> was enacted, with no c<strong>on</strong>siderati<strong>on</strong> given<br />

<strong>to</strong> how or why <str<strong>on</strong>g>the</str<strong>on</strong>g>y were removed from <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands — imposes c<strong>on</strong>straints <strong>on</strong> <strong>indigenous</strong><br />

<strong>peoples</strong>’ <strong>rights</strong> <strong>to</strong> possess and c<strong>on</strong>trol <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands and natural resources and hinders land<br />

demarcati<strong>on</strong>. Lower courts as well as <str<strong>on</strong>g>the</str<strong>on</strong>g> Superior and Supreme Courts 15 are applying <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

decisi<strong>on</strong> in ways that are completely at odds with <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> land <strong>rights</strong> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong>. In so doing, <str<strong>on</strong>g>the</str<strong>on</strong>g> State is forcing <strong>indigenous</strong> <strong>peoples</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>f <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own lands<br />

and depriving <str<strong>on</strong>g>the</str<strong>on</strong>g>m <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> enjoyment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir basic <strong>rights</strong> as well as fueling violence against<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>m.<br />

70. The failure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State <strong>to</strong> protect <strong>indigenous</strong> <strong>peoples</strong>’ lands from illegal activities, in<br />

particular mining and logging, is a matter <str<strong>on</strong>g>of</str<strong>on</strong>g> grave c<strong>on</strong>cern. Even w<strong>her</strong>e <strong>indigenous</strong> <strong>peoples</strong><br />

have demarcated terri<strong>to</strong>ries, such as in <str<strong>on</strong>g>the</str<strong>on</strong>g> Amaz<strong>on</strong> regi<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g>y lack effective c<strong>on</strong>trol over<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir resources owing <strong>to</strong> increasing invasi<strong>on</strong>s associated with illegal activities, as in<br />

Cachoeira Seca, Apyterewa, Manoki, Yanomami and Ka’apor <strong>indigenous</strong> lands.<br />

E. Health, educati<strong>on</strong> and social services<br />

71. <strong>Brazil</strong> has made efforts <strong>to</strong> improve and adapt its service provisi<strong>on</strong> in relati<strong>on</strong> <strong>to</strong><br />

<strong>indigenous</strong> health care, educati<strong>on</strong> and social services. However, indica<strong>to</strong>rs <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

youth suicide, cases <str<strong>on</strong>g>of</str<strong>on</strong>g> illegal adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> children, infant mortality and<br />

alcoholism, violence against <strong>indigenous</strong> women and <str<strong>on</strong>g>the</str<strong>on</strong>g> accelerated loss <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

languages reflect <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>going lack <str<strong>on</strong>g>of</str<strong>on</strong>g> culturally appropriate services.<br />

72. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is particularly c<strong>on</strong>cerned about <str<strong>on</strong>g>the</str<strong>on</strong>g> health impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> illegal<br />

mining and <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> mercury in Yanomami lands. Their experience and <str<strong>on</strong>g>the</str<strong>on</strong>g> challenges<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y face are illustrative <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> integral relati<strong>on</strong>ship between <strong>indigenous</strong> <strong>peoples</strong>’ health,<br />

educati<strong>on</strong> and cultural <strong>rights</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> realizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir terri<strong>to</strong>rial and self-governance<br />

<strong>rights</strong>.<br />

F. Capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Indian Foundati<strong>on</strong>, paternalism and<br />

<strong>indigenous</strong> <strong>peoples</strong> in voluntary isolati<strong>on</strong> and initial c<strong>on</strong>tact<br />

73. Recently proposed measures <strong>to</strong> reduce FUNAI budget and staff run completely<br />

counter <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> demands <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in <strong>Brazil</strong>. They are also at odds with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

recommendati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> previous mandate holder, who had stressed <str<strong>on</strong>g>the</str<strong>on</strong>g> need <strong>to</strong> streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n<br />

FUNAI <strong>to</strong> enable <str<strong>on</strong>g>the</str<strong>on</strong>g> State <strong>to</strong> fulfil its legal obligati<strong>on</strong>s c<strong>on</strong>cerning <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>.<br />

74. Despite its challenges, FUNAI appears <strong>to</strong> have made progress in its efforts <strong>to</strong><br />

overcome paternalistic postures <strong>to</strong>wards <strong>indigenous</strong> <strong>peoples</strong>. However, unless FUNAI is<br />

properly supported, this progress is vulnerable <strong>to</strong> setbacks. Entrenched discriminati<strong>on</strong> and<br />

paternalistic views appear <strong>to</strong> c<strong>on</strong>tinue <strong>to</strong> inform law-making, policymaking and judicial<br />

decisi<strong>on</strong>s by many administrative bodies and authorities. Many regard <str<strong>on</strong>g>the</str<strong>on</strong>g> current political<br />

and instituti<strong>on</strong>al weakening <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI as symp<strong>to</strong>matic <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State’s resistance <strong>to</strong> fully<br />

transiti<strong>on</strong> <strong>to</strong> new relati<strong>on</strong>ships with <strong>indigenous</strong> <strong>peoples</strong>, based <strong>on</strong> self-determinati<strong>on</strong>.<br />

75. The work <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI in relati<strong>on</strong> <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong> in voluntary isolati<strong>on</strong> is<br />

premised <strong>on</strong> respect for <str<strong>on</strong>g>the</str<strong>on</strong>g> principle <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-c<strong>on</strong>tact, which is unders<strong>to</strong>od as a core element<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> right <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>peoples</strong> in isolati<strong>on</strong> <strong>to</strong> self-determinati<strong>on</strong>, and has served <strong>to</strong> inform <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

guidelines <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Office <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s High Commissi<strong>on</strong>er for Human Rights and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Inter-American Commissi<strong>on</strong> <strong>on</strong> Human Rights and <strong>to</strong> influence <str<strong>on</strong>g>the</str<strong>on</strong>g> policies developed<br />

by neighbouring countries. In this regard, FUNAI has an important role <strong>to</strong> play as a<br />

c<strong>on</strong>tribu<strong>to</strong>r <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> work <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Amaz<strong>on</strong> Cooperati<strong>on</strong> Treaty Organizati<strong>on</strong>, an<br />

intergovernmental body established <strong>to</strong> address <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> cross-border <strong>indigenous</strong><br />

<strong>peoples</strong> in voluntary isolati<strong>on</strong> or initial c<strong>on</strong>tact and <strong>to</strong> promote high-level regi<strong>on</strong>al dialogue<br />

<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> treaty. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is, however, c<strong>on</strong>cerned that missi<strong>on</strong>ary activity is<br />

posing a threat <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong> in initial c<strong>on</strong>tact as well as <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> traditi<strong>on</strong>al forms or<br />

organizati<strong>on</strong> and aut<strong>on</strong>omy <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r remote <strong>indigenous</strong> groups.<br />

G. Safeguards <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Development Bank<br />

76. Despite reassurances from <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Development Bank (BNDES) that impacts<br />

<strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong> are adequately c<strong>on</strong>sidered in <str<strong>on</strong>g>the</str<strong>on</strong>g> projects it funds, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is c<strong>on</strong>cerned that its safeguards and practices are inadequate <strong>to</strong> ensure<br />

protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, in particular in <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te<br />

experience and <str<strong>on</strong>g>the</str<strong>on</strong>g> massive loans provided <strong>to</strong> agribusiness corporati<strong>on</strong>s allegedly involved<br />

in evicti<strong>on</strong>s and violence against <strong>indigenous</strong> <strong>peoples</strong>.<br />

H. Corporate resp<strong>on</strong>sibility <strong>to</strong> respect <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong><br />

77. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> highlights <str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibility <str<strong>on</strong>g>of</str<strong>on</strong>g> businesses sourcing goods or<br />

materials, such as sugar, soy or animal produce, from Ma<strong>to</strong> Grosso do Sul, or timber, palm<br />

oil or minerals from elsew<strong>her</strong>e in <strong>Brazil</strong>, <strong>to</strong> c<strong>on</strong>duct adequate human <strong>rights</strong> due diligence <strong>to</strong><br />

ensure respect for <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir supply chains. Similarly, companies<br />

involved in mining, hydroelectric dams, transmissi<strong>on</strong> lines or infrastructure projects have a<br />

resp<strong>on</strong>sibility <strong>to</strong> c<strong>on</strong>duct due diligence with regard <strong>to</strong> <strong>indigenous</strong> <strong>rights</strong> and assess whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> State has complied with its duty <strong>to</strong> c<strong>on</strong>sult <strong>to</strong> seek <str<strong>on</strong>g>the</str<strong>on</strong>g> free, prior and informed c<strong>on</strong>sent<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and has guaranteed that <str<strong>on</strong>g>the</str<strong>on</strong>g> projects will not impact <strong>on</strong> <strong>indigenous</strong><br />

<strong>peoples</strong>’ <strong>rights</strong>.<br />

78. Given <str<strong>on</strong>g>the</str<strong>on</strong>g> serious nature <str<strong>on</strong>g>of</str<strong>on</strong>g> violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> — including<br />

allegati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> ethnocide — and <str<strong>on</strong>g>the</str<strong>on</strong>g> failure <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian authorities <strong>to</strong> adequately address<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>m or provide effective remedies, particular cauti<strong>on</strong> is necessary <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> corporate<br />

ac<strong>to</strong>rs, including banks, in order <strong>to</strong> live up <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir resp<strong>on</strong>sibility under <str<strong>on</strong>g>the</str<strong>on</strong>g> Guiding<br />

Principles <strong>on</strong> Business and Human Rights, 16 <strong>to</strong> “know and show” that <str<strong>on</strong>g>the</str<strong>on</strong>g>y are not complicit<br />

in or c<strong>on</strong>tributing <strong>to</strong> such <strong>rights</strong> violati<strong>on</strong>s.<br />

I. Access <strong>to</strong> justice<br />

79. The lack <str<strong>on</strong>g>of</str<strong>on</strong>g> access <strong>to</strong> justice for <strong>indigenous</strong> <strong>peoples</strong> is a major issue. In <strong>Brazil</strong>,<br />

<strong>indigenous</strong> <strong>peoples</strong> face significant barriers in accessing justice owing <strong>to</strong> a lack <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

resources, cultural and linguistic barriers, instituti<strong>on</strong>al racism and ignorance <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

cultures and <strong>rights</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary and <str<strong>on</strong>g>the</str<strong>on</strong>g> law enforcement forces. These<br />

barriers are compounded by acti<strong>on</strong>s and omissi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State in relati<strong>on</strong> <strong>to</strong> c<strong>on</strong>sultati<strong>on</strong><br />

and participati<strong>on</strong> <strong>rights</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> mechanisms that deny <strong>rights</strong>, such as <str<strong>on</strong>g>the</str<strong>on</strong>g> security<br />

suspensi<strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary, and its failure <strong>to</strong> give adequate c<strong>on</strong>siderati<strong>on</strong> <strong>to</strong> <strong>indigenous</strong><br />

<strong>peoples</strong>’ land <strong>rights</strong>, for example, through <str<strong>on</strong>g>the</str<strong>on</strong>g> inappropriate applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong><br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> Raposa-Serra do Sol ruling. The presumpti<strong>on</strong> that land demarcati<strong>on</strong> processes will be<br />

brought under <str<strong>on</strong>g>the</str<strong>on</strong>g> remit <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> law is <str<strong>on</strong>g>the</str<strong>on</strong>g>n used as justificati<strong>on</strong> <strong>to</strong> delay demarcati<strong>on</strong>, so that<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> law is transformed in<strong>to</strong> an obstacle <strong>to</strong>, ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than an enabler for, <str<strong>on</strong>g>the</str<strong>on</strong>g> realizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>.<br />

80. The failure <strong>to</strong> ensure access <strong>to</strong> justice for <strong>indigenous</strong> <strong>peoples</strong> in a c<strong>on</strong>text w<strong>her</strong>e<br />

his<strong>to</strong>rical violence against <str<strong>on</strong>g>the</str<strong>on</strong>g>m has g<strong>on</strong>e unaddressed, al<strong>on</strong>gside <str<strong>on</strong>g>the</str<strong>on</strong>g> increasing<br />

criminalizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and violent attacks and killings with impunity, sends<br />

a message <strong>to</strong> those resp<strong>on</strong>sible that <str<strong>on</strong>g>the</str<strong>on</strong>g>re will be no repercussi<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir acti<strong>on</strong>s. For<br />

<strong>indigenous</strong> <strong>peoples</strong>, it signals that <str<strong>on</strong>g>the</str<strong>on</strong>g> State instituti<strong>on</strong>s, including <str<strong>on</strong>g>the</str<strong>on</strong>g> law enforcement and<br />

justice systems, lack both <str<strong>on</strong>g>the</str<strong>on</strong>g> will <strong>to</strong> ensure that <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> are protected and any genuine<br />

c<strong>on</strong>cern about <str<strong>on</strong>g>the</str<strong>on</strong>g>ir plight.<br />

J. Recent developments<br />

81. The political situati<strong>on</strong> in <strong>Brazil</strong> changed significantly following <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>’s visit, with <str<strong>on</strong>g>the</str<strong>on</strong>g> appointment <str<strong>on</strong>g>of</str<strong>on</strong>g> an interim Government and <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a number <str<strong>on</strong>g>of</str<strong>on</strong>g> instituti<strong>on</strong>al changes. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is c<strong>on</strong>cerned that <str<strong>on</strong>g>the</str<strong>on</strong>g> political<br />

and ec<strong>on</strong>omic crisis is serving <strong>to</strong> render <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> and issues invisible and<br />

less significant in <str<strong>on</strong>g>the</str<strong>on</strong>g> eyes <str<strong>on</strong>g>of</str<strong>on</strong>g> politicians and <str<strong>on</strong>g>the</str<strong>on</strong>g> public, <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> detriment <str<strong>on</strong>g>of</str<strong>on</strong>g> addressing<br />

structural discriminati<strong>on</strong> and imbalances in power in a manner beneficial <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>m.<br />

82. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> also received informati<strong>on</strong> regarding an escalati<strong>on</strong> in<br />

violence against <strong>indigenous</strong> <strong>peoples</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir leaders following <strong>her</strong> visit. This included<br />

reports <str<strong>on</strong>g>of</str<strong>on</strong>g> increasing violence and discriminati<strong>on</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> states <str<strong>on</strong>g>of</str<strong>on</strong>g> Santa Catarina and Rio<br />

Grande do Sul against <str<strong>on</strong>g>the</str<strong>on</strong>g> Kaingang, Guaranis and Xokleng <strong>peoples</strong>.<br />

83. In an alarming incident <strong>on</strong> 14 June 2016, violent attacks by a group <str<strong>on</strong>g>of</str<strong>on</strong>g> armed men,<br />

reportedly organized by fazendeiros (farm or plantati<strong>on</strong> owners), resulted in <str<strong>on</strong>g>the</str<strong>on</strong>g> death <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>on</strong>e Guarani Kaiowá and <str<strong>on</strong>g>the</str<strong>on</strong>g> injury <str<strong>on</strong>g>of</str<strong>on</strong>g> several o<str<strong>on</strong>g>the</str<strong>on</strong>g>rs in Caarapó city, Ma<strong>to</strong> Grosso do Sul.<br />

According <strong>to</strong> informati<strong>on</strong> received, <str<strong>on</strong>g>the</str<strong>on</strong>g> attack occurred in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Dourados-Amambaipegua <strong>indigenous</strong> lands. This land demarcati<strong>on</strong> had been recently<br />

initiated following studies by FUNAI, and <str<strong>on</strong>g>the</str<strong>on</strong>g> community had occupied a parcel <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

land.<br />

84. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> received informati<strong>on</strong> <strong>on</strong> arrests <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> leaders in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

state <str<strong>on</strong>g>of</str<strong>on</strong>g> Bahia and has communicated with <str<strong>on</strong>g>the</str<strong>on</strong>g> Government expressing <strong>her</strong> c<strong>on</strong>cerns. Fears<br />

have been expressed that <str<strong>on</strong>g>the</str<strong>on</strong>g> April 2016 provisi<strong>on</strong>al decisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> President <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Supreme Court <strong>to</strong> suspend <str<strong>on</strong>g>the</str<strong>on</strong>g> demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Tupinambá de Olivença <strong>indigenous</strong> land<br />

in Bahia may result in fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r violence against <strong>indigenous</strong> <strong>peoples</strong>. She c<strong>on</strong>tinues <strong>to</strong><br />

m<strong>on</strong>i<strong>to</strong>r <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> in both Ma<strong>to</strong> Grosso do Sul and Bahia.<br />

85. Indigenous <strong>peoples</strong>’ representatives provided informati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> eliminati<strong>on</strong> by <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

interim Government <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Women, Racial Equality, Youth and Human Rights<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> establishment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> human <strong>rights</strong> secretariat under <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice. They<br />

expressed c<strong>on</strong>cern about <str<strong>on</strong>g>the</str<strong>on</strong>g> potential <strong>indigenous</strong> <strong>rights</strong> implicati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> this acti<strong>on</strong> and<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r retrogressive measures purportedly being c<strong>on</strong>sidered in relati<strong>on</strong> <strong>to</strong> recent demarcati<strong>on</strong><br />

processes <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> lands.<br />

86. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> shares <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cerns and fears <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> about<br />

regressi<strong>on</strong> in legal and instituti<strong>on</strong>al protecti<strong>on</strong>s. In this regard, she stresses <str<strong>on</strong>g>the</str<strong>on</strong>g> fundamental<br />

importance <str<strong>on</strong>g>of</str<strong>on</strong>g> ensuring that changes <strong>to</strong> government structures resulting from <str<strong>on</strong>g>the</str<strong>on</strong>g> current<br />

political c<strong>on</strong>text must not result in setbacks in <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> and promoti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> human<br />

<strong>rights</strong>.<br />

87. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> c<strong>on</strong>siders <str<strong>on</strong>g>the</str<strong>on</strong>g> disbandment <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Women,<br />

Racial Equality, Youth and Human Rights as a significant regressi<strong>on</strong> in <strong>Brazil</strong>’s<br />

commitment <strong>to</strong> protect human <strong>rights</strong>. She is c<strong>on</strong>cerned that this could have a particularly<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>ound impact <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>, who are am<strong>on</strong>gst <str<strong>on</strong>g>the</str<strong>on</strong>g> most in need <str<strong>on</strong>g>of</str<strong>on</strong>g> protecti<strong>on</strong>. In<br />

this regard, she is also c<strong>on</strong>cerned about <str<strong>on</strong>g>the</str<strong>on</strong>g> status, functi<strong>on</strong>ing and future <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al<br />

Council <strong>on</strong> Human Rights and <str<strong>on</strong>g>the</str<strong>on</strong>g> recently established Nati<strong>on</strong>al Council <strong>on</strong> Indigenous<br />

Policies.<br />

88. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is particularly c<strong>on</strong>cerned about reports that <str<strong>on</strong>g>the</str<strong>on</strong>g> interim<br />

Government is c<strong>on</strong>sidering reversing <str<strong>on</strong>g>the</str<strong>on</strong>g> ratificati<strong>on</strong>s and declarati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> lands<br />

implemented by <str<strong>on</strong>g>the</str<strong>on</strong>g> previous Government, following <strong>her</strong> visit, including measures <strong>to</strong><br />

expropriate C<strong>on</strong>dá <strong>indigenous</strong> land in Santa Catarina. The Nati<strong>on</strong>al Council <strong>on</strong> Human<br />

Rights committed <strong>to</strong> provide <strong>her</strong> with additi<strong>on</strong>al informati<strong>on</strong> <strong>on</strong> visits <strong>to</strong> sou<str<strong>on</strong>g>the</str<strong>on</strong>g>rn <strong>Brazil</strong><br />

immediately following <strong>her</strong> visit.<br />

89. Prior <strong>to</strong> this, <str<strong>on</strong>g>the</str<strong>on</strong>g> previous Government had taken a number <str<strong>on</strong>g>of</str<strong>on</strong>g> measures that were in<br />

accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>’s preliminary recommendati<strong>on</strong>s. 17 These included<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> presidential ratificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Cachoeira Seca <strong>indigenous</strong> land in <str<strong>on</strong>g>the</str<strong>on</strong>g> state <str<strong>on</strong>g>of</str<strong>on</strong>g> Pará, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Piaçaguera <strong>indigenous</strong> land in São Paulo and <str<strong>on</strong>g>the</str<strong>on</strong>g> Pequizal do Naruvotu <strong>indigenous</strong> land in<br />

Ma<strong>to</strong> Grosso, declarati<strong>on</strong>s by <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Justice <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> lands in Ma<strong>to</strong> Grosso<br />

and Ma<strong>to</strong> Grosso do Sul and proactive measures <strong>to</strong> recognize <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

<strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós regi<strong>on</strong> and <strong>to</strong> suspend <str<strong>on</strong>g>the</str<strong>on</strong>g> dam licensing process.<br />

90. While welcoming <str<strong>on</strong>g>the</str<strong>on</strong>g> interim Government’s reaffirmati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong>’s open invitati<strong>on</strong><br />

<strong>to</strong> all special procedure mandate holders, <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> was dismayed <strong>to</strong> learn<br />

that, as part <str<strong>on</strong>g>of</str<strong>on</strong>g> a c<strong>on</strong>gressi<strong>on</strong>al investigati<strong>on</strong> <strong>on</strong> FUNAI and <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Institute for<br />

Col<strong>on</strong>izati<strong>on</strong> and Agrarian Reform (INCRA), certain members <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>gress raised questi<strong>on</strong>s<br />

regarding <strong>her</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial visit <strong>to</strong> <strong>Brazil</strong> and requested informati<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g> individuals who<br />

were involved in it.<br />

91. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> is c<strong>on</strong>cerned that <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>vergence <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

worrying developments will have a negative impact <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>. She<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>refore calls up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <strong>to</strong> implement <str<strong>on</strong>g>the</str<strong>on</strong>g> recommendati<strong>on</strong>s outlined below<br />

and <strong>to</strong> c<strong>on</strong>tinue <strong>to</strong> engage in dialogue with <strong>her</strong> mandate <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> increasingly urgent situati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in <strong>Brazil</strong>.<br />

VII. C<strong>on</strong>clusi<strong>on</strong> and recommendati<strong>on</strong>s<br />

A. C<strong>on</strong>clusi<strong>on</strong><br />

92. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g>’s overall impressi<strong>on</strong>, following <strong>her</strong> visit, is that <strong>Brazil</strong><br />

has a number <str<strong>on</strong>g>of</str<strong>on</strong>g> exemplary c<strong>on</strong>stituti<strong>on</strong>al provisi<strong>on</strong>s pertaining <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong>’<br />

<strong>rights</strong> and was, in <str<strong>on</strong>g>the</str<strong>on</strong>g> past, a leader in <str<strong>on</strong>g>the</str<strong>on</strong>g> area <str<strong>on</strong>g>of</str<strong>on</strong>g> demarcati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’<br />

terri<strong>to</strong>ries. However, in <str<strong>on</strong>g>the</str<strong>on</strong>g> eight years since <str<strong>on</strong>g>the</str<strong>on</strong>g> visit <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> previous mandate holder,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>re has been a disturbing absence <str<strong>on</strong>g>of</str<strong>on</strong>g> progress in <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> his<br />

recommendati<strong>on</strong>s and <str<strong>on</strong>g>the</str<strong>on</strong>g> resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>on</strong>g-standing issues <str<strong>on</strong>g>of</str<strong>on</strong>g> key c<strong>on</strong>cern <strong>to</strong><br />

<strong>indigenous</strong> <strong>peoples</strong>. Instead, informati<strong>on</strong> received points <strong>to</strong> an extremely worrying<br />

regressi<strong>on</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>. In <str<strong>on</strong>g>the</str<strong>on</strong>g> current political<br />

c<strong>on</strong>text, <str<strong>on</strong>g>the</str<strong>on</strong>g> threats facing <strong>indigenous</strong> <strong>peoples</strong> may be exacerbated and <str<strong>on</strong>g>the</str<strong>on</strong>g> l<strong>on</strong>gstanding<br />

protecti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir human <strong>rights</strong> may be at risk.<br />

93. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> makes some recommendati<strong>on</strong>s <strong>to</strong> address <str<strong>on</strong>g>the</str<strong>on</strong>g> most<br />

pressing issues she observed during <strong>her</strong> missi<strong>on</strong>. They relate <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> need for urgent<br />

measures <strong>to</strong> address violence and discriminati<strong>on</strong> against <strong>indigenous</strong> <strong>peoples</strong>;<br />

streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n State instituti<strong>on</strong>s such as FUNAI; build <str<strong>on</strong>g>the</str<strong>on</strong>g> capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> State <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials,<br />

including senior members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> executive and lower court judges, in <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

inappropriate applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> doctrines that deny <strong>rights</strong>; redouble efforts in land<br />

demarcati<strong>on</strong> and protecti<strong>on</strong>; allocate resources <strong>to</strong> improve access <strong>to</strong> justice; guarantee<br />

meaningful good-faith prior c<strong>on</strong>sultati<strong>on</strong> and participati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in<br />

relati<strong>on</strong> <strong>to</strong> large-scale or high-impact development projects and respect for <strong>indigenous</strong><br />

<strong>peoples</strong>’ own c<strong>on</strong>sultati<strong>on</strong> and c<strong>on</strong>sent pro<strong>to</strong>cols and proposals for addressing<br />

development issues; and ensure participa<strong>to</strong>ry impact assessments and redress for<br />

harm caused.<br />

94. Given <str<strong>on</strong>g>the</str<strong>on</strong>g> marginalized status <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> fact that serious<br />

violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>, over recent decades, have not been adequately investigated<br />

or remedied and <str<strong>on</strong>g>the</str<strong>on</strong>g> urgent need <strong>to</strong> address <strong>on</strong>going structural discriminati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> places particular emphasis <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> importance <str<strong>on</strong>g>of</str<strong>on</strong>g> initiating an<br />

independent and transparent nati<strong>on</strong>al inquiry in<strong>to</strong> violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>. This<br />

should be implemented in cooperati<strong>on</strong> with <strong>indigenous</strong> <strong>peoples</strong>, with <str<strong>on</strong>g>the</str<strong>on</strong>g> aim <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

transforming <str<strong>on</strong>g>the</str<strong>on</strong>g> State’s relati<strong>on</strong>ship with <str<strong>on</strong>g>the</str<strong>on</strong>g>m in<strong>to</strong> <strong>on</strong>e that is based <strong>on</strong> respect,<br />

justice and self-determinati<strong>on</strong>.<br />

95. <strong>Brazil</strong> owes a his<strong>to</strong>rical debt <strong>to</strong> its <strong>indigenous</strong> <strong>peoples</strong> who have suffered<br />

marginalizati<strong>on</strong> and discriminati<strong>on</strong> since <str<strong>on</strong>g>the</str<strong>on</strong>g> formati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State. Despite <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

hardships <str<strong>on</strong>g>the</str<strong>on</strong>g>y have endured, <str<strong>on</strong>g>the</str<strong>on</strong>g>y remain unwavering in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir resoluti<strong>on</strong> <strong>to</strong> preserve<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands, <strong>to</strong> maintain and develop <str<strong>on</strong>g>the</str<strong>on</strong>g>ir cultures, cus<strong>to</strong>ms and languages and <strong>to</strong><br />

determine <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own futures. Ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r than being seen as a burden <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> State or an<br />

obstacle <strong>to</strong> nati<strong>on</strong>al development, <str<strong>on</strong>g>the</str<strong>on</strong>g>ir c<strong>on</strong>tributi<strong>on</strong>s <strong>to</strong> <strong>Brazil</strong>ian society should be<br />

widely recognized and fully appreciated and celebrated. With this in mind, <strong>Brazil</strong><br />

should embark <strong>on</strong> an inclusive process <str<strong>on</strong>g>of</str<strong>on</strong>g> belated State-building with its <strong>indigenous</strong><br />

<strong>peoples</strong> premised <strong>on</strong> respectful and just relati<strong>on</strong>ships between self-determining<br />

<strong>peoples</strong>.<br />

B. Recommendati<strong>on</strong>s<br />

Right <strong>to</strong> life, violence and racial discriminati<strong>on</strong><br />

96. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> respectfully urges <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong> <strong>to</strong>:<br />

(a) Take immediate measures <strong>to</strong> protect <str<strong>on</strong>g>the</str<strong>on</strong>g> safety <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> leaders,<br />

including through streng<str<strong>on</strong>g>the</str<strong>on</strong>g>ned and culturally appropriate protecti<strong>on</strong> programmes,<br />

and <strong>to</strong> c<strong>on</strong>duct investigati<strong>on</strong>s in<strong>to</strong> all attacks and killings <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and<br />

bring perpetra<strong>to</strong>rs <strong>to</strong> justice;<br />

(b) C<strong>on</strong>duct a public campaign aimed at eliminating racism, discriminati<strong>on</strong>,<br />

hate speech and violence <strong>to</strong>wards <strong>indigenous</strong> <strong>peoples</strong>;<br />

(c) Accord particular and urgent attenti<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> situati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong><br />

children, youth and women, especially in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> alarming rates <str<strong>on</strong>g>of</str<strong>on</strong>g> suicides in<br />

<strong>indigenous</strong> communities, <str<strong>on</strong>g>the</str<strong>on</strong>g> increasing violence against <strong>indigenous</strong> women and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

illegal adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> children.<br />

Land <strong>rights</strong><br />

97. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> recommends that <str<strong>on</strong>g>the</str<strong>on</strong>g> Government:<br />

(a) Redouble efforts <strong>to</strong> move bey<strong>on</strong>d <str<strong>on</strong>g>the</str<strong>on</strong>g> current impasse in relati<strong>on</strong> <strong>to</strong> land<br />

demarcati<strong>on</strong>. This is particularly urgent in <str<strong>on</strong>g>the</str<strong>on</strong>g> states <str<strong>on</strong>g>of</str<strong>on</strong>g> Ma<strong>to</strong> Grosso do Sul, Bahia,<br />

Santa Catarina and Rio Grande do Sul. 18 The executive should develop, in<br />

collaborati<strong>on</strong> with <strong>indigenous</strong> <strong>peoples</strong>, proactive proposals <strong>to</strong> respect and fulfil<br />

<strong>indigenous</strong> <strong>rights</strong> <strong>to</strong> land, through a thorough examinati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> all avenues available.<br />

This should include approaches <strong>to</strong> address <str<strong>on</strong>g>the</str<strong>on</strong>g> judicializati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> demarcati<strong>on</strong><br />

processes and give c<strong>on</strong>siderati<strong>on</strong> <strong>to</strong> appropriate compensati<strong>on</strong> in relati<strong>on</strong> <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

repossessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> lands, recognized in <str<strong>on</strong>g>the</str<strong>on</strong>g> 1988 C<strong>on</strong>stituti<strong>on</strong> as <strong>indigenous</strong> lands, and for<br />

which <str<strong>on</strong>g>the</str<strong>on</strong>g> Federal or state governments granted titles <strong>to</strong> private individuals;<br />

(b) Complete all demarcati<strong>on</strong> processes pending at FUNAI, <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Justice and <str<strong>on</strong>g>the</str<strong>on</strong>g> Presidency, in particular those threatened by development projects,<br />

agribusiness expansi<strong>on</strong> and natural resource extracti<strong>on</strong> activities;<br />

(c) Develop c<strong>on</strong>crete and prioritized acti<strong>on</strong>s <strong>to</strong> guarantee envir<strong>on</strong>mental<br />

protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> lands and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir natural resources and <strong>to</strong> prevent illegal<br />

activities, with due c<strong>on</strong>siderati<strong>on</strong> <strong>to</strong> and respect for <strong>indigenous</strong> <strong>peoples</strong>’ forms <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

organizati<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir special relati<strong>on</strong>ship with <str<strong>on</strong>g>the</str<strong>on</strong>g>ir lands;<br />

(d) Ensure that all courts have a clear and uniform interpretati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

limitati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Raposa-Serra do Sol ruling and its inapplicability <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> issuance <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

evicti<strong>on</strong> orders for <strong>indigenous</strong> <strong>peoples</strong> or <str<strong>on</strong>g>the</str<strong>on</strong>g> halting <str<strong>on</strong>g>of</str<strong>on</strong>g> demarcati<strong>on</strong> procedures. The<br />

Federal Supreme Court should c<strong>on</strong>tinue <strong>to</strong> accept requests for <str<strong>on</strong>g>the</str<strong>on</strong>g> suspensi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

evicti<strong>on</strong> orders and ensure that future rulings c<strong>on</strong>cerning <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong><br />

are fully c<strong>on</strong>sistent with nati<strong>on</strong>al and internati<strong>on</strong>al human <strong>rights</strong> standards.<br />

Self-determinati<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> duty <strong>to</strong> c<strong>on</strong>sult and free, prior and informed c<strong>on</strong>sent<br />

98. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> recommends that <str<strong>on</strong>g>the</str<strong>on</strong>g> Government:<br />

(a) In collaborati<strong>on</strong> with representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and in<br />

accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g>ir right <strong>to</strong> self-determinati<strong>on</strong>, develop a nati<strong>on</strong>al acti<strong>on</strong> plan for<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous<br />

Peoples in keeping with <strong>Brazil</strong>’s commitment at <str<strong>on</strong>g>the</str<strong>on</strong>g> World C<strong>on</strong>ference <strong>on</strong> Indigenous<br />

Peoples; 19<br />

(b) Implement <str<strong>on</strong>g>the</str<strong>on</strong>g> State duty <strong>to</strong> c<strong>on</strong>sult <strong>indigenous</strong> <strong>peoples</strong> in relati<strong>on</strong> <strong>to</strong><br />

projects, policies and legislative and administrative measures that have an impact <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>. Such c<strong>on</strong>sultati<strong>on</strong>s should be c<strong>on</strong>ducted <strong>to</strong> see <str<strong>on</strong>g>the</str<strong>on</strong>g>ir free, prior and<br />

informed c<strong>on</strong>sent in a manner that takes in<strong>to</strong> account <str<strong>on</strong>g>the</str<strong>on</strong>g> specificities <str<strong>on</strong>g>of</str<strong>on</strong>g> each<br />

<strong>indigenous</strong> people, as affirmed in ILO C<strong>on</strong>venti<strong>on</strong> No. 169, <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s<br />

Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous Peoples and <str<strong>on</strong>g>the</str<strong>on</strong>g> Organizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> American<br />

States draft American Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous Peoples. In <str<strong>on</strong>g>the</str<strong>on</strong>g> case <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

development projects, c<strong>on</strong>sultati<strong>on</strong>s should be informed by independent and<br />

participa<strong>to</strong>ry envir<strong>on</strong>mental, social and human <strong>rights</strong> impact assessments;<br />

(c) Acknowledge and support <str<strong>on</strong>g>the</str<strong>on</strong>g> proactive measures taken by <strong>indigenous</strong><br />

<strong>peoples</strong> <strong>to</strong> realize <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>, including <str<strong>on</strong>g>the</str<strong>on</strong>g>ir right <strong>to</strong> self-determinati<strong>on</strong>. This<br />

includes observing and resp<strong>on</strong>ding <strong>to</strong> c<strong>on</strong>sultati<strong>on</strong> and c<strong>on</strong>sent pro<strong>to</strong>cols developed by<br />

<strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State duty <strong>to</strong> c<strong>on</strong>sult; 20<br />

(d) Ensure full respect for <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in voluntary<br />

isolati<strong>on</strong> in accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> United Nati<strong>on</strong>s Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Indigenous Peoples and <str<strong>on</strong>g>the</str<strong>on</strong>g> draft guidelines <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir protecti<strong>on</strong>. 21<br />

Impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> development projects<br />

99. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> rapporteur recommends that <str<strong>on</strong>g>the</str<strong>on</strong>g> Government:<br />

(a) Adopt measures <strong>to</strong> redress <str<strong>on</strong>g>the</str<strong>on</strong>g> impacts and c<strong>on</strong>sequences <str<strong>on</strong>g>of</str<strong>on</strong>g> mining<br />

activities, agribusiness expansi<strong>on</strong> and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r large-scale development projects <strong>on</strong><br />

<strong>indigenous</strong> <strong>peoples</strong>’ health, lands, cultures and way <str<strong>on</strong>g>of</str<strong>on</strong>g> life, including <str<strong>on</strong>g>the</str<strong>on</strong>g>ir social and<br />

ec<strong>on</strong>omic forms <str<strong>on</strong>g>of</str<strong>on</strong>g> organizati<strong>on</strong>. These measures should also address <str<strong>on</strong>g>the</str<strong>on</strong>g> sec<strong>on</strong>dary<br />

impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> such projects, which are <str<strong>on</strong>g>of</str<strong>on</strong>g>ten associated with speculati<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> entry <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

third parties as a result <str<strong>on</strong>g>of</str<strong>on</strong>g> increased ease <str<strong>on</strong>g>of</str<strong>on</strong>g> access <strong>to</strong> <strong>indigenous</strong> lands;<br />

(b) In <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> allegati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> ethnocide in <str<strong>on</strong>g>the</str<strong>on</strong>g> Belo M<strong>on</strong>te case<br />

brought by <str<strong>on</strong>g>the</str<strong>on</strong>g> Public Prosecu<strong>to</strong>r, extreme cauti<strong>on</strong> should be exercised in relati<strong>on</strong> <strong>to</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Belo Sun mining and <str<strong>on</strong>g>the</str<strong>on</strong>g> Tapajós dam projects. These projects should not be<br />

c<strong>on</strong>sidered if <str<strong>on</strong>g>the</str<strong>on</strong>g> potential for similar impacts exists or if <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong><br />

c<strong>on</strong>cerned withhold <str<strong>on</strong>g>the</str<strong>on</strong>g>ir free, prior and informed c<strong>on</strong>sent following <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

faith c<strong>on</strong>sultati<strong>on</strong>s.<br />

Access <strong>to</strong> justice<br />

100. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> recommends that:<br />

(a) The judiciary, <str<strong>on</strong>g>the</str<strong>on</strong>g> legislature and <str<strong>on</strong>g>the</str<strong>on</strong>g> executive give urgent<br />

c<strong>on</strong>siderati<strong>on</strong>, in collaborati<strong>on</strong> with representatives <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>, <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

eliminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> barriers that prevent <strong>indigenous</strong> <strong>peoples</strong> from realizing <str<strong>on</strong>g>the</str<strong>on</strong>g>ir right <strong>to</strong><br />

justice and guarantee that adequate resources be available <strong>to</strong> this end;<br />

(b) The Government initiate dialogue with <strong>indigenous</strong> <strong>peoples</strong> in relati<strong>on</strong> <strong>to</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> possible c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> a nati<strong>on</strong>al inquiry in<strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> allegati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> violati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

<strong>rights</strong>, as well as raise awareness, recognize State wr<strong>on</strong>gdoings and provide redress<br />

for human <strong>rights</strong> violati<strong>on</strong>s.<br />

Capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> government agencies<br />

101. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> recommends that <str<strong>on</strong>g>the</str<strong>on</strong>g> Government:<br />

(a) Provide adequate funding <strong>to</strong> FUNAI, streng<str<strong>on</strong>g>the</str<strong>on</strong>g>ning its capacity <strong>to</strong><br />

deliver services and its role in protecting <strong>indigenous</strong> <strong>peoples</strong>’ land and selfdeterminati<strong>on</strong><br />

<strong>rights</strong>. This necessitates revisiting cuts <strong>to</strong> its budget and ensuring that<br />

local FUNAI <str<strong>on</strong>g>of</str<strong>on</strong>g>fices are not <str<strong>on</strong>g>the</str<strong>on</strong>g> target <str<strong>on</strong>g>of</str<strong>on</strong>g> such measures. Local <str<strong>on</strong>g>of</str<strong>on</strong>g>fices should have<br />

adequate resources <strong>to</strong> be able <strong>to</strong> provide core services that are relied up<strong>on</strong> by o<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

organs <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> State and by <strong>indigenous</strong> <strong>peoples</strong>, including those in voluntary isolati<strong>on</strong>.<br />

The Nati<strong>on</strong>al Council <strong>on</strong> Indigenous Policies should participate in <str<strong>on</strong>g>the</str<strong>on</strong>g> appointment <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> President <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI, who should have <str<strong>on</strong>g>the</str<strong>on</strong>g> necessary technical competence and<br />

political independence <strong>to</strong> fulfil <str<strong>on</strong>g>the</str<strong>on</strong>g> Foundati<strong>on</strong>’s mandate;<br />

(b) C<strong>on</strong>tinue <strong>to</strong> support and streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> Department <strong>on</strong><br />

Indigenous Health <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Health and <str<strong>on</strong>g>the</str<strong>on</strong>g> Department <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>tinuing<br />

Educati<strong>on</strong>, Literacy, Diversity and Inclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Ministry <str<strong>on</strong>g>of</str<strong>on</strong>g> Educati<strong>on</strong>;<br />

(c) Guarantee c<strong>on</strong>diti<strong>on</strong>s for <str<strong>on</strong>g>the</str<strong>on</strong>g> independent and participative functi<strong>on</strong>ing<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Nati<strong>on</strong>al Council <strong>on</strong> Indigenous Policies;<br />

(d) Develop a more resp<strong>on</strong>sive and targeted family allowance programme<br />

for <strong>indigenous</strong> <strong>peoples</strong>, taking in<strong>to</strong> account <str<strong>on</strong>g>the</str<strong>on</strong>g>ir specific situati<strong>on</strong>s;<br />

(e) Draw <strong>on</strong> less<strong>on</strong>s learned and <str<strong>on</strong>g>the</str<strong>on</strong>g> experience <str<strong>on</strong>g>of</str<strong>on</strong>g> FUNAI and <str<strong>on</strong>g>the</str<strong>on</strong>g> Public<br />

Prosecu<strong>to</strong>r’s Office in support <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong><br />

and disseminate <str<strong>on</strong>g>the</str<strong>on</strong>g>m am<strong>on</strong>g o<str<strong>on</strong>g>the</str<strong>on</strong>g>r government agencies, including hig<strong>her</strong> level<br />

government <str<strong>on</strong>g>of</str<strong>on</strong>g>ficials;<br />

(f) Ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> specific training and guidance <strong>on</strong> <strong>indigenous</strong><br />

<strong>peoples</strong>’ <strong>rights</strong> <strong>to</strong> members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary who address issues such as land <strong>rights</strong>,<br />

prior c<strong>on</strong>sultati<strong>on</strong> and adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> children. This could include, for<br />

example, collegial dialogues with members <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> judiciary in countries with an<br />

extensive body <str<strong>on</strong>g>of</str<strong>on</strong>g> jurisprudence <strong>on</strong> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, such as Colombia.<br />

Recommendati<strong>on</strong>s <strong>to</strong> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r ac<strong>to</strong>rs<br />

102. The United Nati<strong>on</strong>s country team should assume a proactive role in promoting<br />

awareness <str<strong>on</strong>g>of</str<strong>on</strong>g> and respect for <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong> in <strong>Brazil</strong> and assist <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Government in <str<strong>on</strong>g>the</str<strong>on</strong>g> realizati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> its duty <strong>to</strong> respect, protect and fulfil those <strong>rights</strong>. In<br />

cooperati<strong>on</strong> with and guided by <strong>indigenous</strong> <strong>peoples</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> country team should support<br />

<strong>indigenous</strong> <strong>peoples</strong> in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir efforts <strong>to</strong> assert and realize <str<strong>on</strong>g>the</str<strong>on</strong>g>ir c<strong>on</strong>stituti<strong>on</strong>ally and<br />

internati<strong>on</strong>ally recognized human <strong>rights</strong> and <strong>to</strong> participate in relevant processes <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Human Rights Council, such as <str<strong>on</strong>g>the</str<strong>on</strong>g> universal periodic review.<br />

103. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> encourages <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian Development Bank (BNDES)<br />

<strong>to</strong> align its policies with those <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r internati<strong>on</strong>al financial instituti<strong>on</strong>s, such as <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Internati<strong>on</strong>al Financial Corporati<strong>on</strong>, and <strong>to</strong> develop specific safeguards aimed at<br />

ensuring that it does not fund projects that pose a risk <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>.<br />

These policies should guarantee that <strong>indigenous</strong> <strong>peoples</strong> are c<strong>on</strong>sulted, <str<strong>on</strong>g>the</str<strong>on</strong>g>ir free,<br />

prior and informed c<strong>on</strong>sent is obtained and transparent and participa<strong>to</strong>ry<br />

envir<strong>on</strong>mental, social and human <strong>rights</strong> impact assessments are c<strong>on</strong>ducted whenever<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> are potentially impacted by a project funded by <str<strong>on</strong>g>the</str<strong>on</strong>g> Bank.<br />

104. In keeping with <str<strong>on</strong>g>the</str<strong>on</strong>g>ir independent obligati<strong>on</strong>s <strong>to</strong> respect <strong>indigenous</strong> <strong>peoples</strong>’<br />

<strong>rights</strong>, corporati<strong>on</strong>s, including banks and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r investment facilities, should c<strong>on</strong>duct<br />

due diligence in relati<strong>on</strong> <strong>to</strong> <strong>indigenous</strong> <strong>peoples</strong>’ <strong>rights</strong>, including <str<strong>on</strong>g>the</str<strong>on</strong>g>ir land and<br />

c<strong>on</strong>sultati<strong>on</strong> and c<strong>on</strong>sent <strong>rights</strong>, both for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own operati<strong>on</strong>s and for those in <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

supply chains. In all cases w<strong>her</strong>e human <strong>rights</strong> have been violated, companies should<br />

participate in meaningful remediati<strong>on</strong> processes in c<strong>on</strong>sultati<strong>on</strong> with <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cerned<br />

<strong>indigenous</strong> <strong>peoples</strong>, use <str<strong>on</strong>g>the</str<strong>on</strong>g>ir leverage <strong>to</strong> prevent fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r <strong>rights</strong> violati<strong>on</strong>s and ensure<br />

appropriate remediati<strong>on</strong>.<br />

105. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> reiterates <str<strong>on</strong>g>the</str<strong>on</strong>g> recommendati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Working Group<br />

<strong>on</strong> Business and Human Rights <strong>on</strong> its missi<strong>on</strong> <strong>to</strong> <strong>Brazil</strong> in 2016 regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> need <strong>to</strong><br />

(a) review <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> security suspensi<strong>on</strong> mechanism in <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>text <str<strong>on</strong>g>of</str<strong>on</strong>g> vulnerable<br />

communities affected by development projects; (b) promptly carry out <strong>indigenous</strong><br />

land demarcati<strong>on</strong> and ensure that it remains <str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibility <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> executive,<br />

c<strong>on</strong>trary <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> proposal c<strong>on</strong>tained in PEC 215 <strong>to</strong> place it under <str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibility <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> legislature; (c) improve <str<strong>on</strong>g>the</str<strong>on</strong>g> capacity <str<strong>on</strong>g>of</str<strong>on</strong>g> and <str<strong>on</strong>g>the</str<strong>on</strong>g> resources allocated <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>Brazil</strong>ian<br />

Institute <str<strong>on</strong>g>of</str<strong>on</strong>g> Envir<strong>on</strong>ment and Renewable Natural Resources (IBAMA) and improve<br />

coordinati<strong>on</strong> between <str<strong>on</strong>g>the</str<strong>on</strong>g> Institute and FUNAI in order <strong>to</strong> streng<str<strong>on</strong>g>the</str<strong>on</strong>g>n <str<strong>on</strong>g>the</str<strong>on</strong>g> regulati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

large development projects and deliver sustained protecti<strong>on</strong> for affected communities<br />

and enable <str<strong>on</strong>g>the</str<strong>on</strong>g>m <strong>to</strong> m<strong>on</strong>i<strong>to</strong>r <str<strong>on</strong>g>the</str<strong>on</strong>g> social and envir<strong>on</strong>mental impacts <str<strong>on</strong>g>of</str<strong>on</strong>g> such projects and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> fulfilment <str<strong>on</strong>g>of</str<strong>on</strong>g> any c<strong>on</strong>diti<strong>on</strong>s imposed in mitigati<strong>on</strong> plans. 22<br />

106. The <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> also urges <str<strong>on</strong>g>the</str<strong>on</strong>g> Government <strong>to</strong> implement <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

recommendati<strong>on</strong>s from <str<strong>on</strong>g>the</str<strong>on</strong>g> 2012 universal periodic review that it had accepted, with<br />

regard <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> need <strong>to</strong> ensure protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> leaders <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> and human<br />

<strong>rights</strong> defenders fighting for <str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong>; awareness campaigns <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>rights</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<strong>indigenous</strong> <strong>peoples</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> laws related <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>m; implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

c<strong>on</strong>sultati<strong>on</strong> and c<strong>on</strong>sent <strong>rights</strong> in accordance with ILO C<strong>on</strong>venti<strong>on</strong> No. 169 and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

United Nati<strong>on</strong>s Declarati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> Indigenous Peoples in relati<strong>on</strong> <strong>to</strong> projects<br />

and legislative and administrative measures impacting <str<strong>on</strong>g>the</str<strong>on</strong>g>m; greater protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir <strong>rights</strong> <strong>to</strong> land, terri<strong>to</strong>ries and resource, as recognized in <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>stituti<strong>on</strong> and<br />

ILO C<strong>on</strong>venti<strong>on</strong> No. 169; and poverty reducti<strong>on</strong> and social services that directly<br />

target <strong>indigenous</strong> <strong>peoples</strong> in a culturally appropriate manner. 23<br />

107. Implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> recommendati<strong>on</strong>s in <str<strong>on</strong>g>the</str<strong>on</strong>g> present report as well as <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

recommendati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> previous mandate holder <strong>on</strong> his visit <strong>to</strong> <strong>Brazil</strong> in 2009, <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Working Group <strong>on</strong> Business and Human Rights and <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> universal periodic review<br />

process should proceed with <str<strong>on</strong>g>the</str<strong>on</strong>g> full and effective participati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong>.<br />

108. The Government <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Brazil</strong> should make every effort <strong>to</strong> address <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>cerns<br />

raised by <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Rapporteur</str<strong>on</strong>g> in <str<strong>on</strong>g>the</str<strong>on</strong>g> present report and live up <strong>to</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> emblematic<br />

global benchmark that <strong>Brazil</strong> had set for <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>indigenous</strong> <strong>peoples</strong> in its<br />

1988 C<strong>on</strong>stituti<strong>on</strong> and through its ratificati<strong>on</strong> and adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> internati<strong>on</strong>al human<br />

<strong>rights</strong> instruments. To realize this, <str<strong>on</strong>g>the</str<strong>on</strong>g> measures outlined in <str<strong>on</strong>g>the</str<strong>on</strong>g>se recommendati<strong>on</strong>s<br />

are urgently required.<br />
