<strong>Scholarships</strong> <strong>Awarded</strong> <strong>to</strong> <strong>59</strong> <strong>High</strong> <strong>School</strong> <strong>Graduates</strong>.<br />

On April 5th, <strong>2010</strong>, 82 members of the Summit <strong>High</strong> <strong>School</strong> Class of <strong>2010</strong> were awarded approximately $297,000 from 65 community organizations.<br />

Among these awards, The Summit Foundation and its partners provided 52 students with $106,500 in scholarships. Eight of these scholarships awarded<br />

by The Foundation were distributed through a joint program with Summit County Government (SCG.) Since 1991, The Foundation’s scholarship program<br />

has awarded more than $1.4 million <strong>to</strong> local high school graduates.<br />

In addition <strong>to</strong> the scholarships awarded <strong>to</strong> Summit <strong>High</strong> <strong>School</strong> graduates, scholarships were awarded this spring <strong>to</strong> students graduating from neighboring<br />

community high schools, as well as through a scholarship program offered by NRC Broadcasting through The Summit Foundation, bringing the <strong>to</strong>tal value of<br />

the scholarships awarded <strong>to</strong> <strong>59</strong> students through The Summit Foundation in Spring <strong>2010</strong> <strong>to</strong> $122,752.<br />

Board of Trustee Profile.<br />

Phyllis Martinez<br />

Gary and Phyllis Martinez<br />

Born and raised in Chicago, Phyllis graduated from Northwestern University<br />

and worked as a teacher of the hearing impaired in Illinois for several years.<br />

In 1975, with a newly acquired passion for skiing, she headed <strong>to</strong> the<br />

mountains of Summit County, living and skiing at Copper Mountain for a year,<br />

and then settling in Breckenridge and beginning her fundraising career at<br />

The Keys<strong>to</strong>ne Center. Phyllis met husband Gary, the current Summit County<br />

Manager, on a blind date that ended with a pool game at Shamus O’Toole’s<br />

Roadhouse Saloon (now the “Breckenridge Theater”). Despite that ominous<br />

beginning, they found they had much in common—including a dedication <strong>to</strong><br />

public service and building community—and married in 1980. Other than a<br />

six-year hiatus in Eagle County, Phyllis and Gary have lived in Breckenridge<br />

continuously, raising two sons, and enjoying a full life in what, they believe, is<br />

the best place on earth.<br />

Phyllis has served in a number of paid and volunteer positions in fundraising<br />

and marketing. She worked for The Keys<strong>to</strong>ne Center for over 11 years,<br />

serving as Direc<strong>to</strong>r of Development and Communications, and as Direc<strong>to</strong>r of<br />

Development for the Heuga Center for Multiple Sclerosis during her time in<br />

Eagle County. She managed accounts and special events for Cope Daley<br />

McCrea Public Relations, and now serves as a Community Liaison for the<br />

Colorado Mountain College Foundation, raising capital and special program<br />

funds for the Summit and Timberline campuses. She finds volunteering for<br />

local events and nonprofits one of the most rewarding parts of life in Summit<br />

County, and has served on the Boards of the Backstage Theatre and<br />

Bristlecone Health Services, and is a former President of the Breckenridge<br />

Festival of Film.<br />

Phyllis and Gary have been involved with The Summit Foundation as<br />

donors and volunteers since the organization’s inception in 1984. Gary<br />

was a member of The Foundation’s Board of Trustees for 15 years, from<br />

1990 <strong>to</strong> 2001; Phyllis has served on the Board since 2007. She currently<br />

is active on The Foundation’s Grant and Scholarship Committee and the<br />

Marketing Committee.<br />

Phyllis believes The Summit Foundation makes Summit County a better place<br />

<strong>to</strong> live and visit. “The Foundation makes it easy for people <strong>to</strong> feel a part of our<br />

community,” she says. “It’s the most important resource in Summit County<br />

for nonprofits—and for creating opportunities for philanthropy and volunteerism<br />

for everyone—whether they are new <strong>to</strong> the area—or have lived here for<br />

30 years.”<br />

A special thank you <strong>to</strong> Keys<strong>to</strong>ne Resort and Vail Resorts<br />

Echo for hosting our inaugural first tracks program on<br />

March 4th. We were pleased <strong>to</strong> greet nearly 100 of The<br />

Summit Foundation’s passholders and <strong>to</strong>p donors for an<br />

exclusive morning at Keys<strong>to</strong>ne Resort.<br />

The Summit Foundation’s guests enjoyed skiing on freshly<br />

groomed runs on North Peak before the mountain<br />

opened <strong>to</strong> the general public. A private breakfast followed<br />

at The Outpost and a few guests rode the gondolas <strong>to</strong><br />

join us for breakfast.<br />

While serving as a thank you <strong>to</strong> our donors for their<br />

continued support <strong>to</strong> The Foundation, the event also<br />

served as a celebration of a successful endowment fund<br />

campaign—which had been kicked off a year previous<br />

in honor of The Summit Foundation’s 25th anniversary.<br />

Death and Taxes: What the Heck is Going on with the Estate Tax?<br />

By Steven R. Smith, JD, CFP ®<br />

According <strong>to</strong> Ben Franklin, “nothing can be said <strong>to</strong> be certain, except<br />

death and taxes.” Today, due <strong>to</strong> legislation signed by President George W.<br />

Bush in 2001, nothing is more uncertain than the confluence of death<br />

and taxes—the federal estate tax.<br />

Enacted in 1916, this tax applies <strong>to</strong> wealth transferred <strong>to</strong> beneficiaries upon<br />

the death of the property owner. There are several, fundamental moving<br />

parts we’ll skim over:<br />

1. The exemption amount (the value of property at death above which tax<br />

is imposed upon)<br />

2. The marital deduction for property passing <strong>to</strong> a surviving spouse<br />

3. The charitable deduction<br />

4. The tax rate on the taxable estate<br />

Of course, estates face a myriad of collateral issues, such as:<br />

1. The successor’s cost basis for inherited property<br />

2. The Generation Skipping Transfer Tax (GSTT) when grandchildren and<br />

beyond benefit<br />

3. The federal gift tax imposed on <strong>to</strong>tal lifetime transfers above $1 million<br />

Most taxpayers will need <strong>to</strong> tend <strong>to</strong> the basics. For others, execution of<br />

an intricate strategy through a highly skilled team of professionals may<br />

be advised.<br />

A Tortured His<strong>to</strong>ry.<br />

The Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA)<br />

raised the estate tax exemption gradually <strong>to</strong> $3.5 million in 2009; lowered<br />

the maximum estate tax rate <strong>to</strong> 45%; eliminated the estate tax and the<br />

GSTT in <strong>2010</strong>; and sunsets on December 31st—res<strong>to</strong>ring prior law and<br />

satisfying rules against increasing the budget deficit for more than ten<br />

years. That makes the 2011 exemption amount $1 million. Also under<br />

EGTRRA for <strong>2010</strong>: “carry-over” rather than “step up” rules apply for the<br />

tax basis of inherited property (subject <strong>to</strong> certain exemptions.)<br />

Continuing <strong>to</strong> Benefit The Summit Foundation.<br />

The Summit Foundation will again be the beneficiary of the <strong>2010</strong> Breck Crest<br />

Mountain Marathon. Comprised of 5 mile, Half Marathon, and Marathon<br />

trail runs, the races are scheduled for Sunday, September 5, <strong>2010</strong> in<br />

conjunction with The Summit Foundation’s 23rd Anniversary Rubber Duck<br />

Races. $5 from each race entry will be donated <strong>to</strong> The Summit Foundation.<br />

As the event beneficiary over the past three years, The Summit Foundation<br />

has received $6,700 in proceeds from event promoter Jeff Westcott<br />

and his company, Maverick Sports Promotions, as well as event sponsors<br />

and participants.<br />

Born of a political tug-of-war between conservatives bent on permanent<br />

repeal and moderates and liberals aiming <strong>to</strong> retain the tax, both sides want<br />

<strong>to</strong> blame the other for the turmoil.<br />

Talk About a Moving Target.<br />

Given what goes in<strong>to</strong> a sound estate plan, families want one that, unrevised,<br />

works for five <strong>to</strong> ten years. The current morass makes it unlikely that a plan<br />

could be optimal for deaths in 2009, <strong>2010</strong> and beyond.<br />

A typical estate plan consists of two trusts: one maximizes the exemption<br />

amount (a credit-shelter or family trust), the other captures the unlimited<br />

marital deduction. The two trusts eliminate taxes on family wealth equal <strong>to</strong><br />

twice the exemption amount. Under the 2009 regime that might have been<br />

$7 million. For deaths occurring in 2011 and thereafter the <strong>to</strong>tal exempt<br />

amount would be $2 million; resulting in a difference in after tax family wealth<br />

of around $2.5 million—a good reason <strong>to</strong> consider the charitable deduction.<br />

Will There be a Fix?<br />

Only the most cynical thought we would be here <strong>to</strong>day, with most practitioners<br />

confident of resolution before January 1, <strong>2010</strong>. The House passed a bill<br />

making the 2009 rules permanent—the Senate never acted. President<br />

Obama’s proposed budget includes similar provisions. Could we see<br />

legislation retroactive <strong>to</strong> January 1st? Such an act might not be constitutional,<br />

and families could wait years for the courts <strong>to</strong> decide. The farther we get<br />

in<strong>to</strong> <strong>2010</strong>, the less likely it is. For those families and their advisors willing<br />

<strong>to</strong> wade in<strong>to</strong> this mire <strong>to</strong>gether, extreme flexibility would be in order. Not <strong>to</strong><br />

mention a sense of humor.<br />

The popular annual event is known for its rugged nature, elevation gain,<br />

and incredible scenery. All races are run on dirt singletrack trails and forest<br />

service roads in the Ten Mile Range above Breckenridge. One of the most<br />

difficult and scenic long-distance events in America, the near-marathon<br />

distance race traverses the Ten Mile Range above timberline and rises <strong>to</strong><br />

an altitude of 12,400 feet.<br />

Help The Summit Foundation Drop<br />

12,000 Ducks In<strong>to</strong> Blue River on September 4th.<br />

Saturday, September 4, <strong>2010</strong> will bring thousands of people <strong>to</strong>gether in<br />

Breckenridge <strong>to</strong> join in the festivities at The Summit Foundation 23rd<br />

Annual Great Rubber Duck Race. The fun will begin at 11 a.m. and<br />

continue throughout the afternoon with three amazing races with family<br />

friendly activities throughout the day.<br />

The Summit Foundation is looking forward <strong>to</strong> a competitive field of over<br />

12,000 little rubber ducks racing from Main Street Station <strong>to</strong>wards the<br />

finish line at the Riverwalk Center. The ducks have been training all year<br />

and are vying for the <strong>to</strong>p 25 spots for amazing prizes valued over $10,000.<br />

Help The Summit Foundation send 12,000 ducks down Blue River by<br />

adopting ducks at summitfoundation.org or various locations throughout<br />

the county throughout the month of August and early September.<br />

Register Now for The Grand Lodge<br />

on Peak 7 Annual Golf Tournament.<br />

Twenty-three years of tradition carries on this year as The Summit Foundation hosts<br />

The Grand Lodge on Peak 7 Annual Golf Tournament on June 13 and 14, <strong>2010</strong>.<br />

Thank you again <strong>to</strong> Grand Lodge on Peak 7 for the continued title sponsorship support.<br />

Hosted by the Town of Breckenridge at the Breckenridge Golf Club, the one-day<br />

<strong>to</strong>urnament is limited <strong>to</strong> 36 four-person teams. Sunday evening, June 13th, players<br />

and sponsors will be brought <strong>to</strong>gether at the Breckenridge Golf Course for the Burke &<br />

Riley’s/Clubhouse Restaurant Welcome Party and Calcutta. Monday morning,<br />

June 14th, a shotgun start will send 36 teams out on the greens. The day will<br />

continue with on-course games and challenges, lunch, and each team vying for the<br />

coveted trophy and prize winnings. Immediately following <strong>to</strong>urnament play, the Coors<br />

19th Hole Tournament party includes a silent auction and awards presentation.<br />

Sponsorship for a team of four is $1,500. In addition <strong>to</strong> supporting The Summit<br />

Foundation and the many nonprofit organizations The Foundation serves, the buy-in<br />

offers many benefits <strong>to</strong> the players throughout the day’s event. It entitles each player<br />

Mountain Art Gathering returns in 2011.<br />

The Summit Foundation Mountain Art Gathering will take a break in <strong>2010</strong> and will<br />

return in a re-energized form in 2011. As Keys<strong>to</strong>ne Neighborhood Company is<br />

constructing a new pavilion structure <strong>to</strong> replace the current tent structure, The<br />

Foundation became concerned about the availability of the venue for the summer<br />

of <strong>2010</strong>. This and other fac<strong>to</strong>rs prompted The Foundation <strong>to</strong> take a break for<br />

<strong>2010</strong>, but commit <strong>to</strong> a rejuvenated event in 2011. Watch for more details from us<br />

in 2011.<br />

Jim and Jimmy Patalan<br />

Jim Patalan was raised in the suburbs of Detroit. He has<br />

very fond memories of visiting his brother in Colorado,<br />

and could always see himself as part of a community in<br />

Colorado. That vision became reality 11 years ago when<br />

Jim became a resident of Park County. He thoroughly<br />

enjoys all that Park and Summit County have <strong>to</strong> offer.<br />

Jim and his son, Jimmy, have been actively involved<br />

in many charitable and community activities over the<br />

years, including volunteering with the Breckenridge<br />

Festival of Film, National Reper<strong>to</strong>ry Orchestra, Team<br />

Breckenridge, Town of Breckenridge and The Summit<br />

Foundation. Jim takes pleasure in teaching Jimmy<br />

responsibility and the importance of giving back<br />

through volunteering.<br />

Jimmy is currently a 7th grader at Summit Middle <strong>School</strong><br />

and has really taken a liking <strong>to</strong> his role as “The Duck”<br />

during The Summit Foundation’s annual duck race,<br />

sporting the duck costume, and entertaining kids and<br />

adults alike. Jimmy has been volunteering with his Dad<br />

for over three years and is happy <strong>to</strong> be able <strong>to</strong> support<br />

his community and give back. They believe volunteering<br />

is a great way <strong>to</strong> meet other wonderful volunteers and<br />

be a part of something bigger.<br />

Breckenridge Festival of Film<br />

The cast of the <strong>2010</strong> Murder Mystery Dinner, one of the Festival’s annual fundraisers.<br />

Breckenridge Festival of Film (BFF) is one of the oldest independent film festivals in the United States.<br />

Now in its 30th year, the BFF is hosted by nationally-known film critic Jeffrey Lyons who serves as<br />

master of ceremonies and modera<strong>to</strong>r of the discussions and forums along with his son Ben Lyons, E!<br />

Network’s resident film expert. The four-day event held each June (June 10 – 13, <strong>2010</strong>) in our own<br />

community, features a unique array of independent films, premieres, film education programs, and<br />

personal retrospectives of featured guests.<br />

The mission of the Breckenridge Festival of Film is <strong>to</strong> enrich lives through the ideas and emotions<br />

inspired by the art of filmmaking. The Festival is also a means <strong>to</strong> celebrate independent filmmakers,<br />

enrich the cultural community of Summit County, and provide a educational, creative, and inspirational<br />

learning environment where participants can focus on their craft and interact intimately with guest<br />

filmmakers and men<strong>to</strong>rs throughout this four-day Festival.<br />

Through the generous funding of The Summit Foundation, the BFF continues <strong>to</strong> educate and inspire<br />

both the youth and aspiring filmmakers of Summit County. We bring in visi<strong>to</strong>rs from not only Denver<br />

and the Front Range but also from all around the country. Each year, the Festival offers seminars with<br />

<strong>to</strong>p professionals in the industry and features films never before seen or premiered.<br />

The Summit Foundation is a strong supporter of the Breckenridge Festival of Film’s youth and education<br />

programs, which highlight our own Summit County rising stars. For five years, the BFF has showcased<br />

the Best of Summit <strong>High</strong> <strong>School</strong>’s student films created by our own Summit <strong>High</strong> <strong>School</strong> students.<br />

The Festival works with Summit <strong>High</strong> <strong>School</strong> film teacher Scott Porter <strong>to</strong> help the students network<br />

with the industry professionals we bring in <strong>to</strong> attend seminars. The Summit <strong>High</strong> students also show<br />

their films and learn more about how <strong>to</strong> continue in the career of filmmaking. Last year, the Festival<br />

showcased 12 films produced by Summit <strong>High</strong> students and held free seminars with 10 <strong>to</strong>p industry<br />

professionals for those students.<br />

The Festival has also featured children’s movie premieres over the past five years including Kung Fu Panda,<br />

Race <strong>to</strong> Witch Mountain, and Shark Tale among others.<br />

The BFF is a 501(c)(3), private, nonprofit organization governed by a volunteer board of direc<strong>to</strong>rs.<br />

Funding for the Festival comes from local public and private grants, sponsorships, fundraising events,<br />

individual contributions, in-kind assistance, and revenue from tickets and merchandise. More than<br />

150 individual volunteers, four local theaters, and other venues are involved in this annual event.<br />

Tickets for the Festival are extremely affordable with individual movie tickets just $10. Four-punch<br />

passes can be purchased for $34 and are transferable. An all-access pass <strong>to</strong> all movies and parties<br />
