hen accountability (ehtisab) is understood as a performance
audit as well besides a fiscal one will the mohtasib be seen to
Wperform his or her job of ehtisab. In other words, there is a need
to have another watchdog to watch this watchdog. An examination of the
demographic of public thronging the secretariat suggests that there is a
pretty large number of people from the moffusil towns and even remote
villages that seek redress at Srinagar for matters that should have been
addressed at the village level or at the most by district administrations. On
paper governance is decentralized to a certain extent, but is it so on ground?
Ideally only about ten percent of the cases related to governance should
have to make its way to the state secretariat, and only policy matters should
need the direct attention of the Chief Minister. But we seem to have an
inverted pyramid as far as the state is concerned. The situation at the
national level is no better. The hands-on, pro-active approach by Prime
Minister Modi in running the affairs of the government does not square up
with his much asserted 'maximum governance, minimum government'
promise, unless he understands government to mean bureaucracy.
Sometimes it is difficult to decide who actually is the Minister of External
Affairs of the country, Modi himself or Mrs. Sushma Swaraj? Likewise, is
Arun Jaitley the Finance Minister or the Defence Minister when he is not
the chief spokesman of the government, a role he has assigned to his own
self? The government at the centre seems to be made up of just about half a
dozen of ministers, who are beginning to look more and more like members
of the Roman senate. The other ministers seem to have become superbureaucrats.
In our own state, the case is not much different. Civil
administration seems to be concentrated in the hands of just a handful of
people, not all being elected representatives of people or government
appointees. These people decide on much that is supposed to be
government with all its wings, organs and departmental structure. What a
district magistrate is empowered to decide gets decided elsewhere. How a
Chief Minister ought to lead the government, or the Prime Minister lead the
nation appears, sometimes, confusing to people at large. It is hoped that,
henceforth, there is clarity on several issue that worry the people of this
land, on issues that are emotive or induce insecurity among sections of
people, or trends that appear to cause an amount of unease or doubt in the
general population.
“Separation Is A Wound Which Can`t Heal up Except
Those Who Gives The Wound”
By: Historian Willams
A Divided Movement
n July 1914, Gandhi left South Africa
to return to India. He supported the In 1931,
IBritish war effort in World War I but a f t e r B r i t i s h
remained critical of colonial authorities for authorities made
measures he felt were unjust. In 1919, Gandhi s o m e
launched an organized campaign of passive c o n c e s s i o n s ,
resistance in response to Parliament's Gandhi again
passage of the Rowlett Acts, which gave called off the
colonial authorities emergency powers to r e s i s t a n c e
suppress subversive activities. He backed off movement and
after violence broke out–including the a g r e e d t o
massacre by British-led soldiers of some 400 r e p r e s e n t t h e
Indians attending a meeting at Amritsar–but Congress Party at
visible figure in the movement for Indian C o n f e r e n c e i n
As part of his nonviolent non- some of his party
cooperation campaign for home rule, Gandhi colleagues–particular
stressed the importance of economic ly Mohammed Ali
independence for India. He particularly Jinnah, a leading
advocated the manufacture of khaddar, or voice for India's Muslim
homespun cloth, in order to replace imported m i n o r i t y – g r e w
textiles from Britain. Gandhi's eloquence and frustrated with Gandhi's
embrace of an ascetic lifestyle based on methods, and what they
Gandhi turned the independence movement strikes in protest of the
eturn for Indian cooperation with the war
effort. Instead, British forces imprisoned the
entire Congress leadership, bringing Anglo-
Indian relations to a new low point.
Partition:
After the Labor Party took power in
Britain in 1947, negotiations over Indian home
rule began between the British, the Congress
Party and the Muslim League (now led by
Jinnah). Later that year, Britain granted India
its independence but split the country into two
dominions: India and Pakistan. Gandhi
strongly opposed Partition, but he agreed to it
in hopes that after independence Hindus and
Muslims could achieve peace internally. Amid
the massive riots that followed Partition,
Gandhi urged Hindus and Muslims to live
peacefully together, and undertook a hunger
strike until riots in Calcutta ceased.
On July 17, 1944, Gandhi wrote a letter to
Jinnah and requested to meet him. Jinnah,
with the approval of the Muslim League,
agreed to meet Gandhi in Bombay. The Talks
lasted from September 19, 1944 to September
24, 1944. Jinnah presented the stance of the
Muslim League while Gandhi told him that he
had called upon him in a personal capacity.
The stressed nutshell of the Gandhi's talk was
that a separate homeland for the Muslims was
“nothing but a ruin for the whole of India”. Mr.
Gandhi said, “If, however, Pakistan had to be
conceded, the areas in which the Muslims are
in an absolute majority should be demarcated
by a Commission approved by both the
Congress and the Muslim League. The wishes
of the people of these areas will be obtained
through Referendum. These areas shall form
a separate state as soon as possible after
India is free from foreign domination. There
shall be a treaty of separation which should
also provide for the efficient and satisfactory
administration of foreign affairs, defense,
internal communication, custom and the like
which must necessarily continue to be the
matters of common interest between the
contracting countries”.
Jinnah explained the Muslim stance
that the Muslims were a nation according to
any definition of nation with a distinctive
outlook of life and on life and that they were a
nation of 100 million. He also clarified that the
separation of a Muslim state was in favor of not
only Muslims but it would also benefit the rest
of India. The talks ended in smoke because
Jinnah did not agree with
Gandhi that the whole of the
power should be transferred
to the Congress after attaining
independence from the British
Raj and then Congress
w o u l d g r a n t
freedom to the
Muslims.
Death of Gandhi
I n J a n u a r y
1948, Gandhi
carried out yet
another fast,
this time to
bring about
peace in the
city of Delhi.
On January
30, 12 days
after that fast
ended, Gandhi
was on his way to
an evening prayer
meeting in Delhi
when he was shot to
death by Nathuram
Godse, a Hindu
fanatic enraged by
Mahatma's efforts
to negotiate with
Jinnah and other
Muslims. The next
day, roughly 1 million
people followed the
p r o c e s s i o n a s
Gandhi's body was
The conflict in Kashmir is rooted in the painful
birth of India and Pakistan.
Britain relinquished its control of the Indian
subcontinent in 1947, splitting it into a
predominantly Hindu India and a Muslim
Pakistan.
Murder of Humanity in Kashmir
he bloodbath continues in the valley of
Reshis and Sufi's , makes anybody to
understand that in troubled state of TJammu and Kashmir Humanity have
taken a long holiday here , on contrary, murder
of humanity is now a reality on the road shows.
Islam is universal in outlook and speaks for
humanity as a whole. It has no chosen race or
people, nor does it give preferences to anyone
except in terms of virtue and uprightness of
character.
Islam endeavors to set up cooperation
and close knitted society in which people enjoy
equal rights, and their duties are tied to each
other by the bounds of love, respect, and
cooperation.The incidents happening in
Kashmir needs global condemnation and keen
attention for amelioration. The doing of good
and forbidding of evil is one of the most
important principles of faith and ensures the
healthy progress of a society. In the modern
world, the media plays an important role in
influencing the life structure of the society.
Therefore, it is highly important to put the right
people in its in-charge.
Where are so called Civil Society
members, Intellectuals, religious organisations,
Islamic Clerics, responsible Citizens, Social
Activists, Human Rights Defenders and so on ?
Do not you people can raise your voice high
against the loss of precious human lives. Cannot
you people preach the masses and take an
initiative towards peace and development.
Evey matter needs peaceful atmosphere and
holistic discussion to find a solution. Bullet,
Violence and terrorism will lead us towards
annihilation. We are losing our young
generation to the gun.
We have lost 11 individuals, Kashmiris
and humans from last 24 hours. Encounters ,
Civil Killings, Hartals, stone pelting, burning of
Karar Hashmi
Institutions, ambush, and so on have become
mouth piece of everybody living in the state of
Jammu and Kashmir. It is true that Violence is
met with the violence only but result of all this
frenzy mess is that we are hastly moving
towards the Civil war in the valley in which
brother will kill his own brother without
knowing the logic of execution such sinful
act.Whether a police man, Army men or a
Militant is killed in the Kashmir, it is worth
condemnable and murder of the humanity. From
last two days dozens of Mothers have lost their
kiths and kins and it is she who knows the actual
pain and anguish. Mere condemnation,
statements and bandh calls cannot silent the gun
culture, violence and terrorism in the State of
J&K. We have collectively found a peaceful way
and get the things diplomatically done and
executed.
The Indian leadership and Pakistan must
come forward to find a peaceful way as per
wishes of the Kashmiris in finding a lasting
solution for the betterment of humanity in
keeping view the present Scenario into
NIGHT FLIGHT
(The more the cost is passed on, the higher it becomes – but pay someone must)
Shantiveer Kaul
Certain things have an afterlife. And
certain a life after. It is in the latter
category that leaves or flower petals
pressed in the pages of books and certain books
themselves fall. In early seventies of the
century gone by when Sartre and Camus had
already been deconstructed, in a manner of
speaking, in our mind's eye – suddenly Andre
Gide, who was their senior, began to fascinate
us. In our trilingual minds pace, where Urdu
and Kashmiri occupied equal salience and
Iqbal, Ghalib, Faiz and Manto were discussed
as animatedly as Akhtar, Nadim, Kamil and
Rahi, there was something awe-inspiring
about the authors from shores afar who came to
us enveloped in the heady smell of some exotic
paper crackling like fresh currency notes
directly off the shelves of Kashmir Book Shop.
A visit to the bookshop was a rarely missed
ritual and a new arrival would cause feverish
excitement and the news of that arrival would
go around a group of people very quickly
indeed. So, it was the time when we would be
discussing the ideas of Ayn Rand in the
University Campus that an old French writer
made an appearance on the
bookshelves of Kashmir Book
Shop. Antoine de Saint-Exupery
had written the book 'Night Flight'
in 1931 and it had shortly become an
i n t e r n a t i o n a l b e s t s e l l e r .
Incidentally, Gide wrote the
foreword to its first edition. In 1932
it was translated into English by
Stuart Gilbert and the next year –
1933 – turned into a movie starring
Clark Gable. It was recreated in an
Italian opera in 1940 and continued
to be printed in modest numbers for
many years in editions in French,
English and several other languages
it was translated into. The book had enjoyed a
fair run of success and almost completed its
life cycle without being classified as a classic.
However, it appeared that in the early 70s the
book, Gilbert's translation of it in particular,
got another lease of life internationally and
also in Kashmir. Suddenly it became de
rigueur to read or appear to have read it.
The book is about the night flight of an
mail carrying aircraft of Patagonia Mail which
its owner forces the pilot to undertake during a
thunderstorm. Now, in 1930s there were no
flight instruments and facilities either on board
or on ground and night flying was akin to a
game of Russian roulette with the odds heavily
stacked against the pilot. If a thunderstorm is
thrown into the mix, one can see the kind of
stage Saint-Exupery has set in this novel. The
owner is in radio contact with the pilot as the
situation becomes progressively more
dangerous for the flight and then the radio
contact is lost. It is here that the book ends. A
major concern of the novel is whether 'karma'
(the imperative of action that defines life) is
more important than life itself.
Having read the book in 1972 or
thereabouts, I did not remember all this – the
plot and the background of the writer and the
book. There was a vague memory of a speech
by a character that had stayed, in some form,
with me. And the other day it haunted me to the
extent that I had to get hold of a copy of the
book and re-read it after forty years. And there
was that speech again – "We don't ask to be
eternal. What we ask is not to see acts and
objects abruptly lose their meaning. The void
surrounding us then suddenly yawns on every
side." It was then that the answer to the
question: “Why do some books have a 'life
after'?” hit me. Some books, like some events
and some people, have certain truths within
them which make us revisit them across time.
It is not like clothes or hairstyles, that tend to
get repeated in a cyclical manner. The truths in
these books, or events, or people – are
immutable. And these are the kinds of truths
that define civilization.
"We don't ask to be eternal. What we
ask is not to see acts and objects abruptly lose
their meaning. The void surrounding us then
suddenly yawns on every side" Who is doing
what 'karma' in Kashmir and what will the
result of that be, for the result will certainly be
there. The more the cost is passed on, the
higher it becomes – but pay someone must. In
the unfortunate situation Kashmir finds itself
in, it has become easy for everyone to blame
everyone else except himself or herself. But at
the end of the day the bereaved are all
Kashmiris, all of them - wherever they are.
ARTICLE 35 A
“It is an article that empowers
the J&K state`s Legislature to
define “permanent residents”
of state and provide special
rights and privilege to those
permanent residents”
M
Historical and Legal Facts
Order, 1954 - issued by the President of India, "in
exercise of the powers conferred by" clause (1) of
Article 370 of the Constitution, with the concurrence
of the Government of the State of Jammu and
Kashmir. The 1927 hereditary State Subject Order
granted to the state subjects the right to government
office and the right to land use and ownership, which
were not available to non-state subjects.
Insertion of article 35 A into Indian constitution:
Following the accession of Jammu and Kashmir to
the Indian Union on 26 October 1947, The Maharaja
ceded control over defence, external affairs and
communications (the 'ceded subjects') to the
Government of India. The Article 370 of the
Constitution of India and the concomitant
Constitutional Order of 1950 formalized this
relationship. Discussions for furthering the
relationship between the State and the Union
continued, culminating in the 1952 Delhi Agreement,
whereby the governments of the State and the Union
agreed that Indian citizenship would be extended to
all the residents of the state but the state would be
empowered to legislate over the rights and privileges
of the state subjects, who would now be called
permanent residents. Following the adoption of the
provisions of the Delhi Agreement by the Constituent
Assembly of Jammu and Kashmir, the President of
India issued The Constitution (Application to Jammu
and Kashmir) Order, 1954, through which Indian
citizenship was extended to the residents of the state,
and simultaneously the Article 35A was inserted into
the Indian constitution enabling the State legislature
to define the privileges of the permanent residents
any Pandits leaders and reformist especially
Jai LalKilam , ShankerLalKoul , Jia Lal Jalali started
agitation against for securing rights of state subject
the outcome of which was that Persian language was
removed and replaced by Urdu language in the reign
of Maharaja Pratab Sngh. This had negative impact
on pundit community who were not acquainted with
new language fully were thrown out by Maharaja
Pratap Singh. An influx of Urdu knowing Punjabi
Muslim from India came to Kashmir and Maharaja
recruited them. This created bitterness among Pandits
and they started opposing the recruitment of Indian
in Kashmir courts and British residency supported
them as well. The result of this agitation was creation
of state subject definition committee soon after the
accession of Maharaja Hari Singh after 1926 CA.The
new definition arrived at the committee was accepted
by new Maharaja Hari Singh in 1927.So there after
impoverished region in the
peace at his home last year
people joined his funeral
prayers. A relentless fighter,
Sheikh Zakiri remained active
in the public life of Kargil, a key
strategic town in the Ladakh region
of Kashmir. Zakiri was deeply influenced
by Islamic Revolution of Iran and its founder
Imam Roohullah Khomeini. During the Islamic
Revolution in Iran he fully realized the guiding
spirit of the revolution which is to revive the true
In1989 Zakiri with his fallowers
founded an Islamic orginization name it
which played a key role, not only in
educational and social sectors, but gave a
new direction and meaning to politics of
principles of Iran's revolution and inculcated them among his disciples. Despite his
influence he remained down to earth personality, a reason he earned love and respect
among the masses. He always stressed on purity of soul which reflects the true
teachings of Islam and guides to moderation which is must in this age where everyone
seems to be in race of getting more and more. He kept
himself away from greed of this materialistic world and
remained sharply focused on welfare of humankind to
gain pleasure of The Almighty Allah.
His established IKMT-backed candidates not only
reached state assembly but to parliament as well thus
breaking the myth of Ladakh being a monopoly of a
from within by the conservative clergy but also from the
established political parties of the state all his life. He
however successfully thwarted their attempts to split the
community for their vested political interests. Zakiri was
heard urging people to remain united and steadfast and
work for the overall development of Kargil. Zakiri was a
combatant scholar who sincerely struggled all his life for
Zakiri, would be remembered for long
but also for his contribution in the socioeconomic
of the people of Kargil.
