penses in curred as a re sult of Ruidoso Horse Sale Co.’s dis po si tion of the items
con tained in the Re pos i tory.
Pur chaser may elect Re jec tion only upon com ply ing with the fol low ing:
(1) Written state ment from Pur chaser re quest ing Re jec tion must be re ceived by the
Ruidoso Horse Sale Co. within twenty-four (24) hours af ter the ses sion in which the
horse is sold and Be fore the horse leaves the Ruidoso Horse Sale grounds;
(2) Ra dio graphs of the sub ject horse must be taken within twenty-four (24) hours after
the ses sion in which the horse is sold and be fore the horse leaves the Ruidoso
Horse Sale grounds;
(3) cop ies of the Ra dio graphs to gether with Pur chaser’s vet er i nary cer tif i cate (“Neg a-
tive Cer tif i cate”) con tain ing the opin ion of Pur chaser’s vet er i nar ian de scrib ing in detail
the spe cific de fect on which the claim is based and that de fect, in the opin ion of
the cer ti fy ing vet er i nar ian will, more likely than not, ma te ri ally and ad versely af fect
the horse’s suit abil ity for train ing and rac ing.
In the event ra dio graphs placed in the Re pos i tory do not rea son ably re veal the de fect
de scribed in the Neg a tive Cer tif i cate, Con signor shall ei ther ac cept Re jec tion or deliver
to Ruidoso Horse Sale a Con signor’s vet er i nary cer tif i cate con trary to that of
the Pur chaser (“Pos i tive Cer tif i cate”). The Pos i tive Cer tif i cate must be re ceived by
Ruidoso Horse Sale Co. within twenty-four (24) hours of Con signor’s re ceipt of the
Neg a tive Cer tif i cate.
In the event of a re ceipt by Ruidoso Horse Sale Co. of a Neg a tive and Pos i tive Cer tif i-
cate, Ruidoso Horse Sale Co. will pro vide Con signor and Pur chaser with a list of a
min i mum of five (5) vet er i nar i ans and a panel of three (3) vet er i nar i ans shall be convened
in the same man ner as pro vided for in Con di tion Thir teen-Ar bi tra tion. The
Con signor and Pur chaser ac knowl edge that the se lec tion pro cess is fair and reason
able to each of them. A panel of three (3) vet er i nar i ans shall be elected.
Ruidoso Horse Sale Co. shall pro vide Con signor and Pur chaser (or their rep re senta
tives) with a list of not less than five (5) vet er i nar i ans. Con signor shall have the
first strike of the vet er i nar ian deemed most un ac cept able to him, and Pur chaser
shall have the sec ond strike, and they shall al ter nate there af ter un til three (3) vet er i-
nar i ans re main on the list. Ruidoso Horse Sale Co. shall then de ter mine if all three
vet er i nar i ans can serve on the panel and if not, Ruidoso Horse Sale Co. can vas the
other vet er i nar i ans struck in re verse or der un til three are found who will serve. If
three are not found, the par ties shall re peat the pro cess un der such con di tions as
Ruidoso Horse Sale Co. shall de ter mine un til three vet er i nar i ans are found who will
serve. The Con signor and Pur chaser ac knowl edge that the se lec tion pro cess set
out herein is fair and rea son able to each of them.
The panel shall de ter mine, based upon such ex am i na tion(s) that each panel mem ber
de ter mines ap pro pri ate to sup port their de ci sions, whether the horse has an in jury
to or dis ease of the bone struc ture which will, more likely than not, ma te ri ally and adversely
af fect its suit abil ity for train ing and rac ing, which was not rea son able revealed
on the Re pos i tory ra dio graphs, and in that event the sale shall be can cel led.
Oth er wise, the sale shall stand. The de ci sion of the panel shall be fi nal, bind ing and
con clu sive on all par ties, ab sent fraud or bath faith. If the panel is not unan i mous, a
ma jor ity vote shall be de ter mi na tive.
The lim ited right of Re jec tion con tained in this Con di tion shall ter mi nate re gard less of
whether twenty-four (24) hours have elapsed, im me di ately upon the re moval of the
horse from Ruidoso Horse Sale Co.’s grounds.
Con signor shall have the sole re spon si bil ity con cern ing the ac cu racy of the dis closures/an
nounce ments and both Con signor and Pur chaser agree that Ruidoso
Horse Sale Co. is ab solved from any li a bil ity re lat ing to such an nounce ments/disclo
sures and both agree to hold the Ruidoso Horse Sale Co. harm less from any loss
in curred by ei ther of them re lat ing to such an nounce ment/dis clo sure.
If Re jec tion is re quested by Pur chaser on the ba sis of non-com pli ance with items
(1), (2), or (3) of this Con di tion Thir teen-Ar bi tra tion, Pur chaser must give writ ten
no tice to Ruidoso Horse Sale Co. within four teen (14) days of the sale of the horse
and Ruidoso Horse Sale Co. shall con duct such in ves ti ga tion as it deems ap pro-
