New Zealand fails
A Punjabi man’s attempt
to stay in New
in India. He came to New
Zealand on a student
Greedy real estate agents, brokers
must face double fines: OREA
The Canadian Parvasi
TORONTO: The Ontario Real
Estate Association (OREA) has
proposed increased fines on real
estate salespeople and brokerages
who violate the code of ethics to
pocket big commissions. This recommendation
has been made in a
white paper published on Wednesday.
In the white paper, OREA recommends
that the fines on salespeople
who violate the Real Estate
and Business Brokers Act should
be increased to $50,000.
Similarly, the brokerage which
violate the code of ethics must be
Indo-Canadian billionaire Prem Watsa’s Fairfax
sells Singapore insurance business for $1.6 billion
Agencies
TORONTO: Fairfax Financial
Holdings Ltd., which
is controlled by Indo-Canadian
Prem Watsa, is selling
its stake in Singaporean
insurer First Capital
Insurance Ltd. for US$1.6
billion as part of a broader
partnership agreement
that will ensure the Canadian
insurance and investment
company receives 25
fined $100,000. According to OREA,
the average fine per case last year
was just $6,000. At a time of record
per cent of the subsidiary's
profits, reports the Canadian
Press.
Hyderabad-born Watsa,
who is the chairman and
CEO of Fairfax, controls
more than 50 percent stake
in the Toronto-based company.
He is considered one
of the richest Indo-Canadians,
with personal worth
over a billion dollars
In a conference call
Thursday, Prem Watsa
property prices, these small fines
don’t serve as any deterrent for
greedy salespeople.
"Even under a system of higher
fines registrants could still profit
from unethical behaviour,’’ says
OREA.
The white paper wants the industry
regulator, the Real Estate
Council of Ontario (RECO), to be
empowered to force realtors violating
the code of ethics to repay
all their profits. The white paper
also wants that RECO must be given
the power to suspend a member
or revoke licenses. According to
RECO, its investigations against
its members last year led to 28 people
losing or being denied licence
and 29 convictions.
said the all-cash deal to sell
its 97.7 per cent stake in the
business to Japan's Mitsui
Sumitomo Insurance Co.
is part of a "strategic alliance"
with Mitsui, under
which the companies will
pursue global partnership
opportunities. The partnership
provides Fairfax
with the potential to gain
exposure in other regions
of the world as well.
BRAMPTON: Two teenagers have been arrested and
charged with home robbery in Brampton. The incident
Canadian accused of hacking
Yahoo pleads not guilty
The Canadian Press
SAN FRANCISCO: A lawyer
of a Canadian man accused
in a massive hack of
Yahoo emails says his client
has pleaded not guilty
to all charges against him
in a San Francisco courtroom
on Wednesday.
Karim Baratov was
arrested in Hamilton in
March under the Extradition
Act after U.S. authorities
indicted him and
three others for computer
hacking, economic espionage
and other crimes.
Baratov's U.S.-based
lawyer, Andrew Mancilla,
says his next court appearance
will be Tuesday.
The Canadian Press
Toronto man arrested for
trying to carry gun on flight
The Canadian Parvasi
Last week, the 22-yearold
decided to forgo his extradition
hearing and face
the charges in the United
States in what his Canadian
lawyer has called an
effort to speed up the legal
process.
The Hamilton man
signed documents agreeing
to waive the hearing
before an Ontario judge
on Friday, after weighing
the decision for months.
Baratov has been held
without bail since his arrest
because an Ontario
Superior Court judge
ruled that he was too
much of a flight risk to be
released prior to an extradition
hearing.
TORONTO: A Toronto man has been charged with trying
to carry a semi-automatic handgun on board a flight
from Winnipeg to Toronto.
The handgun was seized on Tuesday when Mohammad
Peyawary, 35, from Toronto tried to board a Torontobound
flight from the James Armstrong Richardson International
Airport
in Winnipeg.
The gun was
found in his carry-on
bag. Police
said there was no
threat to the public
as the gun was unloaded
and the man carried no ammunition. Mohammad
Peyawary has been charged with unlawful transport of
an unsecured restricted firearm and carrying a concealed
weapon.
The arrest assumes significance as Peyawary’s 29-
year-old brother Mustafa Peyawary was found dead inside
a Winnipeg apartment on August 13.
According to Winnipeg police, Mustafa suffered beatings
over a long period and died from blunt force trauma.
Two persons have been arrested in the case.
The judge also found
that Baratov's parents
would not make appropriate
sureties since they
had not been suspicious
of their son's alleged activities
while he lived under
their roof.
The Canadian Parvasi
American authorities
alleged in court documents
that Baratov, who
was born in Kazakhstan,
posed an "extremely high
flight risk'' in part due to
his alleged ties to Russian
intelligence agents and
his financial resources.
He appealed the ruling
that denied him bail but it
was upheld in June.
Yahoo said last September
that information
from at least 500 million
user accounts had been
stolen in a cyberattack
two years earlier. Baratov
is accused of hacking 80
Yahoo accounts and faces
20 years in prison in the
U.S. if convicted.
Canada's minister Judy
Foote stepping down
OTTAWA: Judy Foote is announcing
her resignation from the federal
cabinet and plans to step down as a
Liberal MP.
The Newfoundland and Labrador
MP has been on an indefinite leave of
absence from the Public Works and
Government Services Department
since April due to family health issues.
Prime Minister Justin Trudeau is
not expected to immediately name a
replacement for Foote, whose portfolio
has been overseen on an interim
basis by Natural Resources Minister
Jim Carr.
But insiders say the portfolio —
which involves resolving the fiasco
over the Phoenix pay system — will
go to an experienced minister, necessitating
a small shuffle of the
current cabinet lineup.
Trudeau is also expected to
award rookie Liberal MP Seamus
O'Regan with a junior cabinet post
in order to ensure Newfoundland
and Labrador retains its representation
around the cabinet table.
BRAMPTON: A 39 year-old woman suffered minor injuries
No shortcuts for asylum seekers
coming to Canada, says Trudeau
The Canadian Press
OTTAWA: Prime Minister
Justin Trudeau has
sought to combat criticism
that thousands of people
arriving at the Canada-
U.S. border to seek asylum
are throwing the immigration
system into chaos.
On the contrary, he
said everything is working
as it should.
"I can understand the
concerns Canadians share
about whether this is a
short cut, whether this is
somehow uncontrolled immigration,"
he said following
a meeting in Montreal
with federal and provincial
officials overseeing
response efforts.
"What I'm very pleased
to be able to say . . . is that
the rules on Canada's immigration
system continue
to be enforced."
Nearly 10,000 people
have been apprehended
at the border since the
start of the year as they've
sought to enter Canada
in order to claim refugee
status — almost equivalent
to the total number of
claims filed for all of 2013.
Of those who have arrived
this year, nearly 7,000
have arrived just since
July, the vast majority
at an unofficial crossing
point between Quebec and
New York.
Temporary camps to
house them have been set
up at border, and hundreds
of others have been
bussed to Cornwall, Ont.,
to be housed there while
the preliminary process
of applying for asylum begins.
The government has
also redeployed dozens of
police, border guards and
immigration officers to
manage the problem and
is also now focusing on
how to best support the
new arrivals while they
await a hearing on their
refuge claim.
Trudeau said one option
being explored is
accelerating the process
to give them temporary
work permits so they'll be
less dependent on the temporary
social supports in
place.
However, Conservative
immigration critic
Michelle Rempel blasted
Trudeau's handling of
what she called a crisis.
Camps on the border
and asking an already
overwhelmed immigration
and settlement system
to do more with no additional
resources is not a
solution, she told a news
conference Wednesday.
She said the opposition
has been raising the
issue for months, since
the arrivals at the border
numbered only in the dozens,
but the government's
response continues to fall
short. "A photo op after a
meeting will not cut it,"
she said.
"The prime minister of
Canada, in order to help
the world's most vulnerable
and to salvage the
Canadian asylum claim
system needs to come up
with a credible plan and
he needs to explain it to
Canadians."
Many of those who've
arrived in Canada have
been propelled by changing
immigration policy
in the United States that
began with the inauguration
of President Donald
Trump and his first attempt
in January to block
immigration to the U.S.
from certain predominantly
Muslim countries
and halt the refugee program.
In response to that
move, Trudeau tweeted:
"To those fleeing persecution,
terror & war, Canadians
will welcome you,
regardless of your faith.
Diversity is our strength
#WelcomeToCanada."
The message drew attention
around the world
and it set up expectations
among asylum seekers,
both the Conservatives
and the NDP say.
The NDP also say that
Trudeau's current messaging
is just as misleading.
He repeated Wednesday
that those crossing irregularly
into Canada will see
no special consideration
given to their file. But to
say there's no advantage
to doing so is unfair, NDP
immigration critic Jenny
Kwan said.
If they go the legal way,
she said, they'll be turned
away because of the agreement
between Canada and
the U.S. that precludes
people from making asylum
claims at official land
border crossings. Under
international law, once
they've crossed the border,
Canada must process
their claims, she noted.
If Trudeau is serious
about stopping the asylum
flow, he should suspend
the deal, she said.
Trudeau said Wednesday
the agreement will
remain in place. He said
when he talks about there
being no advantage, he
was speaking of the longer
term — claims are assessed
on the merits, not
based on how someone enters
the country.
The Liberals are also
continuing their outreach
in the U.S. to try and dispel
myths circulating there
about the Canadian immigration
system, Trudeau
said, touting Liberal MP
Emmanuel Dubourg's trip
to Miami to meet members
of the Haitian diaspora
there. The vast majority
of arrivals in recent weeks
have been from Haiti, as
the U.S. is currently considering
lifting a pause
on deportations to that
country. Canada resumed
deportations to Haiti this
year after its own lengthy
pause following a devastating
2010 earthquake in
that country.
Grieving Canadian father whose baby died in fire
tells how his wife tried to get pregnant for years
The Canadian Press
EDMONTON: The father
of a baby who died in a
house fire says he tried
to go back into his burning
house three times,
but couldn't get past the
flames.
Cordell Brown said he
was sleeping on the main
floor of his southwest Edmonton
home Tuesday
morning when he woke to
find his porch on fire.
Brown said his wife,
Angie Tang, was asleep
on the second floor with
their son, five-month-old
Hunter.
He said he tried to fight
the fire with the garden
hose before crews arrived.
“The fire was so intense,”
Brown said. “From
the time that we noticed
the fire, because it was
very instant, the fire started
in about two seconds
and it engulfed the whole
house.”
Brown and six others
who lived in the home
were able to escape on
their own. Firefighters rescued
Tang and their baby.
Hunter died of his injuries
and Tang is in hospital,
where she remains under
sedation.
He said doctors
brought her out of sedation
briefly, and he and
other family members told
her that Hunter had died.
“Took eight of us to
hold her down, she didn’t
take that very well and
she was re-sedated,”
Brown said.“Doctors were
saying there was pretty
serious damage to her
lungs and all of her airway,
and there are burns
from the smoke because
she was in the fire for almost
20 minutes,” he said.
Brown said he and Tang
had been trying to have a
baby for about four years.
He told Global News that
his mother died of cancer
last year and they used the
inheritance money for fertility
treatments.
“Hunter was a fertility
baby, having Hunter was
a $50,000 expense,” Brown
said. “We loved him to the
moon and back. He was
our most prized possession.
Our dogs are dead.”
Edmonton police say
an autopsy done on the
baby Wednesday determined
he died of smoke
inhalation. They say fire
was deliberately set and
have opened a homicide
investigation.
Brown urged anyone
with information to call
police, and had a message
for whoever was behind
the blaze.
“Whoever started the
fire, I don’t know if they
did it as a prank or whatever,
but it’s past a prank
now, people, you almost
killed six or seven people,
you did kill one person.”
Quebec to pay $642 each month to asylum seekers
Agencies
MONTREAL: There's a report the Quebec
government will hand out welfare cheques
next week to between 4,000 and 5,000 asylum
seekers.n Radio-Canada says the
three-day operation at Montreal's Palais
des congres convention centre will begin
next Wednesday. The network says they
will receive various amounts, depending
on their family and conjugal situation. The
minimum monthly payment is $642.92.
Nearly 10,000 people have been apprehended
at the border since the start of the
year as they've sought to enter Canada in
order to claim refugee status — almost
equivalent to the total number of claims
filed for all of 2013. Of those who have arrived
this year, nearly 7,000 have arrived
just since July, the vast majority at an unofficial
crossing point between Quebec and
New York.
Toronto police looking for 5
scamsters posing as roofers
TORONTO: Toronto police
say they're looking into several
cases of homeowners being
defrauded by individuals
posing as roofers. They say
that since March, five cases
of alleged fraud have been reported
to them from a region
east of the downtown core.
In two cases, police allege the
suspects knocked on the doors
of homeowners and told them
their roof needed repairs,
took payment in advance,
but never actually fixed anything.
Police say two other
homeowners refused to pay
the suspects for fear of a scam.
And in one case, two suspects
allegedly took cash to repair a
roof, but then claimed they'd
overcharged the homeowner
and pulled out a debit machine.
Police say in that case
once the homeowner typed in
her PIN, the suspects grabbed
her debit card and ran off.
One-third of asylum seekers entering Canada are under-age
Agencies
MONTREAL: Up to onethird
of the 7,000 people who
have crossed illegally into
Quebec from the U.S. in the
last six weeks are children,
the province's immigration
minister said Wednesday.
Quebec's education department
is considering
running programs for the
kids — including teaching
classes — inside the temporary
shelters set up to house
refugee applicants in the
Montreal area, said Kathleen
Weil. "We received the
demographic statistics last
night," Weil told reporters
after meeting with the Intergovernmental
Task Force on
Irregular Migration, which
included the prime minister.
"We need the children to
feel secure," she said. "They
are here for an uncertain
amount of time. The education
department is looking
into what to do with the kids
in the meantime." The task
force was created to help
provinces and the federal
government co-ordinate a
response to the roughly 7,000
people — mainly Haitians —
who have crossed the Quebec-New
York state border
in the last six weeks.
Up to 2,300 are under 18
years old, Weil said. They
began entering Canada illegally
after the Trump administration
said it may end
"temporary protected status''
for Haitians in the U.S.,
which was granted following
their country's massive
2010 earthquake.
The influx of thousands
of people in such a short
time has strained Quebec's
resources, especially its
housing infrastructure.
Opposition politicians in
Quebec have criticized the
federal government's handling
of the border crossers,
some calling for Trudeau to
suspend international agreements
forcing Canada to accept
people entering through
illegal border points.
Ultra-nationalist and
other right-wing and antiimmigration
groups have
become increasingly vocal
in the province, and have demanded
the federal and provincial
governments stop
welcoming border crossers.
Toronto airport strike to
continue as ground staff
The Canadian Press
TORONTO: Striking
ground crew workers at
Canada's busiest airport
have voted overwhelmingly
to reject the latest offer
from their employer and
will continue a four-weeklong
work stoppage.
A spokesman for Teamsters
Union Local 419 says
the workers employed by
Swissport vote 98 per cent
to reject a new contract after
turning down an offer
by a wide margin in late
July. "The first offer was rejected
by 95 per cent so this
is actually a stronger rejection,"
said union spokesman
Christopher Monette.
"Swissport's second offer to
our members was almost
identical to the first one.
All they did was change a
few details."
About 700 cabin cleaners,
baggage handlers, and
other ground crew workers
employed by Swissport
reject new offer
at Toronto's Pearson International
Airport have been
on strike since late July.
Swissport services
30 airlines at the airport,
including Air Transat,
Sunwing Airlines, British
Airways, Cathay Pacific,
Air France, KLM and Lufthansa.
Air Canada and
WestJet are not serviced
by Swissport.
The ground crew strike
has not significantly affected
passengers, although
the airport has been warning
travellers that the labour
disruption could affect
some flights.
Terms of the latest offer
were not released but
the company had said it
was optimistic the workers
would accept the deal.
Their concerns have
included pay and benefits
cuts, scheduling issues,
and what their union calls
a lack of respect from Swissport
managers. "We're
dealing with a company
that is proposing and doing
the same thing over and
over expecting different results
and that's a slap in the
face really to our workers,"
said Monette.
"This lack of respect
was evident in the company's
first and second offers.
They wanted to impose a
three-year wage freeze on
workers at the top of the
wage scale. The problem is
that's actually the majority
of workers at Swissport."
In a statement on Wednesday, RECO Registrar Joseph Richer said his body should be
He also said RECO will soon launch a new education programme to train people before
they join the real estate profession.
The new education programme will include "more hands-on experience and more rigorous
"We are in shock. What
she says she doesn’t know
"We just don't know
quoted as saying.
Singh became friends
CIBC expects 'moderation' in new mortgages
as new regulations take shape
The Canadian Press
TORONTO: Soaring home
prices have been a boon to
the banks' mortgage business,
but recent government
efforts to cool the
housing market could impact
lenders if the economy
falters, the Canadian Imperial
Bank of Commerce said
Thursday.
While Canada's economy
is pumping out jobs and
growing at a steady pace, a
potential shock could put
borrowers at risk of foreclosure
— particularly those
who have overextended
themselves to buy homes,
said CIBC chief risk officer
Laura Dottori-Attanasio.
"If house prices do come
off, we need our borrowers
to continue to have their
jobs to service their loans,"
Dottori-Attanasio told investors
on the bank's thirdquarter
conference call.
"But in the event we find
ourselves taking on assets,
we do have — and continue
to have — a good buffer as
it relates to that loan-tovalue."
The prospect of more
Canadians missing debt
payments has become a hot
topic of discussion in the
financial sector as Canada
heads into an uncertain
economic climate next year.
Many economists are calling
for slower economic growth
next year, saying the nearly
four per cent pace logged in
the first quarter of this year
is not sustainable.
Moody's Investor Service
said in a report earlier
this week that mortgage
growth is driving record
consumer debt levels, which
had reached $1.69 of debt for
each dollar of disposable income
as of March 31.
Meanwhile, stricter
regulations drafted by the
Office of the Superintendent
of Financial Institutions
(OSFI) last month could
also put the brakes on loan
portfolio growth by curbing
mortgage demand considerably.
An imposed "stress
test" for all uninsured mortgages
would make it harder
to qualify.
CIBC's chief executive
Victor Dodig acknowledged
that higher interest rates
and regulatory changes
would lead to a "moderation"
in new mortgages, but
reassured analysts that the
bank is not concerned about
any imminent impact.
"We're not expecting a
stepwise decline in consumer
lending activity," he said.
CIBC became the second
Canadian bank
to boost its quarterly
dividend, following the
path led by Royal Bank
on Wednesday. An increase
of three cents
puts CIBC's payment at
$1.30 per share.
The bank posted
net income of $1.1 billion
$2.60 per common
share, which was down
from $3.61 per share in
the 2016 third quarter
when CIBC recorded
an unusual gain from
the sale of its minority
interest in American
Century Investments.
But net income at
its Canadian wealth
management arm was
down 73 per cent or
$370 million from last
year, when CIBC recognized
a $383-million
gain from the ACI
transaction.
Excluding that
gain, wealth management's
adjusted net
income was $136 million,
up 10 per cent. At U.S. commercial
banking and wealth
management, adjusted
earnings was up $19 million
at $44 million, mainly due to
the acquisition of Private-
Bank.
Indo-Canadian billionaire Prem
Watsa’s Fairfax sells Singapore
insurance business for $1.6 billion
Continued from page 01
Canadian insurance companies have
targeted Asia for growth as burgeoning
middle classes mean increased demand
for protections and benefits that insurers
offer.
"This partnership with MSI its truly
a game changer for Fairfax, a real winwin
opportunity with a long term like
minded-partner," said Prem Watsa, Fairfax
chairman and chief executive officer
told shareholders on a conference call.
Watsa also said the partnership
agreement with MSI also gives it a foothold
in Japan. The Toronto-based company
said the sale of First Capital will
net US$900 million of after-tax profit, or
US$33 per share. Fairfax will take a 25
per cent quota share, under which the insurer
will share a certain percentage of
premiums and losses. Fairfax expects its
ongoing vested interest in First Capital's
existing and future business will see significant
returns.
"If First Capital writes $100 million
worth of business, we'll take a quota
share of 25 per cent, which will be $25
million and that $25 million will be going
into one of our companies," Watsa
explained.
"You'll get 25 per cent of the earnings
and you'll get 25 per cent of the growth,
that made it a very unusual and attractive
transaction."
Watsa praised the deal, saying First
Capital is the "undisputed leader" in Singapore.
The company provides home, accident,
travel and car insurance, as well
as coverage for theft, industrial, civil
engineering projects and marine cargo
businesses.
Fairfax estimates First Capital will
grow from $400 million in gross premiums
today to over $1 billion over time.
First Capital's current CEO Ramaswamy
Athappan will continue as head of the insurance
provider as well as in his role a
chairman of Fairfax Asia. The deal is expected
to close late this year or early next
year. Fairfax is primarily invested in
North American property and casualty
insurance businesses but has diversified
to other regions and industries.
Justin Trudeau and his Liberals perhaps have
not yet grasped the public anger over the issues of
refugees and asylum seekers.
When they let in 30,000 Syrian refugees, the
majority of Canadians were not pleased because a
refugee costs the taxpayers’ a lot of money. After
all, Liberals didn’t pay the refugees from their own
pockets.
Yes, Canada must meet its international
obligations, but its government must also listen ot
its people.
But these politicians and their supporters were
busy all the time trying to the tell the world: look
how great humanitarian nation we are. Canadians,
however, didn’t buy this as surveys by Angus Reid
later showed.
People knew that politicians were doing all this
for votes, but nobody talked openly about it. For
the mainstream Canadian media, these are no-go
topics.
Now we have another crisis on our hands as
thousands of asylum seekers have poured into
Quebec from the US. Politicians of all hues are
saying what suits them politically.
But the moot point is that a set of laws define a
moderate state nation. If there are no laws, there is
no state. This country’s laws are being broken.
The asylum seekers are using unofficial points
because they cannot make asylum claims at official
land entries. Since last month, these asylum seekers
have been using a particular point in Quebec to
come here and seek asylum. Quebec is reportedly
all set to pay over $600 dollar each month to these
asylum seekers.
But this out-of-touch Prime Minister says
everything is working as it should.
"I can understand the concerns Canadians share
about whether this is a short cut, whether this is
somehow uncontrolled immigration...What I'm
very pleased to be able to say . . . is that the rules
on Canada's immigration system continue to be
enforced."
But the average Canadian is thinking otherwise.
Just wait for the public backlash.
and all of the people some of the time, but you
cannot fool all of the people all of the time.
Indo-Canadian community’s role
in upcoming Ontario elections
We in India are used to the political
temperature rising much before elections.
Though Lok Sabha elections in India are
not due till 2019, there is already much
hustle and bustle about them. Compare
this to the scene in Ontario where
elections are only nine months away but
few people are talking about them. I am
sure not many know who the contenders
are for Premiership.
Progressive Conservatives (Tories)
and Liberals are considered mainstream
parties and the NDP is somewhat like the
leftist parties back in India. Liberals have
been in power since 2003. Will they be
able to hold on to power or will the Tories
replace them this time? Let us talk about
Tories. They have ruled Ontario for 80
years out of 150 years of Confederation.
They were and are a dominant force in
the countryside. But in recent years the
influx of new immigrants in urban centres
has changed electoral mathematics.
In the GTA, Punjabis dominate in
Brampton. Traditionally, they have been
inclined towards the Liberals. Tories
will have to engage with the Punjabi
community if they have reap to electoral
benefits. The party seems taken a lead
in announcing some candidates. PC
leader Patrick Brown has been trying to
build bridges with Punjabi and Gujarati
communities. He has been to Gujarat and
Punjab. He has built good bonds with
Gujaratis, but he will have to work hard
to win over Punjabis.
Pre-poll surveys indicate that the
majority of Ontarians, including some
traditional Liberal vote banks, believe
that the incumbent government should
Acquisition of immovable
property by way of purchase,
transfer or disposal by way of
sale or inheritance or gift in
India is the most important
issue which NRIs, and even
revenue or land registering
authorities in India do not
know. All such acquisitions,
especially agricultural land,
are being made back home
under general notion or assumptions
which do not hold
any legal sanction. In India
now, NRIs investment is
governed by the Foreign Exchange
Management Act or
FEMA 1999 and Regulations,
2000 under the overall control
of the Reserve Bank of India
(RBI).
To be more specific and
clear, acquisition/disposal of
immovable property in India
is discussed in following categories:
-
A) By NRIs holding Indian
passport:
Brig Nawab Heer and
Ms Preet Heer
be changed. For the Liberals, Premier
Kathleen Wynne still enjoys a very good
equation with the Indian community.
She is trying to woo voters with a $15
minimum wage, free pharma care up to
age 25, free tuition for college kids and
reducing hydro rates, etc.
As for the huge Punjabi community,
if Wynne clears on a priority basis the
community’s long-standing demands
for seniors’ homes and long-term care
centres, the Liberals will gain an edge.
She has already played one card to wean
away the Sikh community.
Tories will look to cash in on some
of the failures of Liberals, including
high insurance rates, lack of affordable
housing and homes for the seniors, and
failure to improve commuting and fixing
high cost of living. Voters in and around
Brampton will seek promises on better
medical facilities, LRT, the University
for Brampton, HW 413, improved
commuting and traffic, reduced auto
insurance rates, abolition of temporary
workers hiring and enhanced quota for
family immigration. Voters do not care
whether these issues fall in the preview
of city council or the federal government.
If PC Party have to break strong hold
of Liberals on the Punjabi community
because of their perceived pro-immigrant
bias, Brown and Co will have to convince
voters that they too will look after the
1. NRIs holding Indian
passports can purchase all
types of immovable property
except for agricultural land.
No permission from the
RBI to buy residential or commercial
immovable property
in India is required.
2. The purchase consideration
may be paid either
by remittance of funds from
abroad through normal banking
channels or out of NRE/
FCNR/NRO account.
3. NRIs do not require
any permission for acquisition,
transfer, or disposal of
immovable property except
a farmhouse or agricultural
land or plantation property.
4. An NRI has to file a declaration
in Form IPI-7 with
the RBI for the acquisition of
commercial property for carrying
out any industrial, commercial
or trading activity
by their proprietary/partnership
firm within 90 days from
the date of purchase.
welfare of immigrants.
Now let us talk about budding
leaders. One interesting thing about these
budding political leaders in the Indian
community is that few have emerged
from the grass roots. Most of them are
parachute candidates and their major
vote banks are centred around religious
places. And the sad part is that most
people in the Indo-Canadian community
vote on the basis of the candidate’s caste,
origin in India, language and other
factors, not on the basis of the candidate’s
education, leadership qualities and
competence. This trend, if not checked,
will prove counterproductive for all the
parties and the country. The second
important thing about our elected leaders
is that they dishonestly avoid giving their
opinions on the burning local issues.
Voters must start asking tough questions
about their stand on controversial issues
before the elections.
Thirdly, it is also reported that some
of Indian political parties are taking keen
interest in the local politics in Canada.
I am afraid to say that in the long run
it is not in the interest of anyone. The
Indo-Canadian community may end up
importing undesirable political practices
from India. In fact, some bad political
traits from India seem to have already
infiltrated Canadian political culture.
The upcoming election contest in Ontario
will be interesting and close one. It will
be a major challenge for the PC Party if
they can ride on the anti-incumbency
factor and people’s desire for change. The
Liberal Party will have to contend with
voter anger over unfulfilled promises.
Can NRIs buy property in India?
Ravinder Pal
Singh Walia
B) By NRIs who are foreign
citizens but of Indian
origin:
1. NRIs who are holding
foreign citizenship can buy
residential or commercial
immovable property in India.
However, no farmland or
agricultural land can be purchased.
2. Under the general permission,
the RBI has allowed
them to acquire, transfer or
dispose of by way of sale or inheritance,
immovable properties
situated in India.
3. It is, however, necessary
for foreign citizens of
Indian origin to declare such
property to the RBI within
a period of 90 days from the
date of purchase in the form
IPI 7 to the Chief General
Manager, Exchange Central
Dept., Foreign Investment
Division, Central Office, RBI,
Mumbai.
To sum it up, NRIs holding
Indian passports and
foreign citizenship can now
acquire, sale, gift all type of
property, both residential
and commercial. But they are
debarred from acquiring agricultural
land, farm -house and
plantation property except inherited
land. Failure to follow
the above-noted law can have
serious consequences under
FEMA and regulations.
The International News Weekly INTERVIEW/OPED
August 25, 2017 | Toronto
09
Now US widow files application in Alberta
seeking damages from Khadr
The Canadian Press
TORONTO: Canadian
lawyers acting for the widow
of an American special
forces soldier have filed
an application in Alberta
— essentially duplicating
one filed earlier in Ontario
— seeking enforcement
of a massive U.S. damages
award against former
Guantanamo Bay detainee
Omar Khadr.
The claim calls on the
Court of Queen's Bench
to recognize the judgment
from Utah, and to issue a
"corresponding" judgment
in the amount of $173.88
million — the Canadian
value of the US$132.1-million
American award made
in June 2015.
"Given that Canada
has substantially similar
legislation in relation to
civil actions for victims
of terrorism, it is entirely
consistent with the fundamental
public policy
of Canada to enforce the
U.S. judgment," the notice
states. "There are no defences
to enforcement and
recognition that operate in
favour of the defendant in
this case."
According to the notice,
bringing the Alberta
action in parallel with
the Ontario case is proper
"given the territorial limitations
of the respective
judgment-enforcement regimes."
Calgary-based lawyer
Dan Gilborn refused to
discuss the proceedings on
Thursday, saying his office
was not authorized to comment.
While the Alberta
action was filed in early
July amid word that the
federal government was
paying Khadr $10.5 million
to settle a civil lawsuit,
the lawyers acting for the
Americans said they were
having trouble serving notice
on him.
"We have thus far been
unable to locate Mr. Khadr
for personal service, although
we are aware that
he has been residing in
Edmonton, Alta., for much
of the past two years," Gilborn
wrote Aug. 14 in a letter
to Khadr's lawyers, a
copy of which was obtained
by The Canadian Press.
One of Khadr's Edmonton-based
lawyers, Nate
Whitling, said on Thursday
that it would be a waste of
time and money to try two
identical actions at once.
"It's two duplicative actions
and there's no point
in proceeding with both of
them," Whitling said from
Edmonton.
He also said the Alberta
action had been filed
too late. Both actions — the
Ontario one was filed June
8 — are on behalf of relatives
of U.S. special forces
Sgt. Chris Speer, who was
killed in Afghanistan in
July 2002.
Speer had been part of
a massive American assault
on an insurgent compound,
where Khadr, then
15 years old, was captured
badly wounded. Retired
U.S. sergeant Layne Morris,
who was blinded in one
eye during the same operation,
is a co-applicant.
The applications —
like the uncontested civil
suit in Utah — lean heavily
on Khadr's guilty plea
before a widely discredited
military commission
in Guantanamo Bay in
2010 to having thrown the
grenades that killed Speer
and blinded Morris. Khadr
later said his confession to
five purported war crimes
was his only way out of the
infamous prison and to return
to Canada.
Khadr, 30, who recently
got married, has been
on bail in Edmonton for
the past two years pending
his appeal in the U.S. of his
commission convictions.
The Americans failed
last month to get an injunction
freezing Khadr's assets
— including the $10.5-
million sources said the
federal government paid
him — pending outcome of
the Ontario enforcement
action.
However, in previous
Ontario filings, Whitling
argued against enforcement
of the Utah judgment
given its reliance on the
military commission. Canadian
courts are statute
barred from enforcing foreign
judgments that offend
Canada's public policy, he
noted, and the Supreme
Court has found the Guantanamo
system contrary
to Canadians' concept of
justice.
"Officials at the highest
levels of the Canadian
government have already
stated...that (Khadr's) detention
and prosecution in
GTMO offended our most
basic values and principles,"
Whitling said in
court filings.
What if Canada is caught in US-North Korea missile war?
We must join US ballistic missile defence, says Romeo Dallaire
Agencies
OTTAWA: Retired general
and senator Romeo
Dallaire says Canadians
can't just assume the U.S.
will shoot down a missile
heading towards Canada,
and that it is time for this
country to finally embrace
continental missile
defence.
"Canada should join
the ballistic missile defence
program," Dallaire
said in an interview
Thursday.
"We currently cannot
put a hand on our
heart and say that it will
be used to help us should
something happen."
His comments come
amid growing concerns
that Canada could be
caught in the middle of a
conflict between the U.S.
and North Korea, which
has been showing off its
growing nuclear and missile
arsenal.
The U.S. invited Canada
to join its continental
missile-shield system
more than a decade ago,
but then-prime minister
Paul Martin opted against
it in 2005 following an extremely
divisive national
debate.
Since then, Canada
has sat on the sidelines as
the U.S. has spent more
than $100 billion building
a series of land- and seabased
interceptors that
could stop the type of limited
attack North Korea
might launch.
Ballistic missile defence
has also been adopted
by NATO allies in
Europe and those in the
Asia-Pacific region such
as Australia and South
Korea, leaving Canada as
an outlier.
That doesn't mean
Canada wouldn't see a
ballistic missile attack
coming. Canadian and
American militaries work
side-by-side monitoring
potential airborne threats
through the North American
Aerospace Command,
or Norad.
But any decision on
whether to shoot down
such a threat would rest
solely with U.S. officials,
who Dallaire noted have
no legal obligation to react
if the missile is heading
toward Canada.
Joining ballistic missile
defence would not
only create that obligation,
Dallaire said, but
also act as a deterrent
should North Korea or
any other country use
Canada as a "proxy target"
for the U.S.
"Feeling that (the U.S.)
would respond is quite
different than having it
somewhere on paper and
being able to hold them
accountable to respond
should Canada be targeted,"
Dallaire said.
Dallaire acknowledged
having his own doubts
about missile defence
when the issue was first
raised, but he said the
technology has improved
significantly.
And while critics have
pointed to the cost of the
system, Dallaire said such
arguments overlook the
potential technological
and other industrial benefits
participation in such
a project would entail.
"Budgets cannot be ignored
and the Americans
realize the budgetary limitations
that we have and
the scale of our financial
investment in national
defence," he said.

Theatre on Sept. 8 will be
followed by an intimate
onstage performance.
Emmy-nominated filmmaker
Chris Moukarbel
directed the doc, which
goes behind the scenes
of the life of the singer,
whose real name is Stefani
Joanne Germanotta.
Organizers say the Netflix
original documentary
follows her over an eightmonth
period as she records
her personal struggles as
she copes "with intense
emotional and physical
pain." Viewers also get to
see her with family members,
friends and her dogs
at home.
"Moukarbel's documentary
offers an unprecedented
look at Lady Gaga
in full creative mode: the
ideas, the emotion, the
sheer work it takes to do
what she does," TIFF artistic
director Cameron
Bailey said Thursday in a
statement. "I had a rare opportunity
to create a portrait
of an artist with such
an open heart and mind. I
feel really lucky that Gaga
trusted me and my vision,"
added Moukarbel.
TIFF has also announced
four new special
events for the fest. Among
them is an exclusive first
look at footage from "Legend
of the Demon Cat"
with Chinese director
Chen Kaige, who will do a
Q-and-A and is also on the
jury for this year's Toronto
Platform Prize.
Meanwhile, actress
Priyanka Chopra will be
on hand for an evening
celebrating actor and firsttime
feature filmmaker
Paakhi A. Tyrewala's "Pahuna:
The Little Visitors."
Chopra co-produced the
film, about three Nepalese
children separated from
their parents.
Other special events
include a Q-and-A for the
world premiere of "On My
Way Out: The Secret Life
of Nani and Popi," directed
by Brandon and Skyler
Gross. Canadian filmmaker
Barry Avrich and
comedy star Howie Mandel
produced the 40-minute
documentary, which profiles
two 95-year-old Holocaust
survivors. Avrich
and the directors will be at
the Q-and-A.
The menu on India's last night
as a British colony
By Mohammed Shafeeq
were some of the dishes on
the dinner menu at The Taj
Mahal Palace, Mumbai, on
the night of August 14, 1947.
The night when India ushered
in its independence,
it was celebration time
at the famed five-star hotel
with music, dance and
speeches and, of course, the
delicious food, reflecting
the Indo-French cuisine of
those times. At Shamiana,
the popular restaurant at
the hotel, the menu of three
courses was set to cabaret
entertainment, albeit rationed
as per government
regulations at the time, say
officials of the Taj Group of
Hotels. The rationing conditions
were applicable to all
restaurants at that time and
diners had to choose course
combinations rather than
feast on each choice.
Dosabhai Framji Karaka
also known as D.F. Karaka,
an Indian newspaper
editor and then owner of
Current Weekly, addressed
the guests, the officials said
quoting from the book 'The
Taj at Apollo Bunder'.
Seventy years later, Taj
has recreated the menu
served on that memorable
night. The group's flagship
hotels in Delhi, Hyderabad,
Chennai, Bengaluru and
Kolata besides Taj Mahal
Palace, Mumbai, will take
their guests back in time
by serving the same dishes
beginning this week and till
Independence Day.
The chefs have developed
a menu which is in
sync with the culinary
trends of that year. They
had to go back and understand
the essence of the recipes,
and adapt it to current
tastes using local ingredients
and techniques.
"We've retained the
Indo-French touches not
just in the dish names, but
also in their foundations on
the core French sauces and
ingredients -- albeit with a
modern Indian twist," said
a chef.
Nitin Mathur, Executive
Chef at Taj Krishna,
Hyderabad, pointed out that
since the photographs of the
dishes are available, they
used their imagination to
match the menu.
"As chefs we tried to
recreate the whole thing by
working on it. We used our
imagination to match the
menu," Mathur told IANS.
"We did not tweak the
menu and retained all dishes
that were there," he added.
However, the chef has
provided few choices to the
vegetarians. "There were
no vegetarian choices in the
menu, but we have added a
few," Mathur said.
There were a total of
five combinations on the
original menu, comprising
a soup, a starter, two dishes
in the main course and one
dessert.Words like 'al Indienne',
'a l'Hindustan', 'independence'
and 'liberation'
were added in tune with the
significance of the occasion.
The chef tried to match
the preparation of the menu
with the Indian dishes.
Cardamom enhanced
clear chicken soup (Consomme'
al Indienne) was
the only soup served, but
the chef has added another
soup -- creamy almond veloute.
The starter comprises
three flavoured smoked cottage
cheese steaks with mint
chutney (Delicacies a l-Hindustan).
The original main
course comprised Paupiette
de saumon joinville (Salmon
roulade, soft creamy mash,
wilted spinach, turned vegetables
and joinville sauce)
and Poularde souffle Independence
(chicken souffle
with steamed vegetables
and lemon parsley sauce).
The chef added two vegetarian
choices -- Crepes
aux epinards (stuffed spinach
crepes with makhani
gravy) and Champignons
Vol-au-Vents (truffle and
wild mushroom, paprika
cheese sauce).
Taj has fixed Rs 1,947 as
the price of this dinner (for
one person). While guests
will enjoy the sumptuous
meals inside, the hotels from
outside will be illuminated
in the Indian tricolour.

India not banning Rs 2,000 notes
Agencies
NEW DELHI: The Indian government is
not considering banning Rs 2,000 notes
while the Reserve Bank of India (RBI) will
decide when to issue the new Rs 200 note
that has been notified, Finance Minister
Arun Jaitley said on Wednesday.
Asked whether the government was
considering the phasing out of newly introduced
Rs 2,000 notes, Jaitley told reporters
here after a meeting of the cabinet:
"No, there was no such discussion."
On the Rs 200 notes notified by the government
on Wednesday, Jaitley said the
RBI would decide on the matter.
"The whole process regarding when
the notes will be printed, RBI will take
care of that issue. Thus, it will be appropriate
for the RBI to announce about dates
and matters related to the note printing,"
Jaitley said.
Rajiv Gandhi killing convict
gets parole to visit ailing father
Agencies
formally announced the launch of
the new Rs 200 note. Earlier, Minister
of State for Finance Santosh
Kumar Gangwar told IANS that
the Rs 200 note, printing of which
had begun, would be in circulation
soon. The move to introduce the
new currency was to increase the circulation
of smaller denomination notes. Postdemonetisation,
there have been reports
of people facing problems in using the Rs
2,000 note as sufficient quantum of smaller
denomination notes of Rs 100 and Rs 500
were not available.
Chennai: The Tamil Nadu
government on Thursday
granted parole to A.G. Perarivalan,
one of those convicted
in the assassination of former
Prime Minister Rajiv Gandhi,
to visit his ailing father.
It is the first time Perarivalan
has been given parole
since his arrest in 1991.
His mother had applied
for one month parole for him
to visit his ailing father.
The government order,
granting him 'ordinary leave'
or parole, did not specify the
number of days of parole. It
also said that strong police
escort should be provided to
Perarivalan during the leave
period. PMK founder S. Ramadoss
in a tweet expressed
happiness at the development.
Earlier, Tamil Nadu
Chief Minister K. Palaniswami
had told the assembly that
the matter is under the government's
consideration.
He said the government
would take into consideration
the feelings of all concerned
and take a decision.
Perarivalan and six other
convicts have been in prison
since 1991, the year a woman
India linking Aadhaar with
PAN in 'national interest'
IANS
New Delhi: Law Minister Ravi Shankar
Prasad on Thursday said linking the Aadhaar
number with the Permanent Account Number
(PAN) was in the national interest as it would
prevent money laundering.
Prasad, who is also the
Information Technology
Minister, was answering
a question on the issue of
linking the Aadhaar number,
in view of the Supreme
Court's Thursday judgment
that right to privacy was a
fundamental right.
The government had in
June notified rules that required
all assessees to mandatorily
link their Aadhaar
number with their PAN effective from July 1.
It had also said that from July 1 onwards,
every person eligible to obtain Aadhaar must
quote their Aadhaar number or their Aadhaar
enrolment ID number for filing of income tax
returns as well as for applications for PAN.
Asked to clarify the government telling
the Supreme Court that citizens could not
claim "absolute" right over their body parts,
Prasad told media persons these were just exchanges
in the court.
"You quote one of the
exchanges in the courts.
Whenever cases are argued,
there is banter, exchanges,
but ultimately, the core of
the argument is noted in the
judgment and conclusion is
reached. Therefore what I
read of Attorney General's
argument is what is noted
in the judgment itself," he
said.
Prasad did not comment
on a query about the impact of the judgment
on the surrogacy bill that does not allow homosexuals
and live-in couples to go for surrogacy.

India's oldest cinematographer
Ramananda Sengupta dead
IANS
Kolkata: Country's oldest
cinematographer Ramanda
Sengupta, who worked with
legends like Jean Renoir,
Ritwik Ghatak and Mrinal
Sen, died in Kolkata on
Wednesday, West Bengal
Chief Minister Mamata Banerjee
said in a statement.
Sengupta, 101, left behind
his son.
Born on May 8, 1916 in
Dhaka, Sengupta studied in
Santiniketan in his formative
years and got his first
break in 1938 when he joined
Film Corporation of India in
Kolkata (then Calcutta) as
an assistant cameraman.
His first film as a full-time
cinematographer was in
"Purbaraag" directed by Ardhendu
Mukherjee in 1946.
Two years later, French
Adirector Jean Renoir came
to Kolkata to shoot The River
(Le Fleuve, released in
1951), and Sengupta joined
him initially as a clapper
boy, but ended up as the operating
cameraman while
the auteur's nephew Claude
Renoir was director of photography.
He worked with Ritwik
Ghatak on his debut film Nagarik,
that was completed in
1952, but released a quarter
century later in 1977 after
the film maker's death. In
1955, when Mrinal Sen made
his debut film Raat Bhore,
he chose Sengupta as his
cinematographer. Sengupta
worked behind the camera
in over 70 films, including
landmark ones like Shilpi,
Nishithe, Bindur Chhele,
Personal Assistant, Headmaster
and Teen Bhubaner
Pare.
Sengupta was also a
founding member of the
Technicians' Studio in South
Kolkata's Tollygunge.
Condoling Sengupta's
demise, the chief minister
said his death has caused
an irrepairable loss to the
world of films.
"I pray that his soul rest
in peace. I extend my sympathies
to his bereaved family,"
said Banerjee.
Jammu Sikhs
protest against
video clip
IANS
Jammu: Sikh community members on Thursday
staged a protest here and demanded action against
persons involved in recording a derogatory video clip
on some Sikh gurus that has gone viral.
Sikh religious leaders and community members
demanded action against those responsible for spreading
the derogatory video clip on social media. Police
have registered an FIR (First Information Report) in
the case and assured action against those responsible
for the mischief. Meanwhile, intelligence sources said
it was being investigated whether the video clip was
intended to stoke passions among the Sikh community
at a time when the verdict would be delivered
on Friday in the case against Gurmeet Ram Rahim
Singh, the founder of Dera Sacha Sauda sect. The sect
chief, who has lakhs of followers in Punjab, Haryana,
and other states, has been accused by a former female
follower of raping her more than once inside the
sprawling Dera campus on the outskirts of Sirsa town
in Haryana, 260 km from Chandigarh. The Special
Central Bureau of Investigation court in Panchkula
in Haryana has asked the sect chief to appear in court
on the day when it pronounces its verdict. The hearing
in the case has been going on since 2007. The Dera
Sacha Sauda founder has little following among the
Sikh community in Jammu and Kashmir.
Dera chief appeals for peace
Agencies
Chandigarh: Dera chief Gurmeet Ram Rahim Singh
on Thursday appealed to his followers to maintain
peace before his court appearance on Friday."I have
always respected the law. Despite pain in my back, I
will obey the law and must visit the court," Gurmeet
Ram Rahim Singh tweeted. He urged his followers to
maintain peace. "I believe in God. All should maintain
peace." The CBI case against him has been going on
since 2007. The sect chief, who has lakhs of followers in
Punjab, Haryana and other states, has been accused by
a former female follower of raping her more than once
inside the sprawling Dera campus on the outskirts of
Sirsa town in Haryana, 260 km from Chandigarh. Nearly
two lakh sect followers have reached Panchkula and
nearby places from across Punjab, Haryana and other
states, raising fears of possible violence.

Right to privacy declared a fundamental right in India
IANS
New Delhi: Coming out
strongly in support of individual
freedom, the Supreme
Court on Thursday
declared right to privacy as
a fundamental right guaranteed
by the Constitution,
a ruling that could have a
bearing on the case related
to Aadhaar that has been
made mandatory in various
services.
In a unanimous verdict,
a nine-judge Constitution
bench observed that privacy
was protected as an
intrinsic part of life and
personal liberty and freedoms
guaranteed by the
Constitution. The verdict
can impact on the apex
court's earlier judgement
re-criminalising gay sex.
Rejecting the government's
contention that privacy
was not a fundamental
right, the bench headed by
Chief Justice J.S. Khehar
unanimously overturned
two earlier rulings in the
M.P. Sharma and Kharak
Singh cases that held that
the right to privacy was not
protected by the Constitution.
"The right to privacy
is protected as an intrinsic
part of the right to life and
personal liberty under Article
21 and as a part of the
freedoms guaranteed by
Part III of the Constitution.
Decisions subsequent to
Kharak Singh which enunciated
the above (line) lay
down the correct position
in law," the bench said.
There were six judgements
written by the nine
judges but all of them held
that right to privacy was a
fundamental right.
The other judges in
the bench were J. Chelameswar,
S.A. Bobde,
R.K. Agrawal, Rohinton F.
Nariman, A.M. Sapre, D.Y.
Chandrachud, S.K. Kaul
and S. Abdul Nazeer. They
were ruling on a reference
by the court hearing petitions
filed by retired Karnataka
High Court judge
K.S. Puttaswamy and others
against the validity of
the Aadhaar scheme on the
ground that it violated the
right to privacy.
In his ruling, Justice
Kaul said: "Let the right of
privacy, an inherent right,
be unequivocally a fundamental
right embedded in
part III of the Constitution
but subject to the restrictions
specified, relatable
to that part. This is the
call of today. The old order
changeth yielding place to
new." Thursday's verdict
was hailed by the opposition
and legal experts and
led to a fresh sparring between
the government and
the Congress.
The Congress saw in
the verdict a setback for
the government which had
argued there was no fundamental
right to privacy.
Congress President Sonia
Gandhi slammed Prime
Minister Narendra Modi's
government, saying the
court had struck a blow on
the "unbridled encroachment
and surveillance by
the State and its agencies in
the life of common man".
Gandhi said the verdict
heralds a new era for individual
rights, personal liberty
and human dignity.
But Law Minister Ravi
Shankar Prasad and Finance
Minister Arun Jaitley
termed the ruling as
positive, saying the government
shared the court's
view that privacy was a
fundamental right. They
said the court had endorsed
the government's view
that citizens' data could
be collected to ensure that
benefits of social welfare
schemes reach the targeted
poor.
"The government does
not give the right to release
data to anyone, except in
case of compelling public
interest," Prasad said.
Both the ministers
lashed out at the Congress
record on individual rights
and cited the Emergency
regime of 1975-77 to show
its scant regard for liberty.
Against the backdrop of
Aadhaar controversy, the
court expressed the hope
that the central government
would take necessary
steps putting in place a robust
regime for data protection.
"But the data has to
be utilised for legitimate
purposes and not unauthorisedly
for extraneous
purposes. This will ensure
legitimate concerns of the
State are duly safeguarded
while, at the same time,
protecting privacy concerns,"
it said.
Referring to the committee
chaired by former
Supreme Court judge B.N.
Srikrishna to review data
protection norms, the apex
court said since the government
had initiated the process
of reviewing the area
of data protection, it would
be best to leave the matter
for experts.
Recalling the ADM Jabalpur
case in which the
apex court declared that
right to liberty could be suspended
during Emergency,
the judges said the ruling
by four judges in that case
"are seriously flawed".
"Life and personal liberty
are inalienable to human
existence. These rights are
primordial rights. They
constitute rights under
natural law. No civilized
state can contemplate an
encroachment upon life
and personal liberty without
the authority of law. "It
would be preposterous to
suggest that a democratic
Constitution without a Bill
of Rights would leave individuals
governed by the
state without either the existence
of the right to live
or the means of enforcement
of the right."
The judgement is likely
to impact on the interpretation
of Section 377 of the Indian
Penal Code that criminalises
same sex. It refers
to the Delhi High Court
judgement that decriminalises
the section and the Supreme
Court ruling overturning
it and said the apex
court had found fault with
the basis of the High Court
verdict. It said the Supreme
Court's earlier view that a
miniscule fraction of the
country's population constitutes
lesbians, gays, bisexuals
or transgenders"
"is not a sustainable".
"In a democratic Constitution
founded on the rule
of law, rights (of minorities)
are as sacred as those
conferred on other citizens
to protect their freedoms
and liberties. Sexual orientation
is an essential attribute
of privacy."
"The right to privacy
and the protection of sexual
orientation lie at the core
of the fundamental rights
guaranteed by Articles 14,
15 and 21 of the Constitution."
Dera chief verdict: Army on standby; curfew imposed in Sirsa
IANS
Chandigarh: The Army
was on Thursday evening
put on standby in Haryana
and Punjab even as authorities
ordered imposition of
curfew in Sirsa town from
10 p.m. onwards, on the eve
of a court verdict in a rape
case against controversial
self-styled godman Dera Sacha
Sauda sect chief Gurmit
Ram Rahim Singh.
Sirsa Deputy Commissioner
Prabhjot Singh said
that the curfew would remain
imposed till further
orders.
Punjab Chief Minister
Amarinder Singh told media
here on Thursday evening
that the Punjab government
and police were
fully prepared to deal with
any situation emerging after
the court verdict.
"We have made adequate
deployment of police
and para-military forces.
The Army is on standby
(if the situation demands).
We are in touch with the
Western Command and the
south western command,"
the Chief Minister said.
Haryana Additional
Chief Secretary, Home, Ram
Niwas, said that the Army
has been alerted and would
be requisitioned if the situation
demanded.
He said that senior
Haryana Police officers
have been deputed along
with civil administration
officers to deal with any
situation.
The tri-city area of
Panchkula, Chandigarh
and Mohali (in Punjab)
were turned into a fortress,
ahead of Friday's judgment
by CBI special court judge
Jagdeep Singh.
The situation in Sirsa
and Panchkula towns, both
in Haryana, was tense on
Thursday with thousands
of sect followers converging
at both places in support of
the sect chief and announcing
that they were ready for
a "do or die" battle for their
leader, and the security personnel
being stationed in
large numbers to maintain
law and order.
Curfew-like restrictions
have been imposed in Panchkula,
Sirsa, Chandigarh and
some other places, with educational
institutions shut
for two days (Thursday and
Friday), trains cancelled
and bus services disrupted.
Authorities have suspended
mobile internet services (including
2G, 3G, 4G, CDMA
and GPRS) and all SMS services
and all dongle services
provided on mobile networks,
except voice calls for
the next three days, while
shops in Panchkula and
Sirsa have been shut and
stadiums converted into
temporary jail complexes.
A Central Bureau of
Investigation (CBI) special
court in Panchkula town in
Haryana is to announce its
verdict in the alleged rape
and sexual exploitation of
a 'sadhvi' (female religious
follower) by the sect chief
on Friday.
Haryana and Punjab,
where the sect has millions
of followers, was put
on high alert on Thursday
with thousands of security
personnel stationed in sensitive
areas.
The alleged rape and
sexual exploitation, first
reported through an anonymous
letter in 2002 to the
then Prime Minister Atal
Bihari Vajpayee and the
Chief Justice of the Punjab
and Haryana High Court
here, has taken nearly 15
years to reach the verdict
stage. The High Court had
ordered a CBI probe into the
matter.
The sect followers regard
their chief, who has a
colourful and controversial
personality and has acted in
and directed three movies,
as a "messenger of god".
Thousands of security
personnel, including paramilitary
forces, have been
deployed to control the
"premis" or sect followers
at Panchkula, as they converged
from across the region.

The International News Weekly VIEWS
Will Modi opt for early general election?
Amulya Ganguli
The synchronisation of
the next general election
with the assembly polls of
2018 to set a pattern may
not be the only reason why
the Narendra Modi government
is said to be considering
bringing forward the
2019 general election by a
year.
While the need to evolve
a system where the major
elections are held simultaneously
has been talked
about for some time, the
present conjecture relates
mainly to the calculations
about the prospects of the
ruling party at the Centre.
The belief seemingly
is that it will be better for
the Bharatiya Janata Party
(BJP) to cash in on whatever
gains it has made in the
last three-and-a-half-years
rather than wait for another
20 months or so when its inadequacies
on the employment
front and in relieving
the distress of farmers may
become more apparent.
It will serve the party
better, therefore, to advance
the dates of the general
election when the Modi
magic hasn't quite faded as
a recent opinion poll has
shown and the opposition
continues to be in disarray.
Although the government
cannot but derive
considerable satisfaction
from the opposition's discomfiture,
it cannot be
unaware of the fact that it
still has pockets of influence
as is evident from the
marginal improvement in
the Congress's position in
the recent Madhya Pradesh
local elections and the Trinamool
Congress's sweeping
victories in the West
Bengal municipal polls.
The BJP also knows
that it has to guard against
the anti-incumbency factor
affecting the party's prospects
in the assembly elections
in Madhya Pradesh,
Chhattisgarh, Rajasthan
and Gujarat next year. Even
if it wins, a loss of seats
compared to the previous
elections can be disheartening
on the eve of the general
election if it is held in 2019.
It will also be demoralising
for the BJP if the Congress
wins in Karnataka and the
CPI-M in Tripura. Holding
the general election earlier
will enable the BJP to avoid
such uncomfortable possibilities.
What the BJP will
have to remember is that
people often vote against the
ruling party because of dissatisfaction
with its performance
even if the opponent
is weak. This happened in
Goa and Manipur, where
the Congress was the first
party before it lost this position
because of the BJP's
success in weaning away a
number of legislators. However,
such defections could
not hide the fact that there
was dissatisfaction with the
BJP. The same disenchantment
has also been voiced
by a fairly wide section of
the people in recent weeks
as can be seen from the protest
letters written to the
Prime Minister by retired
bureaucrats and army veterans
and the processions
taken out by scientists
about the encouragement
of obscurantist practices by
the ruling dispensation.
These grievances have
nothing to do with unemployment
and farmers' distress
which are undoubtedly
the two most serious
problems faced by the government.
Instead, these are
the grouses of the average
middle-class householders
who have been feeling
uneasy about the growing
climate of intolerance although
it probably does not
affect them in a personal
capacity.
Even then, the depredations
of the gau rakshaks,
along with the possibility of
the police entering private
homes to check whether
anyone is eating beef, as the
Maharashtra government
wants to do, the competitive
jingoism in TV channels,
the foul language used
by the BJP's supporters
against the party's opponents
in the social media,
the distortion of history,
including the blanking out
of Jawaharal Nehru's name
from the speeches of high
dignitaries, are some of
the trends which can cause
unease among the common
people.
No one can predict the
cumulative effect of these
feelings over the next two
years, along with the slowing
down of the economy
which is a prime cause of
the unemployment problem.
Although early general
elections can enable the
government to make hay
while the sun is still shining,
albeit faintly, it is only
a temporary palliative.
As of now, a more longstanding
solution of the
current ills is not visible.
As a result, the BJP has to
continue to depend on the
faith which the average person
still places in the Prime
Minister's ability to tide
over the difficult situations
through hard work.
The government is also
fortunate that it hasn't had
to face the kind of corruption
charges which brought
down its predecessor and
still hobbles many of the
opposition parties. At the
same time, it is obvious
that the expectations of rapid
economic advancement
which are behind Modi's
success have been largely
belied. No wonder the "achhey
din" phrase is not heard
any more.
The BJP's other problem
is its total dependence on
Modi, which is not unlike
what it was in the Congress
in Indira Gandhi's heyday.
It is a scenario which is not
politically healthy for a party,
as can be seen from the
Congress's present plight
when it is pathetically dependent
on the dynasty despite
its fading charisma.
The BJP, on its part, has to
capitalise on Modi's popularity
as long as it brings in
the votes. Hence, the need
for the general election next
year.
Britain wants India and China to
resolve Doklam face-off
IANS
Kolkata: Calling upon India
and China to peacefully
resolve the Doklam standoff,
British High Commissioner
to India Dominic
Asquith on Thursday ruled
out any intervention on
the part of his country as
neither party has sought
its services.
"We think, we still
think, we always thought,
and continue to think, it
should be resolved peacefully.
And so we look forward
to these two countries
- India and China
- resolving the issue. They
are trying to do."
Asquith said the two
countries would get opportunities
to discuss the issue
in the next few weeks.
"A few opportunities
are coming up in the next
few weeks. I hope they
make progress. We will
support and encourage
them," he said.
The High Commissioner
said he had not held any
discussions on the Doklam
issue with Chinese Ambassador
to India Luo Zhaohui.
"No. it's not my business.
I meet my opposite
number from China, who
is in Delhi, just as I meet
the other envoys. But I did
not talk to him on this (issue),
because it is not my
role, as a third party," he
said.
Asquith answered in
the negative when asked
whether his country could
play a role as a third party
to work out a solution to
the problem.
"I think we have been
asked, neither by the Chinese
side, nor the Indian
side, to be involved. So
since we have not been
asked, it means we will
not impose our services. If
neither party wants us to
intervene, we won't intervene."
About the security
scenario in South Asia
against the backdrop of the
India-Pakistan tensions,
Asquith said his country
considered both nations
as friends, but pointed out
Britain has for long been
standing by New Delhi on
the issue of fighting terrorism.
"We have been standing
shoulder to shoulder
with India on the issue of
fighting terrorism for a
long long time. You notice,
the first country (British
Prime Minister Theresa)
May visited outside the EU
is India. So this is a very
important relationship
which we are going to take
forward," he asserted.
However, Asquith was
categorical that Britain
would not intervene in the
ongoing dispute between
India and Pakistan.
"India and Pakistan
both the countries are our
friends. We value the relationship
with them very
deeply.We are not going
to intervene between them
just as we won't intervene
between India and China
on the issue of Doklam.
Both the countries are
very important for us," he
added.
Emphasising the utmost
importance of securing
the data in a digital
economy, he said they
would be working more
closely with India in order
to protect the data in cyber
space within the next couple
of years.
"Digital economy is
to make sure that people
feel confident that their
personal data is protected.
So the cyber security is
very important. we have
been working on that very
closely with India. We will
go even more close in the
next year or two.
"We would be collaborating
with India in order
to secure data that is out
there in the cyber space.
That is the most sensible
step to take. If you are going
to be a digital economy
you have to protect the
data," he said.

Trudeau plays down Trump's threat to blow up NAFTA
The Canadian Press
OTTAWA: Prime Minister
Justin Trudeau is playing
down the latest threat from
President Donald Trump
that the North American
Free Trade Agreement is
a bad deal from which the
U.S. will likely exit.
Trump's latest threat
to "terminate" NAFTA
came during a campaignstyle
speech at a rally in
Arizona on Tuesday night,
when he told the crowd he
didn't think a new deal on
NAFTA good enough for
the United States was possible.
It is not the first time
he has made such a threat,
but it is the first time since
Canada, the U.S. and Mexico
sat down to start renegotiating
the 24-year-old
trade agreement.
Trudeau's response
Wednesday afternoon was
to stay the course.
"We're going to stay
focused on what we've
always known and what
we've always said, that
the North American Free
Trade Agreement has resulted
in millions of good
jobs on both sides of the
Canada-US border and is of
benefit to both Canadians
and Americans," he said
during a news conference
in Montreal.
"There are opportunities
we have to improve
and update the North
American Free Trade
Agreement and we're negotiating
in good faith and
working hard to do just
that, but we're going to stay
focused on the hard work
we have ahead of us at the
negotiating table and that's
how we've approached this
from the very beginning
and I don't see anything
changing in that." Canada's
pro-NAFTA offensive
in the United States has included
intense lobbying to
both state and congressional
representatives with
data showing nine million
American jobs depend on
trade and investment with
Canada.
Foreign Affairs Minister
Chrystia Freeland was
unavailable to comment
Wednesday, but she as
good as predicted Trump
would threaten to bail on
NAFTA during her appearance
before a House of
Commons committee last
week when she said there
likely would be "dramatic
moments ahead." A Foreign
Affairs official speaking
on background said
the only thing unexpected
about Trump's NAFTA termination
threat was that it
came so quickly after renegotiations
started.
"We knew it was very
likely the president would
play this card," he said.
"We're not going to get rattled
by this."
He said this was why
the Canadian government
has been working at developing
relationships with
others in the NAFTA circle
in the United States.
Canadian international
trade expert Peter Clark
said that is exactly the response
necessary here.
"You can't ignore
Trump, he's a real wild
card," said Clark, president
of the Ottawa firm
Grey, Clark, Shih and Associates.
"But if he threatens
something and you overreact,
he is going to come
back and double down on
it. You can't give it legs."
Mexico's foreign minister
also shrugged off the
Trump tirade as par for the
course, initially tweeting
that Mexico would remain
at the table, calm and firm
in Mexico's national interest.
Wednesday he told
Mexican television Trump
was "negotiating in his
own particular style."
U.S. Trade Representative
Robert Lighthizer said
in a statement released by
his office that "President
Trump has been clear from
the very beginning that if
the NAFTA renegotiation
is unsuccessful, he will
withdraw from the agreement."
However at a town
hall meeting at AT&T's
Dallas headquarters on
Wednesday, Rep. Kevin
Brady, chairman of the
House ways and means
committee, called Trump's
rhetoric "red hot" and acknowledged
he'd like to see
Trump take a "different approach
in tone"
But he also suggested
the people at the negotiating
table are not working
off Trump's's whims.
"The actions by his
trade team are measured"
he said. "They are following
the trade objectives
Congress gave them."
Back in Canada, Randy
Hoback, the Conservative
critic for Canada-U.S. relations,
said Trump's comments
might be more bluff
than belief, but that doesn't
mean they shouldn't be
taken as a warning.
"It really puts the
screws to everyone at the
table to get something done
quickly," said Hoback.
He said he hopes Canada
can get a new deal done,
but the government has to
prepare for the possibility
of NAFTA being torn up.
"We need to prepare
for what we would do if
NAFTA isn't there," said
Hoback.

What house owners should know before
hanging a 'For Lease' sign on their property
The Canadian Parvasi
TORONTO : With real estate sales softening
in many markets across Canada,
homeowners looking to unload their
property may find it preferable to hang
out a "For Lease" sign on the front lawn
rather than sell it for a less desirable
price.
While rental properties can provide
a stream of reliable income, housing experts
say the first-timer's success will depend
on a lot of factors — ranging from
the location and condition of your property
to the tax and legal implications of
becoming a landlord.
Royal LePage CEO Phil Soper says
property owners should start by getting
an up-to-date comparative market analysis
from their broker or sales rep.
"The challenge, like pricing any product,
is to find the maximum value that
you can drive in the marketplace and
keep it empty for the minimum amount
of time," says Soper.
"You can kill the entire economics of
renting your condo or your house out if
it stays empty for any extended period
of time."
Other than taking a month of turnover
to freshen up a property, he says,
you never want a rental sitting without
a tenant.
Soper adds that landlords will also
be affected by their personal preferences,
skills and available time to manage
the property. "It's not for me but other
people love it. They love the do-it-yourself
stuff. They love the regular income.
They even like dealing with tenants and
become friendly with them."
Toronto realtor Daniel Greenbaum
of Forest Hill Real Estate says one of the
key services he provides as a sales representative
for landlords is screening
prospective tenants to be sure they have
good references, are qualified in terms
of income and are likely a good fit for the
owner. "Unfortunately, once somebody
moves into a property, it's very hard to
get rid of them," Greenbaum says.
Lawyer Max Cohen, senior partner
at Cohen LLP in Toronto, says landlord-tenant
law falls under provincial
jurisdiction and the rules vary across
the country. "Alberta, for example, is a
little more landlord-friendly than Ontario
(which) tends to be a fairly tenantfriendly
environment."
He adds that landlords need to understand
how they'll be taxed under federal
law when the property is sold.
Once a principle residence becomes
an income property, there's a change
to its eligibility for an exemption from
capital gains tax — potentially a large
amount of money, depending on the specific
circumstance. "It doesn't mean that
all of the gain is taxable (but) probably
just as important you can't eliminate the
capital gains tax by moving back and living
in the property for awhile," Cohen
says.
Low oil prices continue to hit Alberta
The Canadian Parvasi
EDMONTON: Sluggish
oil prices are forcing Alberta
to dip into its reserve
fund and look for
more in-house savings to
keep its $10.5-billion deficit
from sliding further
into the red.
In his first-quarter fiscal
update, Finance Minister
Joe Ceci said the
province had expected
the West Texas Intermediate
benchmark oil price
to average out at US$55 a
barrel this year.
Instead, it's hovering
below US$49 a barrel
and isn't expected to rise
much in the near term.
"The forecast (at budget)
in March was based
on the best private sector
forecasts available.
The same is true of the
updated forecast," Ceci
said Wednesday. "What it
speaks to is a tremendous
less.
Ceci said the government
"One could at least
wonder whether the second
$200 million wasn't
concocted to make today's
media conference go better
for the minister."
Ceci noted there are
bright signs on the horizon.
The province expects
the economy to grow by
3.1 per cent in 2017, up
from the March budget
forecast of 2.6 per cent.
Employment is also expected
to rise by 1.3 per
cent, higher than the 0.9
per cent forecast in the
budget.
Alberta has been
struggling for years with
a prolonged trough in oil
prices, draining billions
of dollars from its bottom
line and throwing
thousands of people out of
work.
WASHINGTON: As India’s tensions with China rise
because of the continuing border face-off, New Delhi
is breaking new grounds in its relationship with
the US. After 40 years, the US has started supplying
crude oil to India.
"New breakthroughs! oil shipments from US to
India has started," said a tweet by the Indian Embassy
in Washington. Indian Ambassador Navtej Sarna
yesterday exchanged documents for the shipment
with Texas Governor Greg.
The first shipments which left the US between
Aug 6-14 will reach India early next month.
President Trump has welcomed the latest development
in bilateral relations. The US state department
said, ``The President pledged that the United
States would continue to be a reliable, long-term
supplier of energy. "During the Prime Minister's
June visit to the White House, President Trump
and Prime Minister Modi committed to a comprehensive
review of their trade relations with the
goal of creating a fair and reciprocal trading relationship
and removing obstacles to growth and
jobs creation, including in the energy sector. ’
After President Obama in December 2015 lifted
the 40-year-old embargo on crude oil shipments to
India, the two countries are deepening their ties
in the energy sector.
The first contracts of about $100 million have
been signed by the Indian Oil Corporation and
Bharat Petroleum.
before being extradited to the U.S.
to face charges in April 2016.
Weeks later, court documents
show that Dhaliwal pleaded guilty
to one of the eight charges against
Not possible to have Shahrukh, Salman and
Aamir in the same film, says director Balki
IANS
New Delhi: Filmmaker
R. Balki, who has worked
with Amitabh Bachchan
in all his movies, doesn't
think it's practical for him
to plan a project with Bollywood's
leading Khans.
At an interactive
session on Harnessing
the Power of Creativity
from Ads-Shads to Films-
Shilms for Ficci Ladies
Organisation (FLO), Balki
was asked if he'd be given
the option to work with
Shah Rukh Khan, Aamir
Khan and Salman Khan,
who would it be at the top
of his list.
He said he's working
with Akshay Kumar in
"PadMan", and would love
to keep working with Amitabh.
Prodded why he does
not work with the Khans,
he said: "No, not like
that..It's just that if I start
thinking of making a film
with them right now, I
will get quite old by the
time I start... I'd rather be
more practical."
Balki was present
with his filmmaker wife
Gauri Shinde, both of
whom have contributed
significantly to the Indian
advertising field as well
brought a freshness to
Hindi cinema with their
movies. While Balki is
known for movies like
"Cheeni Kum" and "Paa",
Gauri has carved her
niche with heart-warming
films like "English Vinglish"
and "Dear Zindagi".
In a field where 'nepotism'
is the hot debate, the
two are examples of outsiders
who have cemented
their space.
Gauri, who is junior to
Balki in the ad and filmmaking
world, quipped:
"He got there first... So,
there's a bit of nepotism
there... I think it's tough
until you prove yourself,
and you need something
success."
Balki said that "it's an
industry like most other
industries... They celebrate
success".
"It's really simple.
There can be camps and
other things, but all
camps form around successful
people... It's very
strange. But to achieve
that, you need something
very interesting to start
with and more importantly
lots of luck...
"There are some brilliant
people out there who
haven't had the chance to
be famous and it's not getting
any easier... Once you
have all that, it's not that
tough to survive in the industry
because there are
camps."
My best is yet to come, says Chateshwar Pujara
By Debayan Mukherjee
Kolkata: Cheteshwar Pujara,
India's standout performer
in the last 12 months
wearing the white flannels,
feels he still has a lot of areas
to improve on and his
best is yet to come.
"As a cricketer, I always
feel my best is yet to come
and I have been working
hard for it," Pujara, who has
just helped India rout Sri
Lanka 3-0 in the Test series
in the latter's backyard, told
IANS in a telephonic interview.
"I am performing well,
but I still feel there are areas
I can improve and even
perform better. So this is
not the best phase of my
life. I think the best is yet to
come," said the 29-year-old
right-hander known for his
craft at the crease.
In the last year or so,
the Saurashtra batsman
has gone from strength to
strength, becoming the new
Mr. Dependable in Virat
Kohli's Test team.
The second-highest run
getter in Sri Lanka, amassing
309 in three games,
which included two centuries,
Pujara has been India's
most consistent batsman
alongside Kohli since the
team's return from the tour
of the West Indies last year.
He aggregated 1,316 runs
from 13 matches in the 2016-
17 home season.
Pujara feels playing
county cricket for Nottinghamshire
in England has
helped him a great deal.
"This was my third season
(in county cricket). My
first was for Derbyshire,
then I played for Yorkshire.
This time I played for Nottinghamshire.
So I've always
enjoyed playing county
cricket," said Pujara,
who struck a century and a
half-century in five innings
of four games for Nottinghamshire.
"The wickets are always
challenging; there is always
something in it for the fast
bowlers. So when you start
scoring runs you feel confident
as you start knowing
your technique better. The
culture and the atmosphere
also (helps). I always have
a good time playing over
there and I learn a lot."
Asked about the way India
virtually bulldozed Sri
Lanka, Pujara said the team
played to its strength after
fine preparation.
"We have always backed
our strengths. All our batsmen
and bowlers are very
well prepared. As a team we
outplayed them; that is what
I think and I don't know
about how they played and
how their bowlers were.
They were a decent team,
but we were stronger. We
are the No. 1 Test team in
the world and we played
like that."
The islanders surrendered
meekly, losing by 304
runs in the first rubber and
the next two by an innings
and 53 runs and by an innings
and 171 runs.
Pujara, who pays his
bills by playing only Tests,
will be seen in action for
the national team next in
November when Sri Lanka
comes to India.
Asked if it would be an
ideal preparation ahead of
India's tour of the mightier
South Africa, Pujara said:
"Playing in South Africa
against South Africa will
be challenging. But at least
before that we will be playing
three Tests against Sri
Lanka in India. So the good
thing is that we will all be
together.
"We will have to have
different gameplans and
strategies when we play in
South Africa, but playing
against Sri Lanka in India
will help us continue with
our form. Conditionwise it
will be different, but it is
always good to play international
cricket before an
overseas tour."
Does Pujara fancy his
chances in the shorter formats?
"There will be a time
when I will get my opportunity.
At this point, all I
can say is I am improving
on a few things which is
helping me in Tests and
eventually will help me in
the shorter formats."
Pujara, who has played
under M.S. Dhoni and now
under Virat Kohli, refused
to compare the two as captains,
saying both wanted
India to win.
"To me and everyone,
that is the most important
thing. I have enjoyed
playing under MS and I
now enjoy playing under
Virat."
Dhoni, Bhuvi guide India to three-wicket victory over Sri Lanka
IANS
Pallekale: Disciplined innings
from former skipper
Mahendra Singh Dhoni
and pacer Bhuvneshwar
Kumar saw India defeating
Sri Lanka by three wickets
in a thrilling second One-
Day International here on
Thursday
Chasing a revised target
of 231 due to rain, India were
cruising at 108 for no loss in
the 16th over. But the match
turned on its head in a space
of six overs as the visitors
lost seven wickets for just 22
runs.
All-rounder Akila Dananjaya
created havoc in the
India's batting line-up as he
scalped six wickets in his 10
overs.
But then Dhoni (45 not
out) and Bhuvneshwar A(53
not out) forged a match-winning
partnership to seal the
deal for India.
India now lead the five
match series 2-0. The visitors
had defeated Sri Lanka
by nine wickets in the ODI
at Dambulla.
Indian openers Dhawan
and Rohit started the
chase perfectly by forging
a 109-run partnership. The
duo slammed Sri Lankan
bowlers all around the park.
In the process, Rohit completed
his half-century. But
after adding four more runs,
the Mumbai batsman was
adjudged leg before wicket
off Dananjaya.
Trying to be aggressive,
Dhawan mistimed a shot
and fell prey to Milinda Siriwardana
in the very next
over.
All eyes were on new
batsmen Lokesh Rahul, Kedar
Jadhav and Virat Kohli,
but the trio failed to rise to
the expectations and were
dismissed by Dananjaya in
the same over at scores of 1.,
4 and 4 respectively.
With half of the side
back to the pavilion, it
was now on Dhoni and allrounder
Hardik Pandya but
the the latter disappointed
as he was also dismissed by
Dananjaya after three overs
with no runs to his credit.
With chances of winning
looking sleek, Bhuvneshwar
then joined Dhoni in the
middle and played sensibly.
The duo forged a 100-run
partnership and finished
the proceeding with more
than two overs to spare.
Earlier, sensible innings
from Siriwardana (58)
and Chamara Kapugedera
(40) helped Sri Lanka score
236/8. But due to rain, the
target was revised to 230.
Apart from the duo,
opener Niroshan Dickwella
(31) contributed to the cause
for the hosts.
After going down in the
first ODI by nine wickets,
Sri Lanka regrouped their
strategy in this game and
started off on a positive note
but some poor shot selection
from the in-form and experienced
players resulted in
their downfall in the middle
overs.
However, Siriwardana
and Kapugedera played the
ball to its merit to stabilise
the innings. But after the
fall of the latter's wicket,
the lower-order failed to
provide the much required
support and, thus, the hosts
only managed to score a
chaseable target. On the
other hand, Indian bowlers
stepped up to the occasion
in the overcast conditions
and chipped in with vital
wickets at regular intervals.
The fielding was also up to
the mark.
After India won the toss
and put the Islanders in to
bat, the hosts crossed the 40-
run-mark in the eighth over
but then Dickwella was sent
back to the pavilion. Soon
Danushka Gunathilaka,
who troubled the visitors in
the first ODI, was dismissed
by leg-spinner Yuzvendra
Chahal. Once again the
middle-order got exposed
soon and experienced players
Upul Tharanga (9) and
Angelo Mathews (20) were
dismissed by Hardik Pandya
and Axar Patel, respectively.
But just when things
seemed poor for the hosts,
Siriwardana and Kapugedera
displayed their temperament
and forged the crucial
quality time
runs for their team. After
giving a tough fight in the
middle, the duo was, however,
sent packing by Jasprit
Bumrah. Then the lowerorder
batsmen -- ananjaya
(9), Dushmantha Chameera
(6) and Vishwa Fernando (3)
-- once again failed to make
their mark and Sri Lanka
only managed to score 236 in
their allotted 50 overs.
For India, pacer Bumrah
scalped four wickets
while leg-spinner Chahal
took two.
Indian cricket captain Virat Kohli and his actress girfriend Anushka
Sharma enjoying some quality time together in Sri Lanka.
