AN ORDINANCE OF THE CITY OF MALIBU REPEALING ORDINANCE NO. 383<br />
(FOLLOWING RELATED COURT DECISION)<br />
The City Council of the City of Malibu does ordain as follows:<br />
SECTION 1. Recitals<br />
1. Ordinance No. 383 was enacted as Measure R, adopted by initiative on November 4, 2014. The measure<br />
added Malibu Municipal Code Sections 17.02.045, 17.22.060, 17.24.050, 17.26.050, 17.28.050, 17.30.050,<br />
And 17.66.130 and amended General Plan sections 1.4.2 Land Use (LU) Element Goal 2 and 1.5.18 and Figures<br />
LU-2(A)-(E), Your Malibu, Your Decision Act of Chapters 17.02, 17.22, 17.24, 17.26, 17.28, 17.30,<br />
17.66, relating to regulating formula retail establishments in the Civic Center Commercial District. On May<br />
5, 2015, The Park at Cross Creek LLC and Malibu Bay Company, LLC filed a lawsuit against the City of<br />
Malibu challenging Ordinance No. 383 and Measure R. (Case No. BS155299).<br />
2. On December 14, 2015, the trial court issued a ruling on the parties’ cross motions for judgment on the<br />
pleadings stating that Measure R is invalid because it (1) subjects administrative acts to a public vote and<br />
therefore exceeds the scope of the voters’ initiative authority; (2) violates substantive due process to the extent<br />
that it requires the submission of an administrative matter for voter approval; and (3) creates an illegal<br />
conditional use permit. On April 5, 2016, the trial court issued a declaratory judgment that Measure R is invalid<br />
and enjoined the City of Malibu from enforcing Measure R.<br />
4. On June 21, 2017, the court of appeal affirmed the trial court’s judgment. (Case Nos. B271620 and<br />
B275311.)<br />
5. On August 9, 2017, the California Supreme Court denied the City’s request for Immediate Stay Request<br />
and Petition for Review. (Case No. S243351.). The court of appeal’s decision in The Park at Cross Creek<br />
LLC et al. v. City of Malibu is now final.<br />
SECTION 2. Repeal<br />
Ordinance No. 383 is hereby repealed in its entirety.<br />
SECTION 3. The City Clerk shall certify the adoption of this ordinance.<br />
Ordinance No. 425 was introduced by the Malibu City Council at its meeting held on November 13, 2017.<br />
Second reading and adoption of the ordinance are scheduled for November 27, 2017.<br />

Pursuant to the authority and criteria contained in the California Environmental<br />
Quality Act (CEQA), the Planning Director has analyzed<br />
the proposed project. The Planning Director has found that this project<br />
is listed among the classes of projects that have been determined not to<br />
have a significant adverse effect on the environment. Therefore, the<br />
project is categorically exempt from the provisions of CEQA pursuant<br />
to CEQA Guidelines Section 15303(a) and (e) – New Construction.<br />
The Planning Director has further determined that none of the six exceptions<br />
to the use of a categorical exemption apply to this project<br />
(CEQA Guidelines Section 15300.2).<br />
A written staff report will be available at or before the hearing. Following<br />
an oral staff report at the beginning of the hearing, the appellants<br />
may be given up to 15 minutes to make a presentation. Any<br />
amount of that time may be saved for rebuttal. All other persons wishing<br />
to address the Council will be provided three minutes to address<br />
the Council. These time limits may be changed at the discretion of the<br />
Council. At the conclusion of the testimony, the Council will deliberate<br />
and its decision will be memorialized in a written resolution. Copies<br />
of all related documents, including the grounds for appeal, are<br />
available for review at City Hall during regular business hours. Written<br />
comments may be presented to the City Council at any time prior<br />
to the beginning of the public hearing.<br />

The draft ordinance was assessed in accordance with the authority and criteria contained in the California<br />
Environmental Quality Act (CEQA), the State CEQA Guidelines (the Guidelines), and the environmental<br />
regulations of the City. Per Section 15061(b)(3) of the State CEQA Guidelines, the draft ordinance is exempt<br />
from the requirements of CEQA because it can be seen with certainty that the provisions contained herein<br />
would not have the potential for causing a significant effect on the environment. The ordinance would allow<br />
delivery of marijuana by existing dispensaries which will reduce the impact on the environment as trips by<br />
multiple customers to the dispensary will instead be consolidated into one or two trips during the day per dispensary.<br />
A written staff report will be available at or before the hearing. All persons wishing to address the<br />
Commission will be afforded an opportunity in accordance with the Commission’s procedures. Copies of all<br />
related documents are available for review at City Hall during regular business hours. Written comments<br />
may be presented to the City Council at any time prior to the beginning of the public hearing.<br />

The Malibu City Council will consider an amendment to add Chapter 10.18 to Title 10 (Vehicles and Traffic)<br />
of the Malibu Municipal Code to establish a citywide oversize vehicle restrictions which prohibit the<br />
parking of commercial oversize vehicles on City streets and limit the parking of non-commercial vehicles to<br />
two hours between the hours of 12:00 a.m. and 5:00 a.m. on public streets<br />
