The Mountains Recreation &
Conservation Authority (MRCA)
is a local government joint powers
entity owning fee title to public
access areas and public access
easements within the city of
Malibu. A general description of
MRCA activities may be found

Various parties are in violation of
the California Coastal Act and
such violations are depriving the
public of access rights secured by
Coastal Commission conditions
on property owned or subject to
the management of the MRCA.
The MRCA is soliciting statements
of qualification from California
attorneys with experience
and/or expertise with respect to
coastal access issues in order to
implement a program to enforce
provisions of the California
Coastal Act pursuant to Chapter 9
(commencing with Section
30800) of Division 20 of the Public
Resources Code.
Statements of Qualification need
not have a specific format, but
should address the following: (1)
Proof of good standing membership
in the California State Bar;
(2) description of prior experience
and/or special expertise in litigating
public access issues related to
the California Coastal Act; (3)
specific southern California and
especially Malibu examples
should be discussed in detail, including

The California Environmental Quality Act (CEQA) applies only to projects which have the potential for
causing a significant effect on the environment. Pursuant to CEQA Guidelines Section 15061(b)(3), where it
can be seen with certainty that there is no possibility that the activity in question may have a significant effect
on the environment, the activity is not subject to CEQA. After analyzing the project, the Planning Director
determined that there is no possibility the amendment will have a significant effect on the environment
and accordingly, the exemption set forth in Section 15061(b)(3) applies.
